उत्तर प्रदेश —षि उत्पादन मण्डी अधिनियम, 1964 (उत्तर प्रदेश अधिनियम संख्या 25 सन् 1964) की धारा 26-भ के अधीन शक्तियों का प्रयोग करके, राज्य —षि उत्पादन मण्डी परिषद, लखनऊ, राज्य सरकार के पूर्व अनुमोदन से, उत्तर प्रदेश —षि उत्पादन मण्डी परिषद (अधिकारी और कर्मचारी अधिष्ठान) विनियमावली, 1984 का संशोधित करने की दृष्टि से निम्नलिखित विनियमावली बनाती हैं।
उत्तर प्रदेश —षि उत्पादन मण्डी परिषद (अधिकारी और कर्मचारी अधिष्ठान) (ग्यारहवाँ संशोधन) विनियमावली, 2022
1-(1) यह विनियमावली उत्तर प्रदेश राज्य —षि उत्पादन मण्डी परिषद (अधिकारी और संक्षिप्त नाम और प्रारम्भ कर्मचारी अधिष्ठान) (ग्यारहवाँ संशोधन) विनियमावली, 2022 कही जाएगी।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।
विनियम 2 का संशोधन
2-उत्तर प्रदेश राज्य —षि उत्पादन मण्डी परिषद (अधिकारी और कर्मचारी अधिष्ठान) विनियमावली, 1984 (जिसे आगे ''उक्त विनियमावली'' कहा गया है) में, नीचे स्तम्भ-1 में दिये गये विनियम 2 के खण्ड(क) के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात :-

स्तम्भ-2 (क) अपर निदेशक, संयुक्त निदेशक और उप निदेशक (प्रशासन/विपणन) का तात्पर्य मण्डियों के अपर निदेशक (प्रशासन), संयुक्त निदेशक (प्रशासन/विपणन) और उप निदेशक (प्रशासन/विपणन) से है।
(क) 'अपर निदेशक', 'संयुक्त निदेशक' और 'उप निदेशक' (प्रशासन/विपणन) का तात्पर्य मण्डियों के अपर निदेशक, संयुक्त निदेशक (प्रशासन/विपणन) और उप निदेशक (प्रशासन/विपणन) से है।
3-उक्त विनियमावली में, नीचे स्तम्भ-1 में दिये गये विनियम 9 के अधीन सारणी की विनियम 9 का संशोधन
प्रविष्टि के स्थान पर स्तम्भ-2 में दी गयी प्रविष्टि रख दी जायेगी, अर्थात् :-
स्तम्भ-1
स्तम्भ-2 1- -निदेशक और अपर निदेशक 1- -निदेशक और अपर निदेशक (प्रशासन) एवं वित्त नियंत्रक को छोड़कर समूह ''क'' के समस्त पद।
एवं वित्त नियंत्रक को छोड़कर समूह क के समस्त पद।
4-उक्त विनियमावली में, नीचे स्तम्भ-1 में दिये गये विनियम 10 के स्थान पर स्तम्भ-2 विनियम 10 का संशोधन
में दिया गया विनियम रख दिया जायेगा, अर्थात् :-
स्तम्भ-1
स्तम्भ-2 (1) पद निम्नलिखित प्रकार से भरे (1) पद निम्नलिखित प्रकार से भरे जायेंगे-
जायेंगे-
(क) सीधी भर्ती द्वारा; (क) सीधी भर्ती द्वारा;
(ख) परिषद् के कर्मचारियों की पदोन्नति
(ख) परिषद् के कर्मचारियों की पदोन्नति द्वारा;

किन्तु निदेशक, अपर निदेशक और वित्त नियंत्रक के पद प्रतिनियुक्ति द्वारा भरे जायेंगे। :- निदेशक भारतीय प्रशासनिक सेवा के अतिकाल वेतनमान का एक अधिकारी होगा, अपर निदेशक (प्रशासन), राज्य सिविल सेवा (कार्यपालिका शाखा) की चयन श्रेणी का अधिकारी होगा तथा वित्त नियंत्रक राज्य वित्त सेवा का विशेष वेतनमान का अधिकारी होगा।
ः- निदेशक भारतीय प्रशासनिक सेवा के अतिकाल वेतनमान का अधिकारी होगा, अपर निदेशक राज्य सिविल सेवा (कार्यपालिका शाखा) की चयन श्रेणी का अधिकारी होगा तथा वित्त नियंत्रक राज्य वित्त सेवा का विशेष वेतनमान का अधिकारी होगा।
(2)(क) निदेशक, अपर निदेशक (प्रशासन) और वित्त नियंत्रक के पदों को छोड़कर समूह ''क'' के समस्त पद पदोन्नति द्वारा भरे जायेंगे और उप निदेशक (प्रशासन/ विपणन) के पद नीचे यथा संसूचित रूप से पदोन्नति द्वारा भरे जायेंगे :-
(2)(क) निदेशक, अपर निदेशक और वित्त नियंत्रक के पदों को छोड़कर समूह क के समस्त पद पदोन्नति द्वारा भरे जायेंगे और उप निदेशक (प्रशासन/विपणन) के पद नीचे यथा संसूचित रूप से पदोन्नति द्वारा भरे जायेंगे :-

1- -चयन का मानदण्ड अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर।

2-विपणन अधिकारी संवर्ग के पदों से दो पद-चयन का मानदण्ड अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर।
2-विपणन अधिकारी संवर्ग के पदों से दो पद-चयन का मानदण्ड अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता होगा।
3-प्रचार अधिकारी के पद से एक पद प्रथम बार तथा उसके पश्चात् विपणन अधिकारी के पद से एक पद अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर।
3-प्रचार अधिकारी के पद से एक पद प्रथम बार तथा उसके पश्चात् विपणन अधिकारी के पद से एक पद अनुपयुक्त अभ्यर्थियों को अस्वीकार करते हुए ज्येष्ठता के आधार पर चयन द्वारा।
4-उप निदेशक (प्रशासन/विपणन) मुख्यालय के लिये एक पद तथा अन्य उप निदेशक (प्रशासन/विपणन) के पद राज्य पी0सी0एस0 सेवा के अधिकारियों से प्रतिनियुक्ति द्वारा।
4-उप निदेशक (प्रशासन/विपणन) मुख्यालय के लिये एक पद तथा अन्य उप निदेशक (प्रशासन/विपणन) के पद राज्य पी0सी0एस0 (प्रांतीय सिविल सेवा) के अधिकारियों से प्रतिनियुक्ति द्वारा।
(ख) समूह ''ख'' में 50 प्रतिशत पद पदोन्नति द्वारा और 50 प्रतिशत सीधी भर्ती द्वारा भरे जायेंगे, परन्तु यह कि निजी सचिव ग्रेड-2 के पद पदोन्नति द्वारा भरे जायेंगे।
(ख) समूह 'ख' के 50 प्रतिशत पद पदोन्नति द्वारा भरे जायेंगे और 50 प्रतिशत सीधी भर्ती द्वारा भरे जायेंगे, परन्तु यह कि निजी सचिव ग्रेड-2 के पद पदोन्नति द्वारा भरे जायेंगे।
(ग) समूह ''ग'' के लिपिक संवर्ग में निम्नतम् श्रेण्ी के पद निम्नवत् भरे जायेंगे :-
(ग) समूह ग के लिपिक संवर्ग में निम्नतम श्रेण्ी के पद निम्नानुसार भरे जायेंगेः-
(1) 80 प्रतिशत पद सीधी भर्ती द्वारा, (1) 80 प्रतिशत पद सीधी भर्ती द्वारा,
(2) 15 प्रतिशत पद समूह ''घ'' के कार्मिकों से पदोन्नति द्वारा जिन्होंने हाईस्कूल या उसके समकक्ष परीक्षा उत्तीर्ण कर ली हो।
(2) 15 प्रतिशत पद समूह घ के कार्मचारियों, जिन्होंने हाईस्कूल या उसके समकक्ष परीक्षा उत्तीर्ण कर ली हो, में से पदोन्नति द्वारा।
(3) 5 प्रतिशत पद समूह ''घ'' के कर्मिकों से पदोन्नति द्वारा जिन्होंने इण्टरमीडिएट अथवा उसके समकक्ष परीक्षा उत्तीर्ण कर ली हो, और 5 वर्ष की निरन्तर सेवा भी समूह ''घ'' के पद पर श्रेष्ठता के आधार पर पूरी कर ली हो।
(3) 5 प्रतिशत पद समूह घ के कर्मचारियों, जिन्होंने इण्टरमीडिएट अथवा उसके समकक्ष परीक्षा उत्तीर्ण कर ली हो, और 5 वर्ष की निरन्तर सेवा भी समूह घ के पद पर योग्यता के आधार पर पूरी कर ली हो, में से पदोन्नति द्वारा ।
(घ) समूह ''ग'' में निम्नतम् श्रेणी से अधिक के वेतनमान में समस्त पद पदोन्नति द्वारा भरे जायेंगे परन्तु यह कि विधिक सहायक, सहायक प्रोग्रामर एवं चालक के पद सीधी भर्ती द्वारा भरे जायेंगे।
(घ) समूह ग में निम्नतम् श्रेणी से अधिक के वेतनमान में समस्त पद, पदोन्नति द्वारा भरे जायेंगे परन्तु यह कि विधिक सहायक, सहायक प्रोग्रामर एवं चालक के पद सीधी भर्ती द्वारा भरे जायेंगे।

IN exercise of the powers under section 26-x of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 (U.P. Act no. 25 of 1964), the State Agricultural Produce Markets Board, Lucknow with the previous approval of the State Government, makes the following regulations with a view to amend the Uttar Pradesh Agricultural Produce Markets Board (Officers and Staff Establishment) Regulations, 1984.

Short title and
1. (1) These regulations may be called The Uttar Pradesh Agricultural commencement
Produce Markets Board (Officers and Staff Establishment) (Eleventh Amendment) Regulations, 2022.
(2) They shall come into force with effect from the date of their publication in Gazette.
