सं0 वन/क्षेत्र पदा॰-06/2012-50/प0व0—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये, बिहार के राज्यपाल, वनों के क्षेत्र पदाधिकारी संवर्ग में भर्ती एवं इसके सेवा शर्तो को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

भाग-I

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ । - (1) यह नियमावली ''बिहार वनों के क्षेत्र पदाधिकारी संवर्ग (भर्ती एवं सेवा शर्तें) नियमावली, 2013'' कहलायेगी। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा।

(3) यह बिहार गजट में प्रकाशन की तिथि से प्रवृत्त होगी। 2. परिभाषाएँ ।- इस नियमावली में जबतक कोई बात विषय या सन्दर्भ के प्रतिकूल न हो - (i) ''सरकार'' से अभिप्रेत है बिहार सरकार एवं 'विभाग' से अभिप्रेत है पर्यावरण एवं वन विभाग, बिहार सरकार;

(ii) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (iii) ''संवर्ग के सदस्य'' से अभिप्रेत है इस नियमावली के प्रावधानों के अधीन नियुक्त व्यक्ति और इसमें वनों के क्षेत्र पदाधिकारी के पद पर पहले से कार्यरत व्यक्ति भी शामिल होंगे;

(iv) ''नियमावली'' से अभिप्रेत है बिहार वनों के क्षेत्र पदाधिकारी संवर्ग (भर्ती एवं सेवा शर्तें) नियमावली 2013; (v) ''प्रधान मुख्य वन संरक्षक'' से अभिप्रेत है, पर्यावरण एवं वन विभाग में प्रधान मुख्य वन संरक्षक के पद पर पदस्थापित एवं ''बल के प्रमुख'' के रूप में कार्यरत पदाधिकारी;

(vi) ''मुख्य वन संरक्षक'' से अभिप्रेत है, क्षेत्रीय मुख्य वन संरक्षक, या मुख्य वन संरक्षक के समकक्ष अन्य पदाधिकारी;

(vii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है प्रधान मुख्य वन संरक्षक; (viii) ''संवर्ग'' से अभिप्रेत है वनों के क्षेत्र पदाधिकारी का संवर्ग;

(cid:18)बहार गजट (असाधारण), 17 जनवर(cid:15) 2014 (ix) ''अनुसूचित जन जातियाँ'' से अभिप्रेत है भारतीय संविधान (अनुसूचित जनजातियाँ आदेश-1950) के भाग-II में उल्लिखित जनजातियाँ;

(x) ''अनुसूचित जातियाँ'' से अभिप्रेत है संविधान (अनुसूचित जातियाँ आदेश-1950) के भाग-II, में उल्लिखित जातियाँ;

(xi) ''पिछड़ी जातियाँ'' से अभिप्रेत है बिहार सरकार द्वारा समय-समय पर पिछड़ी जातियों के रूप में अधिसूचित जातियाँ;

(xii) ''अत्यन्त पिछड़ी जातियाँ'' से अभिप्रेत है बिहार सरकार द्वारा समय-समय पर अत्यन्त पिछड़ी जातियों के रूप में अधिसूचित जातियाँ;

(xiii) ''पिछड़े वर्ग की महिलाओं'' से अभिप्रेत हैं अनुसूचित जातियाँ, अनुसूचित जनजातियाँ, अत्यन्त पिछड़ी जातियाँ तथा पिछड़ी जातियों की महिलाऐं।

भाग-II

वनो के क्षेत्र पदाधिकारी संवर्ग में नियुक्ति

3. वनों के क्षेत्र पदाधिकारी के मूल कोटि में नियुक्ति निम्नवत्‌ की जायेगी :- (क) इस नियमावली के भाग-III के प्रावधानों के अनुसार खुली प्रतियोगिता परीक्षा के माध्यम से सीधी नियुक्ति द्वारा (ख) इस नियमावली के भाग-IV के प्रावधानों के अनुसार वनपाल से प्रोन्नति द्वारा;

4. (1) इस संवर्ग मेंं कुल पदों का पचास प्रतिशत सीधी नियुक्ति के द्वारा तथा शेष पचास प्रतिशत वनपाल से प्रोन्नति के द्वारा भरा जायेगा। (2) संवर्ग का स्वीकृत बल राज्य सरकार द्वारा, समय-समय पर, यथा विनिश्चित होगा।

5. प्रधान मुख्य वन संरक्षक कोटिवार सीधी भर्त्ती तथा प्रोन्नति द्वारा नियुक्ति हेतु, बिहार सरकार द्वारा लागू आरक्षण रोस्टर के अनुसार, सामान्यतया प्रत्येक वर्ष पहली अप्रैल को रिक्तियों की गणना करेंगे एवं तदनुसार सीधी भर्त्ती के लिए आयोग को 30 अप्रैल तक अधियाचना भेजेंगे।

6. बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण (अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गों के लिये) अधिनियम, 1991 एवं इसके अधीन राज्य सरकार द्वारा, समय-समय पर, विहित नियमावली एवं रोस्टर नियुक्ति एवं प्रोन्नतियों पर लागू होंगे।

भाग-III सीधी भर्त्ती द्वारा नियुक्ति (खुली प्रतियोगिता परीक्षा के माध्यम से)

7. (1) वनों के क्षेत्र पदाधिकारी के स्तर पर सीधी भर्त्ती आयोग की अनुशंसा पर की जायगी। (2) नियम 5 के तहत दी गयी अधियाचना के आधार पर आयोग समय-समय पर, उस रीति से जैसा कि वह उचित समझें, इस संवर्ग की कोटिवार रिक्तियों को सीधी नियुक्ति द्वारा भरने के लिये घोषणा करेगा। (3) आयोग इस प्रयोजनार्थ प्रतियोगिता परीक्षा आयोजित करेगा।

8. उम्र सीमा, शैक्षणिक अर्हता तथा शारीरिक मानदण्ड । -

(1) उम्र सीमा - प्रतियोगिता परीक्षा में सम्मिलित होने के लिए उम्मीदवार की आयु, आयोग को प्रेषित अधियाचना के वर्ष में, पहली अगस्त को 21 वर्ष से कम नहीं होगी। अधिकतम आयु वही रहेगी जो राज्य सरकार (सामान्य प्रशासन विभाग) के संकल्प के तहत आरक्षण कोटिवार समय-समय पर निर्धारित की जाय। सरकारी सेवकों के लिए, जो इस प्रतियोगिता परीक्षा में भाग लेना चाहेगें, अधिकतम आयु सीमा राज्य सरकार (सामान्य प्रशासन विभाग) के संकल्प के अधीन विनिश्चित अधिकतम आयु सीमा के अनुसार होगा। (2) उम्मींदवार की आयु की गणना मैट्रिक या समकक्ष परीक्षा में उल्लिखित जन्म-तिथि के आधार पर की जायेगी। (3) शैक्षणिक अर्हताएँ । - वनों के क्षेत्र पदाधिकारी की नियुक्ति हेतु न्यूनतम शैक्षणिक अर्हता पशुपालन एवं पशुरोग विज्ञान, वनस्पति विज्ञान, रसायन विज्ञान, भूगर्भ विज्ञान, गणित, भौतिक शास्त्र, सांख्यिकी एवं जन्तु विज्ञान विषयों में से कम से कम एक विषय के साथ स्नातक की डिग्री होगी अथवा कृषि स्नातक, वानिकी अथवा अभियंत्रण में किसी मान्यता प्राप्त विश्वविद्यालय या समकक्ष से स्नातक की डिग्री धारक होना चाहिये।

9. (1) सरकारी सेवक, जो इस पद पर नियुक्ति-परीक्षा में प्रवेश हेतु इस नियमावली के प्रावधानों के अधीन पात्र हाें अपना आवेदन पत्र, बिहार सरकारी सेवक (पदों के लिए आवेदन) नियम, 1951 के अधीन विहित प्राधिकृत पदाधिकारी के माध्यम से समर्पित करेंगे।

(2) प्रतियोगिता परीक्षा में भाग लेने के लिये अवसरों की कोई सीमा नहीं होगी परन्तु सरकारी सेवक अधिकतम तीन बार ही भाग ले सकेगें।

10. प्रतियोगिता परीक्षा के निम्नलिखित भाग होंगे :-

(क) लिखित परीक्षा (ख) साक्षात्कार (ग) शारीरिक सामथ्र्य परीक्षण

11. लिखित परीक्षा ।- बिहार कर्मचारी चयन आयोग के द्वारा, नियुक्ति हेतु ली जाने वाली परीक्षाओं के लिये संचालन नियमावली, 2010 (समय-समय पर यथा संशोधित) के अनुसार आयोग लिखित परीक्षा, आयोजित करेगा। लिखित परीक्षा के लिये कुल अंक का विनिश्चय आयोग द्वारा किया जायेगा। परीक्षा के परीक्षाफल हेतु न्यूनतम अर्हतांक के सम्बंध में निर्णय आयोग द्वारा बिहार सरकार द्वारा निर्गत दिशा-निर्देश के अनुसार लिया जायेगा। 12. साक्षात्कार (मौखिक परीक्षण) । - लिखित परीक्षा में प्राप्त अंकाें के आधार पर उपलब्ध रिक्तियों की संख्या के एक निश्चित अनुपात में, जो आयोग द्वारा निर्धारित किया जायेगा, उम्मींदवारों को साक्षात्कार के लिये आयोग द्वारा आमंत्रित किया जायेगा। साक्षात्कार मेें उम्मींदवारों के सम्पूर्ण व्यक्तित्व एवं वनों के क्षेत्र पदाधिकारी के पद पर नियुक्ति के लिये उनकी योग्यता आँकी जायेगी। साक्षात्कार का कुल अंक- 50 होगा। साक्षात्कार में प्राप्त अंक को लिखित परीक्षा में प्राप्तांक में जोड़ा जायेगा तथा दोनों के योग के आधार पर मेधा सूची तैयार की जायेगी।

13. शारीरिक समर्थता परीक्षण - साक्षात्कार (मौखिक परीक्षण) के लिये आमंत्रित उम्मींदवारों के लिए नियम-8 (4) के अनुसार एक शारीरिक समर्थता परीक्षण आयोग द्वारा आयोजित किया जायेगा। इस परीक्षण हेतु आयोग, यदि उचित समझे, विभाग की मदद ले सकेगा। आयोग के किसी सदस्य की अध्यक्षता में विभागीय पदाधिकारियों की एक समिति इस प्रयोजनार्थ गठित की जा सकेगी। यदि कोई उम्मीदवार शारीरिक समर्थता परीक्षण में असफल होता है तो उसे केवल लिखित परीक्षा एवं साक्षात्कार में प्राप्त अंकों के आधार पर नियुक्ति हेतु अनुशंसित नहीं किया जायेगा।

14. चिकित्सीय परीक्षण - (1) आयोग निदेशक प्रमुख, स्वास्थ्य सेवायें, बिहार सरकार से अनुरोध कर सिविल सर्जन, पटना या जैसा आयोग उचित समझे, विशेषज्ञ चिकित्सक की सेवा तथा साक्षात्कार के लिये आमंत्रित उम्मीदवारों का आयोग द्वारा विनिि"चत प्रपत्र में चिकित्सीय प्रमाण-पत्र प्राप्त कर सकेगा।

(2) वनों के क्षेत्र पदाधिकारी पद पर नियुक्ति के लिए, सफल एवं चयनित उम्मींदवारों का मानसिक एवं शारीरिक रूप से पूर्णतः उपयुक्त होना आवश्यक होगा। उन्हें ऐसे शारीरिक दोषों से पूर्णतः मुक्त होना चाहिए जिसके कारण सेवाकाल में उन्हें अपने कर्तव्यों एवं दायित्वों के दक्षतापूर्वक निर्वहन में किसी तरह की बाधा हो। नियुक्ति के लिये एक आँख वाले व्यक्ति की अनुशंसा नहीं की जायेगी।

15. आयोग द्वारा सरकार को अनुशंसा । - आयोग नियम 12 के अनुसार शारीरिक समर्थता परीक्षण तथा चिकित्सीय परीक्षण मे सफल उम्मीदवारों की एक अंतिम मेधा सूची, रिक्तियों के अनुसार, सरकार द्वारा विहित आरक्षण कोटिवार तैयार करेगा एवं उसे सरकार को नियुक्ति हेतु अनुशंसित करेगा। आयोग द्वारा अनुशंसित उम्मीदवारों का पैनल एक वर्ष के लिये वैध होगा।

16. इस प्रकार अनुशंसित उम्मींदवारों का वन क्षेत्र पदाधिकारी के पद पर नियुक्ति आदेश नियुक्ति प्राधिकार द्वारा, उन सभी जाँच-पड़ताल, सत्यापन इत्यादि, जिसे सरकार द्वारा आवश्यक समझा जाय, के पश्चात निर्गत की जायेगी।

17. (1) अंतिम रूप से चयनित उम्मींदवारों की नियुक्ति विभाग में वनों के क्षेत्र पदाधिकारी के पद पर परिवीक्षा पर की जायेगी। उन्हें 2 वर्ष का प्रशिक्षण राज्य सरकार द्वारा यथा विनिश्चित मान्यता प्राप्त संस्थानों मेें लेना होगा। वनों के क्षेत्र पदाधिकारियों की कुल परिवीक्षा अवधि दो वर्षों की होगी। (2) अगर परिवीक्षा पर नियुक्त कर्मी की, कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार संतोषप्रद नहीं पाया जाय एवं/या वह इस नियम के उपनियम (1) के अधीन विनिश्चित प्रशिक्षण सफलतापूर्वक पूरा नहीं करता है तो परिवीक्षा अवधि एक वर्ष के लिये बढ़ाई जा सकेगी। अगर परिवीक्षा पर नियुक्त कर्मी की कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार विस्तारित अवधि में भी संतोषप्रद नहीं हो एवं/या वह निर्धारित प्रशिक्षण को सफलतापूर्वक पूरा नहीं कर पाता है तो उसे सेवान्मोचित कर दिया जायेगा। (3) परिवीक्षा अवधि में वनों के क्षेत्र पदाधिकारी सरकार द्वारा, समय-समय पर, विनिश्चित वेतनमान एवं अन्य भत्ता प्राप्त करने के हकदार होंगे। परिवीक्षा-अवधि सफलतापूर्वक पूरा करने के बाद, परिवीक्षा पर बितायी गयी अवधि सेवा-अवधि मानी जायेगी।4 (cid:18)बहार गजट (असाधारण), 17 जनवर(cid:15) 2014 18. अंतिम रूप से चयनित एवं नियुक्त वनों के क्षेत्र पदाधिकारी को प्रधान मुख्य वन संरक्षक द्वारा विहित बन्ध-पत्र एकरारनामा पर यथा निर्धारित शर्तों को स्वीकारते हुये सहमति व्यक्त करना होगा।

भाग-IV

प्रोन्नति द्वारा नियुक्ति

19. विभाग में सेवारत वनपाल प्रोन्नति द्वारा वन क्षेत्र पदाधिकारी के पद पर नियुक्ति के लिए पात्र होंगे। वनों के क्षेत्र पदाधिकारी के पद पर प्रोन्नति हेतु वनपाल को :- (क) वनपाल प्रशिक्षण परीक्षा अथवा वनरक्षी प्रशिक्षण परीक्षा में उत्र्तीण होना अनिवार्य होगा। (ख) वनपाल के रूप में 8 वर्षों की नियमित एवं लगातार सेवा अनिवार्य होगी।

20. नियुक्ति प्राधिकार द्वारा प्रत्येक वर्ष पहली अप्रील को रिक्तियों की गणना प्रोन्नति के लिए कोटा के अनुसार आरक्षण तथा आरक्षण रोस्टर के अनुसार की जाएगी।

21. वनपाल से वन क्षेत्र पदाधिकारी के पद पर प्रोन्नति हेतु, प्रधान मुख्य वन संरक्षक द्वारा नाम निर्दिष्ट मुख्य वन संरक्षक, (प्रशासन एवं मानव संसाधन विकास) या मुख्य वन संरक्षक की पंक्ति के किसी अन्य पदाधिकारी के स्तर पर गठित स्क्रीनिंग समिति द्वारा वनपाल के सेवा इतिहास एवं प्रोन्नति वर्ष से पूर्व विगत 5 वर्षों की वार्षिक गोपनीय प्रतिवेदन की संवीक्षा के आधार पर प्रोन्नति हेतु सूची तैयार की जायेगी।

22. प्रोन्नति हेतु सामान्य प्रशासन विभाग, बिहार सरकार द्वारा यथाधिकथित नियमों/परिपत्रों/अनुदेशों का अनुपालन सुनिश्चित किया जायेगा।

23. ऐसे वनपाल की, जिन्हें निलंबित कर दिया गया हो एवं जिनके विरूद्ध विभागीय कार्यवाही/आपराधिक कार्यवाही आरंभ की गयी हो, प्रोन्नति पर पक्षपात रहित विचार किया जायेगा एवं निर्णय सीलबंद लिफाफे में रखा जायेगा किन्तु उसकी प्रोन्नति के संबंध में अंतिम निर्णय विभागीय कार्यवाही/आपराधिक कार्यवाही के निपटारे के उपरांत ही लिया जायेगा। दंड प्राप्त वनपालों की प्रोन्नति के संबंध में सामान्य प्रशासन विभाग, बिहार सरकार द्वारा समय-समय पर निर्गत निदेशों के अनुसार निर्णय लिया जा सकेंगा।

24. इस नियमावली के नियम 21 के अधीन गठित स्क्रीनिंग समिति द्वारा वरीयता क्रम से तैयार किया गया पैनल सभी सेवा अभिलेखों यथा-सेवा पुस्तिका एवं ए0सी0आर0 के साथ नियुक्ति प्राधिकार को प्रेषित किया जायेगा। 25. प्रधान मुख्य वन संरक्षक के स्तर पर विभाग द्वारा गठित विभागीय प्रोन्नति समिति की बैठक में प्रोन्नति के संबंध में अंतिम निर्णय लिया जायेगा। नियुक्ति प्राधिकार द्वारा उक्त आधार पर प्रोन्नति आदेश अन्य आवश्यक प्रक्रियाओं को पूरा करने के उपरान्त निर्गत किया जायेगा।

भाग-V

अंतर वरीयता

26. ऐसे मामले में, जहाँ संवर्ग में नियुक्ति, एक ही वर्ष की रिक्तियों के विरूद्ध सीधी भर्त्ती एवं प्रोन्नति द्वारा नियुक्ति के द्वारा की गयी हो, वहाँ संवर्ग में प्रोन्नति द्वारा नियुक्त सदस्य सीधी भर्त्ती द्वारा नियुक्त सदस्य से वरीय होगा।

27. इस नियमावली के भाग-III में अधिकथित खुली प्रतियोगिता के माध्यम से एक ही संव्यवहार में नियुक्ति सदस्यों की आपसी वरीयता आयोग द्वारा नियुक्ति हेतु आयोजित परीक्षा में प्राप्तांक एवं प्रशिक्षण में प्राप्त प्राप्तांक के आधार पर विनिश्चित की जायगी। आयोग द्वारा आयोजित परीक्षा के प्राप्तांक के लिए पचहत्तर प्रतिशत तथा प्रशिक्षण के प्राप्तांक के लिए पचीस प्रतिशत अधिमान होगा। कुल प्राप्तांक की समानता की दशा में प्रशिक्षण में प्राप्तांक पर वरीयता विनिश्चित की जायेगी।

28. प्रोन्नति द्वारा संवर्ग में एक ही संव्यवहार में नियुक्त सदस्यों की आपसी वरीयता, वनपाल सम्वर्ग में उनकी आपसी वरीयता के आधार पर, विनिश्चित की जायगी।

भाग-VI

वेतन एवं भत्ता आदि

29. वन क्षेत्र पदाधिकारी को वह नियत वेतन एवं भत्ता भुगतेय होगा जो सरकार द्वारा, समय-समय पर, उनके लिए विनिश्चित किया जाय।

30. वन क्षेत्र पदाधिकारी को अपने कर्तव्य अनुपालन के समय नियुक्ति प्राधिकार द्वारा समय-समय पर यथा निर्धारित वर्दी धारण करनी होगी।

भाग-VII

प्रोन्नति

31. वनों के क्षेत्र पदाधिकारी, जो आठ वर्षाें की सेवा अवधि पूर्ण कर चुके हों, बिहार वन सेवा नियमावली, 2013 के अनुसार बिहार वन सेवा के मूल कोटि के पद पर प्रोन्नति द्वारा नियुक्ति के पात्र होंगे।5 (cid:18)बहार गजट (असाधारण), 17 जनवर(cid:15) 2014

भाग-VIII

प्रकीर्ण

32. अनुशासन, नियंत्रण एवं अपील - बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) के प्रावधान वनों के क्षेत्र पदाधिकारी संवर्ग के अनुशासन, वर्गीकरण, नियंत्रण एवं अपील संबंधी मामलों में लागू होगें।

33. इस नियमावली में विशिष्ट रूप से अनुपबंधित सेवा शर्त्तें बिहार सेवा संहिता एवं राज्य सरकार द्वारा समय-समय पर जारी अन्य निर्णयों से शासित होंगी।

34. इस नियमावली में से किसी नियम के निर्वचन में कोई संदेह की दशा में उसे सरकार को निर्दिष्ट किया जायेगा और जिसपर राज्य सरकार का विनिश्चय अंतिम होगा।

35. इस नियमावली के प्रावधानों में से किसी को प्रभावी करने में यदि कोई कठिनाई उत्पन्न हो तो राज्य सरकार राजपत्र में प्रकाशित आदेश द्वारा, इस नियमावली के प्रावधानों से असंगत न हो ऐसा प्रावधान कर सकेगी जो कठिनाईयों के निराकरण के लिये आवश्यक या समीचीन प्रतीत हो।

36. निरसन एवं व्यावृति - (1) इस सन्दर्भ में वर्तमान नियमों/विनियमों को एतद द्वारा निरस्त किया जाता है।

परन्तु इस निरसन के होते हुये भी वर्तमान नियमों/विनियमों के अधीन किया गया अथवा की गयी कार्रवाई इस नियमावली के प्रावधानों के अधीन किया गया अथवा की गयी मानी जायेगी मानों यह नियमावली उस दिन प्रवृत्त थी जब ऐसा कुछ भी किया गया अथवा ऐसी कार्रवाई की गई थी।

(2) उस निरसन के होते हुये भी इस नियम के उप-नियम (1) के अधीन तथा उस हद तक जब वे इस नियमवाली के प्रावधानों के विरूद्ध न हों, उसके अधीन प्रोद्‌भूत अथवा प्रोद्‌भूत माना गया कोई अधिकार एवं उनके अधीन उपगत दायित्व प्रभावित नहीं होगा।

The 6th January 2014 Bihar Range Officers of Forests Cadre (Recruitment and Service Conditions) Rules 2013 No. Van/Kshetra. Pada.-06/2012-50 /E&F—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to frame the following rules for regulating the recruitment and service conditions in the cadre of Range Officer of Forests.

PART - I 1. Short title, Extent and Commencement :—(1) These rules shall be called "The Bihar Range Officer of Forests cadre (Recruitment and Service Conditions), Rules 2013". (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with effect from the date of publication in the Bihar Gazette. 2. Definitions - In these Rules, unless there is anything repugnant to the subject or the context- (i) "Government" means the State Government of Bihar and 'Department' means Department of Environment and Forests, Government of Bihar; (ii) "Commission" means the Bihar Staff Selection Commission; (iii) "Member of Cadre" means a person appointed to the Cadre under the provisions of these Rules and shall also include the persons already working on the post of Range officers of Forest;

(cid:18)बहार गजट (असाधारण), 17 जनवर(cid:15) 2014 (iv) "Rules" means the Bihar Range Officer of Forests Cadre (Recruitment and Service Conditions) Rules, 2013; (v) "Principal Chief Conservator of Forest" means an Officer posted on the post of Principal Chief Conservator of Forests and working as "Head of the Force" in the Department of Environment and Forests. (vi) "Chief Conservator of Forest" means Regional Chief Conservator of Forest or other officers equivalent to Chief Conservator of Forest; (vii) "Appointing Authority" means the Principal Chief Conservator of Forests; (viii) "Cadre" means the Cadre of Range Officer of Forests; (ix) "Scheduled Tribes" means Tribes mentioned in Part-II of the Constitution of India (Scheduled Tribes Order - 1950); (x) "Scheduled Castes" means Castes mentioned in Part-II of the Constitution of India (Schedule Castes order-1950). (xi) "Backward Castes" means Castes notified as Backward Castes from time to time by the Government of Bihar. (xii) "Extremely Backward Castes" means Castes notified as Extremely Backward Castes, form time to time by the Government of Bihar. (xiii) "Women of the Backward Class" means and includes women of Scheduled Castes, Scheduled Tribes, Extremely Backward Castes and Backward castes.

PART-II APPOINTMENT IN THE CADRE OF RANGE OFFICER OF FORESTS 3. Appointment in the basic grade of the Range Officer of Forests shall be made as follows - (a) By direct recruitment through open competitive examination in accordance with the provisions of part -III of these rules. (b) By promotion from foresters in accordance with the provisions of part-IV of these rules. 4. (1) Fifty percent of the total number of posts in this cadre shall be filled up by direct recruitment and the rest fifty percent by promotion from the post of Forester. (2) The sanctioned strength of the cadre shall be as determined by the Government from time to time. 5. Principal Chief Conservator of Forests shall calculate vacancies Category wise, generally every year as on the first of April, to be filled up by direct recruitment and by promotion, in accordance with the Reservation Roster of the Government of Bihar in force and accordingly send requisition for direct recruitment to the Commission by 30th of April.

6. The provisions of the Bihar Reservation of Vacancies in posts and Services (for Scheduled Castes, Scheduled Tribes and other Backword Classes) Act, 1991 and the Rules made there under and roster as prescribed by the State Government from time to time shall be applicable to appointments and promotions in the service.

PART-III APPOINTMENT BY DIRECT RECRUITMENT (THROUGH OPEN COMPETITIVE EXAMINATION) 7. (1) Direct recruitment at the level of Range Officer of Forests shall be done on the recommendations of the Commission. (2) On the basis of requisition made under Rule 5, the commission shall from time to time, announce in such manner as it thinks fit, the category wise vacancies of this cadre to be filled up by direct recruitment. (3) The Commission shall hold Competitive Examination for this purpose.

8. Age Limit, Educational Qualifications and Physical Standard - (1) Age Limit - For appearing in the competitive examination, age of a candidate will not be less than 21 years as on first August of the year of requisition made to the Commission. The maximum age limit shall be same as it may be determined under the resolution of the State Government (The General Administration Department) from time to time, reserve category wise. Maximum age limit to those State Government Employees who want to appear at the competitive examination, will be in accordance with the maximum age limit decided under the resolution of the Government (The General Administration Department). (2) Calculation of age of a candidate shall be made on the basis of the date of birth mentioned in the Matriculation or Equivalent Examination Certificate.

(3) Educational Qualifications - Minimum educational qualification for the appointment to the post of the Range Officer of Forests shall be Bachelor Degree with at least one of the subjects namely Animal Husbandry & Veterinary Science, Botany, Chemistry, Geology, Mathematics, Physics, Statistics and Zoology or a Bachelor's degree in Agriculture, Forestry or in Engineering of any recognized University or equivalent. (iv) Standard of Physical fitness test -

9. (1)Government servant who is eligible for entry in the examination of the appointment to this post under the provisons of these Rules shall submit his/ her application through the prescribed authorized officer under the Bihar Government Servant (Application for the Posts) Rule, 1951. (2) There shall be no limit of opportunity for appearing at the Competitive Examination but a government servant may appear maximum thrice only. 10. There shall be following parts of the Competitive Examination - (a) Written examination. (b) Viva-voce (c) Physical fitness test 11. Written Examination - The Commission shall hold the written examination in accordance with the Conduct of Examination Rules 2010 (as amended from time to time) for the examination to be taken for the appointment by the Bihar Staff Selection Commission. Total marks of the written Examination shall be decided by the Commission. Minimum Qualifying marks for the result of examination shall be decided by the Commission in accordance with the guidelines issued by Government of Bihar. 12. Interview (Viva-voce) - Candidates shall be called for the interview on the basis of marks obtained at the written examination in a particular ratio, to be decided by the Commission, to the number of available vacancies. In the interview the whole personality and ability of a candidate for appointment to the post of Range Officer of Forests shall be tested. Total marks for the interview shall be 50. The marks obtained in the interview shall be added to the marks obtained in the written examination and merit list shall be prepared on the basis of total marks thus obtained.

Physical Fitness Test - A Physical fitness test for the Candidates called for interview shall be held by the Commission in accordance with the Rule- 8(4). The Commission, if it deems proper, may take help of the Department for this test. A Committee of Departmental Officers under the chairmanship of any member of the Commission may be constituted for the purpose. If a candidate fails in the physical fitness test, he shall not be recommended only on the basis of marks obtained in the written examination and interview. 14. Medical Test - (1) On request to the Director in Chief, Health Services, Government of Bihar, the commission may obtain the services of Civil Surgeon, Patna or Medical specialists, as the Commission may deem proper and the medical certificates of the candidates called for interview, in the form decided by the Commission. (2) For appointment to the post of Range Officer of Forests, it is essential for the successful and selected candidates to be mentally and physically fit. They should be completely free from all such physical defects which may restrain him in discharging their duties in their service period. A one eyed candidate shall not be recommended for the appointment. 15. Recommendation to the Government by the Commission- The Commission well prepare a final merit list of candidates qualifying the physical and medical tests, category wise as prescribe by the government according to the vacancies and recommend it the government for the appointment. The panel of candidates recommended by the Commission will be valid for one year. 16. The appointment order of such recommended candidates on the post of Range Officer of Forests shall be issued by the Appointing Authority after all such enquires, verification etc. as may be deemed necessary by the Government. 17. (1) Finally selected candidates shall be appointed as Range Officer of Forests on probation in the department. They will have to undergo professional training for 2 years in a recognized institute as determined by the State Government. The total period of probation shall be of two years for the Range Officer of Forests. (2) If the service, evaluated on the basis of performance of work and conduct of the employee, appointed on probation is not found satisfactory and/or he/she does not successfully complete the training determined under sub rule (1) this Rule, the probation period may be extended for one year. If the service, evaluated on the basis of performance of work and conduct of the employee appointed on probation is not found satisfactory even during the extended period, he/she shall be discharged from service. (3) During the period of probation, the range officers of forest shall be entitled to get pay and allowances, as determined by the Government from time to time. After successful completion of probation, the period spent on probation shall be treated as service period. 18. Finally selected and appointed Range Officer of Forests will have to express their assent to bond/Agreement as prescribed by the Principal Chief Conservator of Forests accepting the conditions as prescribed.

PART- IV APPOINTMENT BY PROMOTION 19. Foresters, serving in the department shall be eligible for appointment by promotion to the post of Range Officer of Forests by promotion. For promotion to the post of Range Officer of Forests:- (a) It shall be necessary for a Forester to pass the Foresters Training Examination or the Forest Guard Training Examination. (b) A regular and continuous service of 8 years as Forester will be essential.

20. Vacancies as on 1st April of each year as per the quota for promotion and as per reservation roster shall be calculated by the Appointing Authority. 21. For Promoting Foresters to the post of Range Officer of Forests, panel of names shall be prepared by a Screening committee at the level of Chief Conservator of Forests (Administration and Human Resource Development) or any other officer of the rank of Chief Conservator of Forests nominated by the Principal Chief Conservator of Forests, on the basis of scrutiny of service history and Annual Confidential Reports (A.C.R.) of Foresters for last five years preceding the year of promotion. 22. Compliance of Rules/ Circulars/ Directions as laid down by the General Administration Department, Government of Bihar for promotion shall be ensured. 23. Impartial Consideration will be made on the promotion of such Forester, who has been suspended and departmental proceeding/criminal proceedings initiated against him, and the decision shall be kept in sealed Cover but final decision regarding his promotion will be taken only after the disposal of the departmental proceeding/the criminal proceeding. Decision regarding promotion of the punished Foresters may be taken in accordance with the directions issued, by the General Administration Department, Government of Bihar from time to time. 24. The panel prepared in order of seniority by the screening committee constituted under Rule 21 of these Rules along with all service records such as service book and A.C.R. shall be sent to the Appointing Authority. 25. Final decision regarding promotion shall be taken in the meeting of departmental promotion committee constituted by the Department at the level of the Principal Chief Conservator of Forests. Appointing authority shall issue promotion order after completing the other necessary procedures.

PART-V INTER-SE SENIORITY 26. In cases, where the appointment in the cadre has been made by direct recruitment and by promotion against the vacancies of the same year, the member appointed by promotion shall be senior to the member appointed by direct recruitment in the cadre. 27. The inter-se seniority of members appointed in the same transaction through open competitive examination as laid down in Part-III of these Rules shall be decided on the basis of marks obtained in the examination conducted, by the Commission for the appointment as well as marks obtained in training. The weightage will be seventy five percent for the marks obtained in the examination conducted by the commission and twenty five percent for the marks obtained in training. In case of equality of total marks, seniority will be decided on the basis of marks obtained in training. 28. The inter-se seniority of members appointed in the same transaction in the cadre by promotion shall be decided on the basis of their inter-se seniority in the cadre of foresters.

PART-VI PAY AND ALLOWANCE ETC. 29. Such fixed Pay and Allowances shall be payable to Range Officer of Forests as may be determined by the Government of Bihar from time to time for them. 30. Range Officer of Forests will have to wear uniform at the time of performance of his duties as decided by the Appointing Authority from time to time.

PART-VII PROMOTION 31. Range Officers of Forests who have completed the service period of 8 years, will be eligible for appointment by promotion, to the post of basic grade of Bihar Forest Service in accordance with Bihar Forest Service Rules, 2013. PART-VIII Miscellaneous

32. Discipline, Control and appeal - The provision of the Bihar Government servants (Classification, Control and appeal) Rules, 2005 (as amended from time to time) shall apply to the Range officer of Forests Cadre relating to the matters of discipline, control and appeals.

33. Service conditions specially not provided in these Rules shall be governed by the Bihar Service Code and other decisions issued by the State Government from time to time.

34. In case of any doubt in the interpretation of any rule of these Rules, the same will be referred to the State Government and the decision of State Government on which shall be final.

35. If any difficulty arises in giving effect to any of the provisions of these rules, the Government may, by order published in the Official Gazette, make such provisions not inconsistent with the provisions of these rules, as may appear to it to be necessary or expedient for removing the difficulty.

36. Repeal and Savings - (1) The existing rules/regulations in this regard are hereby repealed. Provided that notwithstanding such repeal, anything done or any action taken under the provision of existing rules/regulations shall be deemed to have been done or taken under the corresponding provisions of these Rules as if this Rule was in force on the day on which such thing was done or action was taken.

(2) Notwithstanding such repeal as under sub rule (1) and to the extent they are not repugnant to the provisions of these rules, any right accrued or deemed to have been accrued there under or any liability or obligation incurred there under shall not be affected.
