3. Objectives .- a ) Promotion of animal b) It shall come into force with effect from the date of its publication in the Official Gazette.
2. Introduction . The District SPCAs of
welfare generally for the purpose of prevention of cruelty and protecting animals from being subject to unnecessary pain and suffering .
b) Manage and participate in the State ABC programs .
c) To ensure functional viability of the District SPCAs and provide for adequate financial assistance .
4. Eligibility. Both District SPCAs , North and South Goa , duly registered under the Registration of Societies Act , 1860 are eligible to apply.
5. Requirements . a ) To fulfill their North and South Goa having their objectives for promotion of animal welfare and to protect animals from being subjected to unnecessary pain and suffering , are required to encourage the establishment of animal shelters , sanctuaries , water trough , and the likes for providing shelter and amenities to animals rescued from cruelty, incapacitated for work by reason of old age , sickness or injury. These animals are required to be given Veterinary Assistance with the help of Infirmaries and some of them may have to be rehabilitated at Animal Shelters .

The DSPCAs so constituted are required to employ paid staff to manage the office and also to watch , warn or prosecute as required all persons guilty of cruelty to animals and also to manage the ABC programme in the State . As such , they would require adequate financial support in terms of man power like Executive Secretary, DSPCA Inspectors , office staff, Accountant and a Legal council on a retainer basis to help achieve the basic functioning of the DSPCAs .
b) Provision for leasing out suitable Premises for DSPCA office .
c) Out sourcing a vehicle with driver for mobility of the DSPCA Field Officers .
d) Treatment of abused animal rescued by the DSPCA Field Officers , a Veterinary Doctor at the infirmary.
Until such time the DSPCAs have their own infrastructure like building office , infirmary, animal shelter , and vehicles , they will have to rely on leasing out a suitable office premises and the assistance of Animal Welfare Organizations for Veterinary Assistance Shelter and Rehabilitation of the animals rescued .
e) Rehabilitation of rescued animals at Animal Welfare Organizations and / or at Fosters .
f) Travel and Stay costs for DSPCA Invitees/ Personal .
A provision is also required to be made to impart education in relation to the humane treatment of animals , build empathy, and encourage the formation of public opinions against the infliction of pain and suffering to animals .
g) Public awareness on community ownership of animals .

7. Pattern of Assistance . a) The District SPCAs North and South Goa, shall apply to the Directorate of Animal Husbandry & Veterinary Services in advance of every Financial Year for Grant in aid as per the Form at Annexure "A" .

b) The Director AH& VS on due approval from the Government shall disburse the Grant in aid to the DSPCA in two yearly installments , through the Electronic Clearing System , for which these DSPCAs shall provide Bank Account details .
c) The Member Secretary, DSPCA , will verify and certify the bills towards the cost of the components of the Grant in aid released in the first installment and submit an Utilization Certificate as required under the existing administrative , legal and financial regulations to the Director, AH& VS .
d) On subsequent release of the second installment of Grant in aid from the Department ofAH& VS , the DSPCA on utilization of the Grant in aid shall submit the final Utilization Certificate and Audited Report duly prepared by a qualified Chartered Accountant which shall be subject to audit by Statutory Auditors of the Government. Unutilized balance amount may be adjusted in the next installment or refunded into the Government treasury.
The accounts of the grants shall be maintained separately and properly at the DSPCAs and submitted as and when required .
e) The Audited statement of Accounts showing the expenditure incurred by the DSPCAS from the grants should be furnished to the Goa State Animal Welfare Board .
f) The amount for various components at maximum unit cost may be re - appropriated as required for effective implementation of the scheme and provided it does not exceed the sanctioned amount .

Mormugao Port Authority ( Stevedoring and Shore Handling) Regulations , 2022
Notification
makes the following regulations , in supersession of the Mormugao Port Trust (Licensing of Stevedores ) Regulations, 2010 , except as respect things done or omitted to be done before such supersession , namely : -

1. Short title and commencement.- ( 1) These regulations may be called the Mormugao Port Authority ( Stevedoring and Shore Handling ) Regulations , 2022 .
(2) They shall come into force on the date oftheir final publication in the Official Gazette .
2. Definitions . ( 1 ) In these regulations , unless the context otherwise requires , -
(a) "Act " means the Major Port Authorities Act , 2021 ( 1 of 2021 ) ;
(b) " agent " means a person to whom stevedoring and shore handling licence has been issued under regulation 4 ;
(E) -Whereas draft of the Mormugao Port Authority ( Stevedoring and Shore Handling ) Regulations , 2022 which the Board of Mormugao Port Authority proposes to make , in exercise of the powers conferred by sub - section ( 1 ) of section 72 of the Major PortAuthorities Act , 2021 ( 1 of 2021 ) is hereby published for the information of all persons likely to be affected thereby ; and notice is hereby given that the said draft shall be taken into consideration after thirty days from the date on which the copies of this notification as published in the Official Gazette are made available to the public ;
(c) " Form " means forms annexed to these regulations ;
( d) " Licence " means a stevedoring and shore handling licence issued under regulation 4.
Objections or suggestions , if any, to these draft regulations may be sent to the Traffic Manager, Mormugao Port Authority, Headland Sada, or by email at [email protected] within the period specified above;
( e) " Licencee " shall mean a person to whom a stevedoring and shore handling licence has been issued under these Regulations;
The objections or suggestions which may be received from any person concerning the said draft regulations , within the period so specified shall be considered by the Board and the Central Government .
(f) " Licensing Authority " means the Chairperson of the Port;
(g) " Port " means the Mormugao Port;

SCHEDULE
Mormugao Port Authority
( h) " Royalty " means the amount fixed by Board of Mormugao Port , which is payable by the agent to the Board for rendering stevedoring or shore handling services;

( i ) " Shore Handling " includes arranging and receiving the cargo to or from the hook point , inter modal transport from wharf to stack - yard and vice - versa and also receiving and delivering of a cargo from or to sea , railways , waterways or roadways ;
(j ) " Stevedore " is an agent authorised under these regulations for loading , unloading and stowage of cargo ;
In exercise of the powers conferred by section 24 , clause ( h ) of sub - section ( 1 ) of section 26 read with clauses ( f) and ( h ) of sub - section ( 2) of section 72 of the Major Port Authorities Act , 2021 ( 1 of 2021 ) , the Board of Mormugao Port Authority hereby

(k) " Stevedoring " includes loading , unloading and stowage of cargo in any form on board the vessel ;
years of cargo handling or stowage experience and their profiles shall be enclosed alongwith the application .
(3) No person shall undertake to perform the stevedoring and shore handling activities in the port unless he has been issued a licence under these regulations;
( 1 ) " Traffic Manager " means the Officer in charge of the Traffic Department of the Mormugao Port and includes his deputies or assistants or any other officer acting under his authority ;
( 2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning as assigned to them in the Act .
Provided that a person to whom licence has been issued prior to coming into the force of these regulations , may continue to operate under the existing licence for a period of sixty (60) days or till he obtains a licence under these regulations , whichever is earlier after fulfilling requirements .
5. Licensing Authority. Chairperson shall be the licensing authority under these regulations .
3. Application . These regulations shall apply to the stevedoring and shore handling activities undertaken by the agent but shall not apply to the stevedoring and shore handling activities by the Port , Public Private Partnership projects , Build- Operate -Transfer operations / agreements or such other agreements as have been entered into by the Board.
6. Licence Fees . The fee for issue of licence shall be rupees fifty thousand excluding taxes for a period of three years which may be revised by the Board .
7. Stevedoring and Shore Handling Charges . ( 1 ) The Adjudicatory Board shall notify the normative tariff for stevedoring and shore handling activities , separately for mechanized and manual operations .
4. Licensing of stevedoring and shore handling agent .- ( 1 ) Any eligible person fulfils the eligibility criteria can apply for licence in writing to the Chairperson in Form -A, alongwith the documents specified therein and with fee as the Board may fix .
(2) The licence shall be issued to the applicant subject to fulfillment of following criteria:
(2) The Port will notify the ceiling tariff set for stevedoring and shore handling activities and the tariff will be mandatorily displayed on the Port website . No agent shall charge tariff exceeding the ceilings rates notified .
( a) the applicant is a company registered under the Companies Act , 2013 ( 18 of 2013) or a partnership firm or any other legal entity;
(3) The Traffic Manager shall be the nodal officer responsible for monitoring of tariff and responsible for handling all complaints on violation .
(b) the applicant shall deposit interest free refundable security amount of rupees five lakhs to meet any contingency, which shall be refunded after adjusting the claims , ifany, when the licensee ceases to operate ;
(4) The Port shall charge a royalty for the stevedoring and shore handling and fix per metric ton rate and no discrimination will be made on the royalty licence fee .
(c) the applicant possesses equipments required for stevedoring and shore handling activities as specified by the Board;
(d) the applicant shall submit an undertaking to employ atleast six supervisory personnel with minimum two
8. Payment of Royalty. ( 1 ) The Board shall , in respect of the licence , charge a royalty as the licence fee on per metric ton basis and no discrimination shall be made in charging for the same type and quantity of cargo handled by the agents .

10. Validity/Renewal of Licence . ( 1 ) The licence will be valid for a period of three financial years from the date of issuance of the licence .
( 2) An eligible person shall be issued stevedoring licence , shore handling licence or both , and exception , if any, shall be with the approval of the Board .
( 2) Every agent shall be liable to pay royalty in advance , prior to calling of vessel , on the basis of import general manifest quantity, in case of import and on the basis of the quantity declared by the vessel's agent or exporter or export general manifest , in case of export and the actual royalty payable shall be calculated after completion of the vessel's operation based on the total quantum of cargo handled by the agent .
(3) The daily performance report capturing productivity achieved by the agent in the prescribed format shall be submitted to the traffic department online . The officer delegated by the Chairperson will review the performance of agent every month .
( 3 ) The difference in amount of royalty, if any, shall be payable within ten days from the date of raising of the bill and in case of delay in payment of royalty, interest shall be payable as specified in the scale of rates of the port .
(4) The Board may consider the waiver of royalty in following circumstances , namely: -
( 4) Compliance of terms and conditions of the licence issued to the agents will be monitored by Traffic Manager and a report shall be submitted to the Chairperson every month .
(a) cargo handled by the agents during the period of strike called by the registered cargo handling workers of the port;
(b) relief cargo handled during the natural calamities ;
(5) If the Traffic Manager finds any default on the part of agent , he shall cause to issue warning in the event of first default and in the event of second default , the licence of the agent shall be liable to be cancelled .
(c ) defence cargo handled during the emergencies ; and
(6) At the end of three years , the licence shall be renewed on the basis of performance reports .
(d) if such direction is issued by the Government .
( 7) An application for renewal of licence shall be submitted in Form -A , at least three months prior to expiry of licence alongwith the requisite fee . Before renewal of the licence , a report shall be obtained from the Inspector appointed under the Dock Workers or Safety Health and Welfare Act , 1986 ( 54 of 1986 ) in respect of compliance with the safety norms as per the statute and the same shall be taken into consideration for granting renewal .
( 8) If the application for renewal is not received within the stipulated period , such applications may be accepted upon payment of late fees of rupees five thousand excluding taxes.
9. Change in name , Constitution , etc. to be communicated .- The Licensee shall immediately communicate to the Chairperson about any change of the name , title or constitution , director , managing director or partner as the case may be , with a copy of the document in support of such change . Any change in the name , title or constitution of a firm or company holding a stevedoring licence , shall be communicated to the Chairperson forthwith and the firm or company undergoing such a change shall submit a fresh application for the grant of a licence , provided that the Chairperson may at his discretion allow such a firm or company to carry on business till such time a decision is taken on such fresh application and the fresh licence required to be issued in such cases shall however attract the same charges as are payable for the issue of a new licence .
(9) If the agent fulfils the required conditions and found eligible for renewal but awaiting safety clearance before expiry of the licence period , the Port will permit the operation by executing an indemnity bond in

Form- C and retention of the security deposit during such period when the renewal application is under process .
course of operation to the extent of which shall be decided by the Chairperson after carrying out proper enquiry ;
(xi) ensure compliance with the terms and conditions of licence;
( 10) Every licence granted or renewed shall be in Form " B " in electronic format .
(xii) achieve the performance norms fixed by the Port;
of 11. Duties and responsibilities stevedores.- Stevedores or shore handling agent , as the case may be , shall perform the following duties , namely : -
(xiii) get the tariff along with break up approved by the Port and upload on its website.
(xiv) submit promptly any information sought for by the Port.
(i) comply with applicable safety norms and labour laws specified under laws for the time being in force in relation to his activity;
( ii) indemnify the Board against all third party claims arising out of such operations .
(xv) shall take effective steps to improve the performance and submit the daily performance report to the traffic department;
(iii) be solely responsible for any accident or damage resulting either out of negligence , from the use of defective equipment or for other actions ;
(xvi ) shall provide the workers necessary protective safety appliances appropriate for the type of cargo .
12. Cancellation or suspension of licence.- ( iv) ensure that the casual workers deployed by him are covered by the insurance policy and such other benefits under applicable law;
( 1 ) The Chairperson may at any time suspend or cancel the licence issued to an agent for violation of any of the following grounds , namely: -
( v) liable to settle claims as per the Employees ' Compensation Act , 1923 ( 8 of 1923) in case of any accident ;
( i) the performance norms specified by the Port has not been achieved for an average over a period of three months ;
(vi) liable to pay scheduled charges , as per the Scale of Rates in force , to the port in advance;
( ii) charges higher tariff than the tariff approved by the Port;
(iii) has been convicted by the Court of any offence involving moral turpitude;
(vii) employ duly tested adequate equipment or gear, either owned or hired , and deploy trained supervisory personnel for each vessel ;
(iv) contravened safety regulations and failure comply with mandatory dock safety measures ;
(viii) ensure that all the amounts due to the Board are paid on the appointed dates ;
( v) failed to adopt proper and safe handling methods ;
( vi) misrepresentation or misstatement of material facts ;
(ix) comply with such instructions as may be issued from time to time by the Chairperson or any officer acting on his behalf, in the interest of safety, operational requirement , improved productivity, labour discipline or such related matters ;
(vii ) has been adjudged insolvent or under liquidations ;
(x) shall compensate the Board for any loss or damage caused to any gear, plant or other property of the Board during the
(viii) transfer or sub - contracting of the stevedoring operations or activities to any other individual or parties ;

the agent , after making adjustments of the claims of the Board , if any, in the following circumstances , namely:-
( ix) failed to comply with security rules , instructions or International Ship and Port Facility Security code;
(a) on the expiry of the period of licence and no application has been made for renewal;
(x) guilty of misconduct which in the opinion of the Chairperson warrants cancellation or suspension of licence;
(b) on the refusal of the application for renewal of licence ;
( xi) indulged in illegal or corrupt practices;
( c) on cancellation of licence; and
(xii ) causes obstruction to any work in the Port or compromised safety of Port or any illegal or malicious acts ;
(d) if the agent desires to foreclose the licence issued to him and makes an application in writing to the Chairperson for foreclosure and refund of security deposit.
(xiii) for non - compliance of any direction issued by the Chairperson or an officer acting on his behalf;
15. Deployment of workers from Port or Dock Labour Board or licence holder or outside . ( 1 ) Agent shall deploy Port labour for carrying out his activities .
or (xiv) has failed to submit daily performance report any other information sought by the Chairperson or an officer acting on his behalf;
(xv) for contravention and/ or violation of any law for the time being in force; and
(2) In case the Port is unable to supply the requisite workers against the requisition placed by agent , the Port may allow to make their own arrangement for this purpose :
( xvi) Non payment of dues payable to the Port.
Provided that no notional booking or levying of charges should be made and agents shall not be levied any charges for labour, in case the Port does not supply the labour.
Provided that no such licence shall be cancelled or suspended as the case may be until the holder of the licence has been given a reasonable opportunity for showing cause why his licence should not be cancelled or suspended as the case may be .
16. Performance norms .- ( 1 ) The Board shall specify the performance standards to be followed by the agents for carrying out stevedoring and shore handling activities in the Port .
(2) An order of suspension or cancellation of licence shall be communicated in writing within a period of thirty days from the date of order .
(a) The Board may, for the purpose of encouraging compliance with the performance standards specified by it , fix incentives for the agents and may publish quarterly summary of performance achieved by the agents on its website .
13. Appeal . ( 1 ) Any person aggrieved by any order of cancellation or suspension or refusal to issue licence , under these regulations , may prefer an appeal in writing to the Secretary ( Shipping ) , Ministry of Ports , Shipping and Waterways , within thirty days of the communication of the order appealed against .
(2) The Secretary ( Shipping ) , Ministry of Ports , Shipping and Waterways , shall pass such order on the appeal as it deems fit after giving an opportunity to the appellant .
(b) Daily performance report in Form - D shall be submitted by the stevedoring and shore handling agent to the traffic department . Performance of the agent in terms of productivity achieved will be reviewed by the Chairperson or any other officer acting under his authority every month . The monthly performance summary capturing productivity achieved by the agents will be published on the Port website to ensure transparency to the customers .
14. Refund of security deposit .- The security deposit is liable to be refunded to

(c) In case of dry bulk cargo , the norms fixed by Port under the Berthing Policy for Dry Bulk Cargo for Major Ports , 2016 shall be the performance norms for the purpose of these regulations.
(d) In respect of other cargo , not covered under the Berthing Policy for Dry Bulk Cargo for Major Ports , 2016 , including break- bulk and container the performance norms will be those fixed by the Port .
17. Training, use of modern technology. The personnel deployed in stevedoring and shore handling activities shall be trained in modern methods of cargo handling for improving the productivity, efficiency and safety.
18. Miscellaneous . The Chairperson may issue , from time to time , such appropriate operational guidelines or instructions or such other directions as is required for the smooth implementation and execution of these regulations .
19. Interpretation . Any question arises as to the interpretation of these regulations or in respect of any matter not hereinabove or subsequently provided for, the same shall be decided by the Board .
20. Repeal and savings . The Mormugao Port Trust ( Licensing of Stevedores) Regulations , 2010 and the procedures , practices and customs corresponding to these regulations and in force immediately before the commencement of these regulations are hereby repealed:
Provided that any order made or action taken under the regulations , procedure , practices and customs so repealed shall be deemed to have been made or taken under the corresponding provisions of these regulations .

And whereas the indemnifier hereby agrees and accepts by this indemnity bond unconditionally to indemnify the Board of Mormugao Port Authority to pay without raising any objection all such claims , demands , losses or damages , costs , charges , expenses , suits or proceedings caused to or suffered by or would be caused to or suffered by the indemnified whatsoever arising directly or indirectly during the course of or anytime during the subsistence of the said licence or after the expiry of the said licence .

महापत्तन प्राधिकरण अधिनियम , 2021 (2021 का 1 ) की धारा 72 की उप- धारा (2) के खंड (च) और ( ज) के साथ पठित धारा 24 , धारा 26 की उप - धारा ( 1 ) खंड ( ज ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मुरगांव पत्तन प्राधिकरण मंडल , मुरगांव पत्तन न्यास ( स्टीविडोरिंग का लाइसेंसिंग ) विनियम , 2010 का अधिक्रमण करते हुए , कथित अधिक्रमण से पूर्व की गई अथवा करने से छूट गई कार्यवाहियों को छोडकर निम्नलिखित विनियम बनाता है , यथाः-
1. संक्षिप्त नाम और प्रारंभ-- ( i ) इन विनियमों को मुरगांव पत्तन प्राधिकरण ( स्टीविडोरिंग तथा शोर हैण्डलिंग ) विनियम, 2022 कहा जाए।
(ii ) ये विनियम सरकारी राजपत्र में उनके अंतिम प्रकाशन की तारीख से लागू होंगे।
2. परिभाषा-- ( 1 ) इन विनियमों में जब तक संदर्भ में अन्यथा अपेक्षित न हो --
(क) "अधिनियम" का अर्थ महापत्तन प्राधिकरण अधिनियम , 2021 ( 2021 का 1 ) है ।
(ख) "एजेंट" अर्थात वह व्यक्ति जिन्हें विनियम -4 के तहत स्टीविडोरिंग तथा शोर हैण्डलिंग लाइसेंस जारी किया गया है ।
(ग) "फॉर्म" का अर्थ है इन विनियमों के साथ संलग्न फॉर्म ।
(घ) "लाइसेंस" का अर्थ है विनियम -4 के तहत जारी स्टीविडोरिंग तथा शोर हैण्डलिंग लाइसेंस ।
( ड) "लाइसेंसधारी " वह व्यक्ति है जिन्हें इन नियमों के तहत स्टीविडोरिंग तथा शोर हैण्डलिंग लाइसेंस जारी किया गया है।
( च) "लाइसेंसिंग प्राधिकारी " का अर्थ है पत्तन का अध्यक्ष ।
( छ) " पत्तन" का अर्थ है मुरगांव पत्तन ।
( ज ) " रॉयल्टी" का अर्थ है मुरगांव पत्तन के मंडल द्वारा नियत राशि जो स्टीविडोरिंग अथवा शोर हैण्डलिंग सेवाओं के लिए एजेण्ट द्वारा मंडल को देय है ।
(झ ) " शोर हैण्डलिंग " में नौभार की हुक प्वाइंट से अथवा हुक प्वाइंट तक नौभार की व्यवस्था व प्रापण , वार्फ से स्टेक - यार्ड तथा वापसी क्रम में इन्टर मोडल ट्रान्सपोर्ट तथा समुद्र, रेल, जलमार्ग या मार्ग से या तक नौभार का प्रापण तथा प्रेषण, शामिल है ।
(ट) " स्टीविडोर " वह एजेण्ट है जो इन विनियमों के तहत जहाज पर नौभार के भारण , अभारण तथा स्टोवेज हेतु प्राधिकृत है।
(ठ) " स्टीविडोरिंग" में जहाज पर किसी भी प्रकार के नौभार का भारण , तथा स्टोवेज शामिल है।
(ड) "यातायात प्रबंधक" का अर्थ मुरगांव पत्तन के यातायात विभाग के प्रभारी अधिकारी से है और इसमें उनके डीप्युटिज या सहायक या उनके अधिकार में कार्य करनेवाले कोई अन्य अधिकारी शामिल है ।
(2 ) इन विनियमों में प्रयोग किए गए तथा परिभाषित नहीं किए गए किंतु अधिनियम में परिभाषित शब्द तथा अभिव्यक्तियों का वहीं अर्थ होगा जो उन्हें इस अधिनियम में दिया गया है ।
3. लागू होना: -
ये विनियम एजेंट द्वारा कार्यान्वित स्टीविडोरिंग तथा शोर हैण्डलिंग गतिविधियों के लिए लागू है किंतु ये पत्तन की स्टीविडोरिंग तथा शोर हैण्डलिंग गतिविधियों, पब्लिक प्राईवट पार्टनरशिप प्रोजेक्ट ,

बिल्ड ऑपरेट एण्ड ट्रांसफर बर्थ ऑपरेशन्स/ करार या मंडल द्वारा किए गए ऐसे अन्य करार पर लागू नहीं होते है।
4. स्टीविडोरिंग तथा शोर हैण्डलिंग एजेण्ट का लाइसेंसिंगः- ( 1 ) कोई भी पात्र व्यक्ति जो पात्रता मानदण्डों को पूरा करते है , वे लाइसेंस के लिए फॉर्म- क में अध्यक्ष को लिखित में आवेदन कर सकते है जिसके साथ निर्दिष्ट दस्तावेज और शुल्क, जो मंडल द्वारा निर्धारित किया हो, प्रस्तुत करना होगा ।
( 2 ) आवेदक को, निम्नलिखित मानदण्डों को पूरा करने के अधीन लाइसेंस जारी किया जाएगा: - (क) आवेदक , कंपनी अधिनियम, 2013 (2013 का 18 ) के तहत पंजीकृत कंपनी या पार्टनरशिप फर्म या कोई अन्य विधिक अस्तित्व है ;
(ख ) आवेदक, किसी भी आकस्मिकता को पूरा करने के लिए पांच लाख रूपए की ब्याज रहित वापसी योग्य प्रतिभूति राशि जमा करेगा जिसे दावा , यदि कोई हो , को समायोजित करने के पश्चात तब वापस किया जाएगा जब लाइसेंसधारी प्रचालन बंद करता है ;
( ग ) आवेदक के पास मंडल द्वारा निर्दिष्ट किए अनुसार स्टीविडोरिंग तथा शोर हैण्डलिंग गतिविधियों के लिए आवश्यक उपकरण है ;
( घ) आवेदक यह भी वचन देता है कि वह कम से कम छह पर्यवेक्षकीय कार्मिकों को नियोजित करेगा जिन्हें नौभार संभलाई अथवा स्टोवेज में न्यूनतम दो वर्षों का अनुभव हो और आवेदन के साथ उन्हें अपना विवरण संलग्न करना होगा;
3) जब तक किसी व्यक्ति को इन विनियमों के तहत लाइसेंस जारी नहीं किया जाता है तब तक वह पत्तन में कोई भी स्टीविडोरिंग तथा शोर हैण्डलिंग गतिविधियां शुरु नहीं करेगा ।
बशर्ते कि वह व्यक्ति जिन्हें यह विनियम लागू होने से पूर्व लाइसेंस जारी किया गया है , वह मौजूदा लाइसेंस के अधीन साठ ( 60 ) दिनों की अवधि के लिए अथवा इन नियमों के तहत लाइसेंस प्राप्त करने तक, जो भी पहले हो, शर्तों की पूर्ति करने पर प्रचालन जारी रख सकता है ।
5. लाइसेसिंग प्रधिकारी इन विनियमों के तहत अध्यक्ष , लाइसेंसिंग प्रधिकारी होंगे ।
6. लाइसेंस शुल्क: - तीन वर्षों की अवधि के लिए लाइसेंस जारी करने हेतु शुल्क कर रहित रूपए पचास हजार है , जो मंडल द्वारा संशोधित किया जाएगा ।
7. स्टीविडोरिंग तथा शोर हैण्डलिंग प्रभार ( 1 ) न्यायनिर्णायक मंडल स्टीविडोरिंग तथा शोर हैण्डलिंग क्रियाकलापों हेतु मैकनाइज्ड तथा मैन्युअल प्रचालनों के लिए अलग से सामान्य प्रशुल्क अधिसूचित करेगा ।
(2 ) पत्तन स्टीविडोरिंग तथा शोर हैण्डलिंग क्रियाकलापों के लिए सीलिंग प्रशुल्क सेट अधिसूचित करेगा तथा प्रशुल्क को पत्तन की वेबसाइट पर अधिदेशात्मक रूप से प्रदर्शित किया जाएगा । कोई भी एजेण्ट अधिसूचित अधिकतम प्रशुल्क से अत्याधिक प्रशुल्क प्रभारित नहीं करेगा।
(3) प्रशुल्क के मानिटरिंग तथा उल्लंघन संबंधी सभी शिकायतों पर विचार करने के लिए यातायात प्रबंधक जिम्मेदार नोडल अधिकारी होंगे ।
( 4 ) स्टीविडोरिंग तथा शोर हैण्डलिंग हेतु पत्तन रायल्टी प्रभारित करेगा और प्रति मैट्रीक टन नियत करेगा और रॉयल्टी लाइसेंस शुल्क के संबंध में कोई पक्षपात नहीं किया जाएगा ।

8. रॉयल्टी का भुगतानः- ( 1 ) मंडल , लाइसेंस के संबंध में , प्रति मैट्रीक टन के आधार पर लाइसेंस शुल्क के रूप में रॉयल्टी वसूल करेगा और एजेंटों द्वारा संभलाए गए एक ही प्रकार के नौभार व मात्रा के लिए शुल्क प्रभारित करने में कोई पक्षपात नहीं किया जाएगा ।
(2) प्रत्येक एजेंट जहाज के कॉल से पहले आयात के मामले में इंपोर्ट जनरल मेनिफेस्ट क्वांटिटी आधार पर और निर्यात के मामले में जहाज के एजेंट या निर्यातक द्वारा घोषित मात्रा अथवा एक्सपोर्ट जनरल मेनिफेस्ट के आधार पर अग्रिम में रॉयल्टी का भुगतान करने के लिए उत्तरदायी होगा और देय वास्तविक रॉयल्टी की गणना एजेंट द्वारा संभलाए गए नौभार की कुल मात्रा के आधार पर जहाज प्रचालन पूरा होने के बाद की जाएगी ।
(3) रॉयल्टी की राशि में अंतर, यदि कोई हो, बिल की तारीख से दस दिनों के भीतर देय होगा और रॉयल्टी के भुगतान में देरी के मामले में ब्याज पत्तन के दरमानों में निर्दिष्ट किए अनुसार देय होगा ।
(4 ) मंडल निम्नलिखित परिस्थितियों में रॉयल्टी में छूट देने पर विचार कर सकता है , अर्थात; ---
(क) पत्तन के पंजीकृत नौभार संभलाई श्रमिकों द्वारा की गई हड़ताल की अवधि के दौरान एजेंटों द्वारा संभलाया गया नौभार;
(ख) प्राकृतिक आपदाओं के दौरान संभलाया गया राहत नौभार ;
(ग) आपात स्थितियों के दौरान संभलाया गया रक्षा नौभार ; तथा
(घ) यदि सरकार द्वारा ऐसा कोई निर्देश जारी किया गया है ।
9. नाम गठन आदि में परिवर्तन को सूचित किया जानाः-
लाइसेंसधारी नाम , शीर्षक या गठन , निदेशक , प्रबंध निदेशक या पार्टनर , जैसी भी स्थिति हो , में किसी भी परिवर्तन के बारे तुरंत अध्यक्ष को सूचित करेंगे और साथ ही ऐसे परिवर्तन के समर्थन में दस्तावेज की प्रतिलिपि भी प्रस्तुत करेंगे । स्टीविडोरिंग लाइसेंसधारक फर्म या कंपनी के नाम , शीर्षक या गठन में किसी भी प्रकार का परिवर्तन किए जाने पर तुरंत अध्यक्ष को सूचित करेंगे और ऐसे परिवर्तन करनेवाली फर्म या कंपनी लाइसेंस जारी करने के लिए पुनः आवेदन प्रस्तुत करेगी , बशर्ते कि अध्यक्ष अपने निर्णय पर उस फर्म या कंपनी को तब तक व्यवसाय जारी रखने की अनुमति दे सकते हैं जब तक पुनः प्रस्तुत आवेदन पर विचार नहीं किया जाता है और ऐसे मामले में जारी किए जानेवाले नए लाइसेंस के प्रभार भी वही होंगे जैसे नए लाइसेंस के लिए भुगतान किए जाते हैं ।
10. लाइसेंस की वैधता/नवीनीकरण लिए वैध होगा । ( 1 ) यह लाइसेंस , जारी होने की तारीख से तीन वित्तीय वर्षों के
(2) पात्र व्यक्ति को स्टीविडोरिंग लाइसेंस , शोर हैण्डलिंग लाइसेंस , या दोनों जारी किया जाएगा और अपवाद, यदि कोई हो, तो मंडल के अनुमोदन से जारी किया जाएगा ।
(3 ) एजेंट द्वारा प्राप्त उत्पादकता दर्शानेवाला दैनिक निष्पादन रिपोर्ट निर्धारित प्रपत्र में यातायात विभाग को ऑनलाइन प्रस्तुत किया जाएगा । अध्यक्ष द्वारा प्रत्यायोजित अधिकारी एजेंट निष्पादन का प्रति माह पुनरीक्षण करेंगे ।
(4 ) एजेंटों को जारी लाइसेंस की शर्तों का अनुपालन यातायात प्रबंधक द्वारा मानिटर किया जाएगा जिसकी रिपोर्ट प्रति माह अध्यक्ष को प्रस्तुत की जाएगी ।
(5) एजेंट की ओर से यातायात प्रबंधक द्वारा , यदि कोई चूक पायी जाती है तो वे पहली चूक पर चेतावनी जारी करेंगे और दूसरी चूक पर उनका लाइसेंस रद्द किया जाएगा ।

( 6 ) तीन वर्षों की समाप्ति पर लाइसेंस को निष्पादन रिपोर्टों के आधार पर नवीनीकृत किया जाएगा।
( 7 ) लाइसेंस के नवीनीकरण हेतु आवेदन , लाइसेंस समाप्ति से कम से कम तीन माह पहले अपेक्षित शुल्क सहित फार्म ' क' में प्रस्तुत किया जाएगा । लाइसेंस नवीनीकरण से पहले नियमों के अनुसार सुरक्षा मानकों के अनुपालन के संबंध में गोदी कामगार अथवा सुरक्षा स्वास्थ्य तथा कल्याण अधिनियम , 1986 ( 1986 का 54 ) के तहत नियुक्त निरीक्षक से रिपोर्ट प्राप्त की जाएगी जिसपर लाइसेंस का नवीनीकरण करते समय विचार किया जाएगा ।
( 8 ) यदि नवीनीकरण हेतु आवेदन, निर्धारित अवधि के भीतर प्राप्त नहीं होता है तो ऐसे आवेदन कर रहित पांच हजार के विलंब शुल्क का भुगतान कर , स्वीकार किए जा सकते हैं
(9) यदि एजेंट आवश्यक शर्तों को पूरा करते हैं और नवीनीकरण के लिए पात्र है किंतु लाइसेंस अवधि की समाप्ति पूर्व सुरक्षा निर्बाधता की प्रत्याशा में है, तो पत्तन फॉर्म ' ग' में क्षतिपूर्ति बंधपत्र निष्पादित करते हुए तथा नवीनीकरण आवेदन प्रक्रियाधीन रहने के दौरान जमानती जमा का प्रतिधारण करते हुए प्रचालन की अनुमति देगा ।
( 10 ) मंजूर या नवीनीकृत प्रत्येक लाइसेंस इलेक्ट्रॉनिक फोरमेट में फॉर्म " ख " में होगा ।
11. स्टीविडोर्स के कर्तव्य तथा उत्तरदायित्वः स्टीविडोरिंग तथा शोर हैण्डलिंग एजेंट , जो भी मामला हो , निम्नलिखित का अनुपालन करेगा , यथाः-
( i ) उनकी गतिविधि के संबंध में उस समय के लिए प्रभावी किसी भी नियम के तहत निर्दिष्ट लागू सुरक्षा मानकों और श्रम नियमों का अनुपालन करेंगे ;
( ii ) ऐसे प्रचालनों से उत्पन्न तीसरे पक्ष के सभी दावों के लिए मंडल को क्षतिपूरित करेंगे ;
(iii ) लापरवाही , खराब उपकरण के इस्तेमाल अथवा किसी अन्य कार्रवाई के कारण किसी दुर्घटना या क्षति के लिए उत्तरदायी होंगे;
( iv ) सुनिश्चित करेंगे कि उनके द्वारा नियोजित कामगारों को बीमा पॉलिसी तथा नियमों के तहत यथा लागू ऐसे अन्य सुविधाओं के तहत शामिल किया गया है;
(v ) किसी भी दुर्घटना के मामले में कर्मचारी , क्षतिपूर्ति अधिनियम, 1923 ( 1923 का 8 ) के अनुसार दावे का निपटान करने के लिए जिम्मेदार होंगे ;
( vi ) लागू दरमानों के अनुसार पत्तन को निर्धारित प्रभारों का अग्रिम भुगतान करेंगे;
(vii ) प्रत्येक जहाज के लिए पर्याप्त उपकरण या गियर , चाहे अपनी मालकियत का हो या किराए पर लिया गया हो , का विधिवत परीक्षण करेंगे और प्रशिक्षित पर्यवेक्षकीय कर्मियों को तैनात करेंगे ;
( viii ) सुनिश्चित करेंगे कि मंडल को देय पूरी राशि नियत तारीख को अदा की जाती है ;
(ix ) सुरक्षा प्रचालन आवश्यकता, उन्नत उत्पादकता , श्रम अनुशासन की दृष्टि से या ऐसे संबंधित मामलों में अध्यक्ष अथवा उनकी ओर से कोई भी कार्यकारी अधिकारी द्वारा समय - समय पर जारी ऐसे अनुदेशों का अनुपालन करेंगे;

(x) प्रचालन के दौरान यदि मंडल के किसी भी गियर, संयंत्र या किसी अन्य संपत्ति को हानि या क्षति पहुंचती है तो इसकी अच्छी जांच पड़ताल करने उपरांत अध्यक्ष के निर्णय पर , मंडल को क्षतिपूरित करेंगे;
(xi ) लाइसेंस के नियम और शर्तों का अनुपालन सुनिश्चित करेंगे;
(xii ) पत्तन द्वारा नियत कार्यनिष्पादन मानकों को हासिल करेंगे;
(xiii ) ब्रेक- अप सहित प्रशुल्क को पत्तन द्वारा अनुमोदित करवाकर अपनी वेबसाइट पर अपलोड करेंगे;
( xiv ) पत्तन द्वारा मांगी गई कोई भी जानकारी तुरंत प्रस्तुत करेंगे ;
(xv ) निष्पादन में सुधार करने हेतु प्रभावी क़दम उठाएंगे और प्रतिदिन निष्पादन रिपोर्ट यातायात विभाग को प्रस्तुत करेंगे;
( xvi ) नौभार के प्रकार के अनुसार कामगारों को आवश्यक सुरक्षा उपकरण प्रदान करेंगे ।
12. लाइसेंस को रद्द या स्थगित करना ( 1 ) अध्यक्ष , नीचे उल्लिखित किसी का उल्लंघन करने पर एजेंट को जारी लाइसेंस किसी भी समय स्थगित या रद्द कर सकता है , यथाः-
(i ) पत्तन द्वारा निर्दिष्ट निष्पादन मानकों को औसतन तीन महिनों से अधिक अवधि के लिए प्राप्त नहीं किया गया हैं;
( ii ) पत्तन द्वारा अनुमोदित प्रशुल्क से अधिक प्रशुल्क प्रभारित किया जाता हैं;
(iii ) नैतिक अधमतावाला कोई भी अपराध न्यायालय द्वारा सिद्ध हुआ है ;
( iv ) सुरक्षा विनियमों का उल्लंघन तथा अधिदेशात्मक गोदी सुरक्षा उपायों का गैर- अनुपालन किया है ;
(v) उचित तथा सुरक्षित संभलाई पद्धतियों को नहीं अपनाता है;
(vi ) वास्तविक तथ्यों को अयथार्थ रूप से प्रस्तुत करना या अनुचित रूप से बताना;
(vii ) दिवालिया सिद्ध हुआ है अथवा परिसमापन अधीन है;
viii ) स्टीवीडोरिंग प्रचालन या गतिविधियां किसी अन्य व्यक्ति या पार्टियों को हस्तांतरित करना या उप- ठेके पर देना;
( ( ix ) सुरक्षा नियम , अनुदेश या अंतर्राष्ट्रीय जहाज तथा पत्तन सुविधा सुरक्षा संहिता का अनुपालन न करना;
(x) ऐसे किसी भी कदाचार का दोषी है, जिसके लिए अध्यक्ष के विचार से लाइसेंस रद्द या स्थगित किया जा सकता है;
(xi ) अवैध या भ्रष्ट व्यवहार करता हो;
( xii ) पत्तन के किसी भी कार्य में रुकावट पैदा करता है या पतन की सुरक्षा या किसी अवैध या विद्वेष्पूर्ण व्यवहार के साथ समझौता किया है ;
(xiii ) अध्यक्ष या उनकी ओर से कार्यकारी अधिकारी द्वारा दिए किसी भी निदेशों का अनुपालन न करना;
(xiv ) प्रतिदिन निष्पादन रिपोर्ट अथवा अध्यक्ष या उनकी ओर से कार्यकारी अधिकारी द्वारा मांगी गई कोई भी जानकारी प्रस्तुत नहीं की गई है ;
(xv ) उस समय के लिए लागू किसी भी कानून की अवहेलना तथा/ या उल्लंघन किए जाने पर;
(xvi ) पत्तन को देय राशि का भुगतान न करने पर;

उपबंधित है कि ऐसा कोई भी लाइसेंस तब तक रद्द या स्थगित नहीं किया जाएगा जब तक कि लाइसेंसधारी को यह कारण बताने का पर्याप्त अवसर नहीं दिया जाता है कि उनका लाइसेंस रद्द या स्थगित , जैसी भी स्थिति हो , क्यों नहीं किया जाए ।
(2) लाइसेंस के स्थगन/निरसन का आदेश , आदेश की तारीख से तीस दिनों की अवधि के भीतर , लिखित में सूचित किया जाएगा ।
13. अपीलः- ( 1 ) इन विनियमों के तहत , लाइसेंस को रद्द अथवा स्थगित अथवा जारी करने से इनकार करने के किसी आदेश से, यदि कोई व्यक्ति ग्रसित होता है तो उस आदेश, जिसके विरुद्ध अपील की जा रही है , की सूचना से तीस दिनों के भीतर सचिव ( पोत परिवहन ) , पत्तन , पोत परिवहन और जलमार्ग मंत्रालय को लिखित में अपील कर सकता है ।
(2) सचिव ( पोत परिवहन ) , पत्तन , पोत परिवहन और जलमार्ग मंत्रालय , अपीलकर्ता को अवसर देने उपरांत अपील पर यथोचित आदेश दे सकता है ।
14. जमानती जमा की वापसीः- जमानती जमा को , मंडल के दावे , यदि कोई हो , के समायोजन के बाद , एजेंट को निम्न परिस्थितियों में वापस करनी होगी , अर्थातः-
(क) लाइसेंस की अवधि समाप्त होने पर और नवीकरण के लिए कोई आवेदन नहीं किया गया है;
(ख) लाइसेंस के नवीनीकरण के लिए आवेदन करने से इंकार करने पर;
(ग ) लाइसेंस रद्द करने पर; तथा
( घ) यदि एजेंट उसे जारी किए गए लाइसेंस को समाप्त करना चाहता है तथा इसे समाप्त करने और जमानती जमा वापस करने हेतु अध्यक्ष को लिखित में आवेदन करता है ।
15. पतन अथवा गोदी श्रम मंडल अथवा लाइसेंसधारी या बाहर से कामगारों की तैनातीः- ( 1 ) एजेंट अपने कार्यकलापों के लिए पत्तन श्रमिकों को तैनात करेंगे ।
( 2 ) यदि पत्तन एजेंटों की आवश्यकतानुसार कामगारों की आपूर्ति नहीं कर सकता है तो पत्तन , इस प्रयोजन के लिए अपनी व्यवस्था स्वयं करने की अनुमति दे सकता है ।
बशर्ते कि कोई नोशनल बुकिंग अथवा प्रभार उगाही नहीं होगी और यदि पत्तन श्रमिकों की आपूर्ति नहीं करता है तो श्रमिकों के लिए एजेंटों से कोई प्रभार नहीं लिए जाएंगे ।
16. निष्पादन मानकः- ( 1 ) पत्तन में स्टीविडोरिंग तथा शोर हैण्डलिंग कार्यकलाप निष्पादित करने के लिए मंडल एजेंटों द्वारा अपनाए जानेवाले निष्पादन मानकों को निर्धारित करेंगे ।
(क) मंडल , उनके द्वारा निर्धारित निष्पादन मानकों के अनुपालन को बढ़ावा देने के लिए एजेंटों के लिए प्रोत्साहन नियत कर सकते हैं और एजेंटों द्वारा प्राप्त निष्पादन का तिमाही सारांश अपनी वेबसाइट पर अपलोड कर सकते हैं ।
(ख) दैनिक निष्पादन रिपोर्ट फॉर्म घ में स्टीविडोरिंग और शोर हैंडलिंग एजेंट द्वारा यातायात विभाग को प्रस्तुत की जाएगी । प्राप्त उत्पादन के अनुसरण में एजेंट के निष्पादन का पुनरीक्षण प्रति माह अध्यक्ष अथवा उनके प्राधिकार के तहत कार्यरत किसी अन्य अधिकारी द्वारा किया जाएगा। एजेंटों द्वारा प्राप्त उत्पादकता दर्शानेवाला मासिक निष्पादन विवरण पत्तन की वेबसाइट पर दिया जाएगा ताकि उपभोक्ताओं के लिए पारदर्शिता सुनिश्चित की जा सके ।

( ग ) शुष्क बल्क नौभार के मामले में शुष्क बल्क नौभार हेतु महापत्तन, 2016 की बर्थिंग नीति के अंतर्गत पत्तन द्वारा नियत मानक इन विनियमों के प्रयोजनार्थ निष्पादन मानक होंगें ।
(घ) अन्य नौभार के मामले में जो ब्रेक बल्क सहित शुष्क बल्क नौभार हेतु महापत्तन , 2016 की बर्थिंग नीति के अंतर्गत शामिल नहीं है , निष्पादन मानक वह होंगे जो पत्तन द्वारा नियत किए गए हो ।
17. प्रशिक्षण, आधुनिक प्रौद्योगिक का इस्तेमालः- स्टीविडोरिंग तथा शोर हैण्डलिंग कार्यकलापों के लिए तैनात कार्मिकों को उत्पादकता, कार्यक्षमता तथा सुरक्षा को सुधारने की दृष्टि से नौभार संभलाई की आधुनिक पद्धतियों में प्रशिक्षित किया जाएगा ।
18. विविधः- अध्यक्ष , समय - समय पर ऐसे उचित प्रचालन दिशानिर्देश या अनुदेश या ऐसे अन्य निदेश जारी कर सकता है जो इन विनियमों के सुचारु कार्यान्वयन तथा निष्पादन के लिए आवश्यक है ।
19. निर्वचनः- इन विनियमों के निर्वचन के संबंध में या किसी भी मामले में जो यहां ऊपर उल्लिखित न हो या बाद में उपबंधित किया हो , के बारे में कोई प्रश्न उठता है तो उस पर मंडल द्वारा निर्णय लिया जाएगा ।
20. निरसन और व्यावृत्तिः मुरगांव पत्तन न्यास ( स्टीवीडोर्स की लाइसेंसिंग ) विनियम, 2010 तथा इन विनियमों के समरूप तथा इन विनियमों के लागू होने से तत्काल पहले प्रवृत्त प्रक्रियाओं , पद्धतियों तथा रितियों का एतद्वारा निरसन किया जाता है ।
यह भी उपबन्धित है कि इन विनियमों , प्रक्रियाओं , पद्धतियों तथा रीतियों के तहत बनाए आदेशों अथवा उस पर की गई कार्रवाई जिनका निरसन हुआ है , का तात्पर्य इन विनियमों के तत्संबंधी प्रावधानों के तहत बनाए गए या की गई माना जाए ।

क्षतिपूर्ति बंधपत्र

यह क्षतिपूर्ति बंधपत्र श्री / श्रीमती /कु जो है और कार्ड सं. निवासी है जिनकी आधार कार्ड सं. है, ने का / की पुत्र / पुत्री तथा । अथवा पैन तारीख माह, वर्ष को में क्षतिपूर्ति बंधपत्र निष्पादित किया है ।
अथवा
हम , (संस्था का नाम) में जिनकी सीआईएन संख्या तथा पैन सं . है और जिनका वर्ष, पंजीकृत कार्यालय में है और जो श्री / श्रीमती ( अधिकारी / प्रतिनिधि का नाम) , आयु (संस्था का नाम) (पदनाम) है ( जिसे इसमें आगे " क्षतिपूर्तिकर्ता " कहा गया है और इसके अंतर्गत उसके । उनके कानूनी वारिस , उत्तराधिकारी ( कार्यालय में ) तथा समनुदेशिती शामिल है ) मुरगांव पत्तन प्राधिकरण मंडल जिनका कार्यालय तीसरा तल , मुरगांव पत्तन प्राधिकरण , एओ बिल्डिंग , हैड्लैण्ड सडा गोवा , 403804 में है , ( जिसे इसमें आगे " क्षतिपूर्तिधारी " कहा गया है और इसके अंतर्गत कार्यालय में उसके उत्तराधिकारी तथा समनुदेशिती शामिल है ) एक पक्ष है ।
जबकि क्षतिपूर्तिकर्ता ने मुरगांव पत्तन प्राधिकरण (स्टीविडोरिंग तथा शोर हैण्डलिंग) विनियम , 2022 के विनियम 10 ( 7) के तहत स्टीविडोरिंग तथा शोर हैण्डलिंग लाइसेंस की मंजूरी / नवीनीकरण के लिए यातायात प्रबंधक / मुरगांव पत्तन प्राधिकरण को आवेदन किया है और इन विनियमों के अधीन क्षतिपूर्तिकर्ता को कथित विनियमों में निर्धारित बाध्यताओं को कानूनी रूप से पूरा करना है और इसका उल्लंघन या गैर - कार्य निष्पादन या गलत कार्य - निष्पादन या गैर - कानूनी कार्य निष्पादन करने पर ऐसी सभी मांग , नुकसान , अति लागत, प्रभार, व्यय , मुकदमा या कार्यवाही जो जहाज पत्तन की सीमाओं के भीतर होने के दौरान या अन्यथा क्षतिपूर्तिधारी को प्रत्यक्ष या अप्रत्यक्ष रूप से उत्पन्न किसी भी स्थिति या संभाव्य घटना में होती है, जहां तीसरी पार्टी के दावे या लाइसेंसिंग अवधि के दौरान हुई ऐसी कोई हानि के कारण क्षतिपूर्तिकर्ता को वित्तीय रूप से या अन्यथा क्षति पहुंचती है , क्षतिपूरित करेगा ।
और जबकि क्षतिपूर्तिकर्ता इस क्षतिपूर्ति बंधपत्र द्वारा बिना कोई शर्त एतदद्वारा यह सहमति देता तथा स्वीकार करता है कि ऐसे सभी दावे , मांग , हानि या क्षति, लागत , प्रभार, व्यय , मुकदमा या कार्यवाही जो कि कथित लाइसेंस रहने के दौरान या कथित लाइसेंस की समाप्ति के पश्चात या किसी भी समय प्रत्यक्ष या अप्रत्यक्ष रूप से क्षतिपूर्ति हुई या होती है तो मुरगांव पत्तन प्राधिकरण मंडल को, बिना कोई आपत्ति उठाए क्षतिपूरित करेगा ।

और क्षतिपूर्तिकर्ता , क्षतिपूर्तिधारी को एतदद्वारा सहमति देता है कि यह क्षतिपूर्ति बंधपत्र बिना शर्त होगा और तब तक वैध और अपरिवर्तनीय रहेगा जब तक क्षतिपूर्तिकर्ता का लाइसेंस प्रभावी है, जिसमें वह अवधि भी शामिल है जिस दौरान लाईसेंस नवीनीकृत करने हेतु आवेदन पर प्रक्रिया चालू रहती है और जब तक भुगतान और किसी भी दावे का निपटान मुरगांव पत्तन प्राधिकरण मंडल के पक्ष में नहीं होता है ।
इसके साक्ष्यस्वरूप " क्षतिपूर्तिकर्ता " ने उपर उल्लिखित तारीख तथा वर्ष में साक्षियों की उपस्थिति में इसपर अपने-अपने हस्ताक्षर कर दिए है ।
