(क) ''अिधिनयम'' से ताSपय+ रांश(cid:15)य मामीण रोजगार गारंट(cid:15) अिधिनयम 2005 है। (ख) '' िनिध '' से (cid:18)बहार रा0य मामीण रोजगार गारंट(cid:15) िनिध अिभूेत है।
(ग) ''रा0 मा0 रो0 गा0 ःक5म'' से रांश(cid:15)य मामीण रोजगार गारंट(cid:15) ःक5म, (cid:18)बहार अिभूेत है।
(घ) ''मु(cid:8)य काय+पालक पदािधकार(cid:15), रा0 मा0 रो0 गा0 ःक5म, (cid:18)बहार'' से ताSपय+ (cid:18)बहार सरकार (cid:26)ारा िनF(cid:26)+ंट पदािधकार(cid:15) हW जो रा0य ःतर(cid:15)य काय+बम समPवयक होग;।2 (cid:18)बहार गजट, (असाधारण)] 4 माच+ 2009 3333.... (i) रा0य सरकार इस अिधिनयम के तहत (cid:18)बहार रा0य मामीण रोजगार गारंट(cid:15) िनिधःथा(cid:18)पत करेगी।
(ii) इस िनिध म; िनEनांFकत Yप से ूाLत धनरािश जमा क5 जा सके गी:-
(क) रांश(cid:15)य मामीण रोजगार गारंट(cid:15) ःक5म, (cid:18)बहार के काया+Pयवन हेतु भारत सरकार से ूाप ्त धन रािश एवं के Pि(cid:15)य अनुदान।
(ख) रांश(cid:15)य मामीण रोजगार गारंट(cid:15) ःक5म (cid:18)बहार के िनिमB (cid:18)बहार सरकार (cid:26)ारा ूदB अंशदान (आनुपाितक रा0य अंशदान)। इस रािश को आवँयकतानुसार इस िनिध म; जमा नह(cid:15)ं कर सीधे JजलD को भी आवंFटत Fकया जा सकता है।
(ग) सां(cid:18)विधक िनकाय से ूाLत अंशदान, यFद कोई हो।
(घ) (cid:18)व(cid:18)वध Yप से ूाि] यथा ^याज आFद।
(iii) ''मु(cid:8)य काय+पालक पदािधकार(cid:15), रा0 मा0 रो0 गा0 ःक5म, (cid:18)बहार'' के पदनाम से रा0य ःतर(cid:15)य Fकसी भी रांश(cid:15)यकृ त बWक म; बचत खाता खोला जाएगा। इस खाते का संचालन संयु?त हःताKर (cid:26)ारा Fकया जाएगा।

(क) (cid:18)बहार रा0य रोजगार गारंट(cid:15) ःक5म िनिध के संधारण हेतु रा0य ःतर पर लेखा(िनयम) का पालन Fकया जाएगा एवं लेखा बह(cid:15), आFद म; आवँयक ू(cid:18)व(cid:18)pयां क5 जाएगी।
(ख) (cid:18)वFहB ूपऽD म; वा(cid:18)ष+क लेखा तैयार Fकया जाएगा और चाट+ड+ एकाउPटेPट (cid:26)ारा अंके Kण Fकया जाएगा। महालेखाकार एवं (cid:18)वB (cid:18)वभाग को भी समय-समय पर अंके Kण करने का अिधकार होगा।
(ग) इन लेखो का अंके Kण महालेखाकार के ःतर से भी Fकया जा सके गा।

No.R.D.8 (Th)-32/2008-1516—In view of the need for the Bihar State Employment Guarantee Fund Rules 2008, the following rules are notified in exercise of the powers conferred by subsection (1) of section 21 of the N.R.E.G. Act-2005:-
RULES
1. Short Title & Commencement.—These rules may be called ''Bihar State Employment Guarantee Fund (BSE GF) Rules'' 2008.
2. Definitions.—In these rules, unless the context otherwise requires:-
(a) ''Act'' means the National Rural Employment Guarantee Act 2005.
(b) ''Fund'' means the Bihar State Employment Guarantee Fund.
(c) ''NREGS'' means National Rural Employment Guarantee Scheme Bihar.
(d) ''Chief Executive Officer NREGS, Bihar'' means the officer notified as the state level programme coordinator by the Govt of Bihar.
3. Establishment of Bihar State Employment Guarantee Fund.
(i) The Govt of Bihar shall establish the Bihar State Rural Employment Guarantee fund under this Act.
(ii) The fund shall be credited with the following money receipts:-
(a) Grant/Central share of fund received from the Government of India for implementation of NREGS Bihar,
(b) Share (Proportional State Share) released by Bihar Government for NREGS Bihar. If required, this fund may not be deposited in this fund and may directly be allocated to the Districts,
(c) Contribution, if any, from statutory bodies,
(d) Miscellaneous receipt e.g interest etc, accrued.
(iii) Savings Bank account shall be opened in any Nationalized Bank at the State Level in the name of ''Chief Executive Officer NREGS Bihar''. The account shall be operated with joint signatures.
4. Constitution of Managing Committee.— A Managing Committee consisting of the following officials shall be constituted for the management and administration of the fund and to streamline the fund system:-

Rural Development Department, Bihar Chairman.
(ii) Chief Executive Officer
Cum Special/Additional/Joint Secretary,
Rural Development Department Bihar--- Member Secretary.
(iii) Internal Financial Adviser--- Member
(iv) Deputy Secretary/Under Secretary--- Member
5. Duties & Responsibilities of the Managing Committee.—The Managing Committee shall observe and discharge the following acts and duties:-
a. Manage fund flow in such a way so that District Programme Co-ordinators shall be able to meet the labour demand and wage payment properly as per the NREG Act- 2005
b. Review the performance of work and utilization certificates received from the District Programme Co-ordinators in the light of funds released previously.
c. Review the funds flow and deployment of surplus funds of the Bihar State Employment Guarantee Scheme Fund.
d. Appoint Chartered Accountants to audit the accounts of the Bihar State Employment Guarantee Fund at state level.
e. Nominate the joint signatories for effective operation of the Bihar State Employment Guarantee Fund.
6. Duties and responsibilities of the Chief Executive Officer National Rural Employment Guarantee Scheme.—The following shall be the duties and responsibilities of the Chief Executive Officer, NREGS Bihar :-
a. Convene the meetings of the Managing Committee. b. To furnish all reports, returns and other necessary documents to it required to be furnished under the Act to the Central State Government. c. To manage and administer the funds. d. To keep account of all the financial transactions of the Bihar State Employment Guarantee Fund.
e. To prepare annual financial accounts of the Fund and get it audited by a Chartered Accountant.
f. To establish contacts with government and other Departments to achieve the objective of the Fund.
g. To ensure monthly reconciliation of the account of the Bihar State Employment Guarantee Fund.
7. Maintenance and operation of Bank Account:-
a. A Joint savings account shall be opened in any Nationalised Bank, approved by the Management Committee.
b. Savings Bank account opened in the name of Chief Executive Officer shall be operated with joint signatures of the Chief Executive Officer and other authorized officer.
c. All money receipts in the Fund shall be deposited in the savings account immediately and shall be spent on the objectives as referred to in the Act. 8. Allotment of fund to districts for the implementation of National Rural Employment Guarantee Scheme Bihar:-
a. The Chief Executive Officer, NREGS Bihar, shall review and examine the proposals of allotment received from each district in pursuance of instructions as contained in the guidelines of the Central & the State Govts. Accordingly he shall assess the amount to be released to the District Programme Co-ordinators.
b. The Chief Executive Officer NREGS Bihar shall take decision for the release of fund under NREGS Bihar, with the prior sanction of the Principal6 (cid:18)बहार गजट, (असाधारण)] 4 माच+ 2009 Secretary/Secretary of the Rural Development Department, Bihar. For this purpose a sanction order shall be issued by the Rural Development Department, Bihar.
c. This Fund shall be spent only on NREGS Bihar. 9. Account and Audit:- a. Standard accounting procedures shall be followed in respect of maintenance of Bihar State Employment Guarantee Fund and necessary entries such as book, ledgers etc shall be opened.
b. Annual Account shall be in prescribed formats and audited by the Chartered Accountant. Accountant General, Bihar and Department of Finance, Bihar, shall also have the right to audit the accounts from time to time.
