सूचना एवं जन-सम्पर्क विभाग ------- अधिसूचनाएं 28 अक्तूबर 2014 स्था0(मु0)1-13-29/2013-154—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल सूचना एवं जन-सम्पर्क विभाग के जिला/प्रमंडलीय जन-सम्पर्क इकाईयों, का प्रयोग करते हुए बिहार के राज्यपाल सूचना एवं जन-सम्पर्क विभाग के जिला/प्रमंडलीय जन-सम्पर्क इकाईयों, का प्रयोग करते हुए बिहार के राज्यपाल सूचना एवं जन-सम्पर्क विभाग के जिला/प्रमंडलीय जन-सम्पर्क इकाईयों, के छायाकार के पदों पर भर्ती, प्रोन्नति एवं सेवा र्शाों के विनियमन के लिए बिहार सूचना केन्द्र एवं मुख्यालय स्तर के छायाकार के पदों पर भर्ती, प्रोन्नति एवं सेवा र्शाों के विनियमन के लिए बिहार सूचना केन्द्र एवं मुख्यालय स्तर निम्नलिखित नियमावली बनाते हैः-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ

यह नियमावली सूचना एवं जन-सम्पर्क विभाग छायाकार संक्षिप्त नाम, विस्तार एवं प्रारम्भ ।- (1) यह नियमावली सूचना एवं जन-सम्पर्क विभाग छायाकार इस नियमावली में, जब तक संदर्भ से अन्यथा अपेक्षित न हो;

"राज्यपाल" से अभिप्रेत है'', बिहार के राज्यपाल; "सरकार" से अभिप्रेत है'', बिहार सरकार;

से अभिप्रेत है'', बिहार राज्य कर्मचारी चयन आयोग;

े जिला/प्रमंडलीय जन सम्पर्क इकाईयों, बिहार '' से अभिप्रेत है, सूचना एवं जन-सम्पर्क विभाग के जिला/प्रमंडलीय जन सम्पर्क इकाईयों, बिहार (भर्ती प्रोन्नति एवं सेवा र्शा) संवर्ग नियमावली, 2014 कही जा सकेगी। (भर्ती प्रोन्नति एवं सेवा र्शा) संवर्ग नियमावली, 2014 कही जा सके इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृा होगी। 2. परिभाषाएँ ।- इस नियमावली में, जब तक संदर्भ से अन्यथा अपेक्षित न हो (क) "राज्यपाल" से अभिप्रेत है'', बिहार के राज्यपाल (ख) "सरकार" से अभिप्रेत है'', बिहार सरकार (ग) "आयोग" से अभिप्रेत है'', बिहार राज्य कर्मचारी चयन आयोग "नियुक्ति पदाधिकारी'' से अभिप्रेत है , निदेशक, सूचना एवं जन-सम्पर्क विभाग, बिहार; "नियुक्ति पदाधिकारी'' से अभिप्रेत है , निदेशक, सूचना एवं जन-सम्पर्क विभाग, बिहार (घ़) "नियुक्ति पदाधिकारी'' से अभिप्रेत है , निदेशक, सूचना एवं जन-सम्पर्क विभाग, बिहार "विभाग'' से अभिप्रेत है, सूचना एवं जन-सम्पर्क विभाग; (ड) "विभाग'' से अभिप्रेत है, सूचना एवं जन-सम्पर्क विभाग (च) ''संवर्ग'' से अभिप्रेत है, सूचना एवं जन- सूचना केन्द्र और मुख्यालय स्तर पर कार्यरत छायाकार का संवर्ग । सूचना केन्द्र और मुख्यालय स्तर पर कार्यरत छायाकार का संवर्ग

3. संवर्ग की रचना ।- (1) इस संवर्ग में पूर्व से नियुक्त एवं कार्यरत सभी कर्मियो, का अधिसूचना निर्गत - (1) इस संवर्ग में पूर्व से नियुक्त एवं कार्यरत सभी कर्मियो, का अधिसूचना निर्गत की तिथि से स्वतः इस संवर्ग में विलियन हो जायेगा। की तिथि से स्वतः इस संवर्ग में विलियन हो जायेगा।

सम्पर्क विभाग, के प्रशासनिक नियंत्रण में रहेगा। य स्तरीय होगा तथा सूचना एवं जन-सम्पर्क विभाग, के प्रशासनिक नियंत्रण में रहेगा। (2) यह संवर्ग राज्य स्तरीय होगा तथा सूचना एवं जन- विभिन्न कोटि के छायाकारों की संख्या का आकलन उनके ग्रेड के स्वीकृत बल के आधार पर होगा। विभिन्न कोटि के छायाकारों की संख्या का आकलन उनके ग्रेड के स्वीकृत बल के आधार पर होगा। (3) विभिन्न कोटि के छायाकारों की संख्या का आकलन उनके ग्रेड के स्वीकृत बल के आधार पर होगा। छायाकार के स्वीकृत बल की संख्या राज्य सरकार द्वारा समय-समय पर बढाई-घटाई जा सकेगी। छायाकार के स्वीकृत बल की संख्या राज्य सरकार द्वारा समय-समय पर बढाई-घटाई जा सक (4) छायाकार के स्वीकृत बल की संख्या राज्य सरकार द्वारा समय-समय पर बढाई-घटाई जा सक छायाकार संवर्ग के पद सोपान निम्न रूपेण विहित किये जायेंगे। (5) छायाकार संवर्ग के पद सोपान निम्न रूपेण विहित किये जायेंगे।2 (cid:1)बहार गजट (असाधारण), 13131313 नव&बनव&बनव&बनव&बर र र र 2014201420142014

4. नियुक्ति की प्रक्रिया ।- (1) छायाकार ग्रेड- iv के पद पर नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता इन्टरमीडिएट (102) के अलावे फोटोग्राफी में डिप्लोमा उत्तीर्ण, डिजीटल फोटोग्राफी फोटोशॉप के साथ कम्प्यूटर का ज्ञान।

(2) न्यूनतम आयु 18 वर्ष और अधिकतम आयु सीमा वही होगी जैसा कि राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित किया जाय।

(3) नियुक्ति प्राधिकार द्वारा, प्रत्येक वर्ष की 1ली अप्रैल के आधार पर रिक्तियों की गणना की जायेगी और इस प्रकार परिगणित आरक्षण कोटिवार वास्तविक रिक्तियों के आधार पर अधियाचना आयोग को 30वी अप्रैल तक भेजी जा सकेगी।

(4) बिहार राज्य कर्मचारी चयन आयोग लिखित प्रतियोगिता परीक्षा में न्यूनतम अर्हता प्राप्तांक एवं व्यावहारिक दक्षता जाँच के आधार पर अभ्यर्थियों की एक मेधा सूची तैयार करेगा, तथा अपनी अनुशंसा नियुक्ति पदाधिकारी को भेजेगा। लिखित प्रतियोगिता परीक्षा का पाठ्‌यक्रम एवं अर्हता विभाग के परामर्श से अवधारित किया जा सकेगा। (5) मेधा सूची, विभाग में प्राप्त होने के एक वर्ष तक विधिमान्य रहेगी। (6) उच्चतर शैक्षणिक योग्यताधारी को कोई अधिमानता नहीं दी जायेगी। 5. परिवीक्षा अवधि ।- नियुक्ति परिवीक्षा पर दो वर्षो के लिए होगी। नियुक्त कर्मी की सेवा एवं आचार संतोषप्रद नहीं होने की स्थिति में परिवीक्षा अवधि एक वर्ष के लिए बढाई जा सकती है। अगर नियुक्त कर्मी की सेवा और आचार, विस्तारित अवधि में भी संतोषप्रद नहीं रहा तो, वैसे कर्मी बिना किसी सूचना या कारणपृच्छा के सेवा समाप्त किये जाने के लिए उतरदायी होगें ।

6. प्रशिक्षण ।- कर्मी को राज्य सरकार द्वारा मान्यता प्राप्त/अनुशंसित प्रशिक्षण केन्द्र पर उन्नत फोटोग्राफी में प्रशिक्षण प्राप्त करना होगा।

7. विभागीय परीक्षा एवं सम्पुष्टि ।-(1) केन्द्रीय परीक्षा समिति, राजस्व पर्षद, बिहार द्वारा प्रत्येक वर्ष विभागीय परीक्षा आयोजित की जायेगी।

(2) विभागीय परीक्षा छायांकन में निपुणता की जाँच के लिये होगी। विभागीय परीक्षा में अनुाीर्ण रहने पर वेतन वृद्धि रोक दी जायेगी।

(3) नियुक्त कर्मी परीक्ष्यमान काल एवं प्रशिक्षण पूरा करने तथा विभागीय परीक्षा में सफल होने पर संवर्ग में सम्पुष्ट किये जा सकेंगे। विभागीय परीक्षा में उाीर्ण होने पर ही वार्षिक वेतन वृद्धि देय होगी।

(4) नियमावली के आरंभ होने की तिथि को जिनकी आयु 50 वर्ष से अधिक हो उन पर उप-नियम (2) लागू नहीं होगा।

8. प्रोन्नति ।- (1) संवर्ग में सम्पुष्ट छायाकार की मूल कोटि (ग्रेड-iv) से गे्रड- iii, गे्रड-iii से गे्रड- ii, एवं ग्रेड-ii से ग्रेड- i में विभागीय प्रोन्नति परस्पर वरीयता, वार्षिक गोपनीय अभ्युक्ति के आकलन, स्वच्छता, सेवा इतिहास एवं विभागीय प्रोन्नति समिति के अनुशंसा के आधार पर दी जायेगी।

(2) एक गे्रड से दूसरे ग्रेड में प्रोन्नति हेतु सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित कालावधि लागू होगी।

9. आरक्षण ।- राज्य सरकार द्वारा, समय-समय पर, अधिसूचित एवं लागू आरक्षण नीति का अनुपालन नियुक्ति एवं प्रोन्नति में, सक्षम प्राधिकार द्वारा किया जायेगा।

10. पदस्थापन।-नियुक्त छायाकार का पदस्थापन बिहार सूचना केन्द्र, नई दिल्ली/प्रमंडलीय कार्यालय/जिला जनसम्पर्क इकाईयों एवं मुख्यालय स्तर पर होगा एवं सूचना एवं जन-सम्पर्क विभाग के क्षेत्राधीन उपर्युक्त कार्यालयों में स्थानान्तरण/पदस्थापन किया जा सकेगा।

11. इस नियमावाली में जिन विषयों का प्रावधान नहीं हो सका है, उनके लिए राज्य सरकार की प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होगें।

12. निरसन एवं व्यावृति ।- (1) इस नियमावली के आरंभ की तिथि से पूर्व निर्गत प्रासंंगिक संकल्प/परिपत्र आदि एतद्‌ द्वारा निरसित किये जाते हैं।

(2) ऐसे निरसन के होते हुए भी वैसे संकल्प और परिपत्र के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया, या की गयी समझी जाएगी, मानों उस दिन यह प्रवृत थी, जिस दिन वैसा कुछ किया गया या वैसी कोई कार्रवाई की गयी थी।

No. Stha(mu)1-13-29/2013-154—In exercise of the powers conferred by the proviso to Article-309 of the Constitution of India the Governor of Bihar makes the following rules for regulation of recruitment, promotion and other service conditions to the posts of photographer in District/Divisional Public Relations Units, Bihar Information Centre and at Headquarter level of Information and Public Relations Department:-

1. Short title, extent and commencement .- (1) These Rules may be called Information and Public Relations Department photographer (Recruitment, Promotion and Service) Cadre Rules-2014. (2) It shall extend to whole of the state of Bihar. (3) It shall come into force at once.

2. Definitions .- Unless otherwise required in the context, in these Rules (a) ''Governor'' means the governor of Bihar; (b) ''Government'' means the Government of Bihar; (c) ''Commission'' means the Bihar Staff Selection Commission; (d) ''Appointing Authority'' means the Director, Information & Public Relations Department;

(e) ''Department'' means the Information & Public Relations Department; (f) ''Cadre'' means the cadre of Photographer working at District/ Divisional Public Relations Units, Bihar Information Centre and Headquarter of Information & Public Relations Department;

3. Composition of the cadre.-(1)The employees appointed and working at present in this cadre shall automatically be merged in this cadre from the date of issue of notification.

(2) It shall be a State Cadre under administrative Control of the Information & Public Relations Department.

(3) The number of photographer in different categories shall be determined on the basis of their sanctioned strength in their respective grade. (4) The State Government may increase or decrease the sanctioned strength of the photographers, from time to time. (5) The hierarchy of the photographer cadre shall be prescribed as follows :-

Procedure of appointment .- (1) The minimum educational qualification for appointment to the post of photographer grade-IV shall be intermediate (10+2) pass or its equivalent together with Diploma pass in photography, digital photography, knowledge of computer with Photoshop. (2) The minimum age limit shall be 18 years and the maximum age limit shall be the same as may be determined by the State Government (General Administrative Department) time to time.

4 (3) The appointing authority shall determine the vacancies on 1st April of every year and the requisition shall be sent to the Bihar State Staff Selection Commission up to 30th April on the basis of the actual vacancies as per roster. (4) The Bihar State Staff Selection Commission shall prepare a merit list on the basis of minimum qualifying marks obtained in the written competitive examination and practical skill test and send its recommendation to the appointing authority. The Commission shall determine the syllabus for written competitive examination and qualifying marks, in consultation with the Department. (5) Merit list will remain valid for a period up to 1 year from the date of its receipt in the department. (6) No weightage shall be given to higher educational qualification holders.

5. Probation period .- The appointment shall be on probation for a period of two years. The probation period may be extended for one year in case the service and conduct of the appointed employee is found not satisfactory. Even in the extended period the service is not found to be satisfactory, the service of such employee will be liable to be terminated, without any notice or show cause.

6. Training .- The employee shall have to obtain training in advance photography at the institutes recognized /recommended by the state.

7. Departmental examination and confirmation .- (1) The Departmental Examination shall be conducted every year by the Central Examination Board, Board of Revenue, Bihar.

(2) The Departmental Examination shall be conducted for testing the skill in photography. On unsuccessful in the Departmental Examination, increment will be kept withheld.

(3) The appointed employee may be confirmed in the cadre after completion of probation period and on being successful in Departmental Examination annual increment will be admissible.

(4) Sub-rule (2) shall not be applicable to those who have completed more than 50 years of age on the date of commencement of these Rules.

8. Promotion .- (1) The confirmed photographer in the cadre shall be promoted form Basic Category (Grade-iv) to Grade-III, Grade III to Grade II, Grade-II to Grade I, on the basis of inter -se- seniority, annual confidential report, service history and recommendation of departmental promotional committee.

(2) At the time of promotion form one grade to another the Kalawadhi determined by the General Administration Department, from time to time, will be applicable.

9. Reservation .- The reservation policy notified and enforced by the state Government from time to time shall be followed in the appointment and promotion by competent authority.

10. Posting .- The appointed photographer shall be posted at the Bihar Information Centre, New Delhi, Divisional units/ District Public Relations Units and Headquarter and may be transferred/posted to the above mentioned offices under the control of Information & Public Relation Department.

11. The provisions of the relevant codes/rules/resolutions/instructions of the State Government shall be applicable to the subjects for which provision are not made in these Rules.

12. Repeal and Saving .- (1) All relevant resolutions/circulars issued prior to the commencement of these Rules are hereby repealed.

(2) Not withstanding such repeal, anything done or any action taken under such resolutions/circulars shall be to be done or taken under these Rules as if it were come in to force on the day on which such thing was done or such action was taken.
