5555.... (1) सभी भ(cid:1)(1यॉं आयोग क2 अनुशंसा पर शोध सहायक के मूल कोHट मF क2 जायेगी।

(2) शोध सहायक का 100% पद सीधी भ(T से भरा जायेगा।

(3) िनयु(cid:1)) ूािधकार ू_येक वष1 क2 1 अूैल के आधार पर Bर(cid:1))य+ क2 गणना करेगा और उस वष1 के 30 अूैल तक आयोग को अिधयाचना भेज देगा। (4) आयोग Bर(cid:1))य+ को (cid:1)वaा(cid:1)पत करेगा और ूितयोिगता परI7ा के अधार पर सफल अcयिथ1य+ का चयन करने के बाद संबंिधत िनयु(cid:1)) ूािधकार को मेघाबम से अcयिथ1य+ के नाम क2 अनुशंसा करेगा। मेघासूची क2 वैeता (cid:1)वभाग मF अनुशंसा ूािf क2 ितिथ से एक वष1 तक रहेगी।3 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 (5) स4यक् छानबीन के बाद िनयु(cid:1)) ूािधकार अcयथT क2 िनयु(cid:1)) परIवी7ा पर दो वष3 के िलए करेगा।

6666. अह1ता ।अह1ता ।अह1ता ।अह1ता ।---- (1) शोध सहायक के पद पर सीधी िनयु(cid:1)) हेतु &यूनतम शै76णक योhयता सरकार (cid:13)ारा मा&यता ूा8त Hकसी (cid:1)वँव(cid:1)वeालय से (cid:1)वaान ःनातक (भौितक, रसायन एवं ग6णत के साथ) होगी।

7777. उॆ सीमा ।उॆ सीमा ।उॆ सीमा ।उॆ सीमा ।- िनयु(cid:1)) हेतु &यूनतम उॆ सीमा 21 वष1 होगी ओर अिधकतम उॆ सीमा वहIं होगी जो रा/य सरकार (सामा&य ूशासन (cid:1)वभाग) (cid:13)ारा समय-समय पर िनधा1Bरत क2 जाय।

8888. आर7ण ।आर7ण ।आर7ण ।आर7ण ।- िनयु(cid:1)) एवं ूो&नित मF रा/य सरकार (cid:13)ारा समय-समय पर अिधसूिचत आर7ण/रोःटर का अनुपालन आवँयक होगा।

9999.... ूो&नूो&नूो&नूो&नित (cid:13)ारा भ(T ।ित (cid:13)ारा भ(T ।ित (cid:13)ारा भ(T ।ित (cid:13)ारा भ(T ।- ूयोगशाला सहायक के पद+ को शोध सहायक के पद+ मF पBरव(cid:1)(1त कर (cid:1)वलो(cid:1)पत कर Hदया जायेगा एवं व(1मान मF काय1रत ूयोगशाला सहायक+ को (cid:1)विभ&न चरण+ मF शोध सहायक के पद+ पर िन4निल6खत ूावधान के अनुसार ूो&नित दI जायेगी। जबतक पBरव(cid:1)(1त शोध सहायक के पद पर ूो&नित क2 ूHबया पूरI नहIं हो जाती तबतक ूयोगशाला सहायक+ क2 ूो&नित िन4निल6खत ूावधान के अनुसार क2 जायेगी और यह (cid:1)बnकु ल बीच क2 Zयवःथा होगी एवं काया1लय के सभी ूयोगशाला सहायक+ के ूो&नित के बाद भ(cid:1)वंय मF होने वाले शोध सहायक+ क2 सभी Bर(cid:1))यॉं, सीधी िनयु(cid:1)) से भरI जाएगी:-

(i) पBरव(cid:1)(1त शोध सहायक के पद+ पर व(1मान मF काय1रत ूयोगशाला सहायक+ को सव1ूथम िनधा1Bरत (cid:1)विभ&न चरण+ मF ूो&नत Hकया जायेगा। ूो&नित हेतु ऐसे ूयोगशाला सहायक पाऽ ह+गे 6जनक2 &यूनतम शै76णक योhयता मैHशकु लेट हो तथा उXत पद पर कम से कम 10 वष3 का संतोषूद सेवा पूरI कर ली हो एवं अ&यथा ूो&नित के योhय हो और आई0एस0सी0 उ(ीण1 ूयोगशाला सहायक, जो 8 वष3 क2 सेवा पूरI कर िलयF हो एवं अ&यथा ूो&नित के योhय हो। बी0एस0सी0 (भौितक2, रसायन एवं ग6णत) योhयता वाले ूयोगशाला सहायक क2 ूो&नित के िलए यह अविध 7 वष3 क2 होगी। सभी काय1रत ूयोगशाला सहायक के ूो&नित के बाद यHद पBरव(cid:1)(1त शोध सहायक के पद बचे रह जाते है तो इन पर सीधी िनयु(cid:1)) होगी।

(ii) जबतक पBरव(cid:1)(1त शोध सहायक के पद पर ूो&नित क2 ूHबया पूरI नहIं हो जाती है तबतक शोध सहायक के 25 ूितशत पद सीधी िनयु(cid:1)) से भरे जायFगे एवं 75 ूितशत पद उपयु 1Xत ूHबयानुसार ूयोगशाला सहायक+ क2 ूो&नित से भरे जायFगे। 10101010. पBरवी7ा ।पBरवी7ा ।पBरवी7ा ।पBरवी7ा ।- ू_येक भ(T पBरवी7ा पर दो वष3 के िलए होगी ओर (cid:1)वशेष पBर6ःथितय+ मF इसका (cid:1)वःतार एक वष1 के िलए िनयु(cid:1)) ूािधकार (cid:13)ारा Hकया जा सके गा। यHद पBरवी7ा अविध संतोषजनक नहIं हो तो ऐसा अविध (cid:1)वःतार तभी होगा जब िनयु(cid:1))4 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 ूािधकार क2 राय मF पBरवी7ाधीन कमT मF सुधार क2 गु ंजाइश हो। यHद (cid:1)वःताBरत अविध मF भी सेवा संतोषजनक नहIं पाया जाता है तो संबंिधत Zय(cid:1)) को सेवामुXत कर Hदया जायेगा। 11111111. स4पुस4पुस4पुस4पु(cid:1)q ।(cid:1)q ।(cid:1)q ।(cid:1)q ।- पBरवी7ाधीन Zय(cid:1)) पBरवी7ा अविध क2 संतोषजनक समािf के बाद स4पुंट Hकया जायेगा।

13131313. ूो&नूो&नूो&नूो&नित ।ित ।ित ।ित ।----(1) ूयोगशाला सहायक+ को शोध सहायक के पद (संपBरवित1त) पर ूो&नित सामा&य ूशासन (cid:1)वभाग (cid:13)ारा समय-समय पर िनधा1Bरत कालविध के पूरा होने पर और (cid:1)वभागीय ूो&नित सिमित क2 अनुशंसा पर दI जा सके गी। (2) (cid:1)वभागीय ूो&नित सिमित िन4निल6खत को िमलाकर गHठत होगी:-

(क) मु<य अिभयंता- अSय7 (ख) अधी7ण अिभयंता- सदःय (ग) अSय7 (cid:13)ारा (cid:1)विन6rत अनुसूिचत जाित/

16161616.... ःथाःथाःथाःथाना&तना&तना&तना&तरणरणरणरण////पदःथापदःथापदःथापदःथापन ।पन ।पन ।पन ।---- संबंिधत पBर7ेऽ के मुख ्य अिभयंता अपने पBर7ेऽाधीन अपने किम1य+ को आवँयकतानुसार ःथाना&तBरत/पदःथा(cid:1)पत करने के िलए स7म ूािधकारI ह+गे। एक पBर7ेऽ से दूसरे पBर7ेऽ मF ःथाना&तरण/पदःथापन भवन िनमा1ण (cid:1)वभाग मं(cid:1)ऽमंडल सिचवालय (cid:1)वभाग के िनदेश के आलोक मF ूत ्येक वष1 जून माह मF Hकया जाएगा अथवा मं(cid:1)ऽमंडल सिचवालय एवं सामा&य ूशासन (cid:1)वभाग (cid:13)ारा, समय-समय पर, िनग1त अनुदेश+ के आलोक मF Hकया जाएगा। जून माह से अलग Hकसी माह मF5 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 ःथाना&तरण/पदःथापन क2 6ःथित मF उपर क2 पं(cid:1)) के पदािधकारI का अनुमोदन आवँयक होगा।

18181818. कHठनाई का िनराकरण ।कHठनाई का िनराकरण ।कHठनाई का िनराकरण ।कHठनाई का िनराकरण ।- यHद इस िनयमावली के ूावधान+ के काया1&वयन मF कोई कHठनाई उ_प&न हो तो उस कHठनाई को दूर करने के िलए (cid:1)वभाग, समय-समय पर ऐसा सामा&य या (cid:1)वशेष िनदेश जो इस िनयमावली के ूावधान+ से असंगत न हो, जारI कर सके गा।

19191919. िनव1चन ।िनव1चन ।िनव1चन ।िनव1चन ।---- जहॉं इस िनयमावली के ूावधान+ मF Hकसी के िनव1चन के संबंध मF कोई शंका उ_प&न हो, वहॉं मामला सामा&य ूशासन (cid:1)वभाग/(cid:1)व( (cid:1)वभाग (cid:13)ारा (cid:1)विन6rत Hकया जायेगा और उसका िनण1य अंितम होगा।

20202020. िनरसन एवं Zयािनरसन एवं Zयािनरसन एवं Zयािनरसन एवं Zयावृ(cid:1)( ।वृ(cid:1)( ।वृ(cid:1)( ।वृ(cid:1)( ।---- (1) इस संवग1 के संबंध मF पूव1 मF िनग1त सभी संकnप एवं अनुदेश, एतw (cid:13)ारा िनरिसत Hकये जाते है।

(2) ऐसा िनरसन के होते हुए भी ऐसे संकnप, अनुदेश के अधीन Hकया गया कोई काय1 या क2 गयी कोई कार1वाई इस िनयमावली के अधीन Hकया गया या क2 गयी समझी जायेगी मानो यह िनयमावली उस Hदन ूवृ( थी 6जस Hदन ऐसा काय1 या ऐसी कार1वाई क2 गयी थी।

la0 [email protected]/2014-8590(Bh)— In exercise of the powers conferred under proviso to Article 309 of the constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the recruitment and service-condition of technical cadre (Laboratory Assistant and Research Assistant) of Bihar Building Construction Department.

Chapter: 1

Preliminary

1. Short title, extent & Commencement-

(1) These Rules may be called as the "Bihar Building Construction Department Technical cadre (Regional/Head quarter establishment) (recruitment & Service conditions) Rules, 2014".

(2) It will extend to whole state of Bihar. (3) It will come in to force at once.

2. Definitions.- In these Rules, unless otherwise require in the subject or context:-

(I) ''State Government'' means the Government of Bihar.

(II) ''Department" means Building Construction Department.

(III) ''Cadre'' means Technical cadre Research Assistant (Regional establishment) in Building Construction Department.

(IV) 'Commission' means Bihar staff selection commission: (V) "Appointing Authority" means the Chief Engineer, Building Construction Department of concerned range.

(VI) "Fixed date" means the date of coming it to force of these Rules. And (VII) "Member" means any personnel and all the personnel appointed in the cadre before coming in to effect of these Rules.

3. Constitution of cadre- Structure of Technical Cadre (Research Assistant) shall

Note:- The order relating to the pay scale of these posts shall be issued with concurrence of the Finance Department. The present chain of posts of Laboratory Assistant, Research Assistant shall remain continued till further order.

4. Cadre strength- The Cadre strength shall be the same which may be determined by the Department, from time to time.

Chapter: 2 Recruitment 5. (1) All recruitments to the post of basic category of Research Assistant shall be made on the recommendation of the Commission. (2) 100% post of Research Assistant shall be filled up by direct recruitment. (3) The appointing authority, after calculating vacancy on the basis of the position as on 1st April of the year, shall send requisition to the Commission latest by 30th April of that year. (4) The Commission shall advertise the vacancy and shall select candidates on the basis of Competitive Examination. After preparation of merit list in order of merit, the Commission shall send the recommendation to the concerned Appointing Authority. The validity of merit-list shall be up to one year from the date of receipt of the recommendation in the Department. (5) The Appointing Authority, after proper verification, shall appoint the candidates for two years on probation.

6. Qualification- (1) Minimum educational qualification for the direct recruitment to the post of Research Assistant shall be science graduate (with Physics, Chemistry and Mathematics) from any recognized University of the Government.

7. Age limit- Minimum Age limit for appointment shall be 21 years and maximum age limit shall be the same which may be determined by the state Government (General Administration Department) from time to time.

8. Reservation-Compliance of Reservation Act of Government and reservation roster issued from time to time, by the Government shall be necessary. 9. Recruitment by promotion- The post of Laboratory Assistant shall be deleted converting in to the post of Research Assistant and the present working Lab. Assistant shall be promoted to the post of Research Assistant in different phase7 (cid:1)बहार गजट (असाधारण), 22222222 अगःतअगःतअगःतअगःत 2014201420142014 according to provision described here-under. Promotion of Lab. Assistant shall be made according to the following provisions unless the promotion to the converted post of Research Assistant shall not be completed, and it shall be absolutely an arrangement for interregnum period and after promotion of all the Lab. Assistants of the office, the future appointment to the posts of Research Assistant shall be made by direct recruitment only.

(i) Converted post of Research Assistant shall be filled up by the working Lab. Assistant by promotion in different phases. Lab. Assistants, who possess minimum educational qualification of matriculation and have rendered at least 10 years satisfactory service and are otherwise eligible to be promoted, and I.sc pass Lab. Assistant who have rendered 8 years satisfactory service and are otherwise eligible to be promoted shall be eligible for promotion. For B.sc (Physics, Chemistry & Mathematics) degree holder the period for promotion shall be of 7 years. If the post of Research Assistant remains vacant after promotion of all the Lab. Assistants, the remaining vacant posts shall be filled by direct recruitment.

(ii) 25% posts shall be filled up by direct recruitment unless the process of promotion to the converted post of Research Assistant is not completed and 75% posts shall be filled up by promotion of Lab. Assistant according to above mentioned provision.

10. Probation-Every recruitment shall be for two years on probation and in special circumstances it may be extended for one year, if the appointing authority is satisfied that there is a chance of improvement in the probationer. If the service is not found satisfactory in extended period also, the concerned person shall be terminated from service.

11. Confirmation- The Probationer shall be confirmed after completion of satisfactory probation period.

12. Seniority- The inter-se seniority of the member of this cadre shall be according to their merit positions determined by the Commission but the inter-se seniority determined prior to coming in to force of these Rules shall be unchangeable.

13. Promotion-(1) Lab. Assistant may be promoted to the post of Research Assistant (converted) on completion of Kalawadhi as determined by General Administration Department, from time to time, and on the recommendation of Departmental Promotion Committee. (2) Departmental Promotion Committee shall be Constituted consisting of the following:- (a) Chief Engineer Chairman. (b) Superintending Engineer Member (c) An officer of S.C/S.T determined by the chairman (Who shall not be below the rank of Executive Engineer)- Member (d) Senior Technical officer Member Secretary nominated by the Chief Engineer

Chapter:-3 Pay and efficiency bar 14. Pay Scale- The pay scale admissible by the state government of different categories of the post and corresponding pay scale will declared by the state government from time to time.

General/Miscellaneous 15. Level of cadre-This Cadre shall be at the level of range Chief Engineer but in case of transfer of the personnel from one range to another on his own request, the concerned personnel shall be deemed to be junior most in the transferred range.

16. Transfer/Posting-The Chief Engineer of the concerned range shall be competent authority to make transfer/posting of the personnel. Transfer/posting from one range to another shall be made every year in the month of June in the light of instructions of Building Construction Department, Cabinet Secretariat Department and General Administration Department issued, from time to time. In case transfer/posting is made in any month other than the month of June, it shall be necessary to obtain approval of the officer of the above rank. 17. Residue Matters- In respect of such cases, which are not covered specifically by these Rules, the members of this cadre shall be governed by the code/Rules/Resolutions/orders applicable to the officers /employees of appropriate level of the state government.

18. Removal of difficulties- If any difficulty arises in implementation of provisions of these Rules, the Department may issue general or specific instructions which are not inconsistent of the provisions of these Rules from time to time to remove such difficulty.

19. Interpretation-Where any doubt arises in respect of interpretation of any provision of these Rules, it shall be determined by General Administration Department/Finance Department and its decision shall be final.

20. Repeal & savings-(1) All the Rules and Resolutions issued earlier in respect of the cadre are hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the aforesaid Rules, resolutions, orders instructions etc. shall be deemed to be done or taken under these Rules as if these Rules were in force on the date on which such thing was done or such an action was taken.
