((((संसंसंसं0000 पपपपटना टना टना टना 444479797979) ) ) ) पपपपटनाटनाटनाटना, , , , शुबशुबशुबशुबवारवारवारवार,,,, 11116666 जुलाईजुलाईजुलाईजुलाई 2020202010101010 वित्त विभाग ——— अधिसूचना 13 जुलाई 2010 सं0 3ए-2-वे0पु0-18/2009-7549—भारतीय संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल एतद्द्वारा बिहार राज्य कर्मचारी सेवा शर्त्त (सुनिश्चित वृत्ति उन्नयन योजना) नियमावली, 2003 (समय-समय पर यथा संशोधित) को निरसित करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1- laf{kIr uke] foLrkj ,oa vkjaHk A&(i) यह नियमावली बिहार राज्य कर्मचारी सेवा शर्त्त (सुनिश्चित वृत्ति उन्नयन योजना) निरसन नियमावली, 2010 कही जा सकेगी ।
(ii) यह दिनांक 1 जनवरी 2009 से प्रवृत होगी ।
2- (i) बिहार राज्य कर्मचारी सेवा शर्त्त (सुनिश्चित वृत्ति उन्नयन योजना) नियमावली, 2003 (समय-समय पर यथा संशोधित) एतद्द्वारा निरसित की जाती है ।
(ii) इस निरसन के होते हुए भी, दिनांक 31 दिसम्बर 2008 तक बिहार राज्य कर्मचारी सेवा शर्त्त (सुनिश्चित वृत्ति उन्नयन योजना) नियमावली, 2003 (समय-समय पर यथा संशोधित) के अधीन की गई कोई भी कार्रवाई वैध रूप से मान्य की जायगी । दिनांक 31 दिसम्बर 2008 तक किसी कर्मचारी को उक्त नियमावली के अधीन ऐसा वित्तीय उन्नयन यदि देय हो, मंजूर किया जाएगा । आगे और कि 31 दिसम्बर 2008 और इस निरसन नियमावली के प्रभावी किये जाने की तिथि के बीच निरसित ए0सी0पी0 नियमावली के अधीन वेतन प्रोन्नति प्राप्त होगी । 2 (cid:18)बहार गजट (असाधारण)] 16 जुलाई 2010 The 13th July 2010 No. 3A- 2 PR- 18/2009- 7549— In exercise of powers conferred under Proviso to Article 309 of the Constitution of India, Governor of Bihar is hereby pleased to make the following Rules to repeal the Bihar State employees conditions of service (Assured Career Progression Scheme) Rules -2003 (as amended from time to time):-
1. Short title, extent and commencement.—(i) These Rules may be called the Bihar State Employees Conditions of Service (Assured Career Progression Scheme) Repeal Rules 2010.
(ii) It shall come into force with effect from 1st January 2009.
2. (i) The Bihar State Employees Conditions of Service (Assured Career Progression Scheme) Rule, 2003 (as amended from time to time) is hereby repealed.
(ii) Notwithstanding this repeal, the action taken under Bihar State Employees Conditions of Service (Assured Career Progression Scheme) Rules, 2003 (as amended from time to time) up to 31st December 2008 shall be legally recognized. Such financial Progression if due up to 31st December 2008 under the said Rules to the any employee, shall be sanctioned. Further more the Pay promotion under repealed A.C.P rules will be available in between 31st December 2008 and the date of this repeal Rules is made effective.
