अधिसूचना
कारखाना अधिनियम, 1948 (अधिनियम संख्या 63 सन् 1948) की धारा 66 की उपधारा (1) के खण्ड (ख) के परन्तुक के अधीन शक्तियों का प्रयोग करके, राज्यपाल इस अधिसूचना के सरकारी गजट में प्रकाशित किये जाने के दिनांक से कारखाना मेसर्स यूनीलीवर इण्डिया लिमिटेड (यूआईएल), भूखण्ड संख्या क-2 यू0पी0एस0आई0डी0सी0 इण्डस्ट्रियल एरिया, भरूआ सुमेरपुर, जिला हमीरपुर में सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य के घण्टों में, निम्नलिखित शर्तों के अध्यधीन, महिलाओं के नियोजन को लोक हित में प्राधिकृत करती हैं :- 1-किसी महिला को उसकी लिखित सहमति पर सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य कारखाने में कार्य करने की अनुमति दी जा सकती है।
2-किसी भी महिला को पूर्वोक्त अधिनियम की धारा 54 के अनुसार किसी भी दिवस में नौ घण्टे से अधिक और धारा 51 के अनुसार किसी भी सप्ताह में अड़तालिस घण्टे से अधिक कार्य करने की अनुमति नहीं होगी।
3-यदि किसी महिला को सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य किसी समय कार्य करने के लिए बुलाया जाय तो कारखाने के अधिष्ठाता/प्रबन्धक उसके निवास स्थान से कारखाने तक लाने और उसके निवास स्थान तक वापस ले जाने के लिए कारखाने के व्यय पर महिला के सुरक्षित परिवहन का आवश्यक प्रबंध करेगा। 4-किसी भी महिला को जो सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य कारखाने में काम करने से इंकार करती है, उसे केवल इसी आधार पर नियोजन से नहीं हटाया जायेगा।
5-कारखाने का अधिष्ठाता/प्रबन्धक सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य काम करने वाली समस्त महिलाओं को पर्याप्त और सुरक्षित कैन्टीन सुविधा प्रदान करेगा। 2 उत्तर प्रदेश असाधारण गजट, 9 मई, 2022 7-किसी महिला को उसकी लिखित सहमति के बिना सायं 7.00 बजे से प्रातः 6.00 बजे के मध्य कार्य करने के लिए बाध्य नहीं किया जाएगा। 8-कारखाने के अधिष्ठाता/प्रबन्धक द्वारा उपरोक्त किसी भी शर्त का उल्लंघन करने पर इस अधिसूचना का प्राधिकार स्वतः समाप्त हो जायेगा।

THE Governor is pleased to order the publication of the following English translation of notification no. 537/XXXVI-03–2022-110(Sa.)-2020, dated May 9, 2022 for general information:

Dated Lucknow, May 9, 2022
IN exercise of the powers under proviso to clause (b) of sub-section (1) of section 66 of the Factories Act, 1948 (Act no. 63 of 1948), the Governor is pleased to authorize, in public interest, with effect from the date of publication of this notification in the official Gazette, the employment of women between the hours of 7.00 p.m. and 6,00 a.m. in the factory M/s Unilever India Limited (UIL), Plot no. A-2, UPSIDC Industrial Area, Bharua Sumerpur, district Hamirpur subject to the following conditions :– 1. Any woman may be permitted to work in the factory between the hours of 7.00 p.m. and 6.00 a.m. on her written consent.
2. No woman shall be allowed to work for more than nine hours in a day according to section 54 and more than forty eight hours in a week according to section 51 of the aforesaid Act.
3. If a woman is called for work any time between the hours of 7.00 p.m. and 6.00 a.m., the occupier/manager of the factory shall make necessary arrangements at the expense of the factory for her safe transport from her residence to the factory and back to her home.
4. No woman who declines to work in the factory between the hours of 7.00 p.m. and 6.00 a.m. shall be removed from employment only on this account.
5. The occupier/manager of the factory shall provide adequate and safe canteen facility to all women working between the hours of 7.00 p.m. and 6.00 a.m.
6. Before calling any woman to work between the hours of 7.00 p.m. and 6.00 a.m., the occupier/manager of the factory shall intimate the proposed arrangements by an undertaking ensuring the compliance of above conditions to a local inspector.
7. No woman shall be bound to work between the hours of 7.00 p.m. and 6.00 a.m. without her written consent.
8. The authorization in this notification shall automatically cease on violation of any of the above conditions by the occupier/manager of the factory.
