सं0 6/एन0-07-35/2010 (अंश)-439(6)—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अन्तर्गत, महिला स्वास्थ्य कार्यकर्त्ता (ए.एन.एम.) संवर्ग में नियुक्ति, प्रोन्नति एवं सेवा शर्तो को अवधारित करने के लिए निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ। - (1) यह नियमावली ''बिहार महिला स्वास्थ्य कार्यकर्त्ता (ऑक्जीलियरी नर्स मिडवाईफ) संवर्ग नियमावली, 2013'' कही जा सकेगी।

2. इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। 3. यह तुरन्त प्रवृत होगी। 2. परिभाषाएँ। - जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में- (1) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; (2) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; (3) 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित जिला के असैनिक शल्य चिकित्सक-सह-मुख्य चिकित्सा पदाधिकारी;

(4) 'ए0एन0एम0' से अभिप्रेत है ऑक्जीलियरी नर्स मिडवाईफ; (5) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (6) 'संवर्ग' से अभिप्रेत है बिहार महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) संवर्ग; (7) 'परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट; तथा (8) 'मान्यता प्राप्त संस्थान' से अभिप्रेत है भारतीय नर्सिग परिषद से ए0 एन0 मिडवाइफरी कोर्स के लिए मान्यता प्राप्त संस्थान ।

3. संवर्ग का गठन। - बिहार महिला स्वास्थ्य कार्यकर्त्ता का संवर्ग जिला स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों की संख्या तथा संवर्ग के पदों की कुल संख्या उतनी होगी जितनी सरकार द्वारा स्वीकृत की गयी हो। 4. संवर्ग का पदसोपान। - इस संवर्ग की विभिन्न कोटियाँ एवं पदसोपान परिशिष्ट-1 के अनुसार होंगे। 5. भर्ती।- इस संवर्ग में नियुक्ति मूल कोटि के पद पर सीधी भर्ती से, आयेाग की अनुशंसा के आधार पर होगी।2 (cid:18)बहार गजट (असाधारण), 25 अ+तूबर 2013 6. अहर्ताएँ। - (1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता मान्यता प्राप्त संस्थान से भारतीय नर्सिंग परिषद्‌ द्वारा समय-समय पर, अवधारित अवधि का ए0एन0 मिडवाईफरी में प्रशिक्षण कोर्स में उत्तीर्णता एवं तत्संबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा।

(2) सीधी भर्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की एक अगस्त को उम्र के अवधारण के लिए कट ऑफ डेट माना जायेगा।

7. भर्ती की प्रक्रिया। - (1) नियुक्ति प्राधिकार वर्ष की 1 अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर और रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा।

(2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन पत्र आमंत्रित करेगा और निम्नलिखित के आधार पर मेधासूची तैयार करेगा :-

ः- 50 अंक ः- 10 अंक (क) ए0एन0एम0 कोर्स की परीक्षा में प्राप्तांक के लिए (ख) उच्चतर डिग्री के लिए (ग) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक) (घ) साक्षात्कार के लिए

ः- 25 अंक ः- 15 अंक -----------

कुल :-100 अंक टिप्पणी। - ए0 एन0 एम0 के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा कर करना होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50 प्रतिशत अंक प्राप्त किया गया हो तो उसे 50 % x 0.5 = 25 अंक दिये जायेंगे। (3) आयोग उपर्युक्त उप-नियम (2) के आधार पर तैयार मेधा - सूची और अधियाचित रिक्तियों के अनुरूप, आरक्षण कोटिवार, अनुशंसा नियुक्ति प्राधिकार को भेजेगा जिसके आधार पर नियुक्ति पर विचार किया जा सकेगा। (4) साक्षात्कार के लिए प्रक्रिया का निर्धारण आयोग के द्वारा अवधारित की जायेगी। 8. परिवीक्षा अवधि। -नियुक्ति के उपरान्त परिवीक्षा अवधि दो वर्षो की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसी महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) को सेवा-मुक्त कर सकेगा।

9. विभागीय परीक्षा। - महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) को विभाग द्वारा आयोजित विभागीय परीक्षा उत्तीर्ण करनी होगी। विभागीय परीक्षा का पाठयक्रम विभाग द्वारा अवधारित किया जायेगा।

10. सम्पुष्टि। - परिवीक्षा अवधि में संतोषजनक सेवा होने और विभागीय परीक्षा उत्तीर्ण करने पर महिला स्वास्थ्य कार्यकर्त्ता (ए0 एन0 एम0) को सेवा में सम्पुष्ट किया जा सकेगा।

11. वरीयता। - महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) की आपसी वरीयता आयोग द्वारा तैयार मेधासूची के अनुसार अवधारित की जायेगी।

12. परिशिष्ट - 1 में उल्लिखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से नियुक्त एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।

13. प्रोन्नति के सोपान। - (1) सेवा में सम्पुष्ट महिला स्वास्थ्य कार्यकत्र्ता (ए0 एन0 एम0) को, रिक्ति की उपलब्धता के अधीन रहते हुए एवं वरीयता-सह-योग्यता के अनुसार परिशिष्ट-1 में उल्लिखित उच्चतर पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा।

(2) प्रोन्नति पर विचारार्थ, सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित कालावधि का पूरा होना आवश्यक होगा। प्रोन्नति संबधी और चारित्री या पी0ए0आर0 आरोप/ विभागीय कार्यवाही/ आपराधिक कार्यवाही आदि संबंधी सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन, प्रोन्नति पर विचार करते समय आवश्यक होगा।

14. विभागीय प्रोन्नति समिति। - (1) प्रोन्नतियाँ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर होंगी।

(2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा। 15. आरक्षण। - सरकार के आरक्षण अधिनियम के प्रावधानों और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. परिधान (यूनिफार्म)। - महिला स्वास्थ्य कार्यकत्र्ताओं के लिए कत्र्तव्य के दौरान विभाग द्वारा निर्धारित परिधान धारित करना अनिवार्य होगा।

17. इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है, उनके लिए सरकार की प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।

18. शंकाओं का निराकरण। - यदि इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई संशय हो तो विभाग को निर्देशित किया जायेगा और इस सम्बन्ध में विभाग का विनिश्चय अन्तिम होगा।3 (cid:18)बहार गजट (असाधारण), 25 अ+तूबर 2013 19. कठिनाई का निराकरण। - यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी कठिनाई का निराकरण करने की शक्ति होगी।

20. निरसन एवं व्यावृत्ति। - (1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय - समय पर निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि इस नियमावली के प्रवृत्त होने की तिथि के प्रभाव से निरसित समझे जायेंगे। (2) ऐसा निरसन के होते हुए भी, उपर्युक्त नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत्त थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

नोट :- उपर्युक्त सभी कोटियों का वेतन बैंड एवं ग्रेड-पे वही होगा जो सरकार द्वारा समय-समय पर निर्धारित किया जाय।

सं0 6/एन0-07-35/2010 (अंश)-440(6), अधिसूचना सं0 6/एन0-07-35/2010 (अंश)-439(6) का निम्नलिखित अंग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से, एत्‌द द्वारा प्रकाशित किया जाता है जो भारत के संविधान के अनुच्छेद-348 के खंड (3) के अन्तर्गत अंंग्रेजी भाषा में उक्त अधिसूचना का प्राधिकृत पाठ समझा जायेगा।

No. 6/N-07-35/10 (part)-439(6)—In exercise of powers conferred by proviso to Article -309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to determine appointment, promotion and service conditions in the A.N.M. cadre under the Health Department . -

1. Short title, extent & commencement. - (1) A.N.M Cadre Rules may be called as the " Bihar Lady Health Worker (Auxilliary Nurse Midwife- A.N.M.) Cadre Rules, 2013." (2) It will extend to the whole State of Bihar.

(3) It will come into force at once.

(cid:18)बहार गजट (असाधारण), 25 अ+तूबर 2013 2. Definitions. - In these Rules, unless otherwise requires in the subject or context:-

(1) ' Government' means Bihar State Government ;

(2) ' Department' means Health Department ;

(3) 'Appointing Authority' means Civil Surgeon-cum-Chief Medical Officer of the concerned District;

(4) 'A.N.M' means Auxilliary Nurse Midwife;

(5) 'Commission ' means Bihar Staff Selection Commission;

(6) 'Cadre' means Bihar Lady Health Worker (A.N.M.) cadre;

(7) 'Appendix' means appendix appended to these Rules; and

(8) 'Recognized Institution' means the institution recognized by the Indian Nursing Council for A.N. Midwifery Course.

3. Constitution of cadre. – The Cadre of Lady Health Worker shall be at district level. In this cadre, number of posts in each grade and total number of posts in the cadre shall be as many as are sanctioned by the government from time to time.

4. Chain posts of cadre. - Different categories and chain posts of this cadre shall be according to appendix-1.

5. Recruitment. - The appointment in this cadre shall be made by direct recruitment to the basic categories posts, on the basis of recommendation of the Commission.

6. Qualification. - (1) For appointment by direct recruitment to the basic categories posts, minimum educational qualifications shall be pass in A.N. Midwifery training course of the period as determined by Indian Nursing council from time to time, from a recognised institution and a certificate related thereto shall be necessary .

(2) For direct recruitment minimum age limit shall be 21 years and maximum age limit shall be the same as may be determined reservation categorywise from time to time by the Government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

Total - 100 marks Explanation :—The marks to be given to a candidate for A.N.M. course examination shall be determined by multiplying the percentage of total marks obtained in the aforesaid5 (cid:18)बहार गजट (असाधारण), 25 अ+तूबर 2013 examination by multiple of 0.5. For example, if a candidate has obtained 50% marks, then he will be given 50% x 0.5 = 25 marks .

(3) The commission shall send prepared merit list on the basis of aforesaid sub-rule (2), and reservation categorywise recommendations in confirmity with requisitioned vacancy to the Appointing Authority. (4) Procedure for interview shall be determined by the Commission.

8. Probation period. - After appointment probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found to be satisfactory in extended period also, then the appointing authority may terminate service of such Lady Health Worker (A.N.M.).

9. Departmental Examination. – The Lady Health Worker (A.N.M.) shall have to pass the departmental examination organised by the Department. The syllabus of departmental examination will be determined by the Department.

10. Confirmation. - On being satisfactory service during probation period and passing of departmental examination a Lady Health Worker (A.N.M.) may be confirmed in the service.

11. Seniority. - The inter-se seniority of Lady Health Worker (A.N.M.) shall be determined according to the merit list prepared by the Commission.

12. The personnel appointed/promoted and working on the posts of this cadre mentioned in appendix – 1 before the commencement of these Rules shall be deemed to be automatically included in this cadre.

13. Chain Posts of Promotion. - (1) Subject to availability of the vacancies and according to seniority cum merit, Lady Health Worker (A.N.M.) shall be considered to be promoted on the posts mentioned in Appendix – 1.

(2) For consideration of promotion, completion of 'KALAWADHI' determined by the General Administration Department, from time to time, shall be necessary. Compliance of instructions issued by General Administration Department, from time to time, with respect to promotion and character roll / P.A.R, allegations / departmental proceedings / criminal proceedings etc., shall be necessary at the time of consideration of promotion.

14. Departmental Promotion Committee. - (1) Promotions will be on the basis of recommendations of the Departmental Promotion Committee.

(2) The Departmental Promotion Committee shall be constituted by the Department. 15. Reservation. - Compliance of provisions of Reservation Act of the Government and reservation roster for direct recruitment and promotion issued from time to time by the Government shall be essential.

16. Uniform. – It shall be essential for Lady Health Workers to wear uniform during duty as determined categorywise by the Department.

17. For the subjects which have not been provided in these Rules, provisions of concerned Code / Rules / Resolutions / Instructions shall apply.

18. Removal of Doubt. - If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect the decision of the Department shall be final.

19. Removal of difficulties. - If any difficulty arises in implementation of provisions of these Rules, the department shall have powers to remove such difficulty.

(cid:18)बहार गजट (असाधारण), 25 अ+तूबर 2013 20. Repeal and Savings. - (1) The Rules and all resolutions, orders, instructions etc issued earlier, from time to time, by the Department with respect to this cadre, shall be deemed to be repealed with effect from the date of coming into force of these Rules.

(2) Notwithstanding such repeal, any work done or any action taken in exercise of the powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to be done or taken under these Rules as if these Rules were in force on the date on which such a work was done or such an action was taken.
