चॅ ूकि (cid:7061)ाम-सेन्दुरिया, तहसील-ओबरा, जिला-सोनभ(cid:7076) का कु ल 633.461 हेक्टेयर क्षेत्र, भारतीय वन अधिनियम, 1927 (अधिनियम संख्या 16 सन् 1927), जिसे आगे "उक्त अधिनियम" कहा गया है की धारा 4 के अधीन सरकारी अधिसूचना संख्या 23(3)-17/14-ख-68, दिनांक 02.08.1969 द्वारा अधिसूचित किया गया था;

और, चॅ ूकि, जिला सोनभ(cid:7076) में कै मूर पर्वत माला के दक्षिण में अवस्थित तहसील रावर्टसगंज (ओबरा) एवं दु(cid:7373)ी के अधीन आने वाले, धारा 4 में अधिसूचित (cid:7061)ामों के सम्बन्ध में, रिट याचिका ((िcid:7059)मिनल) संख्या 1061 सन् 1982 (वनवासी सेवा आ(cid:7088)म बनाम उत्तर प्रदेश राज्य व अन्य) में माननीय उ(cid:6994)चतम न्यायालय, नई दिल्ली द्वारा पारित दिनांक 20.11.1986 के विनिश्चय के अनुसार वन बन्दोबस्ती की कार्यवाही संचालित की गयी जिसमें कु ल 142.888 हेक्टेयर भूमि वन विभाग के पक्ष में (cid:7018)यवस्थापित की गयी;

और, चॅ ूकि, वन विभाग के पक्ष में (cid:7018)यवस्थापित कु ल भूमि में से (cid:7061)ाम सेन्दुरिया के आराजी गाटा सं0 1055 क मि0 रकवा 0.253 हेक्टेयर क्षेत्र के सम्बन्ध में, अनु(cid:6994)छेद 227 के अधीन मामला संख्या 3668 सन् 2020 [रिट (सी) 24185 सन् 2019 से सम्ब(cid:7373)] माननीय उ(cid:6994)च न्यायालय, इलाहाबाद में विचाराधीन है ;

और, चॅ ूकि, कै मूर पर्वत माला के दक्षिण में अवस्थित (cid:7061)ामों की धारा 20 के अधीन अधिसूचना निर्गत किये जाने के सम्बन्ध में उत्तर प्रदेश सरकार द्वारा माननीय उ(cid:6994)चतम न्यायालय, नई दिल्ली में एम0ए0 संख्या 1855 सन् 2021 (उत्तर प्रदेश राज्य बनाम वनवासी सेवा आ(cid:7088)म) रिट याचिका ((िcid:7059)मिनल) सं0 1061 सन् 1982 (वनवासी सेवा आ(cid:7088)म बनाम उत्तर प्रदेश राज्य व अन्य) में दाखिल किया गया, जिसमें माननीय उ(cid:6994)चतम न्यायालय नई दिल्ली ने दिनांक 09-11-2022 को आदेश द्वारा उक्त अधिनियम की धारा 20 के अधीन राज्य सरकार को अधिसूचना जारी करने हेतु अनु(cid:6980)ात किया है;

और, चॅ ूकि, अधिमान दावा हेतु नियत अवधि (cid:7018)यपगत हो चुकी है ;

और, चॅ ूकि, इसमें उपाब(cid:7373) अनुसूची 'ख' में उल्लिखित सीमा के विस्तार तक, रियायत अनु(cid:6980)ात की गई है, जो राज्य सरकार के प्रसादानुसार वापस ली जा सकती है ;

अतएव, अब, उक्त अधिनियम की धारा 20 के अधीन शक्तियों का प्रयोग करके राज्यपाल घोषणा करती हैं कि इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से नीचे अनुसूची 'क' में उल्लिखित 142.635 हेक्टेयर भूमि

माननीय उ(cid:6994)च न्यायालय इलाहाबाद मे विचाराधीन प्रश्नगत 0.253 हेक्टेयर भूमि को कालान्तर में अन्तिम विधिक विनिश्चय के अनुरूप धारा 20 की अधिसूचना में सम्मिलित करने के लिए राज्य सरकार स्वत्रंत होगी।

THE Governor is pleased to order the publication of the following English translation of notification no. 321/LXXXI-2–2024-20(04)-2019 , dated February 13, 2024.

No. 321/LXXXI-2–2024-20(4)-2019

Dated Lucknow, February 13, 2024

WHEREAS total area of 633.461 hectares of village Senduriya, Tehsil Obra, District Sonbhadra was notified vide Government Notification no. 23(3)-17/14-Kh-68, dated 02.08.1969 under section 4 of the Indian Forest Act, 1927 (Act no. 16 of 1927), hereinafter referred to as the "said Act";

AND, WHEREAS, in relation to the villages notified in section 4 falling under Tehsil Robertsganj (Obra) and Duddhi, located to the south of the Kaimur mountain range in Sonbhadra district, forest settlement proceedings were conducted in accordance with the decision dated 20.11.1986 passed by the Hon'ble Supreme Court, New Delhi in Writ Petition (Criminal) no.1061 of 1982 (Banvasi Seva Ashram vs. State of U.P. and others) wherein a total of 142.888 hectares of land was settled in favour of the Forest Department;

AND, WHEREAS, out of the total land settled in favour the Forest Department, regarding Araji Gata no. 1055 K mi Area 0.253 hectare area of village Senduriya, Matters under Article. 227 no. 3668 of 2020 [connected with Writ (C) 24185 of 2019] is under consideration in the Hon'ble High Court, Allahabad;

AND, WHEREAS, in relation to the issuance of notification under section 20 of the villages located south of the Kaimur mountain range, M.A no. 1855 of 2021 (State of Uttar Pradesh Government vs. Banvasi Seva Ashram) was filed in Writ Petition (Criminal)no. 1061 of 1982 (Banvasi Seva Ashram vs. State of U.P and others) by the Government of Uttar Pradesh in the Hon'ble Supreme Court, New Delhi, in which the Hon'ble Supreme Court vide order dated 09.11.2022 has permitted the State Government to issue a notification under section 20 of the said Act;

AND, WHEREAS, the period fixed for preferring claims has elapsed;

AND, WHEREAS, the concession to the extent of the limit mentioned in Schedule 'B' annexed herewith has been allowed which may be withdrawn at the pleasure of the State Government;

NOW,THEREFORE, in exercise of the powers under section 20 of the said Act, the Governor is pleased to declare that 142.635 hectares of land mentioned in Schedule 'A' below, shall be the Reserve Forest with effect from the date of publication of this notification in the Gazette;

In due course of time, the State Government will be free to include the 0.253 hectares of land in question under consideration in the Hon'ble High Court of Allahabad in the notification of section 20 as per the final legal decision.
