सं0 बि०व०से० स्था०-66/05- 3000/प०व०—भारतीय संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये तथा राजस्व विभाग की अधिसूचना संख्या-C/F-1012/55-1635-R दिनांक 30वीं अप्रील, 1955 द्वारा प्रकाशित एवं समय-समय पर यथा संशोधित नियमावली को अवक्रमित करते हुये, बिहार के राज्यपाल, बिहार वन सेवा में नियुक्त व्यक्तियों की भर्त्ती एवं सेवा शर्त्तों कोे विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः-

भाग-1

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ- (1) यह नियमावली बिहार वन सेवा नियमावली 2013 कहलायेगी। (2) यह नियमावली पूरे बिहार राज्य में लागू होगी। (3) यह नियमावली बिहार गजट में प्रकाशन की तिथि से प्रवृत होगी।

2. परिभाषाएंँ- इस नियमावली में जब तक कोई बात विषय अथवा संदर्भ के प्रतिकूल न हो-

(i) 'आयोग' से अभिप्रेत है बिहार लोक सेवा आयोग; (ii) 'सरकार' से अभिप्रेत है बिहार सरकार; (iii) 'प्रधान मुख्य वन संरक्षक' से अभिप्रेत है, पर्यावरण एवं वन विभाग में प्रधान मुख्य वन संरक्षक के पद पर पदस्थापित एवं बल के प्रमुख के रूप में कार्यरत पदाधिकारी;

(iv) 'मुख्य वन संरक्षक' से अभिप्रेत है, क्षेत्रीय मुख्य वन संरक्षक, तथा मुख्य वन संरक्षक के समकक्ष अन्य पदाधिकारी;

(v) 'सेवा का सदस्य' से अभिप्रेत है इस नियमावली के प्रावधानों के अधीन सेवा में नियुक्त कोई व्यक्ति; (vi) 'सेवा' से अभिप्रेत है बिहार वन सेवा; (vii) 'विभाग' से अभिप्रेत है पर्यावरण एवं वन विभाग, बिहार; (viii) 'अनुसूचित जन जाति' से अभिप्रेत है भारतीय संविधान (अनुसूचित जन जातियाँ आदेश-1950) के भाग- II में उल्लिखित जन जातियाँ;

2 (ix) 'अनुसूचित जाति' से अभिप्रेत है भारतीय संविधान (अनुसूचित जातियाँ आदेश- 1950) के भाग-II में उल्लिखित जातियाँ;

(x) 'पिछड़ी जातियों' से अभिप्रेत है बिहार सरकार के द्वारा समय-समय पर पिछड़ी जातियों के रूप में अधिसूचित जातियाँँ;

(xi) 'अत्यंत पिछड़ी जातियों' से अभिप्रेत है बिहार सरकार के द्वारा समय-समय पर अत्यंत पिछड़ी जातियों के रूप में अधिसूचित जातियाँँ;

(xii) 'पिछड़े वर्ग की महिलाओं' से अभिप्रेत है अनुसूचित जन जातियों अनुसूचित जातियों, पिछड़ी जातियों एवं अत्यंत पिछड़ी जातियों की महिलाएं ।

3. (1) नियुक्ति-बिहार वन सेवा के मूल कोटि के पदों पर नियुक्ति निम्नवत की जायेगी :-

(क) इस नियमावली के भाग- II में प्रक्रिया के अनुसार आयोग द्वारा आयोजित प्रतियोगिता परीक्षा के आधार पर सीधी भर्त्ती द्वारा;

(ख) वन क्षेत्र पदाधिकारी, जो वन क्षेत्र पदाधिकारी के रूप में अपनी अपेक्षित सेवा अवधि पूरा कर चुके हो तथा इस नियमावली के भाग- III के अनुसार सेवा के योग्य पाये गये हो, की प्रोन्नति द्वारा;

(2) सेवा मेें पदों की कुल संख्या के पचास प्रतिशत पद प्रोन्नति द्वारा नियुक्ति से तथा पचास प्रतिशत पद सीधी भर्त्ती से भरे जायेगें।

4. बिहार पदाें एवं सेवाओं की रिक्तियाें में आरक्षण (अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गो के लिए) अधिनियम- 1991 एवं उसके अधीन बनाई गयी नियमावली के प्रावधान तथा राज्य सरकार द्वारा समय-समय पर यथाविहित रोस्टर सेवा में नियुक्ति करने तथा प्रोन्नति देने में लागू होंगे।

भाग-II सीधी भर्त्ती द्वारा नियुक्ति। (खुली प्रतियोगिता परीक्षा के माध्यम से) 5. राज्य सरकार सामान्यतया प्रत्येक वर्ष पहली अप्रील को नियम- 3 (2) के अनुसार रिक्तियों की गणना करेगी। रोस्टर क्लीयरेंस के उपरान्त, तदनुसार राज्य सरकार, आयोग को 30 अप्रैल तक रिक्तियों की अधियाचना भेजेगी। अधियाचना की प्राप्ति पर, आयोग प्रत्येक वर्ष, उस रीति से, जिसे वह उचित समझे, प्रतियोगिता परीक्षा के परिणाम के आधार पर सेवा में सीधी भर्त्ती द्वारा भरी जाने वाली रिक्तियों की संख्या की घोषणा करेगा तथा नियम 6 के अधीन पात्र उम्मीदवारों से आवेदन मांगेगा। प्रतियोगिता परीक्षा आयोग द्वारा संचालित की जायेगी। 6. (क) इस सेवा हेतु प्रतियोगिता परीक्षा में शामिल होने के लिये-

(i) किसी उम्मीदवार को परीक्षा-वर्ष के 1 ली अगस्त को 21 वर्ष से कम एवं 30 वर्ष से अधिक आयु का नहीं होना चाहिये। अनुसूचित जातियों, अनुसूचित जनजातियों, पिछड़ी जातियों एवं अत्यन्त पिछड़ी जातियों के उम्मीदवारों को, सरकारी नीति के अनुसार, उम्र सीमा में सुसंगत समय की शिथिलता दी जायेगी। वन प्रक्षेत्र पदाधिकारी के रूप में वनों के क्षेत्र पदाधिकारी के लिए संवर्ग नियमावली में यथा विहित प्रशिक्षित उम्मीदवारों को ऊपरी उम्र सीमा में 5 वर्षो की शिथिलता दी जाएगी।

(ii) उम्मीदवार को अच्छे स्वास्थ्य एवं सुगठित शरीर का होना चाहिये। उसे बिहार वन सेवा के एक सदस्य के रूप में दक्षतापूर्वक कर्तव्यपालन करने में बाधा डालने वाली शारीरिक विकलांगता से मुक्त होना चाहिये। (iii) उम्मीदवार को मान्यता प्राप्त किसी विश्वविद्यालय या समकक्ष से कम से कम एक विषय यथा- वनस्पति शास्त्र, रसायन शास्त्र, वानिकी, भूगर्भ शास्त्र, गणित, भौतिकी, सांख्यिकी एवं प्राणी विज्ञान के साथ स्नातक की डिग्री धारक या कृषि में स्नातक या अभियांत्रिकी में स्नातक डिग्री धारक होना चाहिए।

(ख) ऐसे सरकारी सेवक जो इस पद के लिए योग्य हो, वे अपना आवेदन बिहार सरकारी सेवक (पदों के लिए आवेदन) नियमावली, 1951 के तहत विहित प्राधिकृत पदाधिकारी के माध्यम से देंगे।

7. आवेदन पत्र के साथ कोई भी उम्मीदवार निन्नलिखित अवश्य समर्पित करेगा- (i) नियम 6 के अधीन यथा विहित शैक्षणिक अर्हता का प्रमाण पत्र;

(ii) अंतिम महाविद्यालय/संस्था, जिसमें उसने (पुरूष/स्त्री) अध्ययन किया हो, द्वारा निर्गत चरित्र एवं आचरण का प्रमाण पत्र;

(iii) उम्र का प्रमाण जो सामान्यतया मैट्रिकुलेशन अथवा इसके समकक्ष प्रमाण पत्र की सच्ची प्रतिलिपि होगी।

8. इस भाग के नियम 6 एवं 7 में यथा विहित किसी अपेक्षा के होते हुये भी, आयोग किसी उम्मीदवार से उसकी उम्मीदवारी एवं/अथवा उपयुक्तता के लिए जिसे आवश्यक समझा जाए, अन्य कोई अतिरिक्त प्रमाण पत्र किसी बिन्दु पर भेजने की अपेक्षा कर सकेगा।

9. इस नियमावली के अनूसूची 'क' में विनिर्दिष्ट पाठ्‌यक्रम, जिसे राज्य सरकार द्वारा समय-समय पर पुनरीक्षित किया जा सकेगा, के अनुसार लिखित परीक्षा आयोजित की जायेगी।

10. लिखित परीक्षा में प्राप्त अंकों के आधार पर उम्मीदवारों को साक्षात्कार के लिये बुलाया जायेगा। साक्षात्कार के लिये बुलाये जाने वाले उम्मीदवारों की संख्या, आयोग द्वारा यथा विनिश्चित रिक्तियों के संख्या के3 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 निश्चित अनुपात में होगी। लिखित परीक्षा हेतु न्यूनतम अर्हतांक विभिन्न आरक्षण कोटिवार वही होगा जो सरकार (सामान्य प्रषासन विभाग) द्वारा समय-समय पर निर्धारित किया जायेगा।

11. प्रधान मुख्य वन संरक्षक और/या मुख्य वन संरक्षक या इससे उच्च पंक्ति का भारतीय वन सेवा के पदाधिकारी, आयोग द्वारा साक्षात्कार हेतु गठित बोर्ड के सदस्य होगें।

12. मौखिक जांच परीक्षा में प्राप्त अंक को लिखित परीक्षा के प्राप्तांक में जोड़ा जायेगा तथा दोनों के योग के आधार पर मेधा सूची तैयार की जायेगी।

13. साक्षात्कार के लिये चुने गये उम्मीदवारों को आयोग द्वारा आयोजित शारीरिक जांच से गुजरना होगा जिसके उपरान्त निदेशक, स्वास्थ्य सेवा, बिहार द्वारा गठित चिकित्सा पर्षद (मेडिकल बोर्ड) द्वारा चिकित्सकीय जांच से गुजरना होगा। वैसा उम्मीदवार का चयन, जो शारीरिक जांच में असफल रहता है और/या इस नियमावली से संलग्न परिशिष्ट 'ग' में अपनी उपयुक्तता का चिकित्सकीय प्रमाण पत्र प्राप्त करने में असफल रहता है, नहीं किया जायेगा।

14. शारीरिक योग्यता के निम्नलिखित न्यूनतम मानदंड विहित किये जाते हैं -

15. आयोग द्वारा मेधा के आधार पर इस प्रकार व्यवस्थित ऐसे उम्मीदवारों की सूची, जिन्होंने शारीरिक एवं चिकित्सकीय जांच में अर्हित हो चुके हो, इस सेवा में नियुक्ति हेतु अनुशंसित की जायेगी। आयोग द्वारा अनुशंसित उम्मीदवारों का पैनल एक वर्ष के लिये वैध होगा।

16. नियम 15 के अधीन आयोग द्वारा अनुशंसा मात्र के कारण किसी उम्मीदवार को सेवा में नियुक्ति होने का कोई अधिकार प्रोद्‌भूत नहीं होगा, जबतक कि राज्य सरकार का, ऐसी जांचोपरांत, जैसी आवश्यक समझें, सामाधान न हो जाए कि उम्मीदवार सेवा में नियुक्ति हेतु सभी प्रकार से उपयुक्त है।

17. अंतिम रूप से चयनित उम्मीदवार से राज्य सरकार के साथ विहित प्रपत्र में बाँड/एग्रीमेंट निष्पादित की जायेगी तथा तदुपरांत उनकी नियुक्ति सहायक वन संरक्षक के रूप में 2 वर्ष के लिये परिवीक्षा पर की जायेगी तथा उनसे राज्य सरकार द्वारा यथावधारित मान्यता प्राप्त संस्थानों में दो वर्ष के व्यवसायिक प्रशिक्षण में जाने की अपेक्षा की जायेगी। परिवीक्षा पर नियुक्त सहायक वन संरक्षकाें के नाम को संबंधित संस्थानों में निम्नलिखित दस्तावेजों के साथ भेज दिया जायेगाः-

(क) परिवीक्षा पर नियुक्त प्रत्येक सहायक वन संरक्षक के उम्र का साक्ष्य प्रमाण पत्र;

(ख) परिवीक्षा पर नियुक्त प्रत्येक सहायक वन संरक्षक का नियम 6 क (iii) में यथा विहित शैक्षणिक अर्हता का मूल प्रमाण पत्र;

(ग) नियम 13 के अधीन प्रपत्र 'ग' में निर्गत शारीरिक उपयुक्तता का प्रमाण पत्र; 18. नियम 17 के अधीन परिवीक्षा पर उस प्रकार नियुक्त व्यक्ति यदि उसके अधीन प्रशिक्षण सफलतापूर्वक पूर्ण करने में असफल रहता है तो उस व्यक्ति की परिवीक्षा-अवधि अधिकतम एक साल के लिये बढ़ाई जा सकती है एवं फिर भी यदि वह उक्त बढ़ाई गई अवधि में प्रशिक्षण को पूरा करने में असफल रहता है तो उसकी सेवा सम्पुष्ट नहीं की जायेगी तथा उसकी सेवा समाप्त कर दी जायेगी।

19. नियम 17 के अधीन यथा विहित दो वर्षों की अवधि के भीतर अथवा विस्तारित अवधि के भीतर सफलतापूर्वक प्रशिक्षण पूर्ण होने पर उसके अधीन सहायक वन संरक्षक के पद पर उस प्रकार नियुक्त व्यक्ति की सेवा सम्पुष्ट की जायेगी, यदि और केवल यदि-

(क) उसे राज्य सरकार द्वारा यथा विहित विभागीय परीक्षा में सफल घोषित किया गया हो, एवं (ख) प्रधान मुख्य वन संरक्षक की अनुशंसा से राज्य सरकार को सामाधान हो गया हो कि वह सम्पुष्ट होने योग्य है परन्तु यदि ऐसा व्यक्ति यथाखंड (क) के अधीन सफल घोषित नहीं किया गया हो या खण्ड (ख) के अधीन राज्य सरकार को सामाधान हो गया हो तो उसकी सेवा सम्पुष्ट नहीं की जायेगी एवं उसे सेवोंन्मुक्त कर दिया जायेगा।

20. नियम 17 के अधीन उस प्रकार नियुक्त व्यक्ति, परिवीक्षा की अवधि दौरान, राज्य सरकार द्वारा, समय-समय पर, यथा पुनरीक्षित सहायक वन संरक्षक के पद पर यथा अनुमान्य वेतन एवं भत्ते का हकदार होगा एवं नियम 18 के अधीन उसकी सेवा सम्पुष्ट होने पर परिवीक्षा पर उसकी प्रथम नियुक्ति की तिथि सेवा मेें मूल4 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 नियुक्ति की तिथि मानी जायेगी और वह उक्त तिथि से सेवा के अधीन सभी फायदे के लिए स्वयं हकदार होगा।

भाग - III प्रोन्नति द्वारा नियुक्ति 21. (1) नियम 3 (ख) के अधीन सेवा के मूल कोटि के पद पर वन क्षेत्र पदाधिकारियों की प्रोन्नति द्वारा नियुक्ति पर, बिहार लोक सेवा आयोग के अध्यक्ष या सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा उनकी मेधा-सह-वरीयता के अनुसार विचार किया जायेगा। प्रोन्नति द्वारा नियुक्ति के लिए रिक्तियों की गणना नियम 3 (2) के अनुसार, प्रत्येक वर्ष 1लीं अप्रील को की जायेगी।

(2) आयोग, पर्यावरण एवं वन विभाग द्वारा अग्रेसित दस्तावेजों की समीक्षा कर, मेधा-सह-वरीयता एवं कार्य अभिलेखों, कार्य अनुपालन एवं वार्षिक गोपनीय अभ्युक्तियों के आधार पर, प्रोन्नति द्वारा नियुक्ति हेतु उपर्युक्त वन क्षेत्र पदाधिकारियों की सूची तैयार करेगा।

22. आयोग सेवा में प्रोन्नति द्वारा नियुक्ति हेतु पदाधिकारियों की उपयुक्तता के सम्बंध में अपनी अनुशंसा राज्य सरकार को भेजेगा।

23. सेवा के मूल कोटि के पद पर प्रोन्नति द्वारा नियुक्त होने वाले वन क्षेत्र पदाधिकारियों का अंतिम चयन राज्य सरकार द्वारा नियम 22 के अधीन आयोग की अनुशंसाओं पर विचार करने के बाद किया जायेगा। 24. इस भाग के अधीन प्रोन्नति द्वारा नियुक्त ऐसे पदाधिकारियों को, राज्य सरकार द्वारा यथावधारित मान्यता प्राप्त संस्थानों में, छह सप्ताह के व्यवसायिक प्रशिक्षण लेना होगा।

भाग - IV वरीयता 25. (1) एक साथ सीधी भर्ती द्वारा नियुक्त एवं नियम 18 के अधीन सम्पुष्ट सेवा के सदस्यों की दशा में उनकी आपसी वरीयता उस मेधा क्रम के आधार पर, जिस क्रम में उनके नाम बिहार लोक सेवा आयोग की अंतिम परीक्षा में यथा नियम- 15 के अधीन सफल उम्मीदवारों की सूची में रखा गया हो अवधारित की जायेगी। (2) प्रोन्नति के द्वारा एक साथ सेवा में मूल रूप से नियुक्त वन क्षेत्र पदाधिकारियों की आपसी वरीयता, वन क्षेत्र पदाधिकारी के रूप में धारित उनकी आपसी वरीयता के अनुसार होगी। (3) उस दशा में जहाँ सेवा में नियुक्ति, एक ही वर्ष की रिक्तियों के विरूद्ध दोनों सीधी भर्ती द्वारा एवं वन क्षेत्र पदाधिकारियों की प्रोन्नति द्वारा हुई हो, वहाँ प्रोन्नत सदस्य सीधी भर्ती किये गये सदस्य से वरीय होंगे।

भाग-V वेतन

विभिन्न पदों की संख्या तथा उनका वेतनमान, राज्य सरकार द्वारा समय-समय नियत किया जायेगा। उप वन संरक्षक, वरीय उप वन संरक्षक एवं वन संरक्षक के पद क्रमशः सहायक वन संरक्षक, उप वन संरक्षक एवं वरीय उप वन संरक्षक के प्रोन्नति के पद होंगे।

27. सेवा के सदस्य उप वन संरक्षक एवं पदसोपान के अनुरूप अन्य उच्चतर पदों पर पदों की रिक्ति जिस पर प्रोन्नति दी जानी हो, की उपलब्धता के अनुसार नियम 26 के अधीन प्रोन्नति के पात्र होंगे। उप वन संरक्षक, वरीय उप वन संरक्षक एवं वन संरक्षक के पदों पर प्रोन्नति हेतु न्यूनतम कालावधि क्रमशः 9 वर्ष, 14 वर्ष एवं 19 वर्ष के साथ-साथ जिस पद से प्रोन्नति दी जानी हो उस पर न्यूनतम दो वर्षों की सेवा होगी।

28. इस सेवा का संवर्ग बल तथा संरचना राज्य सरकार द्वारा समय-समय पर आवश्यकतानुसार संशोधित की जा सकेगी।

29. (1) सेवा के वरीयतम वेतनमान में प्रोन्नति की स्वीकृति के लिये बिहार लोक सेवा आयोग के अध्यक्ष या किसी सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति द्वारा चयन किया जायेगा। प्रधान मुख्य वन संरक्षक, बिहार विभागीय प्रोन्नति समिति के सदस्य होंगें। समिति विचारण क्षेत्र में आनेवाले पदाधिकारियाें के सेवा अभिलेख एवं उपयुक्तता को मेधा-सह-वरीयता के सिद्धांत के आधार पर विचार करेगी एवं अपनी अनुशंसा, प्रोन्नति अधिसूचित करने हेतु, विभाग को भेजेगी।5 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 (2) सेवा में अन्य वेतनमानों पर प्रोन्नति देने हेतु विभाग द्वारा यथा अधिसूचित विभागीय प्रोन्नति समिति द्वारा चयन किया जायेगा।

30. राज्य सरकार, इस नियमावली के अधीन विभिन्न प्रावधानों को लागू करने हेतु दिशा-निर्देश, समय-समय पर, जारी कर सकेगी।

31. सेवा के सदस्यों से संबंधित सभी अन्य सेवा के मामले, जो इस नियमावली से आच्छादित न हो, बिहार सेवा संहिता द्वारा शासित होंगे।

32. अनुशासन, नियंत्रण एवं अपील- बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005, समय-समय पर यथासशोंधित, के प्रावधान अनुशासन, नियत्रंण एवं अपील के मामले में, बिहार वन सेवा के सदस्यों पर लागू होंगे।

33. निरसन एवं व्यावृति-(1) इस नियमावली के प्रवृत्त होने की तिथि से, राजस्व विभाग की अधिसूचना संख्या-C/F-1012/55-1635R दिनांक 30 अप्रील 1955 द्वारा प्रकाशित बिहार वन सेवा नियमावली, 1953 ंएवं समय-समय पर यथासंशोधित, निरसित हो जायेगी।

(2) इस निरसन के होते हुये भी निरसित नियमावली द्वारा या के अधीन प्रदत्त किसी शक्ति के प्रयोग में किया गया कोई कार्य अथवा की गई कोई कार्रवाई इस नियमावली द्वारा या के अधीन प्रदत्त शक्तियों के प्रयोग में किया गया या की गई मानी जायेगी मानों यह नियमावली उस दिन प्रवृत थी जिस दिन वह कार्य किया गया अथवा वह कार्रवाई की गई थी।

(3) इस निरसन की किसी बात से इस निरसित नियमावली के अधीन उद्‌भूत कोई अधिकार अथवा उपगत कोई दायित्व या बाध्यता प्रभावित नहीं होगी अथवा प्रभावित हुई नहीं समझी जायेगी ।

अनुसूची-क

बिहार वन सेवा प्रतियोगिता परीक्षा के लिए पाठयक्रम। परीक्षा के लिये निम्नलिखित विषय होंगे। भाषा को छोड़कर सभी विषयों के उत्तर हिन्दी या अंगे्रजी में दिये जा सकते है। प्रत्येक विषय के अंक उसके सामने दर्शाये गये हैं।

(क) कृषि एवं कृषि अभियंत्रण। (ख) कृषि एवं वानिकी। (ग) कृषि एवं पशुपालन एवं पशु चिकित्सा विज्ञान। (घ) रसायन शास्त्र एवं रासायनिक अभियंत्रण। (च) गणित एवं सांख्यिकी। (छ) अभियंत्रण के विषयों में से एक से अधिक नहीं।

जब कि बिहार के महामहिम राज्यपाल ने अपने एवं अपने पदोत्तरवर्ती एवं समनुदेशिती को (करार में तय की गई शर्ताे के अध्यधीन जो इसके साथ एक तिथि में है तथा जिसके प्रथम भाग का .................. करार ................. के बीच तथा दूसरे भाग के उक्त एवं बिहार के महामहिम राज्यपाल के बीच) उक्त को वन विज्ञान, वन कार्य एवं वन प्रशासन से संबंधित सभी विषयों को राज्य वन सेवा महाविद्यालय में पढ़ाने का वचन लिया है तो उक्त महाविद्यालय के प्रधानाचार्य द्वारा उक्त ............. को पढ़ाया जाना आवश्यक समझा जाना चाहिये तथा वे इस बात पर भी सहमत हुये हैं कि उक्त महाविद्यालय में उनके ठहरने के दौरान उन्हें ............... रूपये की दर से भुगतान किया जाय एवं जब कि बिना किसी ऐसे भत्ते को जोड़े हुये इस शिक्षा पर वार्षिक खर्च का आकंलन ............. रूपये प्रति महिना है जिसे लिया जायेगा तथा इन विलेखों के प्रयोजन से उक्त खर्च को वास्तविक मानने पर एतत्‌ द्वारा सहमति हुई है तथा जब कि उक्त ... ........... को उक्त राज्यपाल एवं उनके पदोत्तरवर्ती अथवा समनुदेशिती द्वारा ऐसी शिक्षा एवं वेतन देने पर विचार करने के समय उक्त ............... ने उक्त राज्यपाल एवं उनके समनुदेशिती के साथ करार किया है कि उक्त महाविद्यालय में शिक्षा प्राप्त करने के बाद आवश्यकतानुसार, बिहार सरकार के पर्यावरण एवं वन विभाग में कम से कम 5 वर्ष तक सेवा करेगा तथा इस सम्पूर्ण अवधि में वह तत्परतापूर्वक एवं दक्षतापूर्वक सभी कार्य सम्पन्न करेगा तथा उक्त विभाग के अधिकारी के रूप में उससे अपेक्षित सभी कार्य सम्पन्न करेगा, एवं जबकि उक्त राज्यपाल की सहमत हुये हैं कि उक्त ............. को इस सेवा के लिये कम से कम ............... प्रति महीने की दर से भुगतान किया जायेगा बशर्ते कि उक्त .............. ने उक्त संस्थान के अध्यक्ष के संतोषप्रद रूप में पाठ्‌यक्रम पूरा किया हो तथा वह अपने वेतन श्रेणी के अनुसार विभाग के नियमों एवं विनियमों के अधीन उस समय में अधिकारियों को विभाग द्वारा दी जाने वाले वेतन, पेंशन एवं प्रोन्नति का हकदार होगा एवं जब कि उक्त राज्यपाल, उनके पदोत्तरवर्ती एवं समुनदेशिती को हुये हानि एवं क्षति जो उक्त ................. के अपने अध्ययन को अथवा राज्यपाल उनके पदोत्तरवर्ती एवं समनुदेशिती की सेवा को पूरा करने से पूर्व ही बर्खास्त कर दिये जाने अथवा ऐसे अध्ययन को पूरा करने की तिथि से 5 वर्ष बीतने से पूर्व ही बिना अनुमति के महाविद्यालय छोड़कर जाने से उन्हें उक्त हानि एवं क्षति भुगतना पड़ सकता है, तत्संबंधित सुरक्षा एवं क्षतिपूर्ति प्राप्त करने हेतु तथा उक्त राज्यपाल उनके पदोत्तरवर्ती एवं समनुदेशिती को सम्पूर्ण व्यय (जिसमें उक्त को उपरोक्त महाविद्यालय में किया जाने वाला भुगतान भी सम्मिलित है) जो कि उपरोक्त राज्यपाल उनके पदोत्तरवर्ती एवं समनुदेशिती द्वारा उक्त .............. को उक्त महाविद्यालय में शिक्षा उपलब्ध कराने हेतु वहन किया गया है, के प्रतिदाय को प्राप्त करने के लिये तथा उपरोक्त भुगतान एवं शिक्षा पर जो उक्त ........... को एवं महाविद्यालय को उक्त ................... के उक्त महाविद्यालय में नामांकन हेतु एक शर्त के रूप में दिया गया। यह भी करार किया गया है कि उक्त ............. एवं उक्त ............... एवं उपरोक्त लिखित एकरारनामा विहित शर्तो के अध्यधीन निष्पादित करें। अब उपरोक्त लिखित एकरारनामा अथवा बाध्यता का शर्त यह है कि यदि उक्त ................. उस महाविद्यालय में भली-भाँति निष्ठापूर्वक एवं तत्परतापूर्वक अध्ययन करने उसे पूरा करता है तथा उक्त वन सेवा के लिये अर्हता प्राप्त करता है तथा उस महाविद्यालय में अध्ययन कार्य पूरा करने के उपरान्त आवश्यकता पड़ने पर उक्त राज्यपाल, उनके पदोत्तरवर्ती एवं समनुदेशिती के बिहार सरकार के पर्यावरण एवं वन विभाग में कम से कम 5 वर्ष तक सेवा देगा तथा इस सम्पूर्ण अवधि के दौरान सभी कार्य तत्परतापूर्वक एवं दक्षतापूर्वक करेगा तथा उस विभाग के अधिकारी के रूप में उससे अपेक्षित सभी कर्त्तव्यों का निर्वहन करेगा तथा अपने एकरारनामा एवं एतद्‌ द्वारा7 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 तिथि के करार से संतुष्ट करेगा और यदि उक्त ................. और उनमें से कोई एक, उनके अथवा उनके उत्तराधिकारियों में से कोई निष्पादक प्रशासक एवं प्रतिनिधि भली-भाँति एवं सत्यनिष्ठा से उक्त राज्यपाल, उनके पदोत्तरवर्ती एवं समनुदेशिती को उस हानि एवं क्षति की पूर्ति करेगा जो उक्त .................. उस महाविद्यालय की अवधि में अथवा सरकारी सेवा में बर्खास्त हो जाने अथवा बिना अनुमति के शिक्षा सम्पूर्ण किये बिना उस महाविद्यालय को छोड़ देने अथवा उक्त राज्यपाल, उनके पदोत्तरवर्ती अथवा समनुदेशिती की सेवा को उनके सम्पूर्ण होने की तिथि से 5 वर्ष पूर्व ही छोड़ देने के कारण हुआ हो तथा उपरोक्त इस प्रकार की किसी भी बर्खास्तगी अथवा बिना अनुमति के छोड़ने पर उपरोक्त राज्यपाल, उनके पदोत्तरवर्ती अथवा समनुदेशिती को उक्त ............... के उस महाविद्यालय में हुए शिक्षण पर खर्चे (जिसमें उपरोक्त किये जाने वाले मासिक खर्चे भी शामिल हैं) का भी भुगतान करेगा और तब उपरोक्त लिखित एकरारनामा शून्य करार दिया जायेगा अन्यथा वह पूरी मान्यता एवं क्षमता से कायम रहेगा। परन्तु यह भी कि यह स्पष्ट रूप से करार पाता है तथा उद्‌घोषित किया जाता है कि यह विलेख महामहिम राज्यपाल, बिहार के आदेश के अधीन उक्त ................. के लोक कर्तव्य के निर्वहन के लिये तथा एक ऐसे कार्य के रूप में माना एवं समझा जाता है जिसमें लोग भारत के विधान परिषद्‌ के 1872 के अधिनियम IX की धारा 74 के तात्पर्य के अधीन हितबद्ध है।

इस विलेख के पक्षकारों ने गवाह के रूप में यहां पर अपना हस्ताक्षर एवं मुहर आज एवं इस वर्ष दिया।

(नियम 17)

अनुबंध

अनुबंध के विषय जो कि आज दिन .............. वर्ष ................ दो हजार ........... को प्रथम अंश तथा उक्त द्वितीय अंश के प्रतिपाल्य तथा बिहार महामहिम राज्यपाल के बीच तय पाये गये। जिसके द्वारा प्रत्येक पक्षकार द्वारा जहाँ तक कि एतत्‌ पश्चात दिये गये शर्तो का निम्न रूप से अनुपालन किया जाना है न कि अपने प्रसंविदा का दूसरे के साथ प्रदर्शन-

1. उक्त .............. एतद्‌ द्वारा अपनी इच्छा एवं सहमति से राज्यपाल, उनके पदोत्तरवर्ती एवं समनुदेशिती के बीच हुये इस अनुबंध को निष्पादन करके उसके द्वारा प्रमाणित करना कि उक्त .............. महाविद्यालय के ................ वर्ष के पाठयक्रम के सम्पूर्ण विहित अवधि के दौरान तत्परतापूर्वक, निष्ठापूर्वक अपने अध्ययन का अनुसरण करेगा तथा बिहार सरकार की वन सेवा में अर्हता हासिल करने के लिये अपने तरफ से अधिकतम प्रयास करेगा।

2. उक्त .................. उक्त महाविद्यालय में अपना अध्ययन समाप्त करने के पश्चात आवश्यकतानुसार राज्यपाल, उनके पदोत्तरवर्ती, समनुदेशिती की सेवा में बिहार सरकार के पर्यावरण वन विभाग में कम से कम 5 साल तक रहेगा तथा उक्त सम्पूर्ण अवधि में उक्त विभाग के एक अधिकारी के रूप में उससे अपेक्षित सभी कार्यो का निर्वहन तत्परतापूर्वक एवं दक्षतापूर्वक करेगा।

3. राज्यपाल स्वयं, उनके पदोत्तरवर्ती एवं समनुदेशिती उक्त ............. को राज्य वन सेवा महाविद्यालय में वन विज्ञान, वन कार्य एवं वन प्रशासन से संबंधित सभी मामलों में जिसे विज्ञान माना जाता हो तथा उक्त महाविद्यालय के अध्यक्ष द्वारा उक्त के लिये आवश्यक समझा जाय शिक्षा देने का वचन देते हैं। 4. उस महाविद्यालय में अध्ययन के दौरान ठहरने के क्रम में राज्यपाल .............. रूपये प्रति महीने की दर से भुगतान करेंगें जिसे बढ़ाया जा सकता है बशर्ते कि उक्त महाविद्यालय के प्रधानाचार्य उसके कार्य आचरण से संतुष्ट हों तथा तत्पश्चात बशर्ते कि उक्त बिहार में सेवा में सीधी नियुक्ति हेतु लागू वर्तमान नियमों का पालन करता हो तथा तत्पश्चात उक्त पर्यावरण एवं वन विभाग के एक अधिकारी के रूप में निष्ठापूर्वक एवं तत्परतापूर्वक कम से कम ........... रूपये प्रति महीने पर सेवा देगा बशर्ते कि उक्त ........... में उक्त संस्थान के अध्यक्ष के संतोषप्रद रूप में पाठ्‌यक्रम को पूरा किया हो तथा उक्त अपने वेतन के आधार पर उक्त विभाग के अधिकारी को अनुमान्य वेतन, पेंशन एवं प्रोन्नति से संबंधित सभी अधिकार का उक्त विभाग के नियम एवं विनियमों के अधीन उस समय के लिये हकदार होगा। 5. अंत में, एतद्‌ द्वारा यह अनुबंधित एवं उद्‌घोषित किया जाता है कि राज्यपाल उनके पदोत्तरवर्ती अथवा उनके समनुदेशिती उक्त .................. को उक्त सेवा के दौरान महाविद्यालय में पाठ्‌यक्रम को पूरा करने की अवधि के दौरान उसके द्वारा किये गये किसी तरह की लापरवाही, कर्तव्य निर्वहन करने में असफल रहना, बीमारी अथवा अवज्ञाकारिता या दुःव्यवहार जिसके लिये उक्त महाविद्यालय के प्रधानाचार्य अथवा मुख्य वन संरक्षक द्वारा निर्गत प्रमाण पत्र ही इस अनुबंध को निरस्त करने तथा उसे उस महाविद्यालय से बर्खास्त करने अथवा उक्त विभाग की सेवा से बर्खास्त करने अथवा दोनों के लिये निर्णयात्मक साक्ष्य होगा तथा ऐसे मामले में उक्त एतद्‌ द्वारा स्वीकृत किसी भी सुविधा का हकदार नहीं8 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 होगा तथा उक्त राज्यपाल, उनके पदोत्तरवर्ती अथवा समनुदेशिती को प्रतिदाय (जिसमें उक्त .......... को किया जाने वाला प्रति महीना भुगतान जो कि उसे उपरोक्त महाविद्यालय में ठहरने के दौरान मिलना था) संबंधी सारे खर्चे जो कि राज्यपाल उनके पदोत्तरवर्ती अथवा समनुदेशिती द्वारा उक्त ............. के शिक्षा के उस महाविद्यालय में ठहरने के दौरान खर्च सहित (उक्त भुगतान सहित) वहन किया गया, दिया जाना (वापस किया जाना) है जो इन विलेखों के प्रयोजन हेतु लिये जाने वाले ...................... रूपये हैं। 6. इस अनुबंध को उक्त ................ द्वारा अभिपुष्ट किया जाना है जब वह अपनी वयस्कता प्राप्त कर ले .............................. इस विलेख के गवाह के रूप में उक्त पक्षकारों ने अपने-अपने हस्ताक्षर एवं मुहर आज उपरोक्त लिखित वर्ष को किये।

चिकित्सा प्रतिवेदन

चिकित्सा परीक्षक के दिशा निर्देशन के लिये निम्नलिखित संकेत दिये जाते हैंः- ऐसे किसी व्यक्ति को लोक सेवा में प्रवेश हेतु अयोग्य माना जायेगा जो सरकार अथवा नियोक्ता प्राधिकार, जैसा भी मामला हो, के संतोषप्रद रूप में यह स्पष्ट नहीं कर दें कि उन्हें ऐसी कोई बीमारी अथवा शारीरिक गठन से संबंधित अस्वस्थता अथवा शारीरिक अशक्तता हो जिसके कारण वह उस सेवा के अयोग्य हो, अथवा होने वाला हो।

आयोग का यह निवेदन है कि इस तथ्य को समझा जाना चाहिये कि उपयुक्तता के साथ भविष्य एवं वर्तमान दोनाें जुड़े हैं तथा चिकित्सकीय जांच का मुख्य उद्‌देश्य लगातार प्रभावकारी सेवा से है तथा स्थायी नियुक्ति वाले उम्मीदवारों के मामले में उनके अकाल मृत्यु होने की स्थिति में उन्हें जल्द पेंशन अथवा भुगतान दिये जाने को रोकना है। साथ ही साथ इस तथ्य पर भी गौर किया जाना है कि एक उम्मीदवार की उम्मीदवारी को रद्‌द करने की सलाह केवल उसके शरीर में किसी लघु दोष की वजह से नहीं दी जानी चाहिये जो कि उसके अनवरत प्रभावकारी सेवा में बाधा डालता हो।

प्रपत्र भरने से पूर्व उम्मीदवार से यह सुनिश्चित कर लिया जाना चाहिये कि क्या कि पूर्व में किसी विधिवत गठित भारत सरकार के चिकित्सा प्राधिकार अथवा अन्यत्र सरकारी सेवा के लिये उसे अयोग्य ठहराया गया है।

(क) उम्मीदवार का कथन और उद्‌घोषणा चिकित्सकीय जांच से पूर्व उम्मीदवार निम्न अपेक्षित कथन दें एवं उससे संलग्न उद्‌घोषणा पर अनिवार्य रूप से हस्ताक्षर करें। उसका ध्यान विशेषकर निम्नलिखित चेतावनी पर आकृष्ट किया जाता हैः-

अथवा (ख) दुर्घटना जनित कोई अन्य जिसमें परिरोध अपेक्षित हो अथवा कोई चिकित्सकीय या शल्य चिकित्सा अपेक्षित हो? शरीर पर कोई स्थायी कुप्रभाव अथवा विकलांगता का उल्लेख करें।

4. आपका अंतिम टीकाकरण कब हुआ था? 5. क्या आप अथवा आपके कोई संबंधी यक्ष्मा, गण्डमाला, गठिया, अस्थमा, मूच्र्छा मिर्गी अथवा पागलपन से ग्रसित हुये है?

BIHAR FOREST SERVICE RULES 2013

No. bi.va.se (estab.)-66/05-3000 /E.&F.—In exercise of the powers conferred by the proviso to Article 309 of Constitution of India and in supersession of the rules published by the Revenue Department Notification No. C/F-1012/55-1635-R dated- 30th of April, 1955, as amended from time to time the Governor of Bihar is pleased to make following rules regulating recruitment to and the conditions of service of persons appointed to the Bihar Forest Service:-

PART I

1. Short title, Extent and commencement.- (1) These rules shall be called the BIHAR FOREST SERVICE RULES, 2013

in the Bihar Gazette.

2. Definitions .- In these rules, unless there is anything repugnant to the subject or context- (i) "Commission" means the Bihar Public Service Commission; (ii) "Government" means the Government of Bihar; (iii) "Principal Chief Conservator of Forest" means Officer posted on the post of Principal Chief Conservator of Forest and working as "Head of the force" in Environment and Forest Department;

(iv) "Chief Conservator of Forest'' means Regional Chief Conservator of Forest, Chief Conservator of Forest and other officers equivalent to "Chief Conservator of Forest''11 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 (v) "Member of the Service' means a person appointed to the service under the provisions of these rules;

(vi) "Service" means the Bihar Forest Service. (vii) "Department" means the Department of Environment and Forests, Government of Bihar

(viii) "Scheduled Tribes' means Tribes mentioned in Part-II of the Constitution of India (Scheduled Tribes Order-1950)

(ix) "Scheduled Castes" means Castes, mentioned in Part-II of the Constitution of India (Scheduled Castes, Order-1950)

(x) "Backward Castes" means castes notified as Backward Castes from time to time by the Government of Bihar.

(xi) "Extremely Backward Castes" means castes notified as Extremely Backward Castes from time to time by the Government of Bihar.

(xii) "Women of the Backward Class" means and includes women of Scheduled Castes, Scheduled Tribes, Extremely Backward Castes and Backward Castes.

3. Appointment . - (1) The appointments to the Posts of Basic Grade of Bihar Forest Service shall be made as follows:- (a) By direct recruitment in accordance with the procedure in Part II of these rules on the basis of a competitive examination to be held by the Commission; (b) By promotion of Range Officers of Forests who having completed the requisite length of service as Range officer of Forest, has been found fit for the service in accordance with Part III of these Rules.

(2) Fifty percent of the total number of posts in the service shall be filled up by appointment by promotion and fifty percent by direct recruitment.

4. Reservation .- The provisions of the Bihar Reservation of Vacancies in posts and Services (for Schedule Castes, Schedule Tribes and other Backward Classes) Act, 1991 and the Rules made thereunder and roster as prescribed by the State Government from time to time shall be applicable for making appointment to and for granting promotions in the service.

PART II APPOINTMENT BY DIRECT RECRUITMENT (THROUGH OPEN COMPETITIVE EXAMINATION) 5. The State Government shall calculate vacancies generally every year as on the 1st of April as per rule 3 (2). After obtaining Roster Clearance the Government will send requisition according to reservation roster to the Commission by 30th of April. On receipt of such requisition, the Commission shall announce, each year, in such manner as it thinks fit, such requisitioned vacancies in the service to be filled up by direct recruitment on basis of the result of a Competitive Examination and shall invite application from candidates eligible under Rule 6. The Competitive Examination will be conducted by the Commission.

6. (A) For appearing in the Competitive Examination for this Service,

(i) A candidate must not be less than 21 years and more than 30 years of age as on the 1st of August of the year of examination. Relaxation in age limit for candidates of Scheduled Castes and Scheduled Tribes, backward caste and extremely backward castes will be given as per the policy of Government Relaxation of 5 [five] years in upper age limit shall be given to the candidates trained as Range officer of Forests, as prescribed in the Cadre Rules for Range officer of Forests.

(ii) A candidate must be of sound health and good physique. He or she should be free from any physical infirmity likely to create hindrance in performance of the duties efficiently as a member of the Bihar Forest Service;

(iii) A candidate must hold a Bachelor's degree with at least one of the subjects, namely, Botany, Chemistry, Forestry, Geology, Mathematics, Physics, Statistics and Zoology, or a Bachelor's degree in Agriculture, or in Engineering, of any recognized University or equivalent.

(B) The State Government servant who is eligible for the post shall submit his/her application through the prescribed authorized officer under the Bihar Government Servant (Application for the Posts) Rule, 1951.

7. With application form, a candidate must submit the following:-

(i) Certificate of educational qualification as prescribed under Rule 6; (ii) Certificate of character and conduct issued from the last College / Institute he / she had studied at;

(iii) Certificate of age, which will ordinarily be the true copy of Matriculation certificate or its equivalent certificate.

8. Not withstanding any of the requirements as prescribed in Rule-6 and 7 of this part, the Commission may require a candidate at any point to furnish any such other additional certificate(s), which it may deem necessary for his/her candidature and/or suitability.

9. The written examination shall be held according to the syllabus specified at Schedule A to these rules which may be revised by the State Government from time to time.

10. Candidates will be called for a viva- voce test on the basis of marks obtained at the written examination. The number of candidates called for viva -voce will be in a particular ratio to the number of vacancies as decided by the Commission. The minimum qualifying marks for different reserved categories in the written test will be same as decided by the Government (General Adminstrative Department) from time to time.

11. The Principal Chief Conservator of Forest and/or an officer of the Indian Forest Service of the rank of Chief Conservator of Forests or above shall be a member of the Board constituted by the Commission for Viva-Voce.

12. The marks obtained at the viva- voce test shall be added to the marks obtained at the written examination and the merit list will be prepared based on the aggregate of marks obtained in the written examination and the viva-voce.

13. Candidates selected for interview shall have to undergo physical test conducted by the Commission followed by a medical examination by a Medical Board constituted by the Director, Health Services, Bihar. A candidate, who fails to qualify the physical test and/or fails to obtain a Medical Certificate of his fitness in Form C to these rules, shall not be selected.

15. The list of candidates so arranged in accordance with merit, who have qualified the physical test and medical examination, shall be recommended by the Commission for appointment to this service. The panel recommended by the Commission will be valid for a period of one year.

16. No right to be appointed to the service shall accrue to a candidates for the sole reason of being recommended by the Commission under Rule-15 until the State Government is satisfied on enquiry as may be considered necessary, that the candidate is suitable in all respects for appointment to the Service.

17. Finally selected candidates shall be required to execute a bond/agreement in prescribed Form to the State Government and there after they shall be appointed as Assistant Conservator of Forests on probation for a period of two years and shall be required to undergo a two years professional training at the recognized institutes as determined by State Government. Names of the Assistant Conservator of Forests appointed on probation shall be sent to the concerned institutes alongwith following documents-

(a) Certificate of age of each Assistant Conservator of Forests appointed on Probation. (b) Original Certificate of educational qualification as prescribed under rule- 6 A (iii) of each Assistant Conservator of Forests appointed on Probation. (c) A certificate of Physical fitness as issued in Form C under Rule-13.

18. In case the person so appointed on probation under Rule-17 fails to successfully complete the training thereunder the period of pobation of such person may be extended for a maximum period of one year and in the event such person fails to successfully complete the training thereunder within the extended period his services shall not be confirmed and he shall be discharged from the services. 19. On successful completion of the training within the period of two years or within such extended period as provided under Rule-17 the service of a person so appointed on the post of Assistant conservator of Forests thereunder shall be confirmed, if and only if,

(a) He has been declared successful in the departmental examination as prescribed by the State Government and

(b) The State Government is satisfied with the recommendations of the Principal Chief Conservator of Forest that he is fit to be confirmed

Provided that in case such person is not declared successful as under Clause (a) or the State Governmement is not satisfied under Clause (b) his service shall not be confirmed and he shall be discharged from service.

PART III APPOINTMENT BY PROMOTION 21. (1) Under rule 3 (b) appointment by promotions of Range Officers of Forest to the basic grade post in the service shall be considered in accordance with merit- cum-seniority on the recommendation of the Departmental Promotion Committee constituted under Chairmanship of the Chairman / Member of the Bihar Public14 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 Service Commission. Vacancies for appointment by promotion would be calculated each year as on 1st of April as per Rule-3 (2). (2) After scrutinizing the documents forwarded by the Environment and Forest Department, the Commission shall, on the basis of merit-cum-seniority and their service records, work performance and annual confidential remarks, prepare the list of Range Officers of Forest suitable for appointment by promotion to the Basic grade post of the service.

22. The Commission shall send its recommendation to the State Government with regard to the suitability of the officers for appointment by promotion to the service. 23. The final selection of the Range Officers of Forests to be appointed by promotion to the Basic grade post of the Service shall be made by the State Government after considering the recommendations of the Commission under Rule 22.

24. Such officers appointed by promotion under this part will have to undergo a six week professional training at the recognized institutes as determined by State Government.

PART IV SENIORITY 25 (1) In case of members of the Service appointed by direct recruitment at the same time and confirmed under rule-18 their inter-se seniority shall be determined in order of merit in which their names are placed in the list of successful candidates as under Rule-15 at the final Examination of the Bihar Public Service Commission. (2) The inter-se seniority of Range officers of Forests substantively appointed to the Service by promotion at the same time, shall be in accordance with their seniority inter- se held as Range Officer. (3) In case where appointments are made both by direct recruitment and by promotion of Range officers against vacancies of same year, the promoted member shall be senior to the direct recruited members.

PART V PAY 26. Different Posts and hierarchy of posts of the member of the Bihar Forest Service

The Number of different posts and their pay scale shall be fixed by State Government from time to time. The posts of Dy. Conservator of Forests, Senior Dy. Conservator of Forests and Conservator of Forests would be the promotional posts of Assistant Conservator of Forests, Dy. Conservator of Forests and Senior Dy. Conservator of Forests respectively.

27. Member of the Service shall be eligible for promotion to the post of Deputy Conservator of Forests and to the next higher posts as per the hierarchy of posts under Rule-26 as per the availability of vacant posts to which promotion is to be granted. The minimum length of service for promotion to the posts of Deputy Conservator of Forests, Senior Deputy Conservator of Forests and Conservator of Forest shall be 9 years, 14 years and 19 years respectively alongwith minimum 2 years of service on the post from which the promotion is to be granted.

28. The strength and the structure of the cadre of the Service may be amended from time to time as per the requirement by the State Government.

29. (1) For granting promotion in the highest pay scale of the Service, selection shall be made by a Departmental Promotion Committee constituted under the Chairmanship of the Chairman / Member of the Bihar Public Service Commission. The Principal Chief Conservator of Forests shall be a member of the Departmental Promotion Committee. The committee shall consider the service record and eligibility of the officers in the zone of Consideration on the basis of principle of merit-cum-seniority and send its recommendations to the department for notifying promotion.

(2) For granting promotion to other pay scales of the service, selection shall be made by a Departmental Promotion Committee, as notified by the Department. 30. The state government, from time to time may issue guidelines for implementing different provisions under these rules.

31. All other service matters relating to the members of the service not expressly covered by these rules will be governed by the Bihar Service Code.

32. Discipline, Control and appeal .- The provision of the Bihar Government servant (Classification, Control and Appeal) Rrules 2005 as amended from time to time shall apply to the Members of the Bihar Forest Service in matter of discipline, control and appeals.

33. Repeal and Savings.- (1) With effect from the date of commencement of this Rule the Bihar Forest Service Rules, 1953 published vide notification NO- C/F- 1012/55-1635R Dated 30th of April 1955 of the Revenue Department, as amended from time-to-time, shall stand repealed. (2) Not withstanding such repeal, any thing done or any action taken in exercise of any power conferred by or under the repealed Rules shall be deemed to have been done or taken in the exercise of powers conferred by or under this Rule, as if this Rule was in force on the day on which such thing was done or action was taken. (3) Nothing in the repeal shall affect or be deemed to affect any right acrued or any liability or obligation incurred under the repealed rules.

Medical Reports

The following guidelines are given for the Medical Examination:- A person will be deemed unfit for entry in the public Service who shall not satisfy the Government or the appointing authority, as the case may be, that he has no such diseases, or illness related to physical built-up or physical infirmity rendering him, or likely to render him unfit for this service.

The Commission desires that there should be understanding of the fact that the present and future both are linked with the suitability and the main purpose of medical examination is to ensure continuous service in perpetuity and to avoid payment or sanctioning pension consequent to the premature death in case of the candidate having permanent appointment. At the same time it is also to be noted that rejection of a candidate should not be advised merely on account of a minor defect in his body which does not create any hindrance in rendering perpetual and effective service.

Before filling up the form it should be ascertained from the candidate whether he has been previously held unfit by a lawfully constituted medical authority of Govt. of India or a Govt. service elsewhere.

(a) Candidate's Statement and Declaration. The candidate must make the statement on the following prior to his medical examination and must sign declaration appended thereto. His attention is specially drawn towards the instruction noted below:-
