1. संक्षिप्त भाग, विस्तार एवं प्रारम्भ-(1) यह नियमावली बिहार गृह रक्षा वाहिनी सेवा (संशोधन)नियमावली, 2010 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजकीय गजट में प्रकाशन की तिथि से लागू होगा। 2. नियमावली, 2005 के नियम-4 उप नियम-वैतनिक-1 का प्रतिस्थापन- (1) उक्त नियमावली का नियम-4 के वैतनिक पद-1 निम्नलिखित सीधी नियुक्ति के पद का 50 प्रतिशत पद गृह रक्षकों (दैनिक वेतनभोगी, खिलाड़ी सहित) के लिए कर्णाकित होगा।

व्यवस्था प्रभावी होगा। सीधी नियुक्ति की प्रत्येक संवर्ग बल के लिए कुल आरक्षण प्रतिशत की गणना इससे प्रभावित नहीं होगा। 3. उक्त नियमावली, 2005 के नियम-4 के उप नियम(2) का प्रतिस्थापन ः-(1) उक्त नियमावली के नियम-4 के उप नियम(2) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा।
(2) बिहार गृह रक्षा वाहिनी संगठन के उप समूह '' घ '' के निम्नलिखित पद होगे :-

गृह रक्षकों की नियुक्ति के लिए कर्णाकिंत 50 प्रतिशत पद पर भी नियुक्ति के लिए लागू सामान्य आरक्षण व्यवस्था प्रभावी होगा। सीधी नियुक्ति की प्रत्येक संवर्ग बल के लिए कुल आरक्षण प्रतिशत की गणना इससे प्रभावित नहीं होगा।3 (cid:18)बहार गजट (असाधारण)] 19 माच- 2010 4. उक्त नियमावली, 2005 के नियम-5 उप-नियम(1) के खंड (VI) का प्रतिस्थापन :-नियम-5 के उप नियम (1) ''सिपाही'' के खंड (VI) को निम्नलिखित द्वारा प्रतिस्थापन किया जाएगा।
(VI) (1) सीधी नियुक्ति के पदों का 50 प्रतिशत पद गृह रक्षकों (दैनिक वेतनभोगी,खिलाड़ी सहित) के लिए कर्णाकित रहेगें। (2) उक्त 50 प्रतिशत पदों पर गृह रक्षकों (दैनिक वेतनभोगी,खिलाड़ी सहित) की नियुक्ति निम्नांकित शर्तो के अधीन होगी।
(क) जो संगठन में कम से कम 5 वर्षो की सेवा/ड्युटी दे चुकें हों। (ख) जिन्हें पद के अनुकूल शारीरिक एवं शैैक्षणिक योग्यता एवं अहर्ताएं हों । (ग) जिस तिथि को नियुक्ति पर विचार किया जाएगा उस तिथि को उनकी कम से कम 10 वर्षों की सेवा शेष हों।
5. उक्त नियमावली, 2005 के नियम-5 उप-नियम (2) के खंड (VI) का प्रतिस्थापन ः- नियम-5 के उप-नियम(2) सिपाही (चालक) के खंड (VI) को निम्नांकित द्वारा प्रतिस्थापित किया जायेगा।
(VI) (1) सीधी नियुक्ति के पदों का 50 प्रतिशत पद गृह रक्षकों (दैनिक वेतनभोगी,खिलाड़ी सहित) की नियुक्ति निम्नांकित शर्तो के अधीन होगीः-
(क) जो संगठन में कम से कम 5 वर्षों की सेवा/ड्यूटी दे चुके हों । (ख) जिन्हें पद के अनुकूल शारीरिक शैक्षणिक योग्यता एवं अहर्ता हो। (ग) जिस तिथि को नियुक्ति पर विचार किया जाएगा उस तिथि को उनकी कम से कम 10 वर्षों की सेवा शेष हों।
6. उक्त नियमावली, 2005 के नियम-5 उप-नियम (3) के खंड (VI) का प्रतिस्थापन ः-नियम-5 के उप-नियम (3) अधिनायक(लिपिक), अधिनायक ''अनुदेशक'' के खंड (VI) को निम्नांकित द्वारा प्रतिस्थापित किया जायेगाः-
(VI) (1) सीधी नियुक्ति के पदों का 50 प्रतिशत पद जो गृह रक्षकों (दैनिक वेतनभोगी,खिलाड़ी सहित) की नियुक्ति निम्नांकित शर्त्तो के अधीन होगीः-
(क) जो संगठन में कम से कम 5 वर्र्षों की सेवा/ड्यूटी दे चुके हों । (ख) जिन्हें पद के अनुकूल शारीरिक शैक्षणिक योग्यता एवं अहर्ता हो। (ग) जिस तिथि को नियुक्ति पर विचार किया जाएगा उस तिथि को उनकी कम से कम 10 वर्षों की सेवा शेष हों।
7. नियमावली, 2005 के नियम-7(1)में प्रतिस्थापन-उक्त नियमावली के नियम-7 के खंड(1) में निम्नांकित जोड़ा जाएगा।
(1)(क) सीधी नियुक्ति के पदों का 50 प्रतिशत पद जो गृह रक्षकों (दैनिक वेतनभोगी,खिलाड़ी सहित) के लिए कर्णाकित है; की नियुक्ति निम्नांकित शर्तों के अधीन होगीः-
(क) जो संगठन में कम से कम 5 वर्षाें की सेवा/ड्यूटी दे चुके हों । (ख) जिन्हें पद के अनुकूल शारीरिक शैक्षणिक योग्यता एवं अहर्ता हो। (ग) जिस तिथि को नियुक्ति पर विचार किया जाएगा उस तिथि को उनकी कम से कम 10 वर्षों की सेवा शेष हों।
8. उक्त नियमावली, 2005 के नियम-10 के खण्ड V का प्रतिस्थापन ः-नियम-10 के (खंड)(V) का निम्नांकित द्वारा प्रतिस्थापित किया जायेगाः-
(अ) गृह रक्षक(दैनिक वेतनभोगी,खिलाड़ी सहित) के लिए समूह''घ'' के 50 प्रतिशत आरक्षित पदों को समादेष्टा, बिहार गृह रक्षा वाहिनी, मुख्यालय, पटना की अध्यक्षता में गठित समिति की अनुशंसा पर भरा जाएगा।
9. समूह''ग'' के जिन पदों पर नियुक्ति हेतु चयन प्राधिकार के संबंध में पूर्व से कोई विशिष्ट नियम तथा प्रक्रिया निर्धारित नहीं है, उन पदों पर नियुक्ति बिहार कर्मचारी चयन आयोग की अनुशंसा के आधार पर की जायेगी।

15 मार्च 2010 सं0-एल/एच0जी0-1555/01-2913, दिनांक 15 मार्च 2010 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाषित किया जाता है, जो भारत संविधान के अनुच्छेद 348 के खंड (3) के अधीन अंग्रेजी भाषा में उक्त अधिसूचना का प्राधिकृत पाठ समझा जाएगा।
बिहार-राज्यपाल के आदेष से, (ह0) अस्पष्ट, सरकार के सचिव।4 (cid:18)बहार गजट (असाधारण)] 19 माच- 2010 The 15th March 2010 No.L/H.G.1555/01- 2913./C—In exercise of powers conferred by proviso to Article 309 of the constitution of India the Governor of Bihar is pleased to make the following rules to amend the Bihar Home Guards service Rules, 2005 :-
1. Short title, extend and commencement.—(1) These Rules may be called Bihar Home Guard service(amendment) Rules, 2010
(2) It shall extend to whole of Bihar state. (3) It shall come into force from the date of its publication in Bihar gazette. 2. Substitution of the term "Salaried post" in sub rule (1) of rule-4 of the Rules-2005 (1) Fifty Percent of the following posts to be filled up by direct recruitment mentioned as salaried post " (i) in Rule-4 of the said Rules shall be earmarked for Home Guards ( including daily wages employees, sportsmen).

The existing reservation policy for direct recruitment will also be applied on 50% of the earmarked post for the Home Guard and this will not affect the total reservation percentage of each Cadre post for direct recruitment.
3. Substitution of sub rule (2) of rule-4 of the said Rules, 2005:-
(1) The sub rule (2) of rule-4 of the said rules shall be substituted by the following :- (2) There shall be following posts of sub-group "D" of the Bihar Home Guard organization.

4. Substitution of Clause (vi) of sub rule(1) of rule-5 of the said rules,2005—'Sepoy' of
clause(vi) of sub rule(1) of rule-5 shall be substituted by the following—
(vi)(1) Fifty Percent of the posts for direct appointment shall be earmarked for Home Guards (including daily wages employees, sportsman.)
(2) Appointment of home guards (including daily wages employees, sportsman) against the said 50% earmarked posts shall be made subject to the following conditions :-
(a) Those having served/worked in the organization for at least 5 years. (b) Those having physical fitness and educational qualification prescribed for the post.
(c) They must have at least 10 years of service remaining on the date when their appointment is to be considered.
5. Substitution of clause (vi) of sub rule(2) of rule- 5 of the said Rules, 2005—The clause
(vi) Sepoy (Driver of sub rule(2) of rule 5 shall be substituted by the following :-
(vi)(1) Fifty Percent of the posts for direct appointment shall be earmarked for home guards (including daily wage employees, sportsman ) under the following conditions.
(a) Those having served/worked in the organization for at least 5 years. (b) Those having physical fitness and educational qualification prescribed for the post. (c) They must have at least 10 years of service remaining on the date when their appointment is to be considered.
6 (cid:18)बहार गजट (असाधारण)] 19 माच- 20106. Substitution of clause(vi) of sub rule(3) of rule-5 of the said Rules, 2005—The clause (vi) Havildar (clerk), Havildar Instructor, of sub rule(3) of rule-5 shall be substituted by the following.
(vi)(1) The appointment of the Home Guards (including daily wages employees, sportsman) on the 50% of the post for direct recruitment shall be made under following conditions:-
(a) Those having served/worked in the organization for at least 5 years. (b) Those having physical fitness and educational qualification prescribed for the post. (c) They must have at least 10 years of service remaining on the date when their appointment is to be considered.
7. Substitution of rule–7 (1) of the said Rules, 2005—The clause (1) of Rules- 7 shall be added by the following :-
(1)(a) The appointment on the 50% posts of the direct recruitment, which are earmarked for home guards ( including daily wages employees, sportsman) shall be made under following conditions :-
(a) Those having served/worked in the organization for at least 5 years. (b) Those having physical fitness and educational qualification prescribed for the post. (c) They must have at least 10 years of service remaining on the date when their appointment is to be considered.
8. Substitution of clause (Part) (v) of rule-10 of said Rules, 2005 :-The clause (v) of rule
10 shall be substituted by the following :-
(v) The 50% post of group-D, earmarked for Home Guards (including daily wages employees, sportsman) shall be filled-up on the recommendation of the committee constituted under the chairmanship of Commandant, Bihar Home Guards Headquarter, Patna.
9. Specific provision of appointment where there are no rules and regulation for selection for appointment to Group 'C' posts, the appointment shall be made through Bihar Karamchari Chayan Ayoge.
