अधिसूचना
चूँकि, राज्य के आसवनी और यवासवनी उद्योग में नियोजित कर्मकारों की मजदूरी दरें, पिछली बार उत्तर प्रदेष औद्योगिक विवाद अधिनियम, 1947 (उत्तर प्रदेष अधिनियम संख्या 28 सन् 1947) की धारा 3 (ख) के अधीन अधिसूचना संख्या 28/2016/814/36-2-2016-105-2009, दिनांक 19 जुलाई,, 2016 द्वारा पुनरीक्षित की गयी थी, जो दिनांक 1 सितम्बर, 2010 से दिनांक 31 अगस्त, 2016 तक के लिए लागू थी। उक्त अधिसूचना में यह उपबंध किया गया था कि एक मजदूरी पुनरीक्षण समिति दिनांक 1 सितम्बर, 2016 से गठित की जायेगी जो नयी मजदूरी एवं महगांई भत्तों के सम्बन्ध में सिफारिश करने हेतु सक्षम होगी;
और चूँकि, उत्तर प्रदेश सरकार द्वारा अधिसूचना संख्या 1470/36-2-18-105-2009, दिनांक 31 अक्टूबर 2018 के माध्यम से श्रमायुक्त की अध्यक्षता में एक त्रिपक्षीय समिति गठित की गयी है, जिसे कार्यालय ज्ञाप संख्या 1209(2)/36-2-2021-105-2019, दिनांक 12 जुलाई, 2021 द्वारा उपान्तरित किया गया है;
2 उत्तर प्रदेश असाधारण गजट, 15 जून, 2022और चूँकि, समिति की विभिन्न बैठकें श्रमायुक्त की अध्यक्षता में आहूत की गयीं थी, जिनमें सम्यक् विचारोपरान्त दिनांक 18 दिसम्बर, 2021 को मजदूरी पुनरीक्षण के विभिन्न बिन्दुओं पर विनिश्चय किया गया था। समिति द्वारा कृत विनिश्चय के आधार पर सिफारिशें, श्रमायुक्त, उत्तर प्रदेश द्वारा पत्र संख्या 2073-75/चीनी वेज बोर्ड-21, दिनांक 18 दिसम्बर, 2021 के माध्यम से राज्य सरकार को उपलबध करायी गयी थी, जो सम्यक् विचारोपरान्त स्वीकार की जाती है;
और चूँकि, राज्य सरकार की राय में लोक व्यवस्था को अनुरक्षित रखने और नियोजन को भी अनुरक्षित रखने के लिये मजदूरी तथा परिवर्तनीय महगांई भत्ता पुनरीक्षण के सम्बंध में समिति की सिफारिशों को क्रियान्वित करना आवश्यक है;
अतएव, अब, उत्तर प्रदेष औद्योगिक विवाद अधिनियम, 1947 (उत्तर प्रदेष अधिनियम संख्या 28 सन् 1947) की धारा 3 के खण्ड (ख) के अधीन शक्तियों का प्रयोग करके राज्यपाल, निम्नलिखित आदेश देती हैं और उक्त अधिनियम की धारा 19 के संदर्भ में निदेष देती हैं कि इस आदेष की सूचना गजट में प्रकाषित की जायेगी।
आदेश
श्रमायुक्त, उत्तर प्रदेश की अध्यक्षता में गठित त्रिपक्षीय समिति द्वारा कृत विनिश्चय के आधार पर आसवनी और यवासवनी उद्योग में नियोजित कर्मकारों की मजदूरी संरचना/वेतन का अवधारण दिनांक 1 सितम्बर, 2016 से निम्नानुसार किया जायेगाः- (क) यह कि आसवनियों और यवासवनियों के कर्मकारों को दिनांक 1 सितम्बर, 2016 से रु0 650.00 की एकमुश्त वृद्धि प्रदान की जायेगी।
(ख) अगस्त, 2016 तक के उपभोक्ता मूल्य सूचकांक अर्थात् 6346 प्वाइंट का विलय 2.10 रुपये की दर से मूल मजदूरी में किया जायेगा।
(ग) वार्षिक वेतनवृद्धि- आसवनी उद्योग के कर्मकारों को 0.5 (आधा) प्रतिशत की दर से वार्षिक वेतनवृद्धि प्रदान की जायेगी।
उपर्युक्त सूत्र के आधार पर कर्मकारों के पुनरीक्षित वेतनमान निम्नानुसार होंगेः-

मजदूरी उच्चतर स्लैब (स्तर) में नियत की जायेगी। परिवर्तनीय मंहगाई भत्ता दिनांक 1 सितम्बर, 2016 से 6346 प्वाइंट के ऊपर 2.10 रुपये की दर से तथा दिनांक 1 सितम्बर, 2019 से 7350 प्वाइंट के ऊपर 2.35 रुपये की दर से संदेय होगा। कर्मकार को दिनांक 1 सितम्बर, 2019 से 600.00 रुपये की अतिरिक्त एकमुश्त वृद्धि प्रदान की जायेगी और यदि किन्हीं कर्मकारों का मूल वेतनमान दो स्लैबों के मध्य पड़ता है तो कर्मकारों की वेतन मजदूरी उच्चतर स्लैब में नियत की जायेगी। अधिसूचना संख्या 28/2016/814/36-2-16-105-2009, दिनांक 19 जूलाई, 2016 में यथा अवधारित विशेष भत्ता तदनुसार संदेय होगा। उत्तर प्रदेश असाधारण गजट, 15 जून, 2022 3 ऐसे कर्मकारों को पूर्ववर्ती वेतनमान में दिनांक 31 अगस्त, 2016 को और पुनरीक्षित वेतनमान में दिनांक 1 सितम्बर, 2016 को भुगतान की जा रही मजदूरी का विवरण निम्नानुसार हैः-

रहा है तो ऐसे कर्मकार को दिनांक 1 सितम्बर, 2016 को पुनरीक्षित वेतनमान में अनुमन्य मूल वेतन निम्नानुसार होगाः-

दिनांक 1 सितम्बर, 2016 को उपर्युक्त मूल वेतनमान के आधार पर मूल वेतन 13479.00 रुपये होगा जिसे वेतनमान के अगले प्रक्रम में 13508.00 रुपये निर्धारित किया जायेगा तथा ऐसे कर्मकार की दिनांक 1 सितम्बर, 2016 को कुल मजदूरी निम्नानुसार होगीः-

जिन कर्मकारों का मूल वेतन उपरोक्त संगणना करने पर उनके वेतनमान की अधिकतम सीमा से भी अधिक आता है, तो ऐसे कर्मकारों का वेतन निर्धारण उनके वेतनमान के अधिकतम में अतिरिक्त वेतनवृद्धि देकर किया जायेगा तथा अधिसूचना के लागू रहने तक उसी दर से अग्रतर वेतनवृद्धि अनुमन्य होगी।
ऐसे कर्मकार, जो अपने वेतनमान के अधिकतम पर पहुंच जाते हैं, अधिसूचना के लागू रहने तक अपने वेतनमान में वार्षिक वेंतनवृद्धि पाते रहेंगे। ऐसे कर्मकारों, जो पाँच वर्ष की संतोषजनक सेवा पूर्ण कर चुके हों और जिन्हें पदोन्नति की प्रसुविधा न प्रदान की गयी हो, को वेतन निर्धारण के समय एक अतिरिक्त वेतनवृद्धि की प्रसुविधा मजदूरी निर्धारण के समय प्रदान की जायेगी। कर्मकारों को पुनरीक्षित वेतन के बकायों का भुगतान, अधिसूचना के दिनांक से आठ माह की अवधि में दो किस्तों में किया जायेगा।
ऐसे कर्मकार जो अधिसूचना जारी होने के पूर्व सेवानिवृत्त हो गये हों, को बकायों का भुगतान एक किस्त में किया जायेगा। -यदि कोई कर्मकार किसी स्थानीय करार के अनुसार इस अधिसूचना में उपबंधित प्रसुविधाओं से अधिक कोई मजदूरी भत्ता या कोई अतिरिक्त परिलब्धियां या प्रसुविधाएं प्राप्त कर रहा हो, तो वह उन अतिरिक्त प्रसुविधाओं को प्राप्त करता रहेगा और इस करार से प्रभावित नहीं होगा। स्थानीय करार के अनुसार कर्मचारी द्वारा प्राप्त की जा रही धनराशि का समायोजन, अधिसूचना के अनुसार संदत किये जाने वाले बकायों से नहीं किया जायेगा।
यह अधिसूचना दिनांक 1 सितम्बर, 2016 से अग्रतर आदेश तक प्रवृत्त रहेगी।

अपर मुख्य सचिव। 4 उत्तर प्रदेश असाधारण गजट, 15 जून, 2022 IN pursuance of the provisions of clause (B) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 1172/XXXVI-2–2022-105-2009, dated June 15, 2022:

WHEREAS the rates of wages of Workmen employed in distillery and Breweries Industry of the State were last revised vide notification no. 28/2016/814/36-2-2016-105/2009 dated 19-07-2016, under section 3(b) of the Uttar Pradesh Industrial Disputes Act, 1947 (U.P. Act no. 28 of 1947), which were made applicable from date 01-09-2010 to 31-08-2016 . It was provided in said notification that a committee for wage revision from 01-09-2016 shall be constituted which will be competent to recommend in relation to new wages and dearness allowances;
AND, WHEREAS, a tripartite committee under chairmanship of Labour Commissioner has been constituted by U.P. Government vide notification no. 1470/36-2-18-105/2009, dated 31-10-2018 which has been modified by office memorandum no. 1209(2)/36-2-2021-105/2009, dated 12-07- 2021;
AND, WHEREAS, various meetings of the committee were convened under the chairmanship of the Labour Commissioner, in which after due deliberation, various points of wage revision were decided on 18-12-2021. Based on the decision taken by the Committee, the recommendations were made available to the State Government by the Labor Commissioner, Uttar Pradesh by letter number-2073-75/Chini veg board-21, dated 18-12-2021, which are accepted by it after due consideration;
AND, WHEREAS, in the opinion of State Government it is necessary to implement the recommendations of the committee regarding revision of wages and variable dearness allowance for the maintenance of public order and also for maintaining employment;
NOW, THEREFORE, in exercise of powers under clause (b) of section-3 of Uttar Pradesh Industrial Disputes Act, 1947 (U.P. Act no. 28 of 1947), the Governor is pleased to make the following order and to direct with reference to Section 19 of the said Act that the notice of this order shall be given by publication in the Gazette.
ORDER
On the basis of decision taken by the tripartite committee under chairmanship of Labour Commissioner, U.P. the wage structure/salary to the workmen employed in distilleries and breweries industry shall be determined from dated 01-09-2016 as follows.
1. Revised wage structure:-
(a) That the workmen of distilleries and breweries shall be given lump-sum enhancement of Rs. 650/- from dated 01-09-2016.
(b) The Consumer price index upto August, 2016 (i.e. 6346 point) shall be merged at the rate 2.10 in the basic wage.
(c) Annual increment-The workers of the distillery industry will be given an annual increment at the rate of 0.5 (half) percent.

2. Due to revision as above if the basic wage of workmen falls between two slabs (level), the workmen's pay wages shall be fixed in higher slab (level).
3. Variable Dearness Allowance: Variable dearness allowance shall be payable at the rate of Rs. 2.10/- over and above 6346 points from 01-09-2016 and at the rate of Rs. 2.35/- over and above 7350 point from 01-09-2019.
4. Additional Enhancement: Additional lump-sum enhancement of Rs. 600/- shall be given to workmen from 01-09-2019 and if basic pay scale of any workmen falls in the middle of two slabs, the workers pay wages shall be fixed in the higher slab.
5. Special Allowance : The special allowance as determined in the notification no. 28/2016/814/36-2-2016-105/209 dated July 19, 2016 shall be payable accordingly.
6. Fitment Formula : The details of the instance of wages being paid to such workers as on August 31, 2016 in previous scale and in the revised pay scale on 1st September, 2016 is being given as under:-

Suppose an Unskilled worker is drawing basic pay of Rs. 6862/- in old pay scale on 31st August, 2016.
Then admissible basic pay in revised pay scale on 1st September, 2016 to such worker shall be as follows:

On the basis of above basic pay on 1st September, 2016 shall be Rs. 13479/- which shall be fixed in the next stage of Rs. 13508/- in the pay scale and the total wage of such worker on 1 st September, 2016 shall be as follows:

calculation, their pay will be fixed after adding as extra increment in the maximum of their pay scale and further increment at the same rate shall be admissible till the notification is operative.
Those workmen who have reached maximum of their pay scale will continue to get annual increment in their pay scale till continuance of notification.
7. Seniority Benefits : Those workmen, who has completed five year of satisfactory service and has not been given benefit of promotion, shall be given benefit of an additional increment as the time of wage fixation.
6 उत्तर प्रदेश असाधारण गजट, 15 जून, 20228. Payment of Arrears : Arrears of revised pay shall be paid to workmen in two instalments within eight months from the date of notification.
Those workmen who have been retired before issue of notification, shall be paid arrears in one instalment.
9. If a workmen is in receipt of any wage allowance or any additional emoluments or benefits accordingly to any local agreement over and above the benefits provided in this notification, he shall continue to get those additional benefits and shall not be affected by this agreement. There will be no adjustment of amount being received by the employee as per local agreement from the arrears to be paid as per the notification.
This notification shall remain in force from 01-09-2016 till further orders.
