एस0ओ0 149 दिनांक 27 जुलाई 2009—भारत के संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल श्रम संसाधन विभाग के श्रम पक्ष में ग्रामीण श्रमिक कल्याण केन्द्रों के समाज आयोजक के पदों पर भर्त्ती एवं सेवा शर्त्तों के हेतु निम्नलिखित नियमावली बनानी हैः-
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।—(i) यह नियमावली '' बिहार ग्रामीण श्रमिक कल्याण केन्द्र समाज आयोजक (भर्ती एवं सेवा शर्त्त) नियमावली, 2009'' कही जा सकेगी।
(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ।
(iii) यह तुरन्त प्रवृत्त होगी ।
2. परिभाषाएँ।—जब-तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में -(i) ''सरकार'' से अभिप्रेत है बिहार राज्य सरकार ;
(ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है श्रमायुक्त, बिहार ;
(iii) ''विभाग'' से अभिप्रेत है श्रम संसाधन विभाग, बिहार;
(iv) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग;
(v) ''संवर्ग''से अभिप्रेत है श्रमायुक्त, बिहार के नियंत्रणाधीन समाज आयोजक संवर्ग; तथा (vi) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है श्रमायुक्त, बिहार, पटना ।
3. संवर्ग का गठन।—(i) यह संवर्ग पर्यवेक्षकीय तथा राज्य स्तरीय होगा ।
(ii) इस संवर्ग के सदस्य समाज आयोजक के पदों पर नियुक्ति व्यक्ति होगें, जो श्रमायुक्त बिहार के नियंत्रणाधीन ग्रामीण श्रमिक कल्याण केन्द्रों में होंगे ।2 (cid:18)बहार गजट (असाधारण), 27 जुलाई 2009 fVIi.kh%& इस नियमावली के लागू होने के पूर्व से समाज आयोजक के पद पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग में शामिल समझे जाएँगे ।
4. प्राधिकृत बल।—सरकार, समाज आयोजक के संवर्ग में पदों की प्राधिकृत संख्या निर्धारित कर सकेगी तथा इसके अतिरिक्त स्थायी या अस्थायी पद भी सृजित कर सकेगी, अथवा किसी पद को स्थगित या रिक्त रख सकेगी, जिसके कारण छँटनीग्रस्त होने पर इस संवर्ग का कोई भी सदस्य क्षतिपूर्ति का हकदार नहीं होगा ।
5. आरक्षण।—संवर्ग में नियुक्ति में राज्य सरकार द्वारा समय-समय पर निर्धारित आरक्षण नीति / रोस्टर का अनुपालन आवश्यक होगा । 6. भर्त्ती।—(i) नियुक्ति प्राधिकार द्वारा, आयोग द्वारा आयोजित लिखित प्रतियोगिता परीक्षा के आधार पर प्राप्त अनुशंसा पर समाज आयोजक के पद पर सीधी भर्त्ती से नियुक्त की जाएगी । प्रतियोगिता परीक्षा के लिए पाठ्यक्रम का निर्धारण, आयोग से परामर्श कर, संवर्ग नियंत्री प्राधिकार द्वारा किया जायेगा । (ii) आयोग की अनुशंसा की वैधता अनुशंसा की तिथि से एक वर्ष तक होगी । 7. अर्हत्ता।—किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक डिग्री । न्यूनत्तम उम्र सीमा 21 वर्ष तथा अधिकतम उम्र सीमा वही होगी जो सरकार (कार्मिक एवं प्रशासनिक सुधार विभाग) द्वारा समय-समय पर निर्धारित की जाय ।
8. परिवीक्षा अवधि।—समाज आयोजक कोटि में सीधी भर्त्ती द्वारा नियुक्त कर्मी की परिवीक्षा अवधि सामान्यतः नियुक्ति की तिथि से दो वर्षो की होगी । परिवीक्षा अवधि में सेवा संतोषप्रद नहीं होने पर नियुक्ति प्राधिकार द्वारा परिवीक्षा अवधि अभिलिखित कारणों से एक वर्ष के लिए बढ़ाई जा सकेगी, परन्तु यह कि परिवीक्षा की कुल अवधि तीन वर्षों से अधिक की नहीं होगी । विस्तारित अवधि में भी सेवा संतोषप्रद नहीं होने पर सेवामुक्त किया जा सकेगा, जिसके लिए किसी प्रकार के प्रतिकार का दावा नहीं किया जा सकेगा ।
9. प्रशिक्षण।—विभाग द्वारा यथा अपेक्षित समय-समय पर निर्धारित प्रशिक्षण प्राप्त करना होगा । 10. विभागीय परीक्षा एवं पाठ्यक्रम।—मंत्रिमंडल सचिवालय विभाग (राजभाषा) द्वारा समय-समय पर आयोजित हिन्दी टिप्पण एवं प्रारूपण परीक्षा में उत्तीर्णता प्राप्त करना अनिवार्य होगा । परन्तु यह भी, कि यदि विभाग द्वारा पाठ्यक्रम निर्धारित कर किसी अन्य परीक्षा का आयोजन किया जायेगा तो उसमें भी उत्तीर्णता अनिवार्य होगी ।
11. संपुष्टि।—परिवीक्षा की अवधि में लगातार एवं संतोषप्रद सेवा रहने पर तथा यथा आवश्यक विभागीय परीक्षा में सफलता प्राप्त करने पर सक्षम प्राधिकार द्वारा सेवा संपुष्टि की जा सकेगी ।
12. अवशिष्ट मामले ।—(i) राज्य सरकार के अन्य कर्मियों की सेवा शर्त्तों, अनुशासन, छुट्टी, सुनिश्चित वृति उन्नयन आदि के संबंध में प्रवृत्त सभी नियम, अनुदेश आदि समान रूप से इस संवर्ग के सदस्यों पर भी लागू होंगे ।
(ii) इस संवर्ग की वरीयता सूची कार्मिक एवं प्रशासनिक सुधार विभाग द्वारा निर्धारित माप-दण्डों के अनुसार श्रमायुक्त, बिहार, द्वारा तैयार की जायेगी ।
13. कठिनाईयों का निराकरण एवं निर्वचन।—जहाँ इस नियमावली के किसी प्रावधानों में कोई संदेह उत्पन्न होगा, वहाँ इस विषय पर श्रमायुक्त, बिहार का विनिश्चय अंतिम होगा ।
14. निरसन ।—इस नियमावली के लागू होने के पूर्व इस संवर्ग के प्रसंग में निर्गत सभी संकल्प/ अनुदेश निरसित समझे जाएँगे ।

S.O. 149 dated the 27th July 2009—In exercise of Powers conferred under the proviso to Article 309 of the constitution of India, the Governor of Bihar is pleased to frame the following rules to regulate appointment and service conditions of social organisor in the Rural Labour Welfare Centres.
1. Short title extent and commencement—(i) The rules shall be called " The Bihar Rural Labour Welfare Centre Social Organisor (Appointment and Service Conditions) Rules, 2009.
(ii) These rule shall be extended to whole of the State of Bihar.
(iii) It shall come into force at once.
2. Definitions— In these Rules, unless the context otherwise requires :—
(i) " Government" means state Government of Bihar.
(ii) " Appointing authority means Labour Commissioner, Bihar.
(iii) " Department" means Labour Resources Department, Bihar.
(iv) " Commission" means Bihar State Staff Selection Commission.
(v) " Cadre" means cadre of social organisor under the Labour Commissioner, Bihar; and
(vi) " Cadre controlling authority " means Labour commissioner, Bihar, Patna.
3. Constitution of cadre—(i) This cadre shall be supervisory and of State level.
(ii) The persons appointed on the post of social organisor in the Rural labour welfare centre under the control of Labour Commissioner, Bihar shall be members of this cadre.
NOTE—The persons appointed and working on the post of social organisor before commencement of these rules shall be deemed to be automatically included in this cadre.
4 (cid:18)बहार गजट (असाधारण), 27 जुलाई 20094. Sanction Strength —The Government may determine the authorised number of post in the cadre of social organisor and in addition to that may create temporary or permanent post or may keep any post in abeyance or vacant consequent to which in case of retrenchment no member of the cadre could claim compensation.
5. Reservation —The policy / roaster of reservation determined by the State Government from time to time shall be applicable in appointment in the cadre.
6. Appointment—(i) Direct Appointment on the post of Social organisor shall be made by the appointing authority on recommendation received on the basis of written competative examination conducted by the Commission. The cadre controlling authority in consultation with the Commission shall prescribe the syllabus for the competitive examination.
(ii) The recommendation of the Commission shall be valid for a period of one year from the date of recommendation.
7. Eligibility—Graduation Degree obtained from any recognized university. The minimum age limit shall be 21 years and the maximum age limit shall be the same which may be determine by the Government (Personnel and Administrative Reforms Department) from time to time.
8. Probation period —The probation period for the personnel appointed directly on the post of Social Organisor shall generally be of two years from the date of appointment,. In case the unsatisfactory service during probation period, the probation may be extended for another one year assigning the reason thereof, but total probation period shall not be more than three years. In case of unsatisfactory service during the extended probation period the service shall be terminated for which no compensation shall be claimed.
9. Training— the appointee as required must participate in the training programme arranged from time to time by the department.
10. Department Examination and syllabus—It shall be compulsory for the appointee to pass in Hindi noting and drafting examination conducted from time to time by the cabinet secretariat Department (Rajbhasha). Besides that, if the department conducts any other examination by prescribing syllabus, it shall be compulsory to pass the same.
5 (cid:18)बहार गजट (असाधारण), 27 जुलाई 200911. Confirmation— On completion of satisfactory service continuously during the probation period and passing the departmental examination or required, the competent authority may confirm service.
12. Miscellaneous— (i) All the rules, instructions etc. in respect of other service condition, discipline, leave, Assured Career promotion etc, in force for the State Government employees shall be equally applicable for the member of this cadre also.
(ii) The gradation list shall be prepared by the Labour commissioner, Bihar in accordance with the guidelines issued by the personnel and Administrative Reforms Department.
13. Removal of difficulty and interpretation— If any doubt arises in connection of application of any provision of these rules, the opinion of the Labour Commissioner, Bihar shall be final.
14. Repeal—All circulars / instruction issued is respect of this cadre before commencement of these rules shall be deemed to the repealed.
