0नियु0नियमा0 67/09-1296—भारत-संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत भारत-संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में भर्ती, प्रोन्नति शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में भर्ती, प्रोन्नति शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में भर्ती, प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं - एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिि
1 संक्षिप्त नाम, विस्तार एवं प्रारम्भ।
संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (i) यह नियमावली 'बिहार कृषि अधीनस्थ सेवा, कोटि-8 (माप एवं तौल) नियमावली, 2014 कही जा यह नियमावली 'बिहार कृषि अधीनस्थ सेवा, कोटि-8 (माप एवं तौल) नियमावली, 2014 कही जा यह नियमावली 'बिहार कृषि अधीनस्थ सेवा, कोटि-8 (माप एवं तौल) नियमावली, 2014 कही जा सकेगी। इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। यह तुरंत प्रवृत होगी।
(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह तुरंत प्रवृत होगी।
इस नियमावली में जब तक संदर्भ से अन्यथा अपेक्षित न हो -
'आयोग' से अभिप्रेत है ''बिहार कर्मचारी चयन आयोग'',
2. परिभाषा।- इस नियमावली में जब तक संदर्भ से अन्यथा अपेक्षित न हो - (i) 'विभाग' से अभिप्रेत है बिहार सरकार का कृषि विभाग, 'विभाग' से अभिप्रेत है बिहार सरकार का कृषि विभाग, (ii) 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) का संवर्ग, 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) का संवर्ग, 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) का संवर्ग, (iii) 'आयोग' से अभिप्रेत (iv) 'वर्ष' से अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि, अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि (v) 'सदस्य' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में नियुक्त व्यक्ति, 'सदस्य' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में नियुक्त व्यक्ति, 'सदस्य' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में नियुक्त व्यक्ति, (vi) "नियुक्ति प्राधिकार" से अभिप्रेत है कृषि निदेशक, बिहार, पटना।
"नियुक्ति प्राधिकार" से अभिप्रेत है कृषि निदेशक, बिहार, पटना।
3. संवर्ग का गठन।-
(1) यह सेवा राज्य सेवा होगी तथा कृषि विभाग इस सेवा का प्रशासी विभाग होगा। राज्य सेवा होगी तथा कृषि विभाग इस सेवा का प्रशासी विभाग होगा। राज्य सेवा होगी तथा कृषि विभाग इस सेवा का प्रशासी विभाग होगा। (2) मूल पद निरीक्षक, माप एवं तौल का होगा जिसकी प्रोन्नति का पद सोपान निम्नवत् है- मूल पद निरीक्षक, माप एवं तौल का होगा जिसकी प्रोन्नति का पद सोपान निम्नवत् है- मूल पद निरीक्षक, माप एवं तौल का होगा जिसकी प्रोन्नति का पद सोपान निम्नवत् है- (a) निरीक्षक माप एवं तौल (b) सहायक नियंत्रक माप एवं तौल (c) उप नियंत्रक माप एवं तौल (d) संयुक्त नियंत्रक माप एवं तौल
निरीक्षक माप एवं तौल - मूल पद सहायक नियंत्रक माप एवं तौल - प्रथम प्रोन्नति का पद उप नियंत्रक माप एवं तौल - द्वितीय प्रोन्नति का पद संयुक्त नियंत्रक माप एवं तौल - तृतीय प्रोन्नति का पद2 (cid:1)बहार गजट (असाधारण), 1111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 (3) संवर्ग की संरचना एवं आकार की समीक्षा विभाग द्वारा आवश्यकतानुसार की जा सकेगी। (4) उपर्युक्त पदो ंके लिए सरकार द्वारा निर्धारित वेतनमान देय होगा।
4. मूल कोटि में नियुक्ति ।-
(1) मूल कोटि के पद सीधी नियुक्ति से भरे जायेंगे। (2) प्रति वर्ष 1 ली अप्रैल को संवर्ग में स्वीकृत पदों के विरूद्ध सीधी नियुक्ति के लिए रिक्त पदों की गणना की जायेगी।
(3) शैक्षणिक योग्यता ।- संवर्ग में मूल कोटि के पदों पर सीधी नियुक्ति के लिए न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त विश्वविद्यालय/संस्थान से विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्राद्यौगिकी में स्नातक की डिग्री। (4) सीधी भर्ती द्वारा नियुक्ति ।-
(क) सीधी नियुक्ति आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुशंसित अभ्यर्थियों के बीच से की जायेगी।
(ख) उम्र सीमा - आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी और अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर अवधारित की जाय, परन्तु विशेष परिस्थिति में उसका कारण अभिलिखित करते हुए विभाग इसे बढ़ा सकेगा।
(ग) आरक्षण - सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति
के लिए समय-समय पर अवधारित आरक्षण प्रावधान लागू होंगे।
(घ) सीधी नियुक्ति हेतु विभाग द्वारा सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के
साथ अधियाचना प्रत्येक वर्ष आयोग को भेजी जायेगी।
(ड) प्रतियोगिता परीक्षा के विषय तथा पाठ्यक्रम - प्रतियोगिता परीक्षा में निम्नलिखित पत्र होगें :-
(i) हिन्दी - 100 अंक (एक पत्र) (ii) सामान्य ज्ञान -100 अंक (एक पत्र) (iii) विज्ञान (भौतिकी के साथ)/अभियंत्रण
/प्राद्यौगिकी -200 अंक का (दो पत्र) (प्रत्येक 200 अंक का)
कुल-400 अंक
हिन्दी में 30% अंक प्राप्त करना अनिवार्य होगा, परन्तु इस पत्र में प्राप्तांक की गणना मेधा सूची के प्रयोजनार्थ नहीं की जाएगी। मेधा सूची विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्राद्यौगिकी के 400 अंकों तथा सामान्य ज्ञान मेें प्राप्त अंकों के योग के आधार पर तैयार की जाएगी। हिन्दी एवं सामान्य ज्ञान का पाठ्यक्रम वही होगा जो आयेाग द्वारा उसके द्वारा आयोजित संयुक्त प्रतियोगिता परीक्षा के लिए अवधारित की जाय। विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्राद्यौगिकी का पाठ्यक्रम विभाग द्वारा आयोग के परामर्श से अवधारित किया जाएगा।
(छ) आयोग द्वारा अभ्यर्थियों की अनुशंसा - आयोग लिखित परीक्षा में प्राप्त अंकों के योग के आधार पर सामान्य तथा प्रत्येक आरक्षण कोटिवार मेधा सूची तैयार करेगा और प्रतिवेदित अधियाचना के अनुसार अनुशंसा विभाग को करेगा।
5. परिवीक्षा ।-
(1) सेवा में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षाधीन होगा किन्तुु, विशेष परिस्थितियों में कारण अभिलिखित करते हुए यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी उसका कार्य संतोषप्रद नहीं हो तो उसकी सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, परन्तु इसकी लिखित सूचना कारण सहित उसे दी जाएगी।
(2) परिवीक्षाधीन अवधि की गणना नियमित सेवा में की जायेगी।
6. प्रशिक्षण ।-
(1) नियुक्त किये जाने वाले व्यक्ति को उसकी पदस्थापना से पहले भारतीय विधिक माप विज्ञान संस्थान राँची में बुनियादी पाठ्क्रम सफलतापूर्वक पूरा करना होगा।
(2) बिहार कृषि अधीनस्थ सेवा कोटि-8 (माप एवं तौल) में नियुक्त सदस्यों के लिए प्रोन्नति हेतु विभाग द्वारा अवधारित संस्थान से प्रशिक्षण प्राप्त करना अनिवार्य होगा।
(3) कृषि विभाग द्वारा सेवाकालीन/प्रशिक्षण का आयोजन किया जायेगा, जिसमें अधिकारी को भाग लेना होगा। उक्त आधार पर प्रोन्नति का लाभ अनुमान्य होगा। परन्तु, विभाग द्वारा ससमय प्रशिक्षण का आयोजन नहीं किये जाने की स्थिति में प्रोन्नति वाधित नहीं होगी।3 (cid:1)बहार गजट (असाधारण), 1111 'दस)ब'दस)ब'दस)ब'दस)बरररर 2014201420142014 7. विभागीय परीक्षा ।-
(1) कर्मियों को राजभाषा विभाग, बिहार द्वारा आयोजित हिन्दी टिप्पण एवं प्रारूपण परीक्षा तथा विभाग द्वारा आयोजित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा।
(2) मूल कोटि के वेतनमान में द्वितीय वेतनवृद्धि विभागीय परीक्षा उत्तीर्णता एवं सेवा संपुष्टि के बाद ही देय होगी। 8. सेवा सम्पुष्टि ।-
परिवीक्षा की समाप्ति, विभागीय परीक्षा में उत्तीर्णता तथा अवधारित प्रशिक्षण कार्यक्रम के सफलतापूर्वक पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा स्थायी संवर्गीय पदों के विरूद्ध मूल कोटि में सम्पुष्ट की जाएगी।
9. वरीयता का अवधारण ।- वरीयता का अवधारण सामान्य प्रशासन विभाग द्वारा समय-समय पर अवधारित नीति के आलोक में किया जायेगा।
10. मूल कोटि से उच्चतर पदों पर प्रोन्नति ।-
(1) संवर्ग के पदसोपान में उच्चतर पदों पर प्रोन्नति ठीक नीचे की पंक्ति में कार्यरत कर्मियों से वरीयता सह योग्यता के आधार पर तथा सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत निदेशों के आलोक में दी जाएगी। लेकिन, कर्मियो को कंडिका-6 में प्रावधानित प्रशिक्षण में भाग लेने पर ही प्रोन्नति देय होगी।
(2) परन्तु, विभाग/संस्थान द्वारा नियम 6 (ii) एवं (iii) का प्रशिक्षण ससमय प्रशिक्षण आयोजित नहीं किये जाने के फलस्वरूप प्रोन्नति बाधित नहीं होगी।
(3) प्रोन्नति के लिए संपुष्टि आवश्यक होगी तथा पदों की उपलब्धता आदि पर विचार करते हुये वरीयता सह योग्यता के आधार पर सक्षम प्राधिकार द्वारा विभागीय प्रोन्नति समिति के अनुशंसा पर प्रोन्नति दी जा सकेगी।
(4) विभागीय प्रोन्नति समिति - विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति हेतु विचार किया जा सकेगा। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।
11. प्रकीर्ण - कठिनाई का निराकरण ।-
(1) इस नियमावली के किसी नियम का निर्वचन सामान्य प्रशासन विभाग/विधि विभाग/वित्त विभाग के परामर्श से करने में सक्षम होगा।
(2) विभाग इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण राजपत्र में समुचित आदेश जो इस नियमावली के प्रावधानों से असंगत न हो द्वारा कर सकेगा। (3) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं है, उनके सम्बन्ध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में भी लागू होेगें।
12. निरसन एवं व्यावृति ।-
(1) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/संकल्प एतद द्वारा निरसित किए जाते है।
(2) ऐसे निरसन के होते हुए भी, पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जाएगी मानो यह नियमावली उस दिन प्रवृत थी जब वैसा कुछ किया या वैसी कार्रवाई की गयी थी।

App. R 67/09-1296—In exercise of Power conferred under Proviso of Schedule-309 of the constitution of India, the Governor of Bihar is pleased to make the following rules to regulate the appointment, promotion and service conditions of Bihar Agriculture Sub- Ordinate Service, Category -8 ( Weights and Measures):- 1. Short title, name, extent and commencement i. These rules shall be called Bihar Agriculture Subordinate Service, category -8 (Weights and Measures) Rules -2014 .
ii. It shall extend to the whole of the State of Bihar. iii. It shall come in to force at once. 2. Definition:- In these Rules, unless otherwise requires in the context.
(cid:1)बहार गजट (असाधारण), 1111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 20142014201420144 i. "Department" means Agriculture Department of the Government of Bihar. ii. "Cadre" means cadre of Bihar Agriculture Sub- Ordinate Service category -8 (Weights and Measures ).
iii.. "Commission" means Bihar Staff Selection Commission. iv. "Year" means Financial year i.e. from 1st April to 31st March of next year". v. "Member" means person appointed under Bihar Agriculture Subordinate Service, Category -8 ( Weights and Measures ).
vi. "Appointing Authority" means Agriculture Director, Bihar, Patna. 3. Constitution of Cadre. :- 1 This shall be a state Service and Agriculture Department shall be its administrative Department.
2 Inspector, Weights and Measures shall be the basic post and its hierarchy of promotion shall be in the following manner:
(a) Inspector Weights and measure- basic grade post of this cadre. (b) Assistant Controller – Weights and Measures – 1st Stage ( of Promotion). (c) Deputy controller – Weights and Measures – IInd Stage ( of Promotion). (d) Joint Controller Weights and Measures – III rd stage ( of promotion). 3 The department may review the structure and strength of the cadre as per need. 4 The Pay scale fixed by the Government , shall be admissible for the aforesaid post. 4. Appointment in basic category :- 1. Posts of basic category shall be filled up by direct appointment. 2. The calculation of vacant posts for direct appointment against the sanctioned post of cadre, shall be made on the basis of 1st April every year.
(3) Academic Qualification :- Minimum academic qualification for direct appointment to the posts of basic grade in the cadre shall be graduation in science with physics / Engineering/ Technology, from recognized University / Institute.
(4). Direct Appointment :- (a) Direct appointment shall be made from amongst the candidates recommended on the basis of Competitive Examination conducted by the Commission.
(b) Age Limit :- Minimum aged shall be 21 ( Twenty one ) years on 1st April of the inviting the application and maximum age shall be the same as may be determined from time to time by the Department of General Administration for direct appointment in the Services of the State but in special circumstances, the department may increase it recording reasons for the same.
(c ) Reservation :- The provisions for reservation determined by the Department of General Administration, from time to time, for direct appointment in the services of the state, shall apply.
(d) For direct appointment, requisition along with number of general and category wise vacancies shall be sent to the commission every year by the Department. (e) Subjects and syllabus of Competitive Examination :- There shall be following papers in the Competitive Examination:- (i) General Hindi – 100 Marks ( One paper ) (ii) General Knowledge – 100 Marks ( One Paper ) . (iii) Science ( With physics )/ Engineering/ Technology .

200 Marks each Total – 400 Marks. It shall be compulsory to obtain 30 percent marks in Hindi but the marks obtained is this paper shall not be calculated for the purpose of preparation of merit list. The merit list shall be prepared on the basis of total marks obtained out of 400 marks in science (with physics ) / Engineering/ Technology and the marks obtained in General knowledge . The syllabus for Hindi and General knowledge shall be the same as may be determined by the Bihar Staff Selection Commission, for Joint Competitive Examination Conducted by it . The syllabus for science (with physics)/ Engineering / Technology, shall be prepared by the department with the consultation from commission.
(f) Recommendation of candidates by the Commission :- The Commission shall prepare merit list reserved category wise on the basis of marks obtained in the examination conducted by the Commission and shall send recommendation to the department according to the reported vacancies.
5. Probation-:- (1) Every member appointed by direct recruitment in the service , shall be on probation for the period of 2 years from the date of his Joining but in special circumstances, this period may be extended up-to one year recording the reasons. If in the said extended period also if his performance is not satisfactory, he may be terminated from his services, by the Government, without asking any show cause , but he shall be given its written notice with reasons. (2) The probation period shall be calculated for the purpose of regular service. 6. Training :- 1 The person to be appointed, shall have to complete basic syllabus at Indian weights and measures science Institute Ranchi, successfully before his posting.
2 For promotion, it shall be compulsory for the members appointed in the Bihar Agriculture Subordinate Service category -8 ( Weights and Measures ) to obtain training from the institute determined by the department. Training institute will be selected by the department from time to time.
3 Training during service period will be held by the Agriculture Department in which the officers shall have to participate. The benefit of promotion shall be admissible on the basis of it, but in case, if not holding training in time by the department, their promotion shall not be obstructed.
7. Departmental Examination. 1 It shall be compulsory for the employees to pass in Hindi noting and drafting examination conducted by Rajbhasha Department Bihar, as well as in the departmental examination conducted by the department.
2 Second increment in the pay scale of basic category shall be admissible only after passing in the examination and confirmation of service .
8. Confirmation of service. The services of the members of direct appointment, shall be confirmed against permanent posts in the basic category, only after completing probation period, passing in the Departmental Examination, completing the determined training programmed successfully and on finding spotless service.
(cid:1)बहार गजट (असाधारण), 1111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 20142014201420146 9. Determination of seniority :- The seniority of a member shall be determined in the light of policy determined by the Department of General Administration, from time to time.
10. Promotion on higher posts from the post of basic grade :- 1 Promotion on higher post in hierarchy of service cadre, shall be given to the employees working just below the promotional post , on the basis of seniority and in the light of instructions issued by the Department of General Administration from time to time. But this promotion shall be admissible to the employees only after participating in the training as laid down under rule-6.
2 In case the department/ institute does not organize training in time, their promotion shall not be barred.
3 The working Officers shall be promoted by the Competent Authority on the basis of seniority and after considering confirmation of his services on the post of basis category, confidential remark, internal clearance , vigilance , clearance, report of Lokyaukta, time period , reservation and availability of post.
4 Departmental Promotion Committee. :- The matter of promotion shall be considered on the recommendation of the departmental committee. It shall be constituted by the department .
11. Miscellaneous – Removal of difficulties. :- 1 The department shall be competent to interpret any rule of these rules in consultation with the Department of General Administration/ Law Department/ Finance Department.
2 The department may remove the difficulty, if any in implementation of any rule of these rules, by publication of appropriate order in the official Gazette which is not inconsistent with these Rules..
3 In respect of such subjects or points for which the provisions are not made in these rules, the provisions laid down in Code/ Rules /resolutions/ instruction, into force for the time being by the State Government shall apply to this context of this service also. 12. Repeals and savings :- (1) All circulars / instructions / resolutions in respect of the appointment / service conditions of the employees of this cadre, are hereby repealed.
(2) Notwithstanding such repeal, any thing done or any the action taken under any circular / instruction/ resolution, issued earlier shall be deemed to be done or taken under these Rules as if these Rules were in force when such thing was done or such action was taken.
