Lट?पLट?पLट?पLट?पणीणीणीणी::::- इन पद, के वेतनमान के संबंध म4 (cid:1)व) (cid:1)वभाग कY सहमित से आदेश िनग2त Lकया जाएगा। ूा3पक मेड- II, मेड- I तथा वाःतु(cid:1)वद ूा3पक का व)2मान पदसोपान अगले आदेश तक जारM रहेगा।

4444. संवग2 बल ।संवग2 बल ।संवग2 बल ।संवग2 बल ।- संवग2 बल ऐसा होगा जो भवन िनमा2ण (cid:1)वभाग (cid:13)ारा समय-समय पर अवधाHरत Lकया जाय।

भ)5भ)5भ)5भ)5 5555.... (1) ूा3पक मेड- II का 85% पद सीधी भ)5 से भरा जायेगा और 15% पद योbय अनुरेखक/नील िचऽक से भरा जा सके गा, 9जसके िलए कम से कम 5 (पॉच) वष6 का अनुभव वॉंछनीय होगा।

(2) सभी भ(cid:1))2यॉं आयोग कY अनुशंसा पर ूा3पक कY कोLट म4 कY जायेगी। (3) िनयु(cid:1)* ूािधकार ूdयेक वष2 कY 1 अूील के आधार पर Hर(cid:1)*य, कY गणना करेगा और उस वष2 के 30 अूील तक आयोग को अिधयाचना भेज देगा।

(4) आयोग Hर(cid:1)*य, को (cid:1)वfा(cid:1)पत करेगा और ूितयोिगता परM>ा के अधार पर सफल अhयिथ2य, का चयन करने के बाद संबंिधत/िनयु(cid:1)* ूािधकार, को मेधाबम से अhयिथ2य, के नाम कY अनुशंसा करेगा। मेधासूची कY वैधता (cid:1)वभाग से अनुशंसा ूािi कY ितिथ से एक वष2 तक रहेगी।3 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 (5) स7यक छानबीन के बाद िनयु(cid:1)* ूािधकार अhयथ5 कY िनयु(cid:1)* परMवी>ा पर दो वष6 के िलए करेगा।

16161616.... ःथाःथाःथाःथाना'तना'तना'तना'तरणरणरणरण////पदःथापदःथापदःथापदःथापन ।पन ।पन ।पन ।---- संबंिधत पHर>ेऽ के मुBय अिभयंता अपने पHर>ेऽाधीन अपने किम2य, को आवँयकतानुसार ःथाना'तHरत/पदःथा(cid:1)पत करने के िलए स>म ूािधकारM ह,गे। एक पHर>ेऽ से दूसरे पHर>ेऽ म4 ःथाना'तरण/पदःथापन भवन िनमा2ण (cid:1)वभाग मं(cid:1)ऽमंडल सिचवालय (cid:1)वभाग के िनदेश के आलोक म4 ूdयेक वष2 जून माह म4 Lकया जाएगा अथवा मं(cid:1)ऽमंडल सिचवालय एवं सामा'य ूशासन (cid:1)वभाग (cid:13)ारा, समय-समय पर, िनग2त अनुदेश, के आलोक म4 Lकया जाएगा। जून माह से अलग Lकसी माह म4 ःथाना'तरण/पदःथापन कY 9ःथित म4 उपर कY पं(cid:1)* के पदािधकारM का अनुमोदन आवँयक होगा।

17171717. अविशंटअविशंटअविशंटअविशंट मामले । मामले । मामले । मामले ।---- ऐसे मामल, के संबंध म4 जो इस िनयमावली (cid:13)ारा (cid:1)विशंट 3प से आ"छाLदत नहMं है, संवग6 के सदःय रा0य सरकार के समुिचत ःतर के पदािधकाHरय,/कम2चाHरय, के िलए लागू संLहता िनयमावली, (cid:1)विनयमावली या आदेश, से शािसत ह,गे।

18181818. कLठनाई का िनराकरण ।कLठनाई का िनराकरण ।कLठनाई का िनराकरण ।कLठनाई का िनराकरण ।- यLद इस िनयमावली के ूावधान, के काया2'वयन म4 कोई कLठनाई उdप'न हो तो उस कLठनाई को दूर करने के िलए (cid:1)वभाग, समय-समय पर ऐसा सामा'य या (cid:1)वशेष िनदेश जो इस िनयमावली के ूावधान, से असंगत न हो, जारM कर सके गा।

19191919. िनव2चन ।िनव2चन ।िनव2चन ।िनव2चन ।---- जहॉं इस िनयमावली के ूावधान, म4 Lकसी के िनव2चन के संबंध म4 कोई शंका उdप'न हो, वहॉं मामला सामा'य ूशासन (cid:1)वभाग/(cid:1)व) (cid:1)वभाग (cid:13)ारा (cid:1)विन9rत Lकया जायेगा और उसका िनण2य अंितम होगा।

20202020. िनरसन एवं \यािनरसन एवं \यािनरसन एवं \यािनरसन एवं \यावृ(cid:1)) ।वृ(cid:1)) ।वृ(cid:1)) ।वृ(cid:1)) ।----(1) इस संवग2 के संबंध म4 पूव2 म4 िनग2त सभी संकvप एवं अनुदेश एतw (cid:13)ारा िनरिसत Lकये जाते है।

(2) ऐसा िनरसन के होते हुए भी ऐसे संकvप, अनुदेश के अधीन Lकया गया कोई काय2 या कY गयी कोई कार2वाई इस िनयमावली के अधीन Lकया गया या कY गयी समझी5 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 जायेगी मानो यह िनयमावली उस Lदन ूवृ) थी 9जस Lदन ऐसा काय2 या ऐसी कार2वाई कY गयी थी।

la0 [email protected]/2014-8593(Bh)—In exercise of Powers conferred by proviso to Article 309 of the constitution of India, the Governor of Bihar is pleased to make following Rules to regulate the recruitment and service condition of the Draftsman Cadre of Building Construction Department.

Chapter: - 1

Preliminary

1. Short title, extent & Commencement:-

(I) These Rules may be called "Bihar Building Construction Department Draftsman Cadre (Regional/ Headquarter establishment) (Recruitment & service conditions) Rules, 2014"

(II) It will extend to whole state of Bihar. (III) It will come in to force at once.

2. Definitions- In these Rules, unless otherwise require in the subject or context:-

(I) ''State Government'' means the Government of Bihar. (II) ''Department" means Building Construction Department. (III) "Cadre" means Draftsman cadre (Regional/Headquarter) in Building Construction Department.

(IV) "Commission" means Bihar staff selection commission: (V) "Appointing Authority" means the Chief Engineer, Building Construction Department of the concerned range.

(VI) "Fixed date" means the date of coming in to force of these rules. And (VII) "Member" means any personnel and all the personnel appointed in the cadre before coming into effect of these Rules.

3. Constitution of cadre- Structure of Draftsman Cadre shall be as follows:-

Note:- The order relating to the pay scale of these posts shall be issued with concurrence of Finance Department. The present chain of posts of Draftsman grade-II, grade-I and Architect Draftsman shall remain continue till further order.

4. Cadre strength- The Cadre strength shall be the same which may be determined by Building Construction Department, from time to time.

Chapter: 2 Recruitment 5. (I) 85% Post of Draftsman shall be filled up by direct recruitment and 15% Post shall be filled by promotion from Tracer/Blue Printer for which there shall be at least 5 (five) Years experience. (II) All recruitment shall be made on recommendation of the Commission in Draftsman category. (III) The appointing authority, after Calculating vacancy on the basis of position as on 1st April of the year, shall send requisition to the Commission latest by 30th April of that year. (IV) The Commission shall advertise the vacancy and shall select Candidates on the basis of Competitive examination. After preparation of merit list in the order of merit, the Commission shall send recommendation to the concerned appointing authority. The validity of merit list shall be for one year from the date of receipt of recommendation. (V) The Appointing Authority after proper verification shall appoint the candidates for two years on probation.

6. Qualification-(I) Minimum educational qualification shall be Diploma in Architectural Engineering/Civil Engineering or I.T.I or equivalent in civil draftsman trade.

7. Age limit- Age limit shall be such which may be determined by state Government (General Administration Department) from time to time. 8. Reservation-Compliance of Reservation Act of Government and reservation roster issued from time to time, by the Government shall be necessary,

9. Recruitment through promotion-

(I) Should possess Diploma in Architectural Engineering/Civil Engineering or I.T.I or equivalent with Draftsman trade.

(II) Promotion shall be given according to seniority on the recommendation of Departmental promotion Committee.

10. Probation-Every recruitment shall be for two years on probation. In special circumstances it may be extended for one year, if the appointing authority is satisfied that there is a chance of improvement in the probationer. If the service is not found satisfactory in extended period also, the concerned person shall be terminated from service.

11. Confirmation-The probations shall be confirmed after completion of satisfactory probation period.

12. Seniority- The inter-se Seniority of the member of this cadre shall be according to their merit positions determined by the Commission but the inter-se seniority determined prior to coming in to force of these Rules shall be unchangeable.

13. Promotion-(1) Promotion from basic grade to the higher post may be given after completion of requisite Kalawadhi as determined by General Administration Department from time to time and on recommendation of Departmental promotion Committee. (2) Departmental promotion Committee shall be Constituted as follows:-

(I) Chief Engineer Chairman.

(II) Superintending Engineer Member7 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 (III) An officer of S.C/S.T as determined by the chairman (Who shall not be below the rank of Executive Engineer)- Member (IV) Chief Engineer (Headquarter) Member Secretary

Chapter:-3 Pay and efficiency bar 14. Pay Scale- The pay scale admissible by the state government of different categories of the post and corresponding pay scale will declared by the state government from time to time.

Chapter:-4 General/Miscellaneous 15. Level of cadre-The Cadre shall be of the level of range Chief Engineer but in case of transfer of the personnel from one range to another on his own request, the concerned personnel shall be deemed to be junior most in the transferred range.

16. Transfer/Posting-The Chief Engineer of the concerned range shall be competent authority to make transfer/posting of the personnel. Transfer/posting from one range to another shall be made every year in the month of June in the light of instructions of Building Construction Department, Cabinet Secretariat Department and General Administration Department issued, from time to time. In case transfer/posting is made in any month other than the month of June, it shall be necessary to obtain approval of officer of the above rank.

17. Residue Matters- In respect of such cases, which are not covered specifically by these Rules, the member of this cadre shall be governed by the code/Rules/Resolutions/orders applicable to the officers/employees of appropriate level of the state government.

18. Removal of difficulties- If any difficulty arises in implementation of provisions of these Rules, the Department may issue general or specific instructions which are not inconsistent of the provision of these Rules from to time to remove such difficulty,

19. Interpretation-Here any doubt arises in respect of interpretation of any provision of these Rules, it shall be determined by General Administration Department/Finance Department and its decision shall be final.

20. Repeal & savings-(1) All the Rules and resolutions issued earlier in respect of the Cadre are hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the aforesaid Rules, resolutions, orders instruction etc. shall be deemed to be done or taken under these Rules as if these Rules were in force on the date on which such thing was done or such an action was taken.
