¼d½ 'नियु(cid:304)(cid:389) (cid:366)ाधिकारी' का ता(cid:523)य(cid:330) निदेशक, पंचायतीराज, उ(cid:517)र (cid:366)देश से है; ¼[k½'भारत का नाग(cid:303)रक' का ता(cid:523)य(cid:330) ऐसे (cid:681)(cid:304)(cid:389) से है जो संविधान के भाग-दो के अधीन भारत का नाग(cid:303)रक हो या समझा जाये;

¼x½'संविधान' का ता(cid:523)य(cid:330) भारत का संविधान से है; ¼?k½'सरकार' का ता(cid:523)य(cid:330) उ(cid:517)र (cid:366)देश रा(cid:475) सरकार से है; ¼³½'रा(cid:475)पाल' का ता(cid:523)य(cid:330) रा(cid:475)पाल उ(cid:517)र (cid:366)देश से है; ¼p½'सेवा का सद(cid:735)' का ता(cid:523)य(cid:330) सेवा के संवग(cid:330) म(cid:336) किसी पद पर इस नियमावली अथवा इस नियमावली के (cid:366)ार(cid:641) होने के पूव(cid:330) (cid:366)वृ(cid:517) नियमों या आदेशों के अधीन मौलिक (cid:349)प से नियु(cid:389) (cid:681)(cid:304)(cid:389) से है;

¼N½'सेवा' का ता(cid:523)य(cid:330) उ(cid:517)र (cid:366)देश पंचायतीराज अपर जिला पंचायत राज अधिकारी/ अपर जिला पंचायत राज अधिकारी ((cid:366)ाविधिक)/ अपर जिला पंचायत राज अधिकारी (पंचायत उ(cid:552)ोग) सेवा से है;

¼t½'मौलिक नियु(cid:304)(cid:389)' का ता(cid:523)य(cid:330) सेवा के संवग(cid:330) म(cid:336) किसी पद पर ऐसी नियु(cid:304)(cid:389) से है, जो तदथ(cid:330) नियु(cid:304)(cid:389) न हो, और नियमों के अनुसार चयन के प(cid:686)ात् की गयी हो और यदि कोइ(cid:330) नियम न हो तो सरकार (cid:554)ारा जारी किये गये काय(cid:330)पालक अनुदेशों (cid:554)ारा त(cid:534)मय विहित (cid:366)(िcid:354)या के अनुसार की गयी हो;

¼>½'भत(cid:334) का वष(cid:330)' का ता(cid:523)य(cid:330) किसी कै ले(cid:503)र वष(cid:330) की पहली जुलाइ(cid:330) को (cid:366)ार(cid:641) होने वाली बारह मास की अवधि से है।

Lksok dk laoxZ 4-(1) सेवा की सद(cid:735) सं(cid:421)ा और उसम(cid:336) (cid:366)(cid:529)ेक (cid:373)ेणी के पदों की सं(cid:421)ा उतनी होगी, जितनी सरकार (cid:554)ारा समय-समय पर अवधा(cid:303)रत की जाय।

(2) जब तक कि उपनियम (1) के अधीन प(cid:303)रवत(cid:330)न करने के आदेश न दिए जाय(cid:336), सेवा की सद(cid:735) सं(cid:421)ा और उसम(cid:336) (cid:366)(cid:529)ेक (cid:373)ेणी के पदों की सं(cid:421)ा उतनी होगी जितनी नीचे दी गयी है :-

¼nks½ रा(cid:475)पाल ऐसे अति(cid:303)र(cid:389) (cid:725)ायी या अ(cid:725)ायी पदों का सृजन कर सकती ह(cid:339), जि(cid:590)(cid:336) वह उचित समझ(cid:336)।

1&vij ftyk iapk;r jkt vf/kdkjh & मौलिक (cid:349)प से नियु(cid:389) ऐसे सहायक विकास अधिकारी (पंचायत) म(cid:336) से, जि(cid:590)ोंने भत(cid:334) वष(cid:330) के (cid:366)थम दिवस को इस (cid:349)प म(cid:336) बारह वष(cid:330) की सेवा पूण(cid:330) कर ली हो, विभागीय चयन समिति के मा(cid:559)म से पदो(cid:580)ति (cid:554)ारा।

7-(1)पदो(cid:580)ति (cid:554)ारा भत(cid:334) समय-समय पर यथा संशोधित उ(cid:517)र (cid:366)देश विभागीय पदो(cid:580)ति

समिति का गठन (सेवा आयोग के (cid:407)े(cid:361) के बाहर के पदों के लिए) नियमावली, 1992 के उपब(cid:576)ों के

अनुसार गठित चयन समिति के मा(cid:559)म से, समय-समय पर यथासंशोधित उ(cid:517)र (cid:366)देश सरकारी

सेवक पदो(cid:580)ति (cid:554)ारा भत(cid:334) के लिए मानदंड नियमावली, 1994 म(cid:336) अधिकथित मानद(cid:503) के आधार पर

की जायेगी।

िट(cid:596)णी- चयन समिति म(cid:336) अनुसूचित जातियों, अनुसूचित जनजातियों और नाग(cid:303)रकों के

अ(cid:586) पिछड़े वग(cid:344) को (cid:366)तिनिधि(cid:533) देने के लिए अधिका(cid:303)रयों का नाम निद(cid:337)शन, समय-समय पर

यथासंशोधित अधिनियम की धारा 7 के अधीन कृ त आदेश के अनुसार किया जायेगा।

(2) नियु(cid:304)(cid:389) (cid:366)ाधिकारी, अ(cid:631)थि(cid:330)यों की पा(cid:361)ता सूची, समय-समय पर यथासंशोधित उ(cid:517)र

(cid:366)देश (लोक सेवा आयोग के (cid:407)े(cid:361) के बाहर के पदों पर) चयनो(cid:580)ति पा(cid:361)ता सूची नियमावली, 1986

के अनुसार तैयार करे गा और उसे उनकी च(cid:303)र(cid:361) पंजियों और उनसे संबंधित ऐसे अ(cid:586) अभिलेखों के

साथ जो उचित समझे जायं, चयन समिति के सम(cid:407) रखेगा।

(3) चयन समिति उपनियम (2) म(cid:336) निदि(cid:330)(cid:700) अभिलेखों के आधार पर अ(cid:631)थि(cid:330)यों के मामलों

पर विचार करे गी।

(4) चयन समिति चयनित अ(cid:631)थि(cid:330)यों की (cid:475)े(cid:703)ता (cid:354)म, जैसा कि उस संवग(cid:330) म(cid:336) हो, जिससे

उनकी पदो(cid:580)ति की जानी हो, म(cid:336) एक सूची तैयार करे गी और उसे नियु(cid:304)(cid:389) (cid:366)ाधिकारी को अ(cid:356)सा(cid:303)रत

करे गी

भाग-पाँच-िनयु(cid:304)(cid:389) और (cid:475)े(cid:703)ता

8-(1) नियु(cid:304)(cid:389) (cid:366)ाधिकारी अ(cid:631)थि(cid:330)यों के नाम उसी (cid:354)म म(cid:336) लेकर जिसम(cid:336) वे नियम 7 के

अधीन तैयार की गयी सूची म(cid:336) आये gksa, नियु(cid:389) करे गा।

(2) यदि किसी एक चयन के स(cid:638)(cid:576) म(cid:336) नियु(cid:304)(cid:389) के एक से अधिक आदेश जारी किये जाय(cid:336)

तो एक संयु(cid:389) आदेश भी जारी किया जायेगा, जिसम(cid:336) (cid:681)(cid:304)(cid:389)यों के नामों का उ(cid:671)ेख, उसी (cid:475)े(cid:703)ता

(cid:354)म म(cid:336) किया जायेगा जैसाकि, यथा(cid:304)(cid:725)ति, चयन म(cid:336) अवधा(cid:303)रत किया गया हो, या उस संवग(cid:330) म(cid:336) हो

जिससे उ(cid:590)(cid:336) पदो(cid:580)त किया गया हो।

9-सेवा म(cid:336) अपर जिला पंचायत राज अधिकारी/अपर जिला पंचायत राज अधिकारी

((cid:366)ाविधिक)/अपर जिला पंचायत राज अधिकारी (पंचायत उ(cid:552)ोग) के पद पर मौलिक (cid:349)प से

नियु(cid:389) (cid:681)(cid:304)(cid:389)यों की (cid:475)े(cid:703)ता, समय-समय पर यथा संशोधित उ(cid:517)र (cid:366)देश सरकारी सेवक (cid:475)े(cid:703)ता

नियमावली, 1991 के अनुसार अवधा(cid:303)रत की जायेगी।

भाग-छ:&वेतन इ(cid:529)ािद

10-(1) सेवा म(cid:336) किसी पद पर नियु(cid:389) (cid:681)(cid:304)(cid:389)यों का अनुम(cid:586) वेतनमान ऐसा होगा, जैसाकि

सरकार (cid:554)ारा समय-समय पर अवधा(cid:303)रत किया जाय।

(2) इस नियमावली के (cid:366)ार(cid:641) के समय के वेतनमान नि(cid:635)ानुसार दिये गये ह(cid:339):-

i{k leFkZu 11-किसी पद पर या सेवा म(cid:336) लागू नियमों के अधीन अपे(िcid:407)त सिफा(cid:303)रशों से भि(cid:580) कि(cid:590)ी ं सिफा(cid:303)रशों पर, चाहे लि(cid:304)खत हों या मौ(cid:304)खक विचार नही ं किया जायेगा। किसी vH;FkhZ की ओर से अपने अ(cid:631)थ(cid:330)न के लिए (cid:366)(cid:529)(cid:407) या अ(cid:366)(cid:529)(cid:407) (cid:349)प से समथ(cid:330)न (cid:366)ा(cid:593) करने का कोइ(cid:330) (cid:366)यास उसे नियु(cid:304)(cid:389) के लिए अनह(cid:330) कर देगा।

12-ऐसे विषयों के स(cid:638)(cid:576) म(cid:336) जो विनिदि(cid:330)(cid:700) (cid:349)प से इस नियमावली या विशेष आदेशों vU; fo"k;ksa dk fofu;eu

(cid:554)ारा आ(cid:453)ादित न हो, सेवा म(cid:336) नियु(cid:389) (cid:681)(cid:304)(cid:389), रा(cid:475) के काय(cid:330)कलापों के स(cid:638)(cid:576) म(cid:336) सेवारत सरकारी सेवकों पर सामा(cid:586)तया लागू नियमों, विनियमों और आदेशों (cid:554)ारा शासित होंगे।

13-जहाँ रा(cid:475) सरकार का यह समाधान हो जाय कि सेवा म(cid:336) नियु(cid:389) (cid:681)(cid:304)(cid:389)यों की सेवा lsok dh 'krksZa esa f'kfFkyrk

की शत(cid:344) को विनियमित करने वाले किसी नियम के (cid:366)वत(cid:330)न से किसी विशि(cid:700) मामल(cid:336) म(cid:336) अनुचित कठिनाइ(cid:330) होती है, वहाँ वह उस मामले म(cid:336) लागू नियमों म(cid:336) अ(cid:566)वि(cid:330)(cid:700) किसी बात के होते (cid:352)ए भी, आदेश (cid:554)ारा उस नियम की अपे(cid:407)ाओं को उस सीमा तक और ऐसी शत(cid:344) के अ(cid:559)धीन, जि(cid:590)(cid:336) वह मामले म(cid:336) (cid:586)ायसंगत और सा(cid:644)पूण(cid:330) रीति से काय(cid:330)वाही करने के लिए आव(cid:692)क समझ(cid:336), अभिमु(cid:389) या शिथिल कर सकती है।

O;ko`fRr 14-इस नियमावली म(cid:336) किसी बात का कोइ(cid:330) (cid:366)भाव, ऐसे आर(cid:407)ण और अ(cid:586) (cid:303)रयायतों पर नही ं पड़ेगा, जिनका इस स(cid:638)(cid:576) म(cid:336) सरकार (cid:554)ारा समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अ(cid:586) विशेष (cid:373)ेणियों के (cid:681)(cid:304)(cid:389)यों के लिए उपब(cid:576) किया जाना अपे(िcid:407)त हो।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of all existing rules and orders on the subject, the Governor is pleased to make the following rules regulating recruitment and the conditions of service of persons appointed to the Uttar Pradesh Panchayati Raj Department Additional District Panchayat Raj Officer/ Additional District Panchayat Raj Officer (Technical)/Additional District Panchayat Raj Officer (Panchayat Udyog) Service.

THE UTTAR PRADESH PANCHAYATI RAJ DEPARTMENT ADDITIONAL DISTRICT PANCHAYAT RAJ OFFICER/ ADDITIONAL DISTRICT PANCHAYAT RAJ OFFICER (TECHNICAL)/ ADDITIONAL DISTRICT PANCHAYAT RAJ OFFICER (PANCHAYAT UDYOG) SERVICE RULES, 2022

PART-1-GENERAL

Short title and

1-(1) These rules may be called the Uttar Pradesh Panchayati Raj commencement Department Additional District Panchayat Raj Officer/ Additional District Panchayat Raj Officer (Technical)/Additional District Panchayat Raj Officer (Panchayat Udyog) Service Rules, 2022.

(2) They shall come into force at once.

Status of the 2. The Uttar Pradesh Panchayati Raj Department Additional District

Service

Panchayat Raj Officer/ Additional District Panchayat Raj Officer

(Technical)/Additional District Panchayat Raj Officer (Panchayat Udyog) Service is a

Service comprising Group 'B' posts.

3. In these rules, unless there is anything repugnant in the subject or context:- Definitions

(a) 'Appointing Authority' means the Director, Panchayati Raj Uttar

Pradesh;

(b) 'Citizen of India' means a person who is or is deemed to be a citizen

of India under Part II of the Constitution;

(c) 'Constitution' means the Constitution of India;

(d) 'Government' means the State Government of Uttar Pradesh;

(e) 'Governor' means the Governor of Uttar Pradesh;

(f) "Member of the service" means a person substantively appointed

under these rules or the rules or orders in force prior to the commencement of

these rules to a post in the cadre of the service;

(g) 'Service' means the Uttar Pradesh Panchayati Raj Additional District

Panchayat Raj Officer/ Additional District Panchayat Raj Officer

(Technical)/Additional District Panchayat Raj Officer (Panchayat Udyog)

Service;

(h) 'Substantive appointment' means an appointment, not being an

adhoc appointment, on a post in the cadre of the service, made after selection

in accordance with the rules and, if there were no rules, in accordance with

the procedure prescribed for the time being by executive instructions issued

by the Government;

(i) 'Year of recruitment' means a period of twelve months commencing

on the first day of July of a calendar year.

PART-II-CADRE

Cadre of Service 4- (1) The strength of the service and of each category of post there in shall

be such as may be determined by the Governor from time to time.

(2) The strength of the service and of each category of posts there in shall,

until orders varying the same are passed under sub-rule(1), be as given below.

Provided that—

(i) the appointing authority may leave unfilled or the Governor may hold

in abeyance any vacant post, without thereby entitling any person to

compensation; or

(ii) the Governor may create such additional permanent or temporary

posts as he may consider proper.

PART-III-RECRUITMENT

5. Recruitment to the various categories of posts in the service shall be made Source of recruitment

- By promotion through the Departmental selection committee from amongst substantively appointed Assistant Development Officer (Panchayat) who have completed twelve years service as such on the first day of the year of recruitment.

2. Additional District Panchayat

Raj Officer (Technical)

- By promotion through the Departmental selection committee from amongst substantively appointed Assistant District Panchayat Raj Officer (Technical), who have completed seven years of service as such on the first day of the year of recruitment.

3. Additional District Panchayat

Raj Officer (Panchayat Udyog)

- By promotion through the Departmental selection committee from amongst substantively appointed Panchayat Nirikshak (Udyog), who have completed twelve years of service as such on the first day of the year of recruitment.

PART-IV-PROCEDURE FOR RECRUITMENT

6. The appointing authority shall determine the number of vacancies to be Determination of vacancies

filled during the course of the year of recruitment.

7. (1) Recruitment by promotion shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Procedure for recruitment by Promotion

Promotion Rules, 1994, as amended from time to time, through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee For Posts outside the Purview of the Service Commission Rules, 1992, as amended from time to time.

NOTE-Nomination of officers for giving representation to the Scheduled Castes, Scheduled Tribes and Other Backward Classes of citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Act, as amended from time to time.

(2) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules. 1986, as amended from the time to time, and place the same before the Selection Committee along with their character rolls and such other records, pertaining to them, as may be considered proper.

(3) The Selection Committee shall consider the cases of candidates on the basis of records, referred to in sub-rule (2).

(4) The Selection Committee shall prepare a list of selected candidates in order of seniority as it stood in the cadre from which they are to be promoted and forward the same to the appointing authority.

PART-V-APPOINTMENT AND SENIORITY

Appointment 8. (1) The appointing authority shall make appointment by taking the names

of the candidates in the order in which they stand in the list prepared under rule 7.

(2) If more than one order of appointment are issued in respect of any one selection, a combined order shall also be issued mentioning the names of the persons in order of seniority as determined in the selection or, as the case may be, as it stood in the cadre from which they are promoted.

Seniority

9. The Seniority of persons substantively appointed to the post of Additional District Panchayat Raj Officer/ Additional District Panchayat Raj Officer (Technical)/ Additional District Panchayat Raj Officer (Panchayat Udyog) in the service shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules, 1991, as amended from time to time.

PART-VI-PAY ETC.

10. (1) The scale of pay admissible to persons appointed to a post in the Pay Scale

service shall be such as may be determined by the Government from time to time.

(2) The scales of pay at the time of commencement of these rules are given as

follows:-

PART-VII-OTHER PROVISIONS

Canvassing

11. No recommendations, either written or oral, other than those required under the rules, applicable to the post or service will be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.

Regulation of other matters 12. In regard to the matters not specifically covered by these rules or special orders, persons appointed, to the service shall be governed by the rules, regulations and orders, applicable generally to Government servants serving in connection with the affairs of the state.

Relaxation from the conditions of service

13. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner.

Savings

14. Nothing in these rules shall affect reservations and other concessions required to be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons in accordance with the orders of the Government issued from time to time in this regard.
