सं॰ 3/एम॰-89/2010-1609—भारत संविधान के अनुच्छेद-309 के परन्तुक में प्रदत्त शक्तियों के अधीन बिहार-राज्यपाल राज्य सरकार के कार्यरत कर्मियों द्वारा कम्प्यूटर सक्षमता हासिल करने के लिए निम्नलिखित नियमावली बनाते हैं ।
1. नाम, विस्तार एवं प्रारम्भ।- (1) यह नियमावली बिहार सरकारी सेवक (सम्पुष्टि के लिए कम्प्यूटर सक्षमता) नियमावली, 2011 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरत प्रवृत होगी। (4) यह मात्र सचिवालय सहायकों, पर्यवेक्षकीय संवर्गों एवं समूह 'ग' कर्मियों के संबंध में लागू होगी। 2. परिभाषाएँ- इस नियमावली में- (क) 'राज्य सरकार' से अभिप्रेत है बिहार राज्य सरकार, तथा (ख) 'डी.ओ.ई.ए.सी.सी. सोसाइटी' से अभिप्रेत है भारत सरकार (सूचना प्रौधोगिकी विभाग, संचार एवं सूचना प्रौद्योगिकी मंत्रालय) की एक स्वायत्त वैज्ञानिक संस्था।
3. कार्यरत कर्मियों हेतु कम्प्यूटर सक्षमता की अर्हता- (क) राज्य सरकार की किसी सेवा/संवर्ग नियमावली, जहाँ सम्पुष्टि के लिए कम्प्यूटर सक्षमता जाँच परीक्षा में उत्तीर्ण होना आवष्यक है, में किसी अन्यथा प्रावधान के होते हुए भी, ऐसी प्रत्येक सेवा/संवर्ग में सम्पुष्टि के लिए डी॰ओ॰ई॰ए॰सी॰सी॰ सोसाइटी के एक कोर्स जिसका विनिष्चय सूचना प्रावैद्यिकी विभाग द्वारा किया जायेगा, में उत्तीर्णता का प्रमाण-पत्र होना आवष्यक होगा, और अलग से कम्प्यूटर सक्षमता जाँच की आवष्यकता नहीं रहेगी।
(ख) जो सरकारी सेवक पहले से सम्पुष्ट हैं और उन्हें अगली वेतन-वृद्धि प्राप्त करने हेतु कम्प्यूटर सक्षमता जाँच परीक्षा में उत्तीर्ण होना आवष्यक हो, को अगली वेतन-वृद्धि प्राप्त करने के लिए डी॰ओ॰ई॰ए॰सी॰सी॰ सोसाइटी के एक कोर्स जिसका विनिष्चय सूचना प्रावैद्यिकी विभाग द्वारा किया जायेगा, में उत्तीर्णता का प्रमाण-पत्र होना आवष्यक होगा, और अलग से कम्प्यूटर सक्षमता जाँच की आवष्यकता नहीं रहेगी। वेतन-वृद्धि पर ऐसी रोक ऐसी उत्तीर्णता का प्रमाण-पत्र प्राप्त होने तक रहेगी। प्रमाण-पत्र समर्पित होने पर भूतलक्षी प्रभाव से देय वेतन-वृद्धि अनुमान्य हो जायेगी, बषर्ते कि प्रमाण-पत्र निर्गत होने में विलम्ब के लिए सरकारी सेवक दोषी नहीं हो।2 (cid:18)बहार गजट (असाधारण), 25 मई 2011 (ग) उपर्युक्त प्रावधानों के होते हुए भी परीक्षा में उत्तीर्णता संबंधी उम्र में छूट का कोई प्रावधान यदि किसी सेवा/संवर्ग नियमावली में की गयी है तो वह प्रभावी रहेगा। 50 वर्ष आयु पूरी कर चुके सरकारी सेवकों को, कतिपय शर्तों के पूरा करने पर, विभागीय परीक्षा में उत्तीर्णता से छूट के लिए समय-समय पर निर्गत अनुदेष ऐसे मामलों में भी प्रभावी रहेगा।
4. उपर्युक्त कोर्स में प्रषिक्षण की व्यवस्था सूचना प्रावैधिकी विभाग द्वारा की जायेगी। इसके लिए पाठ्यक्रम का निर्धारण सूचना प्रावैधिकी विभाग द्वारा किया जायेगा।
5. अभिभावी प्रभाव।- राज्य सरकार की किसी सेवा/संवर्ग नियमावली में, इस नियमावली के प्रतिकूल किसी प्रावधान के रहते हुए भी, इस नियमावली के प्रावधानों का अभिभावी प्रभाव होगा।
6. प्रासंगिक संवर्ग नियमावलियों के संगत प्रावधानों का निरसन।- राज्य सरकार की प्रासंगिक संवर्ग नियमावलियों के संगत प्रावधान निरसित समझे जायेंगे। संबंधित विभाग द्वारा प्रासंगिक नियमावली को, विधि विभाग से विधिक्षा कराकर, तदनुरूप संषोधित कर लिया जायेगा।

No. 3/M- 89 /2010-1609—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Gervernor of Bihar is pleased to make following Rules for Computer Competency qualification in appointments by the State Government and achieving computer competency by the working employees-
1. Short title, extent & commencement.— (1)These Rules may be called as the Bihar Government Servants (Computer Competency for recruitment and confirmation) Rules, 2011.
(2) It shall extend to the whole State of Bihar. (3) It shall come into force at once. (4) It shall be applicable with respect to the Secretariat Assistants, Supervisory cadres and Group'C' employees only.
2. Definitions :— In these Rules-
(a) 'State Government' means Bihar State Government; and (b) 'DOEACC Society' means an autonomous society of Department of Information Technology, Ministry of communications and Information Technology, Govt of India.
3. Qualification of Computer Competency for appointment.— Notwithstanding any otherwise provision contained in a Service/Cadre Rules of the State Government, where computer competency is required for appointments and no special qualification has been prescribed, the certificate of passing a Course of DOEACC Society, which shall be determined by the Information Technology Department, shall be necessary for recruitment to each such Service/Cadre and shall be known as qualification for that.
4. Qualification of Computer Competency for working employees :— (a) Notwithstanding any otherwise provision contained in a Service/Cadre Rules of the State Government where passing of Computer computency test is required for confirmation, the certificate for passing a Course of DOEACC Society, which shall be determined by the Information Technology Department, shall be necessary for confirmation in each such service/Cadre, and separate computer competency test shall not be required.
(b) The government servants who are already confirmed, and for whom it is essential to pass computer competency test for getting next increment, the certificate of passing a course of3 (cid:18)बहार गजट (असाधारण), 25 मई 2011 DOEACC Society, which shall be determined by the Information Technology Department shall be necessary for getting next increment and separate computer competency test shall not be required. Withholding of such increment shall remain effective till the receipt of certificate of such passing. After submission of certificate the due increment shall become admissible with retrospective effect, if the delay in grant of certificate is not attributable to the government servant.
(c) Notwithstanding the aforesaid provisions, the provisions regarding age relaxation with respect to passing of examination, if made in any service/cadre Rules, shall remain effective. The instruction issued from time to time with respect to relaxation in passing the departmental examination, for government servants who have completed 50 years of age, on fulfulling certain conditions shall remain effective in such cases also.
5. The arrangement for training in the said course shall be arranged by the Information Technology Department. For this the syllabus shall be determined by the Information Technology Department.
6. Over-riding effect.— Notwithstanding any provision contained contrary to the provision of these Rules, in a Service/Cadre Rules of the State Government the provision of these Rules shall have over-riding effect.
7. Repeal of related provision of relevant Cadre Rules.— The related provisions of relevant Cadre Rules of the State Government shall be deemed to be repealed. The concerned Department shall amend the relevant Cadre Rules accordingly after getting it vetted by the Law Department.
