अध्याय - I 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ-(1) यह नियमावली 'बिहार निबंधन सेवा (भर्ती एवं सेवार्शों) नियमावली, 2010' कही जा सकेगी ।

(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा । (3) यह तुरन्त प्रवृत होगी। 2. परिभाषाएँ ।- इस नियमावली में जब तक कोई बात विषय या संदर्भ के विरूद्ध न हो, (i) ''सेवा'' से अभिप्रेत है बिहार निबंधन सेवा (ii ) ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (iii) ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग; (iv) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (v) ''सदस्य'' या ''सेवा के सदस्य'' से अभिप्रेत है बिहार निबंधन सेवा में नियुक्त व्यक्ति; (vi) 'बिहार निबंधन सेवा' से अभिप्रेत है सेवा की विभिन्न कोटि के पद, यथा :- अवर निबंधक, संयुक्त अवर निबंधक, जिला अवर निबंधक, निबंधन कार्यालयों के निरीक्षक, सहायक निबंधन महानिरीक्षक, उप निबंधन महानिरीक्षक2 (cid:18)बहार गजट (असाधारण)] 4 माच- 2010 तथा समय-समय पर इस सेवा में सृजित होने वाले अन्य राजपत्रित पद; (vii) ''अनुसूची'' से अभिप्रेत है इस नियमावली से संलग्न अनुसूची; (viii) वर्ष से अभिप्रेत है विाीय वर्ष अर्थात 1 अप्रैल से प्रारम्भ होकर अगले वर्ष 31 मार्च को समाप्त होने वाला वर्ष; तथा

(ix) ''वर्ष के दौरान रिक्ति'' से अभिप्रेत है एक वर्ष में बिहार निबंधन सेवा के नए पदों के सृजन या किसी सदस्य की सेवा निवृति या मृत्यु अथवा सेवा से हटाये जाने अथवा पदच्युत किये जाने अथवा त्यागपत्र दिये जाने के फलस्वरूप उपलब्ध रिक्तियाँ अथवा पूर्व वर्षो की ऐसी रिक्तियाँ जो भरी नहीं जा सकी हो ।

3. सेवा की संरचना । -यह सेवा निबंधन,उत्पाद एवं मद्य निषेध विभाग (निबंधन) के प्रशासी नियंत्रण के अधीन होगा जिसके विभागाध्यक्ष भारतीय प्रशासनिक सेवा के प्रधान सचिव/ सचिव के पंक्ति के पदाधिकारी होगें और राज्य सरकार, समय-समय पर, सेवा का संवर्ग बल विनिश्चित कर सकेगी और इस नियमावली की अनुसूची-I में उल्लिखित पूर्व से स्वीकृत पदों के अतिरिक्त इस सेवा के स्थायी/अस्थायी पदों के सृजन की स्वीकृति दे सकेगी ।

4. पद स्थिति। - सेवा के सदस्य राजपत्रित होंगे ।

अध्याय - II भर्ती 5. भर्ती का स्त्रोत । -इस सेवा में मूल कोटि में अवर निबंधक/संयुक्त अवर निबंधक की भर्ती, सीधी भर्ती द्वारा की जाएगी।

6. आरक्षण । - राज्य सरकार द्वारा समय-समय पर विहित नियम एवं प्रक्रिया के अनुसार नियुक्ति में आरक्षण/ रोस्टर का अनुपालन आवश्यक होगा।

7. रिक्तियों का निर्धारण एवं आयोग को संसूचना । - राज्य सरकार प्रत्येक वर्ष की पहली अप्रैल को भरी जाने वाली रिक्तियों की संख्या निर्धारित करेगी तथा इस प्रकार निर्धारित आरक्षण कोटिवार रिक्तियों की सूचना 30 अप्रैल तक आयोग को देगी ।

8. संयुक्त प्रतियोगिता परीक्षा द्वारा भर्ती। - आयोग विभाग से कोटिवार रिक्तियों की संख्या प्राप्त कर विज्ञापन निकाल कर संयुक्त प्रतियोगिता परीक्षा के द्वारा बिहार निबंधन सेवा की सभी मूल कोटि में पदों पर भर्ती के लिए पात्र अभ्यर्थियों से आवेदन प्राप्त करेगा।

9. पात्रता । -सेवा में भर्ती के लिए उम्मीदवारों की उम्र, शैक्षणिक योग्यता आदि राज्य सरकार एवं आयोग द्वारा समय-समय पर यथा निर्धारित रीति एवं विहित प्रावधानों के अनुसार होगा ।

10. मौखिक परीक्षा । -आयोग द्वारा संचालित लिखित परीक्षा में प्राप्त अंकों के आधार पर चयनित अभ्यर्थियों को मौखिक परीक्षा के लिए आयोग द्वारा गठित बोर्ड के समक्ष उपस्थित होना होगा ।

11. चिकित्सा परीक्षा । - नियुक्ति के लिए चुने गये प्रत्येक अभ्यर्थियों को राज्य सरकार द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा परीक्षा के लिए उपस्थित होना पड़ेगा। पदीय कर्तव्यों को दक्षता पूर्वक निष्पादित करने की दृष्टि से जो अभ्यर्थी अपनी अपेक्षित शारीरिक योग्यता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में सफल होगा उसी अभ्यर्थी को नियुक्त करने पर विचार किया जा सकेगा ।

12. आयोग द्वारा अभ्यर्थियों की अनुशंसा । - लिखित एवं मौखिक परीक्षा के आधार पर आयोग मेधा सूची तैयार कर अभ्यर्थियों की उतनी संख्या की अनुशंसा राज्य सरकार को करेगा जितनी संख्या में रिक्तियाँ प्रतिवेदित की गई हों। पैनल की वैधता एक वर्ष तक ही रहेगी। किसी अभ्यर्थी के योगदान न करने अथवा अपेक्षित अभ्यर्थियों का चयन न होने पर अवशिष्ट रिक्तियॉं अगले वर्ष के लिए अग्रणीत कर दी जायेगी।

अध्याय-III 13. वरीयता ।- इस नियमावली के अधीन इस सेवा में नियुक्त किये गये सदस्य की आपसी वरीयता आयोग द्वारा अनुशंसित मेधा सूची के अनुसार निर्धारित की जायगी।

14. परिवीक्षा अवधि - (1) किसी मौलिक रिक्ति के विरूद्ध नियुक्त प्रत्येक पदाधिकारी पदग्रहण की तिथि से दो वर्षो की अवधि तक परिवीक्षा पर रहेगा परन्तु यदि कोई व्यक्ति स्थानापन्न रूप से या अस्थायी रूप से नियुक्त हो तो राज्य सरकार के आदेश से उस अवधि, जो दो वषों से अधिक न हो, की सेवा की गणना परिवीक्षा के रूप में की जा सकेगी।

(2) राज्यपाल परिवीक्षा की अवधि में या उसकी समाप्ति के समय इस सेवा में भर्ती किए गये ऐसे किसी पदाधिकारी की नियुक्ति समाप्त कर सकते हैं, जो नियुक्ति संबंधी शर्तो को पूरा नहीं करता हों अथवा वह सेवा संतोषजनक नहीं रहने या अन्य कारणों से इस सेवा में सम्पुष्टि के योग्य नहीं हो। (3) प्रथम वार्षिक वेतन वृद्धि के बाद अगली वेतन वृद्धि विहित विभागीय परीक्षा में उत्तीर्ण होने के बाद अनुमान्य होगी ।3 (cid:18)बहार गजट (असाधारण)] 4 माच- 2010 15. सम्पुष्टि। -(1) इस सेवा में नियुक्त पदाधिकारी को परिवीक्षा की अवधि की संतोषजनक समाप्ति होने पर सेवा में सम्पुष्ट किया जा सकेगा यदि वह विहित मापदण्ड के अनुसार विभागीय परीक्षा में उत्तीर्ण हो और राज्य सरकार उसे सम्पुष्टि के योग्य समझें ।

(2) सम्पुष्टि के पूर्व सभी पदाधिकारी को बिहार जिला उप रजिस्ट्रार एवं उप रजिस्ट्रार (प्रशिक्षण और विभागीय परीक्षा) नियमावली, 1974 के प्रावधान के अनुसार राजस्व पर्षद द्वारा संचालित लिखित एवं मौखिक परीक्षा उत्तीर्ण करना आवश्यक होगा ।

16. इस सेवा के विभिन्न पदों के वेतनमान राज्य सरकार द्वारा निर्धारित किये जायेंगे या समकक्ष प्रतिस्थापन वेतनमान्‌ राज्य सरकार द्वारा समय-समय पर घोषित किये जा सकेंगे ।

17. प्रशिक्षण । -(1) इस सेवा के पदाधिकारियों को सरकार द्वारा कार्यपालक आदेश से निर्धारित विषयों पर निर्धारित समय के लिए प्रशिक्षण प्राप्त करना होगा जिसमें व्यावहारिक प्रशिक्षण भी शामिल रहेगा, जैसा कि बिहार जिला उप रजिस्ट्र्र्र्‌्र्र्र्रार तथा उप रजिस्ट्र्‌ार (प्रशिक्षण और विभागीय परीक्षा) नियमावली, 1974 में प्रावधानित है।

(2) प्रशिक्षण की समाप्ति पर किए गये मूल्यांकन को विभागीय प्रोन्नति समिति के समक्ष विचारण हेतु उपस्थापित किया जायगा ।

(3) इस सेवा के पदाधिकारियों को उच्चतर पद पर प्रोन्नति दिये जाने के बाद सरकार द्वारा निर्धारित अवधि के लिए पुनर्प्रशिक्षण प्राप्त करना अनिवार्य होगा ।

अध्याय - IV प्रोन्नति 18. (1) इस सेवा की मूल कोटि से भिन्न सभी पद प्रोन्नति द्वारा भरे जायेगें । इस सेवा के मूल कोटि का पद अवर निबंधक एवं संयुक्त अवर निबंधक होगा ।

(2) जिला अवर निबंधक के पद पर मूल कोटि के ऐसे पदाधिकारियों को विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर प्रोन्नति दी जा सकेगी जिनकी सेवा सम्पुष्ट हो तथा सेवा अभिलेख संतोषजनक रहा हो।

(3) प्रोन्नति के लिए राज्य सरकार (कार्मिक एवं प्रशासनिक सुधार विभाग) द्वारा समय-समय पर निर्धारित न्यूनतम कालावधि को पूरा किया जाना आवश्यक होगा। (4) उप निबंधन महानिरीक्षक या राज्य सरकार द्वारा सृजित किये जाने वाले उप निबंधन महानिरीक्षक से भिन्न उच्चतम पदों पर प्रोन्नति आयोग के अध्यक्ष/सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जायेगी । उप निबंधन महानिरीक्षक से निम्न पदों पर प्रोन्नति सरकार द्वारा गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जायेगी । (5) प्रोन्नति में राज्य सरकार द्वारा लागू आरक्षण नीति/रोस्टर का अनुपालन आवश्यक होगा। अध्याय-V अन्य सेवा र्शों 19. इस सेवा के लिए अन्य सेवा शर्तें यथा- अनुशासनिक कार्रवाई, छुट्टी, देय सेवानिवृति लाभ, सुनिश्चित वृत्ति उन्नयन योजना इत्यादि जो इस नियमावली से आच्छादित नहीं हैं या जो इस सेवा के लिए पृथक रूप से अधिसूचित नहीं है; राज्य सरकार द्वारा, समय-समय पर, निर्गत अन्य सुसंगत नियमावलियों, आदेशों तथा परिपत्रों द्वारा नियंत्रित होंगी।

20. राज्य सरकार को इस नियमावली में विहित प्रावधानों को यथा अपेक्षित संशोधित करने का अधिकार होगा। प्रशासी विभाग इस नियमावली के प्रावधानों को कार्यरूप देने के लिए नियमावली के प्रावधान के अनुरूप प्रक्रिया विहित कर सकेगी ।

21. निरसन एवं व्यावृाि।- (1) इस नियमावली के प्रवृत होने की तिथि से 'बिहार निबंधन सेवा (भर्ती एंव सेवार्शों) नियमावली, 2008' निरसित समझी जायगी ।

(2) ऐसा निरसन के होते हुए भी बिहार जिला उप रजिष्ट्र्रार एवं उप रजिष्ट्र्रार (र्भाी) नियमावली, 1974 एवं 'बिहार निबंधन सेवा (भर्ती एंव सेवार्शों) नियमावली, 2008' के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदा शक्ति का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृा थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गई थी। 22. इस नियमावली के लागू होने की तिथि के पूर्व से इस सेवा के विभिन्न पदों, जैसा कि नियम-2(VI) में परिभाषित है, पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस सेवा में शामिल एवं इस नियमावली के अधीन नियुक्त समझे जायेंगे।

18 फरवरी 2010 सं0 1/ए¹-102/96-451-बिहार निबंधन सेवा (र्भाी एवं सेवार्शाें) नियमावली, 2010 का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे संविधान के अनुच्छेद 384 के खण्ड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

District Sub-Registrar Inspector of Registration Offices Assistant Inspector General Deputy Inspector General and Other gazetted posts created in this service from time to time. (vii) ''Schedule'' means Schedule appended to these rules. (viii) "Year" means financial year, i.e., year commencing from 1st April and ending on 31st March of succeeding year. (ix) ''Vacancy during a year'' means the available vacancies during a year due to creation of new posts in Bihar Registration Service or due to retirement or death or removal or dismissal or resignation from service of a member or due to resignation or such vacancies of previous year which could not have been filled up.

3. Structure of Cadre :- This service shall be under the administrative control of Registration, Excise and Prohibition Department (Registration), of which the Head of the Department shall be of the rank of principal Secretary/Secretary of Indian Administrative Service and the State Government may determine the strength of the cadre of the service and may permit the creation of permanent/temporary posts in addition to posts already sanctioned/mentioned in Schedule-I to these Rules. 4. Status of Post :- The members of this Service shall be gazetted.

Chapter - II. Recruitment 5. Source of recruitment: - The recruitment in the basic cadre of Sub Registrar/ Joint Sub Registrar shall be made by direct recruitment. 6. Reservations: - It shall be essential to follow the Reservation/roster in accordance with rules and procedure prescribed by the state Government from time to time. 7. Determination of vacancies and communication to Commission: - On the first April of each calendar year, the State Government shall determine the vacancies to be filled and shall communicate reservation category-wise vacancies so determined to the Commission by 30th April of each year. 8- Recruitment through Combined Competitive Examination :- The Commission, after receiving the vacancy category-wise from the department, shall receive applications from eligible candidates for recruitment on all vacancies in the basic grade of Bihar Registration Service on the basis of Combined Competitive Examination by publishing advertisement. 9. Eligibility - The age, educational qualifications etc. of the candidates for recruitment in the service shall be in accordance with the procedure and provisions as decided by the State Government and Commission from time to time. 10. Viva Voce Test - The candidates selected on the basis of marks obtained in the written examination shall have to appear before the Board constituted by the Commission for viva voce test. 11. Medical Examination - Every candidate selected for appointment shall have to appear for medical examination before the Medical Board constituted by the State Government. The candidates, who shall be able to satisfy the Medical Board regarding their medical fitness with a view to efficient execution of the liability of the official duty, may only be considered for appointment. 12. Recommendation of Candidates by the Commission - The commission shall, after preparing a merit list on the basis of written and viva voce test, recommend the number of candidates according to the vacancy reported to it. The Panel shall remain valid only6 (cid:18)बहार गजट (असाधारण)] 4 माच- 2010 for a year. The remaining vacancies due to non-joining of any candidate or non selection of requisite candidates shall be carried forward for the next year.

Chapter - III. 13. Seniority - The relative seniority of a member recruited in this service under these rules shall be determined according to the merit list recommended by the Commission. 14. Probation Period : - (1) Every officer appointed against a substantive vacancy shall be on probation for two years from the date he joins his post, but if a person has been appointed either on officiating or on temporary basis, such period, not exceeding two years, may be counted as probation by the order of the State Government. (2) The Governor may terminate the appointment of any such officer recruited in the service during or at the time of completion of probation period, who does not fulfill the conditions of appointment or he is unfit for being confirmed in the service due to his unsatisfactory service or otherwise. (3) After first annual increment, the next increment of pay shall be admissible after passing the prescribed departmental examination. 15. Confirmation - (1) An officer appointed in this service may be confirmed after the completion of probation period, if he has passed the departmental examination as per prescribed standard and the State Government considers him to be fit for confirmation. (2) Every officer shall have to pass the written and oral examination conducted by Board of Revenue according to the provisions of Bihar District Sub Registrar/Sub Registrar (Training & Departmental Examination) Rules, 1974. 16. The pay scales for different posts in this service shall be determined by the State Government or the equivalent replacement pay scales may be declared by the State Government from time to time. 17. Training - (1) The officers of this service shall have to get training on subjects and for period as the Government shall direct by executive orders and shall include the practical training as provided in Bihar District Sub Registrar and Sub Registrar (Training and Departmental Examination) Rules, 1974. (2) The evaluation made at the end of training shall be placed before the Departmental Promotion Committee for consideration. (3) It shall be essential for the officers of this service to be retrained after promotion on higher posts for period decided by the Government.

Chapter IV

Promotion

18. (1) All the posts of this service except basic grade posts shall be filled up by promotion. The basic grade posts of this service shall be the posts of Sub-Registrar and Joint Sub-Registrar. (2) On the basis of recommendation of departmental promotion committee, Such officers of the basic grade may be promoted to the post of District sub-Registrar whose services have been confirmed and whose service records have been satisfactory. (3) For promotion, it shall be essential to complete the minimum time period determined by the Personnel and Administrative Reforms Department of the State Government. (4) The promotion to the post of Deputy Inspector General or to the posts of Maximum Pay Scale other than that of Dy Inspector General to be created by the State Government shall be made on the recommendation of Departmental Promotion Committee headed by the Chairman / Member of Bihar Public Service Commission.

The Government shall make the promotion to the post lower than those of Deputy Inspector General on the recommendation of Departmental promotion committee constituted by the Government. (5) It shall be essential to follow the reservation/roster in promotion prescribed by the State Government.

Chapter- V Other Service Conditions 19. The other service conditions for this service, such as, disciplinary action, leave, admissible retirement benefits, assured career promotion etc. which are not covered by these rules or which are not separately notified for this service shall be controlled by the relevant Rules, orders and circulars issued from time to time by the State Government. 20. The State Government shall have the right to amend the provisions of these rules as required. The administrative department may make regulations in order to prescribe the procedure in accordance with the provisions of these rules for implementing these rules. 21. Repeals & Savings - (1) 'Bihar Registration Service (Recruitment & Service Conditions) Rules 2008' shall be deemed to be repealed from the date on which these rules come into force. (2) Despite having such repeal any act done or any action taken in exercise of the powers conferred under Bihar District Sub Registrar and Sub Registrar (Recruitment) Rules, 1974 and 'Bihar Registration Service (Recruitment & Service Conditions) Rules 2008' shall be deemed to be done or taken under these rules as if these rules were in force on the date which such act was done or such action was taken. 22. All the persons appointed and working on different posts of this service as defined in Rule 2 (VI) shall automatically be deemed to be included in this service and subject to these Rules.
