उत्तर प्रदेश क्षेत्र पंचायत तथा जिला पंचायत अधिनियम, 1961 (उत्तर प्रदेश अधिनियम संख्या 33 सन् 1961) की धारा 44 के साथ पठित धारा 237 के अधीन शक्तियों का प्रयोग करके राज्यपाल उत्तर प्रदेश की जिला पंचायतों में अधिशासी अभियंता के पद पर भर्ती और उसमें नियुक् त व्यक्तियों की सेवा की शत(cid:7300) को विनियमित करने के लिए निम्नलिखित नियमावली बनाती हैं।

उत्तर प्रदेश (जिला पंचायत) [अधिशासी अभियंता (सिविल) कें (cid:7076)ीय सं(cid:7059)ाम्य संवर्ग] सेवा नियमावली, 2023 भाग- एक सामान्य

1–(1) यह नियमावली उत्तर प्रदेश (जिला पंचायत) [अधिशासी अभियंता संक्षिप्त नाम और प्रारंभ

(सिविल) का कें (cid:7076)ीय (सं(cid:7059)ाम्य) संवर्ग] सेवा नियमावली, 2023 कही जाएगी;

(2) यह तुरन्त प्रवृत्त होगी। 2–जब तक विषय या संदर्भ में कोई बात प्रतिकू ल न हो इस नियमावली में- परिभाषाएं

(क) ''नियुक्ति प्राधिकारी'' का तात्पर्य राज्यपाल से है; (ख) ''संवर्ग'' का तात्पर्य नियम 3 के अधीन सृजित अधिशासी अभियंता (सिविल)

के कें (cid:7076)ीय सं(cid:7059)ाम्य संवर्ग से है;

(ग) ''सरकार '' का तात्पर्य उत्तर प्रदेश राज्य सरकार से है; (घ) ''राज्यपाल '' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है; (ङ) ''सेवा का सदस्य'' का तात् पर्य उच्चतर सेवा के संवर्ग में किसी पद पर इस नियमावली या इस नियमावली के प्रारम्भ होने के पूर्व प्रवृत्त नियमों या आदेशों के अधीन मौलिक रूप से नियुक् त सेवा के सदस्य से है;

(च) ''सेवा'' का तात् पर्य उत्तर प्रदेश (जिला पंचायत) [अधिशासी अभियंता (सिविल) कें (cid:7076)ीय (सं(cid:7059)ाम्य) संवर्ग] से है;

(छ) ''चयन समिति'' का तात्पर्य नियम 8 के अधीन गठित चयन समिति से है;

(ज) ''राज्य'' का तात्पर्य उत्तर प्रदेश राज्य से है; (झ) ''मौलिक नियुक्ति'' का तात्पर्य सेवा संवर्ग में अधिशासी अभियंता (सिविल) के पद पर नियुक्ति से है, जो तदर्थ नियुक्ति या प्रतिनियुक्ति पर नियुक्त न हों, और इस नियमावली के अनुसार चयन के प(cid:7391)ात की गई हो और यदि कोई नियम न हो तो सरकार द्वारा जारी किये गये कार्यपालक आदेशों द्वारा तत्समय चयन हेतु विहित प्र(िcid:7059)या के अनुसार किया गया हो;

(ञ) ''भर्ती का वर्ष'' का तात् पर्य किसी कै लेण् डर वर्ष की पहली जुलाई से प्रारम्भ होने वाली बारह मास की अवधि से है।

भाग- दो संवर्ग और सदस्य संख्या

संवर्ग का सृजन 3-जिला पंचायतों में अधिशासी अभियंता (सिविल) पद के लिये एक कें (cid:7076)ीय सं(cid:7059)ाम्य संवर्ग सृजित किया जायेगा।

सदस्य संख्या 4-(1) नियम 3 के अधीन सृजित संवर्ग की सदस्य संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर अवधारित की जाय,

(2) जब तक कि उपनियम (1) के अधीन परिर्वतन करने के आदेश न दिये

(क) नियुक्ति प्राधिकारी किसी रिक् त पद को बिना भरे (cid:7263)ए छोड़ सकता है या राज्यपाल उसे आस्थगित रख सकते हैं, जिससे कोई व्यक्ति प्रतिकर का हकदार न हो, या

(ख) राज्यपाल ऐसे अतिरिक् त स्थायी या अस्थायी पदों का सृजन कर

सकती हैं, जितना वह उचित समझे।

भाग- तीन भर्ती

भर्ती का (cid:7090)ोत 5-संवर्ग में अधिशासी अभियंता (सिविल) के पदों पर भर्ती निम्नलिखित (cid:7090)ोतों से की जाएगी;

अधिशासी अभियंता (सिविल)-मौलिक रूप से नियुक् त ऐसे अभियंताओं, जिन् होने भर्ती वर्ष के प्रथम दिवस को सात वर्ष की सेवा पूरी कर ली हो, में से पदोन्नति द्वारा।

आरक्षण

6-अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य (cid:7088)ेणियों के अभ्य(cid:7414)थयों

के लिए आरक्ष् ाण भर्ती के समय प्रवृत्त शासनादेशों के अनुसार किया जायेगा ।

भाग- चार भर्ती की प्र(िcid:7059)या

रिक्तियों का अवधारण

7-नियुक्ति प्राधिकारी भर्ती वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या (नियम 6 के अधीन आरक्षण के अनुसार) अवधारित करेगा, और इसकी सूचना चयन समिति को देगा।

भर्ती की प्र(िcid:7059)या 8–(1) जिला पंचायतों में अधिशासी अभियंता (सिविल) के पद पर भर्ती, अनुपयुक्त अभ्य(cid:7414)थयों को अस्वीकार करते (cid:7263)ए ज्येष्ठता के आधार पर निम्नानुसार गठित चयन समिति के माध्यम से पदोन्नति द्वारा की जाएगी:-

(2) नियुक्ति प्राधिकारी, समय-समय पर यथा संशोधित उत्तर प्रदेश (लोक सेवा आयोग के क्षेत्र के बाहर के पदों पर) चयनोन्नति पात्रता-सूची नियमावली, 1986 के अनुसार जिला पंचायतों में कार्यरत अभियंताओं की ज्येष्ठता सूची से एक पात्रता सूची तैयार करेगा, और उसे चयन समिति के समक्ष, उनसे सम् बन्धित चरित्र पंजिकाओं के साथ रखेगा, जिन् हें वह उचित समझे,

(3) चयन समिति उपनियम दो में नि(cid:7416)दष्ट अभिलेखों के आधार पर अ(cid:7012)य(cid:7414)थयों के मामलों पर विचार करेगी और चयनित अ(cid:7012)य(cid:7414)थयों की उनकी ज्येष्ठता (cid:7059)म में एक सूची जैसा कि वह उस संवर्ग में हो जिससे उसकी पदोन्नति की जानी हो, तैयार करेगी। चयन समिति उक् त सूची नियुक्ति प्राधिकारी को अ(cid:7061)सारित करेगी।

भाग- पॉच नियुक्ति, परिवीक्षा, स्थायीकरण, ज्येष्ठता और स्थानांतरण

नियुक्ति

9-(1) नियुक्ति प्राधिकारी अ(cid:7012)य(cid:7414)थयों की नियुक्तियां उसी (cid:7059)म में करेगा, जिस (cid:7059)म में

उनके नाम नियम-8 के अधीन तैयार की गई सूची में हों;

(2) यदि एक साथ एक से अधिक अ(cid:7012)य(cid:7414)थयों की नियुक्ति की जानी हो तो आदेश में

अभ्य(cid:7414)थयों का ज्येष्ठता (cid:7059)मांक वही होगा जो चयन समिति द्वारा जारी सूची में है।

10-इस नियमावली के अधीन की गई समस्त नियुक्तिय(cid:7292) गजट में अधिसूचित

की जाएंगी।

नियुक्तिय(cid:7292) अधिसूचित की जाएंगी

परिवीक्षा 11-(1) संवर्ग में किसी पद पर मौलिक रूप से नियुक् त किसी व्यक्ति को दो वर्ष की अवधि के लिये परिवीक्षा पर रखा जायेगा;

(2) नियुक्ति प्राधिकारी अभिलिखित किये जाने वाले कारणों से वैयक्तिक मामलों में ऐसा दिनांक विनि(cid:7416)दष् ट करते (cid:7263)ये परिवीक्षा अवधि बढ़ा सकता है, जिस दिनांक तक परिवीक्षा अवधि बढ़ायी जानी हो; परंतु यह कि अपवादिक परिस्थितियों के सिवाय परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी परिस्थिति में दो वर्ष से अधिक नह(cid:7277) बढ़ाई जाएगी;

(3) यदि परिवीक्षा अवधि या बढ़ाई गई परिवीक्षा अवधि के दौरान किसी समय या उसके अंत में नियुक्ति प्राधिकारी को यह प्रतीत हो कि परिवीक्षाधीन (cid:7390)क्ति ने अपने अवसरों का पर्याप्त उपयोग नह(cid:7277) किया है, या संतोष प्रदान करने में अन्यथा विफल रहा है, तो उसे उसके मौलिक पद, यदि कोई हो, पर प्रत्याव(cid:7414)तत किया जा सकता है और यदि उसका किसी पद पर धारणाधिकार न हो तो उसकी सेवाएं समाप्त की जा सकती हैं;

(4) ऐसा परिवीक्षाधीन (cid:7390)क्ति, जिसे उप नियम 3 के अधीन प्रत्याव(cid:7414)तत किया जाए या उसकी सेवाएं समाप्त की जाए, किसी प्रतिकर का हकदार नह(cid:7277) होगा।

स्थायीकरण 12-किसी परिवीक्षाधीन (cid:7390)क्ति को परिवीक्षा अवधि या बढ़ाई गई परिवीक्षा अवधि के अंत में उसकी नियुक्ति में स्थायी कर दिया जाएगा, यदि,

(क) उसका कार्य और आचरण संतोषजनक बताया जाय और उसकी, सत्यनिष्ठा

प्रमाणित हो, और

(ख) नियुक्ति प्राधिकारी का यह समाधान हो जाए कि वह स्थायी किए जाने के

लिए अन्यथा उपयुक्त है।

ज्येष्ठता 13-संवर्ग में अधिशासी अभियंता (सिविल) के पद पर मौलिक रूप से नियुक्त431 RPH 2023 (Panchayati Raj-2 Niyamavali) data 4e 4 mRrj izns'k vlk/kkj.k xtV] 30 twu] 2023 (cid:7390)क्तियों की ज्येष्ठता मौलिक नियुक्ति के आदेश के दिनांक से, और यदि दो या अधिक (cid:7390)क्ति एक साथ नियुक्त किए जाएं तो उस (cid:7059)म में जिसमें उसके नाम नियुक्ति के आदेश में रखे गए हों, अवधारित की जाएगी।

14-सरकार, अधिशासी अभियंताओं को जिला पंचायत प्रयागराज, जौनपुर, तैनाती और स्थानांतरण

आजमगढ, सीतापुर एवं हरदोई में से किसी जिला पंचायत में तैनात कर सकती है, और उन् हें, उक् त पॉच जिला पंचायतों में से किसी भी जिला पंचायत में स्थानांतरित कर सकती है।

भाग- छ: वेतनमान

वेतनमान 15-(1) संवर्ग में नियुक्त (cid:7390)क्तियों का अनुमन्य वेतनमान वही होगा जैसा कि सरकार द्वारा समय-समय पर अवधारित किया जाये;

(2) इस नियमावली के अनुसार अधिशासी अभियंता (सिविल) का वेतनमान

परिवीक्षा अवधि में वेतन

16-किसी परिवीक्षाधीन (cid:7390)क्ति को वेतनमान में उसकी प्रथम वेतन वृ(िcid:7373) तभी दी जाएगी, जब उसने एक वर्ष की संतोषजनक सेवा पूरी कर ली हो, प्रशिक्षण, जहॉ विहित हो, प्राप्त कर लिया हो और f}rh; वेतन वृ(िcid:7373) सेवा के दो वर्ष प(cid:7391)ात तभी दी जाएगी, जब उसने परिवीक्षा अवधि पूरी कर ली हो और उसे स्थायी भी कर दिया गया हो। परन्तु यह कि यदि संतोष प्रदान करने में विफल रहने के कारण परिवीक्षा अवधि बढ़ाई जाये तो इस प्रकार बढ़ाई गयी अवधि की गणना वेतन वृ(िcid:7373) के लिए नह(cid:7277) की जाएगी, जब तक कि नियुक्ति प्राधिकारी अन्यथा निदेश न दे।

भाग- सात अन्य उपबंध

पक्ष समर्थन

17-इस नियमावली के अधीन अपेक्षित सिफारिश से भिन्न किसी सिफारिश, चाहे लिखित हो या मौखिक पर विचार नह(cid:7277) किया जाएगा। किसी अ(cid:7012)यर्थी की ओर से अपनी अ(cid:7012)य(cid:7414)थता के लिए प्रत्यक्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने का कोई प्रयास नियुक्ति के लिए उसे अनर्ह कर देगा।

18-इस नियमावली या विशेष आदेशों से विनि(cid:7416)दष् ट रूप से अनाच्छादित अन्य मामलों का विनियमन

मामलों में संवर्ग में नियुक्त (cid:7390)क्ति, राज्य के कार्यकलापों के संबंध में सेवारत सरकारी सेवकों पर सामान्यतया लागू नियमों, विनियमों और आदेशों द्वारा शासित होंगे।

नियमों में शिथिलीकरण

19-जहां राज्य सरकार का यह समाधान हो जाए कि संवर्ग में नियुक्त (cid:7390)क्तियों की सेवा की शत(cid:7300) को विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष् ट मामले में असम्यक कठिनाई उत्पन्न होती है वहां वह उस मामले में लागू नियमावली में अन्त(cid:7414)वष् ट किसी बात के होते (cid:7263)ए भी, आदेश द्वारा, उस नियम की अपेक्षाओं को उस सीमा तक और ऐसी शत(cid:7300) के अध्यधीन, जिन् हें वह मामले में न्यायसंगत और साम्यपूर्ण रीति से कार्यवाही करने के लिए आवश्यक समझे, अभिमुक् त या शिथिल कर सकती है।

(cid:7390)ावृत्ति

20-इस नियमावली की किसी बात का प्रभाव ऐसे आरक्षण और अन्य रियायतों पर नह(cid:7277)

पड़ेगा जिनका इस संबंध में सरकार द्वारा समय-समय पर जारी शासनादेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष (cid:7088)ेणियों के अ(cid:7012)य(cid:7414)थयों के लिए उपबंध करना अपेक्षित हो।

IN exercise of the powers under section 237 read with section 44 of the Uttar Pradesh Kshettra Panchayats and Zila Panchayats Adhiniyam, 1961 (U.P. Act no. 33 of 1961), the Governor is pleased to make the following rules to regulate the recruitment and conditions of service of persons appointed to the post of Executive Engineer in Zila Panchayats of Uttar Pradesh.

UTTAR PRADESH (ZILA PANCHAYAT) [EXECUTIVE ENGINEER (CIVIL)

CENTRAL (TRANSFERABLE) CADRE] SERVICE RULES, 2023

PART-I

GENERAL

1. (1) These rules shall be called the Uttar Pradesh (Zila Panchayat) Short title and commencement [Executive Engineer (Civil) Central (Transferable) Cadre] Service Rules, 2023.

(2) They shall come into force at once.

Definitions

2. In these rules, unless there is anything repugnant in the subject or context–

(a) "appointing authority" means the Governor;

(b) "cadre" means the Central Transferable Cadre of Executive Engineer

(Civil) created under rule 3;

(c) "Government" means the State Government of Uttar Pradesh;

(d) "Governor" means the Governor of Uttar Pradesh;

(e) "member of the service" means a member of the service substantively appointed under these rules or the rules or orders in force before the commencement of these rules, to a post in the cadre of the higher service;

(f) "service" means the Uttar Pradesh (Zila Panchayat) [Executive Engineer (Civil) Central (Transferable) Cadre] Service;

(g) "selection committee" means the selection committee constituted under rule 8;

(h) "State" means the State of Uttar Pradesh;

(i) "substantive appointment" means appointment to the post of Executive Engineer (Civil) in the cadre of service, not being an ad hoc appointment or on deputation, made after selection in accordance with these rules and, if there were no rules, in accordance with the procedure prescribed for selection for the time being by way of executive orders issued by the Government;

(j) "year of recruitment" means a period of twelve months commencing on the first day of July of a calendar year.

PART-II

CADRE AND NUMBER OF MEMBERS

Creation of

3. A central transferable cadre for the post of Executive Engineer (Civil) in Cadre

Zila Panchayats shall be created.

Number of

4. (1) The strength of cadre of members created under rule 3 shall be such as members

may be determined by the Government from time to time.

(2) The strength of members of service shall, until orders varying the same are passed under sub-rule (1), be as given below:-

(a) the appointing authority may leave unfilled or the Governor may hold in abeyance any vacant post, without thereby entitling any person to compensation; or

(b) the Governor may create such additional, permanent or temporary posts, as he may deem fit.

PART-III

RECRUITMENT

Source of

5. Recruitment to the posts of Executive Engineer (Civil) in the cadre shall be Recruitment

made from the following sources:

Executive Engineer (Civil)–By promotion from amongst the substantively appointed Engineers who have completed seven years of service on the first day of the year of recruitment.

Reservation 6. Reservation for candidates belonging to Scheduled Castes, Scheduled Tribes and other categories shall be in accordance with the Government orders in force at the time of recruitment.

PART-IV

PROCEDURE OF RECRUITMENT

Concept of

7. The Appointing Authority shall determine the number of vacancies (as per

reservation under rule 6) to be filled during the course of the year of recruitment, and

shall inform about the same to the Selection Committee.

Procedure of

8. (1) Recruitment to the post of Executive Engineer (Civil) in Zila

Recruitment

Panchayats shall be made, after rejecting unfit candidates, on the basis of seniority by

way promotion, through a Selection Committee constituted as follows:-

(2) The appointing authority shall prepare an eligibility list of engineers working in the Zila Panchayats, from the seniority list, in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time, and shall place it before the Selection Committee alongwith their character rolls, pertaining to them, as it may deem fit.

(3) The Selection Committee shall consider the cases of the candidates on the basis of the records referred to in sub-rule (2) and shall prepare a list of the431 RPH 2023 (Panchayati Raj-2 Niyamavali) data 4e mRrj izns'k vlk/kkj.k xtV] 30 twu] 2023 7 selected candidates in the order of their seniority as it stands in the cadre from which he is to be promoted. The Selection Committee shall forward such list to the appointing authority.

PART-V

APPOINTMENT, PROBATION, CONFIRMATION, SENIORITY AND TRANSFER

Appointment

9. (1) The appointing authority shall make appointments of the candidates in

the order in which their names appears in the list prepared under rule 8.

(2) If more than one candidate is appointed simultaneously then in the order the seniority number of the candidates shall be same as in the list issued by the Selection Committee.

10. All appointments done under these rules shall be notified in the Gazette. Appointments to

Probation

11. (1) A person on substantive appointment to a post in the cadre shall be

placed on probation for a period of two years.

(2) The appointing authority may, for reasons to be recorded, extend the period of probation in individual cases specifying the date upto which the extension is granted:

Provided that, save in exceptional circumstances, the period of probation shall not be extended beyond one year and in no circumstance beyond two years.

(3) If it appears to the appointing authority, at any time during or at the end of the period of probation or extended period of probation, that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be reverted to his substantive post, if any, and if he does not hold a lien on any post, his services may be dispensed with.

(4) A probationer who is reverted or whose services are dispensed with under sub-rule (3) shall not be entitled to any compensation.

Confirmation 12. A probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation if,

(a) his work and conduct is reported to be satisfactory, and his integrity is certified, and

(b) the appointing authority is satisfied that he is otherwise fit for confirmation.

Seniority 13. The seniority of the persons substantively appointed to the post of Executive Engineer (Civil) in the cadre shall be, determined from the date of the order of the substantive appointment and if two or more persons are appointed together, in the order in which their names were placed in the order of appointment.

Posting and transfer

14. The Government can post Executive Engineers in any of the Zila Panchayats of Prayagraj, Jaunpur, Azamgarh, Sitapur and Hardoi and can transfer them to any of the above five Zila Panchayats.

PART-VI

SCALE OF PAY

Scale of pay

15. (1) The scales of pay admissible to persons appointed to the cadre shall be such as may be determined by the Government from time to time.

(2) The scales of pay of Executive Engineer (Civil) according to these rules shall be as follows:

Pay during probation

16. A person on probation shall be allowed his first increment in the pay-scale when he has completed one year of satisfactory service, has undergone training, where prescribed, and second increment after two years service when he has completed the probationary period and is also confirmed:

Provided that, if the period of probation is extended on account of failure to give satisfaction, such extension shall not count for increment unless the appointing authority directs otherwise.

PART-VII

OTHER PROVISIONS

Canvassing

17. No recommendation, either written or oral, other than that required under these rules shall be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.

Regulation of other matters

18. In regard to the matters not specifically covered by these rules or special orders, persons appointed to the cadre shall be governed by the rules, regulations and orders applicable generally to Government servants serving in connection with the affairs of the State.

Relaxation of 19. Where the State Government is satisfied that the operation of any rule

regulating the conditions of service of persons appointed to the cadre causes undue

hardship in any particular case, it may, notwithstanding anything contained in the rules

applicable to the case, by order, dispense with or relax the requirements of that rule to

such extent and subject to such conditions as it may consider necessary for dealing with

the case in a just and equitable manner.

Savings

20. Nothing in these rules affect reservations and other concessions required to

be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and

other special categories of persons in accordance with the orders of the Government

issued from time to time in this regard.
