1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।—(i) यह नियमावली 'बिहार लेखा सेवा (संशोधन) नियमावली, 2011' कही जा सकेगी ।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (iii) यह तुरंत प्रवृत्त होगी । 2. उक्त नियमावली, 2000 के नियम 4 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :—

''(4) सम्वर्ग का गठन- यह सम्वर्ग वित्त विभाग के प्रशासी नियंत्रण में होगा । इसके विभागाध्यक्ष सुपर टाइम स्केल के भारतीय प्रशासनिक सेवा, भारतीय लेखा परीक्षा सेवा या भारत सरकार के किसी संगठित लेखा सेवा के पदाधिकारी होंगे और वे आयुक्त, लेखा प्रशासन के रूप में पदाभिहित होंगे । आयुक्त, लेखा प्रशासन की नियुक्ति सामान्य प्रशासन विभाग द्वारा की जायेगी।

इस सम्वर्ग की मुख्यतः चार प्रशाखाएं होगी : आंतरिक वित्तीय सलाहकार, कोषागार, भविष्य निधि और लेखा । इस सम्वर्ग के विभिन्न स्तरों के पदों की सूची अनुसूची V एवं VI में दी गयी है। राज्य सरकार समय-समय पर, संवर्गीय बल का निर्धारण करेगी और स्वीकृत पदों के इस सम्वर्ग के अतिरिक्त पदो ंके सृजन की मंजूरी भी दे सकेगी । ''

3. उक्त नियमावली, 2000 के अध्याय-2 (भर्त्ती) के नियम 6(ii) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :—

''किसी भी स्तर पर संवर्गीय पदाधिकारी की अनुपलब्धता की स्थिति में, बिहार वित्त सेवा, बिहार प्रशासनिक सेवा एवं अंकेक्षक सेवा के पदाधिकारियों को रिक्त पदों के विरूद्ध पदस्थापित किया जा सकेगा या महालेखाकार कार्यालय अथवा भारत सरकार के किसी संगठित लेखा सेवा के पदाधिकारियेां से प्रतिनियुक्ति द्वारा भरा जा सकेगा।'''2 (cid:18)बहार गजट (असाधारण), 29 नव+बर 2011 4. उक्त नियमावली, 2000 के अध्याय-3 (विकल्प द्वारा भर्ती) के शीर्षक एवं नियम 9 निम्नलिखित द्वारा प्रतिस्थापित किये जायेगें :—

अध्याय-3 (विकल्प एवं समायोजन द्वारा भर्ती)

''(1) विकल्प द्वारा भर्ती - बिहार वित्त सेवा में कार्यरत व्यक्ति इस सेवा के सदस्य के रूप में आने के लिए अपना विकल्प दे सकते हैं । यह विकल्प सिर्फ दो कोटि के पदों- (ग) उपायुक्त, लेखा कोटि के पद (15600-39100, ग्रेड पे-7600) एवं (घ) संयुक्त आयुक्त, लेखा कोटि के पद (37400-67000 ग्रेड पे-8700) के लिए होगा । यह समायोजन समान वेतनमान में इस सेवा के अन्तर्गत किया जायेगा । ऐसा विकल्प सिर्फ एक बार संशोधन की अधिसूचना के छः महीने के अन्दर वित्त विभाग द्वारा प्राप्त किया जाएगा ।

(2) समायोजन द्वारा भर्ती- बिहार वित्त (राष्ट्रीय बचत) सेवा संवर्ग के पदाधिकारियों को भी प्रशिक्षण के उपरांत इस सेवा के मूल संवर्ग में समायोजित किया जायगा । ''

5. उक्त नियमावली, 2000 के नियम 17 निम्नलिखित द्वारा प्रतिस्थापित किया जायगा :—

'' 17 प्रोन्नति द्वारा भर्ती - (1) इस सेवा के मूल कोटि (बेसिक ग्रेड) से भिन्न सभी पद (आयुक्त का पद एवं अध्याय-3 नियम-9 के द्वारा प्रावधानित मामले तथा अध्याय-4 नियम-11 द्वारा प्रावधानित मामलें को छोड़कर) इस सेवा के सदस्यों को प्रोन्नति देकर भरे जायेंगे ।'''

6. उक्त नियमावली, 2000 की अनुसूची II निम्नलिखित द्वारा प्रतिस्थापित की जायगी :—

''इस सेवा के पदों पर प्रोन्नति के लिए न्यूनतम अर्ह्ररक कालावधि सामान्य प्रशासन विभाग द्वारा, समय-समय पर, निर्गत किए जाने वाले तत्‌संबंधी संकल्प /अधिसूचना के अनुसार होगी।'' 7. नयी अनुसूची का जोड़ा जाना - बिहार लेखा सेवा उक्त नियमावली, 2000 की अनुसूची IV के बाद निम्नलिखित नयी अनुसूची क्रमशः V एवं VI जोड़ी जायगी :—

No. Ko-Pra/stha-19/2011-10562-F—In Exercise of powers conferred by provision to Article 309 of the Constitution of India, Governor of Bihar is pleased to make following amendments in the Bihar Accounts Service Rules, 2000 :-

1. Rule 1of Chapter-1(Preliminary) of the said Rules, 2000 is substituted by the following :—

Short title, applicability and commencement—(i) These rules may be called the Bihar Accounts Service (Amendment) Rules, 2011.

(ii) It shall be applicable to the whole of the State of Bihar. (iii) It shall come into force immediately. 2. Rule 4 of Chapter-1(Preliminary) of the said Rules, 2000 is substituted by the following :-

"Constitution of the Service:—This cadre shall be under the administrative

control of Finance Department. Head of the Department of this shall be

an officer of Indian Administrative Service, Indian Audit & Accounts

Service or any organized Account Service Officer of Government of India.

He shall be designated as Commissioner, Accounts Administration.

Commissioner, Accounts Administration shall be appointed by the

General Administration Department.

There will be mainly four sections of this cadre- Internal Financial Advisor,

Treasury, Provident Fund and Accounts. The list of the posts of this cadre

at different levels is given in schedule V and VI.

The State Government shall decide the number of cadre post from time to time

and can also create additional posts."

3. Rule 6(ii) of Chapter-2(Recruitment) of the said Rules, 2000 is substituted by the following :-

"In case of non-availability of an officer in the cadre at any level, officers of

Bihar Finance Service, Bihar Administrative Service and the Audit Service

may be posted against the vacant post or the vacancies may be filled by

officers on deputation from the office of the Accountant General or any

organized Accounts Service of Government of India."

4. Rule 3 of Chapter-9(Recruitment by Option) and heading of chapter of the said Rules, 2000 is substituted by the following :—

"Chapter-9 (Recruitment by Option and Adjustment)

(i) Recruitment by option- A person serving in the Bihar Finance Service may

exercise his option to be considered as a member of this Service. This

option may be available only for two grades:-

(c) Deputy Commissioner, Accounts (15600-39100, Grade Pay-7600) and

(d) Joint Commissioner, Accounts (37400-67000 Grade Pay-8700).

The adjustment shall be done in equal pay scale in this service. The option

shall be obtained by Finance Department only once within six months

of notification of amendment.

(ii) Recruitment by Adjustment- The Officers of Bihar Finance (National

Saving) Service shall be adjusted in the basic grade post only after

training."

5. Rule 17 of Chapter-5(Recruitment by Promotion) of the said Rules, 2000 is substituted by the following :-

"Recruitment by Promotion- All posts other than those in the basic grade of the

Service (except the post of Commissioner and, by specific matter covered

(cid:18)बहार गजट (असाधारण), 29 uoEcj 2011 by Chapter-3 Rule 9 and Chapter-4 Rule 11) shall be filled by promotion to the basic grade of this Service."

6. Schedule II of the said Rules, 2000 is substituted by the following :-

"Minimum qualifying time for promotion to the posts in this service shall be as

per the Resolution/ Notification of the General Administration Department

in this regard."

7. The schedule 'V' of Bihar Accounts Service Rules 2000 is substituted by the following :-
