डी0पी0एस0-2-0-2/2009-168—प्रोबेशन ऑफ ऑफेन्डर्स एक्ट 1958 की धारा-17 के अधीन बनाए गए 17 के अधीन बनाए गए बिहार प्रोबेशन ऑफ ऑफेन्डर्स रूल 1959 के नियम 9 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये बिहार के राज्यपाल बिहार प्रोबेशन ऑफ ऑफेन्डर्स रूल 1959 के नियम 9 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये बिहार के राज्यपाल बिहार प्रोबेशन ऑफ ऑफेन्डर्स रूल 1959 के नियम 9 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये बिहार के राज्यपाल पदाधिकारियों के पदों पर भर्ती एवं सेवा शर्तों के विनियमन हेतु बिहार बिहार राज्य के प्रोबेशन कार्यालयों में प्रोबेशन बिहार राज्य के प्रोबेशन कार्यालयों में प्रोबेशन पदाधिकारियों के पदों पर भर्ती एवं सेवा शर्तों के विनियमन हेतु बिहार प्रोबेशन (परिवीक्षा) सेवा के लिये निम्नांकित नियमावली बनाते हैः- प्रोबेशन (परिवीक्षा) सेवा के लिये निम्नांकित नियमावली बनाते हैः-
अध्याय 1-सामान्य
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ। यह नियमावली '' बिहार प्रोबेशन (परिवीक्षा) सेवा नियमावली संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह नियमावली '' बिहार प्रोबेशन (परिवीक्षा) सेवा नियमावली 2014'' कही जा सकेगी। (2) इसका विस्तार संपूर्ण राज्य में होगा। इसका विस्तार संपूर्ण राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत्त होगी। यह तुरंत के प्रभाव से प्रवृत्त होगी।

(vii) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है, सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक रूप से गठित ) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है, सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक रूप से गठित ) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है, सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक रूप से गठित समिति;
ााग'' से अभिप्रेत है, कार्यपालिका नियमावली में यथाविर्निदिष्ट गृह विभाग, बिहार; (viii) ''विभाग'' से अभिप्रेत है, कार्यपालिका नियमावली में यथाविर्निदिष्ट गृह विभाग, बिहार ााग'' से अभिप्रेत है, कार्यपालिका नियमावली में यथाविर्निदिष्ट गृह विभाग, बिहार2 (cid:1)बहार गजट (असाधारण), 3333 िसत'बिसत'बिसत'बिसत'बरररर 2014201420142014 (ix) ''कारा एवं सुधार सेवाएँ निरीक्षणालय'' से अभिप्रेत है, महानिरीक्षक, कारा एवं सुधार सेवाएँ बिहार का कार्यालय;
(x) ''प्रोन्नति द्वारा नियुक्ति'' से अभिप्रेत है, प्रोबेशन पदाधिकारी से सरकार द्वारा समय-समय पर नियत प्रतिशत के आधार पर एवं इस नियमावली में यथोलिखित समुचित स्थान पर प्रोन्नति द्वारा की गई नियुक्ति;
(xi) ''प्रोबेशन पदाधिकारी'' से अभिप्रेत है, बिहार के प्रोबेशन कार्यालयों में प्रोबेशन पदाधिकारी के सृजित एवं स्वी—त पद।
3. संवर्ग का गठन।- (1) राज्य अवस्थित सभी प्रोबेशन कार्यालयों, समाज कल्याण विभाग तथा कारा एवं सुधार सेवाएँ निरीक्षणालय में राज्य सरकार द्वारा समय-समय पर सृजित, स्वीकृत एवं अधिसूचित प्रोबेशन पदाधिकारी, प्रधान प्रोबेशन पदाधिकारी एवं निदेशक, प्रोबेशन चर्या के पद। (2) '' बिहार प्रोबेशन सेवा'' में सीधी भर्ती प्रोबेशन पदाधिकारी के रूप में की जायेगी तथा संपूर्ण सेवा अवधि में ''बिहार प्रोबेशन सेवा'' के सदस्यों का सेवा दायित्व कारा एवं सुधार सेवाएँ निरीक्षणालय, समाज कल्याण विभाग तथा राज्य के सभी प्रोबेशन कार्यालयों में समान रूप से होगा। राज्य सरकार सेवा के किसी पदाधिकारी को राज्य अवस्थित किसी भी प्रोबेशन कार्यालय, समाज कल्याण अथवा सेवा के दायित्व वाले किसी अन्य कार्यालय में पदस्थापित कर सकेगी। सरकार, समय-समय पर, अन्य दायित्व हेतु प्रोबेशन पदाधिकारी को प्रतिनियुक्त/प्रतिनियोजित सरकार की आवश्यकतानुसार आदेशित/अधिसूचित कर सकेगी। (3) इस नियमावली के आरंभ होने के पूर्व से उक्त कोटियों में नियुक्त एवं कार्यरत सभी व्यक्ति स्वतः इस सेवा में शामिल समझे जायेंगे।
(4) उक्त सेवा के सदस्यों पर परिचालनात्मक नियंत्रण महानिरीक्षक, कारा एवं सुधार सेवाएँ, बिहार का होगा।
अध्याय 2-भर्ती
4. भर्ती का स्रोत।- सीधी भर्ती- आयोग द्वारा विभिन्न सेवाओं हेतु आयोजित संयुक्त प्रतियोगिता परीक्षा के आधार पर आयोग से प्राप्त अनुशंसा के आधार पर सेवा के मूल कोटि के पदों पर सीधी भर्ती की जायेगी।
(1) आयोग, सरकार द्वारा प्रेषित इस सेवा की रिक्तियों के लिए अधियाचना के आधार पर प्रति वर्ष आयोजित की जाने वाली संयुक्त प्रतियोगिता परीक्षा हेतु विज्ञापन में उसे शामिल करेगा।
(2) आयोग अपनी विहित रीति एवं प्रक्रिया द्वारा आयोजित परीक्षा के आधार पर चयनित उम्मीदवारों की सूची विभाग को अनुशंसित कर प्रेषित करेगा।
(3) सेवा में प्रवेश की आयु वही होगी जो समय-समय पर सरकार द्वारा विहित की जाय। (4) शैक्षणिक योग्यता- किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक या समकक्ष। (5) चिकित्सा परीक्षण- बिहार प्रोबेशन सेवा हेतु सीधी भर्ती के आधार पर नियुक्ति हेतु अनुशंसित अभ्यर्थियों को योगदान के समय असैनिक शल्य चिकित्सक से स्वास्थ्य परीक्षण के उपरान्त उनके द्वारा निर्गत स्वास्थ्य प्रमाण-पत्र प्रस्तुत करना अनिवार्य होगा। अभ्यर्थियों के स्वस्थ होने पर ही नियुक्ति की जाएगी। नियुक्ति प्राधिकार को किसी चिकित्सा संस्थान/चिकित्सा महाविद्यालय अथवा गठित चिकित्सा बोर्ड द्वारा समर्पित चिकित्सा परीक्षण की रिपोर्ट पर विचार करने के बाद आयोग द्वारा अनुशंसित सूची के किसी भी उम्मीदवार की उम्मीदवारी को स्वीकार या रद्द करने की अधिकारिता होगी। आयोग द्वारा आयोजित परीक्षा में उत्तीर्णता आयोग की अनुशंसा से किसी उम्मीदवार की नियुक्ति का दावा स्थापित नहीं होगा जब तक कि सरकार अपनी विहित रीति एवं प्रक्रिया द्वारा अपने स्तर से उम्मीदवार की सेवा हेतु सभी दृष्टिकोण से उपयुक्तता की जाँच कराकर संतुष्ट न हो ले।
5. आरक्षण।- नियुक्ति एवं प्रोन्नति में बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण (अनुसूचित जातियों, अनुसूचित जन जातियों एवं अन्य पिछड़े वर्गों के लिए) अधिनियम 1991, समय-समय पर यथा संशोधित, के प्रावधान लागू होंगे।
6. परिवीक्षा एवं उसकी अवधि।- सीधी भर्ती से नियुक्त अभ्यर्थी को सेवा के प्रारंभ में परिवीक्षा पर नियुक्त किया जायेगा। परिवीक्षा की अवधि नियुक्ति की तिथि से दो वर्ष की होगी।
7. प्रशिक्षण/विभागीय परीक्षा।- परिवीक्षा अवधि में सीधी भर्ती द्वारा नियुक्त व्यक्ति से ऐसा प्रशिक्षण लेने या ऐसी विभागीय परीक्षा में उतीर्ण होने की अपेक्षा की जायेगी जो सेवा नियंत्री प्राधिकार द्वारा समय-समय पर विहित की जाय। संवर्ग के सदस्यों की सेवा संपुष्टि एवं आगे की प्रोन्नति पर विचार नहीं किया जायेगा यदि विभाग द्वारा विहित किसी कारा, प्रशासनिक प्रशिक्षण संस्थान या अन्य संस्थान में आयोजित अनिवार्य प्रशिक्षण पाठ्यक्रम में सम्मिलित नहीं होंगे और अथवा विभागीय परीक्षा में उतीर्ण नही होंगे। परन्तु किसी कारण से ऐसे प्रशिक्षण का आयोजन संभव नहीं हो तो संवर्ग नियंत्री प्राधिकार इस अपेक्षा को शिथिल कर सकेगा।
8. प्रोन्नति।- (1) संवर्ग के पद- इस संवर्ग में निम्नांकित पद सोपान होंगें :-
(i) प्रोबेशन पदाधिकारी3 (cid:1)बहार गजट (असाधारण), 3333 िसत'बिसत'बिसत'बिसत'बरररर 2014201420142014 (ii) प्रधान प्रोबेशन पदाधिकारी- प्रोन्न्ति का प्रथम सेापान (iii) निदेशक, प्रोबेशन चर्या- प्रोन्नति का द्वितीय सोपान (2) प्रोन्नति के पद सोपानों पर विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति की कार्रवाई की जायेगी। (3) ऐसी प्रोन्नतियों हेतु न्यूनतम अर्हक सेवा, अर्थात '' कालावधि'' वही होगी जो राज्य के सामान्य प्रशासन विभाग, बिहार द्वारा समय-समय पर विनिश्चित की जाए। (4) संवर्ग की प्राधिकृत संख्या, पदों की संख्या एवं वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अधिसूचित की जाएगी और जो समय-समय पर प्रशासनिक हित में किसी पद का अंतः स्थापन या विलोपन या अन्यथा द्वारा स्वतः पुनरीक्षित या उपांतरित समझी जाएगी। 9. वरीयता।- (1) सीधी भर्ती से नियुक्त सेवा के सदस्यों की पारस्परिक वरीयता आयोग की मेधा सूची के क्रम में निर्धारित की जायेगी।
(2) प्रधान प्रोबेशन पदाधिकारी के पद पर नियुक्त पदाधिकारी की आपसी वरीयता का निर्धारण सामान्य प्रशासन विभाग, बिहार द्वारा समय-समय पर निर्गत अनुदेशों के अनुरूप किया जायेगा।
10. अनुशासनिक कार्रवाई।- बिहार सरकारी सेवा (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 एवं समय-समय पर सरकार द्वारा अधिसूचित/निर्गत प्रावधान, सेवा के सदस्यों पर, लागू होंगे।
11. अवशिष्ट मामले।ं- इस नियमावली या इसके अधीन जारी किये गये आदेशों या विशेष आदेशों से विशिष्टतः अनाच्छादित मामलों के संबंध में संवर्ग के सदस्य राज्य सरकार के समुचित स्तर के कार्मियों के संबंध में लागू विनियमों और आदेशोंं द्वारा शासित होंगे।
12. कठिनाईयों का निराकरण।- इस नियमावली के प्रावधानों के कार्यान्वयन में होने वाली कठिनाईयों के निराकरण के लिये समय-समय पर सरकार यथा आवश्यक सामान्य या विशेष निदेश जारी कर सकेंगी।
13. शिथिल करने की शक्ति।-सरकार की राय में यदि ऐसा करना समीचीन है, और समुचित हो तो उसमें अभिलिखित किये जाने वाले कारणों से, किसी व्यक्ति या पद या पद के किसी वर्ग या कोटि के संबंध में इस नियमावली के किसी प्रावधान को शिथिल कर सकेगी।
14. निर्वचन।- इस नियमावली के प्रावधानों के संबंध में किसी प्रकार की शंका के संबंध में निर्वचन की शक्ति गृह विभाग में निहित होगी और उसका विनिश्चिय अंतिम होगा।
15. निरसन एवं व्यावृति।-(1) इस नियामावली के आरम्भ की तिथि के पूर्व प्रोबेशन सेवा संवर्ग के पदों के लिए अधिसूचित और लागू सभी नियम, संकल्प, परिपत्र आदेश निरसित समझे जायेगें। (2) ऐसे निरसन के होते हुए भी, उक्त नियमावली, संकल्प/परिपत्र/आदेश द्वारा या के अधीन प्रदत्त शक्तियों के प्रयोग में किया गया कोई कार्य या की गई कार्रवाई इस नियमावली के अधीन प्रदत्त शक्तियों के प्रयोग में किया गया या की गई समझी जायेगी, मानो यह नियमावली इस दिन प्रर्वतन में थी, जिस दिन ऐसा कार्य किया गया या ऐसी कार्रवाई की गयी थी।

No. DPS-2-0-2/2009-168—In exercise of Power conferred by the provision of Rule 9 of Bihar Probation of Offenders Rule 1959, made in exercise of powers conferred by the provision of section 17 of Probation of Offenders Act 1958, the Governor of Bihar is pleased to make the following Rules for Bihar Probation Service to Regulate the appointment and service condition to the post of the Probation Officers in the probation offices situated in the State of Bihar:-
CHAPTER I -GENERAL
1. Short title, extent and commencement:—(1) These rules may be called Bihar Probation Service Rules, 2014;
(2) It shall extend to the whole of the State of Bihar; (3) It shall come into force with immediate effect. 2. DEFINITION:—In these rules, unless there is anything repugnant to the subject or context,
(i) 'Government' means Government of Bihar; (ii) 'Commission' means 'Bihar Public Service Commission'; (iii) 'Service' means Bihar Probation Service ; (iv) 'Appointing Authority' means Government of Bihar ;
4(cid:1)बहार गजट (असाधारण), 3333 िसत'बिसत'बिसत'बिसत'बरररर 2014201420142014 (v) 'Service Cadre Control Authority' means Inspector General, Prison and Correctional Services, Bihar;
(vi) 'Direct Recruitment' means recruitment on the basis of Combined Competitive Examination held by Bihar Public Service Commission; (vii) 'Departmental Promotion Committee' means the committee duly constituted by the Government for departmental promotion;
(viii) 'Department' means the Home Department, Bihar as specified in the Rule of Executive Business;
(ix) 'Prisons and Correctional Services Inspectorate" means Office of the Inspector General, Prisons and Correctional Services;
(x) 'Appointment by Promotion' means the appointment made by promotion from the post of Probation Officer to appropriate place as mentioned in these rules and on the basis of the percentage determined, from time to time, by the Government.
(xi) 'Probation Officer' means the created and sanctioned posts of Probation Officer in the probation offices of Bihar.
3. CONSTITUTION OF CADRE:—(1) Post of Probation Officer, Principal Probation Officer, and Director Probation Services, created, sanctioned and notified by State Government from time to time in all Probation offices, Social Welfare Department and Prisons and Correctional Services Inspectorate situated in the State.
(2) Direct Recruitment shall be made on the post of Probation Officer in Bihar Probation Service and the service liabilities of members of the "Bihar Probation Service" shall be in Prisons and Correctional Services Inspectorate, Social Welfare Department and all Probation Offices of the State uniformly in whole service period.
The State Government may post any officer of the Service to any Probation Office, Social Welfare Department or any other offices of service liabilities. The Government may depute/appoint the Probation Officers from time to time, for other responsibilities, or order/notify as the Government may have necessity.
(3) All persons already appointed or working in the said category prior to the commencement of these Rules shall be deemed to included automatically in this Service.
(4) The operational control over the member of the said cadre shall be under the Inspector General, Prisons and Correctional Services, Bihar.
CHAPTER 2- RECRUITMENT:
4. SOURCE OF RECRUITMENT:—Direct Recruitment shall be made in the basic category of the Service on the recommendation made by Commission, on the basis of Combined Competitive Examination held for various services.
(1) The Commission shall include the vacancies of the Service in the advertisement of Combined Competitive Examination annually on the basis of requisition made by the Government.
(2) The Commission shall communicate the list of selected candidates with recommendation to the department, on the basis of examination conducted as per its prescribed manner and procedure.
(3) Age limit for entry in the Service shall be the same as prescribed by the Government from time to time.
(4) Educational Qualification- Graduate or equivalent from any recognised University.
(5) Medical Examination – Candidates recommended for appointment on the basis of direct recruitment to the Bihar Probation Service shall have to produce a medical5 (cid:1)बहार गजट (असाधारण), 3333 िसत'बिसत'बिसत'बिसत'बरररर 2014201420142014 certificate issued by the Civil Surgeon after due medical examination. A candidate shall be appointed only after being found medically fit.
The Appointing Authority shall have Jurisdiction to accept or reject the candidature of any candidate recommended by the Commission after due consideration of Medical report submitted by any Medical Institution/Medical College or Medical Board constituted for such purpose.
The success of a candidate in the examination held by the Commission and recommendation made by the Commission will confer no right to appointment unless the Government is satisfied, after such enquiry as may be considered necessary that the candidate is suitable in all respects for the appointment in the Service.
5. RESERVATION: —The provision of the Bihar Reservation of Vacancies in Posts and Services (for Scheduled Castes, Scheduled Tribes and other Backward Classes) Act, 1991 as amended from time to time by the State Government shall be applicable in appointment and promotion.
6. PROBATION AND ITS PERIOD :—The candidate recruited through direct recruitment will be appointed on probation in the beginning of the service. Probation period shall be of two years from the date of appointment.
7. TRAINING/DEPARTMENTAL EXAMINATION:—Person appointed by direct recruitment shall have required to undergo through such training or pass such Departmental Examination in the probation period, which may be prescribed by Cadre Controlling Authority from time to time.
No member of the cadre shall be considered for confirmation or further promotion unless he/she appears in such compulsory training programme orgainsed in Jail, Administrative Training Institute or other Institution and/or pass Departmental Examination. Provided that Cadre Controlling Authority may relax this provision if it is not possible to organise such training due to any reason.
8. PROMOTION: —(1) Posts of the cadre- Hierarchy of post in this cadre will be as under:-
(i) Probation Officer; (ii) Principal Probation Officer – First stage of the Promotion; (iii) Director, Probation Services – Second stage of the Promotion;
(2) The promotion in different posts of the cadre shall be made on the recommendation of Departmental Promotion Committee;
(3) The minimum qualifying service i.e, "kalawadhi", for such promotion shall be the same as determined by the General Administrative Department, Bihar;
(4) The authorized number of cadre, number of post, and pay scale shall be as notified by the government from time to time and shall be deemed to be automatically revised/modified by insertion or deletion of any post or otherwise in administrative interest.
9. SENIORITY: —The Inter se seniority of the member of the service appointed by direct recruitment shall be determined in accordance with merit list of the Commission.
(2) The Inter se seniority of the officers appointed to the post of Principal Probation Officer shall be determined according to instructions issued by General Administrative Department, from time to time.
10. DISCIPLINARY ACTION: —The provision of the Bihar Government Service (Classification, Control and Appeal) Rules, 2005 and provisions notified/issued by the Government, from time to time, shall be applicable to the member of the cadre.
11. RESIDUAL CASES: —Member of the cadre shall be governed by regulations and orders applicable to the employees of appropriate level of the State Government, in 6 (cid:1)बहार गजट (असाधारण), 3333 िसत'बिसत'बिसत'बिसत'बरररर 2014201420142014 respect of the matters specifically not covered by these rules or by orders or special orders issued there under.
12. REMOVAL OF DIFFICULATIES:—Government may issue as necessary general or special direction from time to time to remove difficulties arising in implementation of the provision of these rules.
13. POWER TO RELAX THIS RULE: —Government may relax any provision of these rules in respect to any person or post or any class of post or category, wherein if it is expedient to do so and is appropriate in the opinion of the Government with written reasons recorded therein.
14. INTERPRETATION:—Power of interpretation in respect of any kind of doubt regarding the provisions of these rules shall be vested in Home Department and its decision shall be final.
15. SAVING AND REPEAL:—(1) All Rules/Resolutions/Circulars/Orders notified and applicable for posts of probation service cadre prior to the date of commencement of these rules shall deemed to be repealed.
(2) Not withstanding such repeal, anything done or any action taken in exercise of the power conferred by or under the said Rules/Resolutions/Circulars/orders shall deemed to be done or taken under these rules as if these rules were in operation on the day when such thing was done or such action was taken.
