IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 1565/Chh-pu-se-2–2024, dated November 8, 2024 :

IN exercise of the powers conferred by clause (c) of sub-section (2) and sub-section (3) of section 46 read with Section 2 of the Police Act, 1861 (Act No. 5 of 1861) and Section 21 of the General Clauses Act, 1897 (Act No. 10 of 1897) and in supersession of all existing rules and order on the subject and all other powers enabling him in this behalf, the Governor, with a view to establishing an independent machinery for the selection and appointment of a suitable person to the post of Selection and Appointment of Director General of Police, Uttar Pradesh (Head of the Police Force) so as to ensure that the said selection, appointment and the consequential tenure are free from political or executive interference and are also commensurate with the peculiar conditions and policing needs of the State of Uttar Pradesh, hereby makes the following rules:-
Selection and Appointment of Director General of Police, Uttar Pradesh (Head of the Police Force) Rules, 2024
1. (1) These rules may be called the "Selection and Appointment of Director Short title and commencement General of Police, Uttar Pradesh (Head of the Police Force) Rules, 2024".
(2) They shall come into force from the date of their publication in the Gazette.
mÙkj çns'k vlk/kkj.k xtV] 8 uoEcj] 2024 5Definitions 2. In these rules, unless the context otherwise requires ,-
(a) "Appointing Authority" means the Governor of Uttar Pradesh;
(b) "Citizen of India" means a person who is or is deemed to be a
citizen of India under part II of the Constitution of India;
(c) "Constitution" means the Constitution of India;
(d) "Government" means the Government of Uttar Pradesh;
(e) "Governor" means the Governor of Uttar Pradesh;
(f) "Nomination Committee" means the Committee constituted under
rule 4;
(g) "Pay Matrix" means the Pay Matrix as specified in Section 3 of the
Indian Police Service (Pay) Rules, 2016;
(h) "Panel" means a panel of a minimum of three and a maximum of
five names of eligible and qualified officers for selection to the post of Director
General of Police, Uttar Pradesh (Head of the Police Force) by the Nomination
Committee.
Procedure for 3. The selection and appointment to the post of Director General of Police,
selection and Uttar Pradesh (Head of the Police Force) shall be made under the provisions of these
appointment Rules.
Constitution of 4. (a) The State Government shall constitute a Nomination Committee
Nomination consisting of, -
Committee (i) A retired Judge of a High Court- Chairman
(ii) Chief Secretary of the Government of Uttar Pradesh- Member
(iii) A nominee of the Union Public Service Commission- Member
(iv) Chairman or nominee of the Uttar Pradesh Public Service
Commission- Member
(v) Additional Chief Secretary/Principal Secretary, Home Department,
Uttar Pradesh–Member- Secretary
(vi) A retired Director General of Police who has served as the head of
the Police Force in the State of Uttar Pradesh- Member.
(b) The Nomination Committee shall prepare a list from among the officers
falling within the scope of consideration under rule 5, in accordance with the procedure
laid down in rule 8 and based on the criteria laid down in rule 6.
Minimum
5. (a) The above shall include only those officers who are holding the post of
Qualification Director General of Police in the State Cadre in the Level 16 of the Pay Matrix.
(b) Where no officer in Level 16 is available for consideration for inclusion
in the list as Director General of Police, Uttar Pradesh (Head of the Police Force) in the
State of Uttar Pradesh, or the Nomination Committee does not find any officer suitable
for inclusion in the list, all officers holding the post of Additional Director General of
Police in the State Cadre in the Level-15 of the Pay Matrix and who have rendered at
least 30 years of service in the Indian Police Service from the 1st January of the
allocation year to the date of the vacancy (for which the list is prepared).
(c) The officer should have a service period of six months or more on the date
of occurrence of the vacancy in the post of Director General of Police, Uttar Pradesh
(Head of the Police Force).
Method of 6. (i) The basis of selection shall be merit and suitability.

Size of List 7. The number of officers included in the list shall be a minimum of 3 (three)

8. (1) The Home Department of the Government of Uttar Pradesh shall send the proposal, complete in all respects, to the Nomination Committee, three months before the occurrence of the vacancy. The proposal shall be accompanied by the following documents:-
(a) Seniority list of officers, duly notified; (b) List of officers fulfilling the eligibility conditions. If some of the officers included in the seniority list are not included in the eligibility list, the reasons for the same must be stated;
(c) Service details of the officers included in the above list showing their previous posts held, nature of duties performed, academic and service achievements etc.;
(d) Details of disciplinary/criminal proceedings against the officers, date of issue of charge sheet to the officers/date of filing of charge sheet in the Court and details of suspension, if any;
(e) Statement of adverse remarks in the ACLs of the officers which have not yet been communicated/ are yet to be communicated and the time limit for making representation against the same to the concerned officer has not expired or the decision on the representation of the officers is pending;
(f) Details of any penalty imposed on the officer during his service period, with specific periods;
(g) Complete and updated Annual Confidential Entry files of eligible officers, if any, statement showing year wise availability of Annual Confidential Entry. Further, if some Annual Confidential Entry is not reviewed or approved by the competent authority, valid reasons for the same should be submitted. A certificate to this effect should also be recorded and kept in the respective Annual Confidential Entry folder;
(h) Court directions, if any, having a bearing on the empanelment; (i) Integrity Certificate on the lines prescribed by Government of India, Ministry of Home Affairs letter No. 14/23/65-AIS (III), dated 28.07.1996;
(j) In case of any officer posted in the cadre or on deputation, a copy of the same shall be enclosed. (2) Procedure to be followed by the Nomination Committee,-
(a) The Nomination Committee shall follow the prescribed procedure for objective evaluation of suitability of officers possessing the minimum qualifications;
(b) The Committee shall do the following:-
(i) Evaluation of the Annual Confidential Entry of the officer with reference to the last 10 years preceding the date of meeting of the Committee.
Only those officers of good standing who have been generally rated as "Very Good" by the Committee in the last 10 years shall be considered for empanelment;
(ii) The Committee will also take into account the experience reflected in the bio-data of the officers, that is, relevant experience for leading the police force (operational, strategic, leadership etc.) to determine the suitability of officers for inclusion in the list, considering the specific challenges faced by the State of Uttar Pradesh;
(iii) The Committee shall also consider the penalties imposed on the officers, if any, and shall exclude from the list any officer who is under suspension or against whom disciplinary/criminal proceedings are pending or whose integrity certificate has been withheld by the State Government or who has been subjected to any punishment other than "Censure" during the last five years or has been subjected to the penalty of "Censure" during the last three years;

of the list or during the Empanelment Committee Meeting (ECM), informs the State
Government in writing that it would not be possible to relieve officers on Central
deputation for appointment to the post of Director General of Police, Uttar Pradesh
(Head of the Police Force), the Empanelment Committee will not evaluate such officers.
Approval by Ministry of Home Affairs for officers on central deputation
10. (1) The State Government shall appoint the Director General of Police,
Uttar Pradesh (Head of the Police Force of Uttar Pradesh) from the list of officers
recommended by the Nomination Committee. The Director General of Police, Uttar
Pradesh (Head of the Police Force) so appointed shall ordinarily hold office for a
minimum term of two years (As per the latest instructions of the Hon. Supreme Court)
or till the age of superannuation of sixty years, whichever is earlier:
Appointment of Director General of Police (Head of Police Force of Uttar Pradesh)
Provided that the State Government may relieve the Director General of
Police, Uttar Pradesh (Head of the Police Force) so appointed from his duties before the
completion of the period of two years, if-
(a) any proceedings have been initiated against him under the All India
Services (Discipline and Appeal) Rules, 1969; or
(b) he has been convicted by a Court in a criminal case or charges have
been framed against him by a Court in a case involving corruption; or
(c) he has become unable to discharge his duties as Director General of
Police, Uttar Pradesh (Head of the Police Force) due to incapacity arising out of
physical or mental illness;
(d) The Director General of Police, Uttar Pradesh (Head of the Police
Force) may be removed from his office by the State Government if it is
satisfied that he has failed to discharge his duties and responsibilities before the
completion of his tenure of two years.
(2) If the Director General of Police, Uttar Pradesh (Head of the Police Force)
is relieved of his duties under the proviso to sub-section (1) and until a new Director
General of Police is appointed by the State Government, the State Government may give
additional charge of the post of Director General of Police, Uttar Pradesh (Head of the
Police Force) to any officer of the rank of Director General of Police in the State.
(3) If a departmental vigilance inquiry has been initiated against any officer
included in the list before his appointment, he shall not be considered for appointment to
the post of Director General of Police, Uttar Pradesh (Head of the Police Force).
11. If any difficulty arises in giving effect to the provision of these rules, the
State Government may by a notified order, make such provisions, not in consistent with
