सं0 गव्य (यो0-2)01/2003/1509—भारत-संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार- राज्यपाल एतद्‌द्वारा पशु एवं मत्स्य संसाधन विभाग के बिहार गव्य संवर्ग में भर्त्ती/प्रोन्नति को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं।

बिहार गव्य संवर्ग भर्त्ती नियमावली, 2013 अध्याय-1 प्रारम्भिक 1. संक्षिप्त नाम विस्तार एवं प्रारम्भ ।- (1) यह नियमावली" बिहार गव्य संवर्ग भर्त्ती नियमावली, 2013" कहलायेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त के प्रभाव से प्रवृत्त होगा। 2. परिभाषायें ।- इस नियमावली में जब तक संदर्भ में अन्यथा अपेक्षित न हो-

(क)"राज्य सरकार"से अभिप्रेत है बिहार राज्य सरकार; (ख)"राज्यपाल"से अभिप्रेत है बिहार के राज्यपाल; (ग) "सदस्य या संवर्ग के सदस्य"से अभिप्रेत है बिहार गव्य संवर्ग में नियुक्त कर्मी; (घ) "कोटि"से अभिप्रेत है बिहार गव्य संवर्ग की विभिन्न कोटि ; (ड.)"संवर्ग"नियंत्री प्राधिकार से अभिप्रेत है निदेशक (गव्य) ; (च) "विभाग" से अभिप्रेत है, पशु एवं मत्स्य संसाधन विभाग; (छ) "आयोग"से अभिप्रेत है, बिहार लोक सेवा आयोग/बिहार कर्मचारी चयन आयोग, पटना।

3. संवर्ग का गठन ।- (1) यह संवर्ग राज्य संवर्ग समझा जायेगा ।2 (cid:18)बहार गजट (असाधारण), 16 +दस-बर 2013 (2) यह संवर्ग पशु एवं मत्स्य संसाधन विभाग के प्रशासी नियंत्रणाधीन होगा।

(3) राज्य सरकार, राजपत्र में अधिसूचना प्रकाशित कर पदनाम एवं पदस्तर (वेतनमान) में परिवर्त्तन कर सकेगी।

(4) इस संवर्ग में प्रस्तावित पदों का विवरण इस नियमावली की अनुसूची में दिया गया है।

(5) इस नियमावली के प्रवृत होने की तिथि से अनुसूची के पदों पर नियुक्त/प्रोन्नत पदाधिकारी इस संवर्ग के सदस्य समझे जायेेंगे।

4. पद स्थिति ।- यह संवर्ग बिहार गव्य संवर्ग वर्ग-III (समूह -ख), बिहार गव्य संवर्ग वर्ग-II (समूह -ख) एवं बिहार गव्य संवर्ग वर्ग-I (समूह-क) में विभक्त रहेगा। वर्ग-III में मूल संवर्ग (Basic Cadre) के पद एवं वर्ग-II,वर्ग-I में प्रोन्नति के सभी पद सम्मिलित रहेंगे एवं संवर्गीय रहेंगे। संवर्ग के विभिन्न पद, उनके वेतनमान एवं नियुक्ति प्राधिकार निम्नवत्‌ होेंंगे -

अध्याय-2

सीधी भर्त्ती

5. सीधी भर्त्ती हेतु आयु सीमा, अर्हता एवं स्त्र्रोत।- (1) अभ्यर्थी की आयु न्यूनतम 21 वर्ष तथा अधिकतम वही होगी जो राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय समय पर निर्धारित किया जायेगा। (2) बिहार गव्य संवर्ग (बेसिक कैडर) में सीधी भर्त्ती हेतु अर्हता किसी मान्यता प्राप्त विश्वविद्यालय/संस्थान से बी0 टेक0 (डेयरी टेक्नोलॉजी)/बी0 एस सी0 (डेयरी टेक्नोलॉजी)/समकक्ष की डिग्री होगी।

(3) इस संवर्ग की मूल कोटि के सभी पद सीधी भर्त्ती द्वारा भरे जायेंगे।3 (cid:18)बहार गजट (असाधारण), 16 +दस-बर 2013 6. रिक्तियों का विनिष्चय एवं आयोग को अधियाचना ।- प्रशासी विभाग प्रत्येक वर्ष 1ली अप्रील को उस वर्ष के इस संवर्ग में सीधी नियुक्ति द्वारा भरी जाने वाली रिक्तियों की संख्या विनिश्चित करेगा तथा इस प्रकार विनिश्चित रिक्तियों की अधियाचना 30 अप्रैल तक आयोग को भेज देगा। यदि किसी वर्ष में अधियाचना भेजने या सीधी नियुक्ति द्वारा, पद भरने की कार्रवाई नहीं की जाती है, तब भी सीधी नियुक्ति द्वारा भरे जाने वाले पदों की गणना वर्षवार की जायेगी और उसे अगले वर्ष के लिए, पिछले वर्ष की रिक्ति मानते हुए, अग्रणीत किया जायेगा। 7. आरक्षण ।- राज्य सरकार द्वारा राज्य संवर्गों के लिए समय-समय पर विहित नियम एवं प्रक्रिया के अनुसार आरक्षण का प्रावधान इस संवर्ग में लागू होगा।

अध्याय -3

वेतन एवं दक्षतावरोध

8. वेतन ।- विभिन्न कोटियों के पदों का वेतनमान/ग्रेड-पे इस नियमावली की अनुसूची के अनुसार होगा तथा उनके तत्‌समान प्रतिस्थापन वेतनमान राज्य सरकार द्वारा समय-समय पर घोषित किये जायेगे।

9. परिवीक्षा अवधि एवं संपुष्टि ।- (1) किसी मौलिक पद के विरूद्ध परिवीक्षा पर नियुक्त प्रत्येक पदाधिकारी को नियुक्ति की तिथि से दो वर्ष की अवधि तक परिवीक्षा पर रखा जाएगा। परिवीक्षण अवधि मे बिपार्ड द्वारा तैयार पाठ्‌यक्रम के अनुसार वे प्रशिक्षण भी प्राप्त करेंगे। परिवीक्षण अवधि में अपेक्षित प्रशिक्षण पूर्ण करने के साथ-साथ संतोषजनक ढंग से परिवीक्षण अवधि पूरी करने एवं अपेक्षित विभागीय परीक्षा उत्तीर्ण होने के उपरांत ही पदाधिकारी को नियुक्ति प्राधिकार द्वारा संतुष्ट किया जा सकेगा । (2) सम्पुष्टि, वार्षिक वेतन वृद्धि एवं प्रोन्नति, विभागीय परीक्षा में उर्त्तीण होने के पश्चात्‌ ही, अनुमान्य होगी। परन्तु इस नियमावली के प्रवृत होने की तिथि के पूर्व नियुक्त इस संवर्ग के सदस्यों पर यह प्रावधान लागू नहीं होगा।

अध्याय -4 संवर्ग प्रबंधन 10. तकनीकी प्रशिक्षण ।- इस संवर्ग के सदस्यों को, तकनीकी प्रशिक्षण के लिए, राज्य में अथवा राज्य से बाहर, राज्य सरकार द्वारा विहित अवधि के लिए भेजा जा सकेगा।

11. विभागीय परीक्षा एवं पाठ्‌यक्रम ।- (1) विभागीय परीक्षा एवं पाठ्‌यक्रम अनुसूची के क्रमांक-11 में उल्लिखित किया गया है। (2) विभागीय परीक्षा रूल्स फॉर डिपार्टमेन्टल एक्जामिनेशन ऑफ गजटेड ऑफिसर्स 1961 के अनुसार केन्द्रीय परीक्षा समिति (राजस्व पर्षद) द्वारा ली जायेगी। विभागीय परीक्षा में उर्त्तीण होने के पश्चात्‌ ही सम्पुष्टि, वार्षिक वेतन वृद्धि एवं प्रोन्नति की स्वीकृति दी जायेगी।

परन्तु इस नियमावली के प्रवृत होने की तिथि के पूर्व नियुक्त इस संवर्ग के सदस्यों पर यह प्रावधान लागू नहीं होगा।

(3) इस नियमावली के प्रवृत होने के उपरांत विभाग द्वारा केन्द्रीय परीक्षा समिति (राजस्व पर्षद)को विभागीय परीक्षा संबंधी पाठ्‌यक्रम उपलब्ध करा दिया जायेगा।

12. प्रोन्नति ।- (1) अनुसूची के स्तम्भ 12 में उल्लेखित विभागीय प्रोन्नति समिति की अनुशंसा पर उक्त अनुसूची के स्तम्भ 11 में उल्लेखित पदधारकों को प्रोन्नति दी जायेगी। (2) कालावधि ( न्यूनतम अर्हक सेवा ) वहीं होगी जो सामान्य प्रशासन विभाग द्वारा, समय-समय पर, विनिश्चित किया जायेगा।

13. अवशिष्ट मामले ।- इस संवर्ग के लिए अन्य शर्त्त्ों यथा - अनुशासनात्मक कार्रवाई, छुट्‌टी, देय सेवा निवृत्ति लाभ इत्यादि, जो इस नियमावली द्वारा आच्छादित नहीं है या जो इस संवर्ग के लिए पृथकरूप अधिसूचित नहीं है, राज्य सरकार के पदाधिकारियों के लिए प्रासंगिक नियमावली में किये गये संबंधित प्रावधानों से नियंत्रित हाेंगे।

14. कठिनाईयों का निराकरण ।- समय-समय पर राज्य सरकार द्वारा अधिसूचना से वैसी कठिनाईयों का निराकरण किया जा सकेगा जिसके लिए युक्तियुक्त कारण हो।

No. गव्य (यो0-2)01/2003/1509—In exercise of the powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following rules to regulate the recruitment and promotion to the Bihar Dairy Cadre of the Animal & Fisheries Resources Department:-

The Bihar Dairy Cadre Recruitment Rules,2013 Chapter - Preliminary 1. Short title, extent and commencement.-(1) These Rules may be called The Bihar Dairy Cadre Recruitment Rules, 2013; (2) It shall extend to the whole of the State of Bihar; (3) It shall come in to force at once. 2. Definition.- In these Rules, unless otherwise requires in the context- (a) "State Government" means The State Government of Bihar; (b) "Governor" means Governor of Bihar; (c) "Member or Member of the cadre" means an employee appointed in the Bihar Dairy Cadre; (d) "Category" means different categories of The Bihar Dairy Cadre; (e) "Cadre Controlling Authority" means The Director (Dairy); (f) "Department" means Animal & Fisheries Resources Department; (g) "Commission" means Bihar Public Service Commission/Bihar State Staff Selection Commission, Patna. 3. Constitution of Cadre. - (1)This cadre shall be deemed to be a state cadre. (2) This cadre shall be under administrative control of The Animal & Fisheries Resources Department. (3) The State Government may change the designation and level of post (Pay Scale). (4) The details of the Proposed Posts in this cadre are given in the schedule to these Rules.

(5) After commencement of these Rules the officers/employees appointed or promoted to the posts of mentioned in the schedule to these Rules shall be treated as a member of this cadre from date of the commencement of these Rules.

4. Status of the Posts.- This cadre shall be divided in Bihar Dairy Cadre Class III (Group-B), Bihar Dairy Cadre Class-II (Group-B) and Bihar Dairy Cadre Class-I (Group-A). Posts of Basic Cadre, and all posts of promotion shall included in Class-III. Class-II & Class-I and their Pay scale and Appointing Authority shall be the following:-

Chapter-2 Direct Recruitment 5. Age limit, qualification and sources for Direct Recruitment.-(1) Minimum age of The Candidates will be 21 years and maximum will be the same which shall be8 (cid:18)बहार गजट (असाधारण), 16 +दस-बर 2013 decided, from time to time, by General Administrative Department of the State Government.

(2) Qualification for the direct recruitment in Bihar Dairy cadre (Basic cadre) will be B.Tech. (Dairy Technology)/B.Sc. (Dairy Technology)/Equivalent degree from any recognized University/Institute.

(3) All Posts of Basic category of this cadre will be filled by Direct Recruitment 6. Determination of Vacancies and Requisition to The Commission.- Every year on 1st April, the Administrative Department will determine the number of Vacancies to be filled up by direct recruitment in this cadre in that year and department will send the requisitions of vacancies to the commission up to 30th April. If in any year, action of sending requisition and filling Posts by direct recruitment is not taken, calculation of Posts to be filled up by direct recruitment will be made year wise and it will be carried forward for coming year treating the vacancies of last year.

7. Reservation.- Provisions of Reservation shall be applicable to this cadre according to the prescribed Rules and Process for the state cadre prescribed, from time to time, by the State Government.

Chapter-3 Pay and Efficiency bar 8. Pay.- Pay scale/Grad pay of different Posts of different Categories will be according to the Schedule of These Rules and Substituted pay scale of equal there to will be declared, from time to time, by the State Government.

9. Probation Period and Confirmation.- Each officer appointed on probation against any basic post shall be placed on probation for two years from the date of appointment. According to the courses prepared by BIPARD, they will get training also. The officers, completing the required training in probation period along with completing the probation period satisfactorily and after passing the required Departmental Examination, may be confirmed by the Appointing Authority.

(2) Confirmation, annual increment and promotion will be admissible only after passing the Departmental Examination, Provided that This Provision will not apply to those members of the cadre appointed prior to the commencement of these Rules.

Chapter-4 Cadre Management 10. Technical Training.- Members of this cadre will be sending within the state or out of the state for the period, prescribed by the state government for technical training.

11. Departmental Examination and courses study. - (1) Departmental Examination and Courses of study are mentioned in serial Number 11 of schedule.

(2) Departmental Examination will be held by Central Examination Committee according to the Rules for the Departmental Examination of Gazetted Officers, 1961. Confirmation, annual increment and promotion will be allowed only after passing the Departmental Examination Provided that this provision will not apply to the members of this cadre appointed prior to the commencement of these Rules.

(3) After the commencement of these Rules, Courses of study relating to the Departmental examination will be provided to the Central Examination Committee (Revenue Board).

12. Promotion. – (1) On the recommendation of Departmental Promotion Committee mentioned in column 11 of schedule, promotion will be given to Post holders mentioned in column 10 of the said schedule.

(2) Kalawadhi (minimum qualifying service) will be same which may be decided by The General Administrative Department from time to time.

13. Residual Cases.- Other conditions for this cadre, namely Disciplinary action, Leave, Admissible Pensioner Benefits etc which are not covered by these Rules or which are not notified for this cadre separately, will be controlled by the Provisions concerned made in the relevant Rules for the officers of the State Government. 14. Removal of difficulties.- Such Difficulties may be removed by notification, made by the State Government for which there may be reasonable reason.
