था0 39/09-1264/कृ॰—भारत-संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत शक्तियों भारत-संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) में भर्ती, प्रोन्नति एवं सेवा शर्तों को का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) में भर्ती, प्रोन्नति एवं सेवा शर्तों को का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) में भर्ती, प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :- विनियमित करने के लिए निम्नलिखित नियमा 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

2. परिभाषा।- इस नियमावली में जब तक

संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (i) यह नियमावली 'बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) नियमावली, 2014 कही जा सकेगी। यह नियमावली 'बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) नियमावली, 2014 कही जा सकेगी। यह नियमावली 'बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) नियमावली, 2014 कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii)यह तुरंत प्रवृत होगी। यह तुरंत प्रवृत होगी। परिभाषा।- इस नियमावली में जब तक संदर्भ से अन्यथा अपेक्षित न हो -

'आयोग' से अभिप्रेत है ''राज्य कर्मचारी चयन आयोग'',

'वर्ष' से अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि

अप्रैल से अगले वर्ष के 31 मार्च तक'' की अवधि, 'नियुक्ति' प्राधिकार से अभिप्रेत है ''कृषि निदेशक, कृषि विभाग।

(i) 'विभाग' से अभिप्रेत है बिहार सरकार का कृषि विभाग, 'विभाग' से अभिप्रेत है बिहार सरकार का कृषि विभाग, (ii) 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) का संवर्ग, 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) का संवर्ग, 'संवर्ग' से अभिप्रेत है बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) का संवर्ग, (iii) 'आयोग' से अभिप्रेत है ''राज्य कर्मचारी चयन आयोग'', (iv) 'वर्ष' से अभिप्रेत है ''वित्तीय वर्ष अर्थात 1 (v) 'सदस्य' से अभिप्रेत है बिहार अधीनस्थ कृषि सेवा कोटि-1 (शष्य) में नियुक्त व्यक्ति, 'सदस्य' से अभिप्रेत है बिहार अधीनस्थ कृषि सेवा कोटि-1 (शष्य) में नियुक्त व्यक्ति, 'सदस्य' से अभिप्रेत है बिहार अधीनस्थ कृषि सेवा कोटि-1 (शष्य) में नियुक्त व्यक्ति, (vi) 'नियुक्ति' प्राधिकार से अभिप्रेत है ''कृषि निदेशक, कृषि विभाग संवर्ग का गठन एवं पद सोपान।-

3. संवर्ग का गठन एवं यह सेवा राज्य सेवा होगी तथा कृषि विभाग इस सेवा का प्रशासी विभाग होगा। यह सेवा राज्य सेवा होगी तथा कृषि (i) इस संवर्ग का मूल पद प्रखंड कृषि पदाधिकारी एवं समकक्ष होगा। इस संवर्ग का मूल पद प्रखंड कृषि पदाधिकारी एवं समकक्ष होगा। 4. मूल कोटि में नियुक्ति एवं प्रोन्नति।- मूल कोटि में नियुक्ति एवं प्रोन्नति।- मूल कोटि के 67 प्रतिशत पद सीधी नियुक्ति से भरे जायेंगे। मूल कोटि के शेष 33 प्रतिशत पद (1) मूल कोटि के 67 प्रतिशत पद सीधी नियुक्ति से भरे जायेंगे। मूल कोटि के शेष 33 प्रतिशत पद मूल कोटि के 67 प्रतिशत पद सीधी नियुक्ति से भरे जायेंगे। मूल कोटि के शेष 33 प्रतिशत पद जनसेवक/ग्रामीण प्रसार कार्यकर्त्ता एवं कृषि समन्वयक से प्रोन्नति द्वारा भरे जायेंगे।

कार्यकर्त्ता एवं कृषि समन्वयक से प्रोन्नति द्वारा भरे जायेंगे।

प्रति वर्ष 1 ली अप्रैल को संवर्ग में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए (2) प्रति वर्ष 1 ली अप्रैल को संवर्ग में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए प्रति वर्ष 1 ली अप्रैल को संवर्ग में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुक्ति के रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुि रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुि2 (cid:1)बहार गजट (असाधारण), 2222 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 पदों के रिक्त होने पर इन्हें सीधी नियुक्ति द्वारा तथा प्रोन्नति के पदों के रिक्त होने पर इन्हें प्रोन्नति द्वारा भरा जाएगा। प्रत्येक वर्ष 30 अप्रैल तक आरक्षण कोटिवार अधियाचना आयोग को नियुक्ति प्राधिकार द्वारा भेजा जायेगा। (3) शैक्षणिक योग्यता - संवर्ग में मूल कोटि के पदों पर सीधी नियुक्ति या प्रोन्नति के लिए न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त विश्वविद्यालय/ संस्थान से कृषि विज्ञान में स्नातक की डिग्री होगी।

(4) सीधी भर्ती द्वारा नियुक्ति ।- (क) सीधी नियुक्ति आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुशंसित अभ्यर्थियों के बीच से की जायेगी।

(ख) उम्र सीमा - आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी और अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर अवधारित की जाय, परन्तु विशेष परिस्थिति में उसका कारण अभिलिखित करते हुए विभाग इसे बढ़ा सकेगा।

(ग) आरक्षण - सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति के लिए समय-समय पर अवधारित आरक्षण प्रावधान लागू होंगे।

(घ) सीधी नियुक्ति हेतु विभाग द्वारा सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के साथ अधियाचना प्रत्येक वर्ष आयोग को भेजी जायेगी।

(ड़) प्रतियोगिता परीक्षा के विषय तथा पाठ्‌यक्रम - प्रतियोगता परीक्षा में निम्नलिखित पत्र होगेः- (i) सामान्य हिन्दी -100 अंक (एक पत्र) (ii) सामान ज्ञान -100 अंक (एक पत्र) (iii) कृषि विज्ञान 200 अंक का दो पत्र कुल- 400 अंक हिन्दी में 30% अंक प्राप्त करना अनिवार्य होगा, परन्तु इस पत्र में प्राप्तांक की गणना मेधा सूची के प्रयोजनार्थ नहीं की जाएगी। मेधा सूची कृषि विज्ञान तथा सामान्य ज्ञान मेें प्राप्त अंकों के योग के आधार पर तैयार की जाएगी। हिन्दी एवं सामान्य ज्ञान का पाठ्‌यक्रम वही होगा जो बिहार राज्य कर्मचारी चयन आयोग द्वारा उसके द्वारा आयोजित संयुक्त प्रतियोगिता परीक्षा के लिए अवधारित की जाय। कृषि विज्ञान का पाठ्‌यक्रम विभाग द्वारा, आयोग के परामर्श से, अवधारित किया जाएगा।

(च) आयोग द्वारा अभ्यर्थियों की अनुशंसा :- आयोग लिखित परीक्षा में प्राप्त अंकों के योग के आधार पर आरक्षण कोटिवार मेधा सूची तैयार करेगा और प्रतिवेदित अधियाचना के अनुसार अनुशंसा विभाग को करेगा। 5. प्रोन्नति द्वारा नियुक्ति - (i) नियमित संवर्ग बल के 33% पदों को रिक्तियों के आधार पर जनसेवक/ग्रामीण प्रसार कार्यकर्त्ता एवं कृषि समन्वयक से प्रोन्नति द्वारा भरा जायगा।

(क) कृषि विभाग के अधीन कार्यरत जनसेवक/ग्रामीण प्रसार कार्यकर्त्ता उपरोक्त 33% के अन्तर्गत 16.5% पदों पर कोटा के अधीन प्रोन्नति के पात्र होगें।

(ख) कृषि विभाग के अधीन कार्यरत कृषि समन्वयकों से 16.5% पदों पर कोटा के अधीन प्रोन्नति के पात्र होगें।

(ii) पदोन्नति हेतु कालावधि वही होगी जो समय-समय पर सरकार द्वारा निर्धारित की गयी हो। (iii) सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में प्रोन्नति के लिए समय-समय पर विहित आरक्षण प्रावधान इस संवर्ग के लिए भी लागू होंगे।

(iv) आयोग की अनुशंसा पर नियुक्त एवं निम्न पद से प्रोन्नति के उपरान्त नियुक्त कर्मी की आपसी वरीयता सामान्य प्रशासन विभाग द्वारा निर्धारित मापदंड के आधार पर निर्धारित होगी।

(v) प्रोन्नति द्वारा नियुक्त कर्मियों की पारस्परिक वरीयता वही होगी जो जनसेवक/ ग्रामीण प्रसार कार्यकर्त्ता एवं कृषि समन्वयक में आपसी वरीयता थी। कृषि समन्वयकों को वरीयता क्रम में उपर रखा जायेगा।

6. परिवीक्षा ।- (i) सेवा में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षाधीन होगा किन्तु, विशेष परिस्थितियों में कारण अभिलिखित करते हुए, यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी उसका कार्य संतोषप्रद नहीं हो तो उसकी सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, परन्तु इसकी लिखित सूचना कारण सहित उसे दी जाएगी।

(ii) परिवीक्षाधीन अवधि की गणना नियमित सेवा में की जायेगी। 7. प्रशिक्षण ।- बिहार कृषि अधीनस्थ सेवा कोटि-1 (शष्य) में नियुक्त सदस्यों के लिए प्रोन्नति हेतु विभाग द्वारा अवधारित संस्थान से प्रशिक्षण प्राप्त करना अनिवार्य होगा। प्रशिक्षण संस्थानों का चयन समय-समय पर विभाग द्वारा किया जायेगा।

कृषि विभाग द्वारा सेवाकालीन/प्रशिक्षण का आयोजन किया जायेगा, जिसमें अधिकारी को भाग लेना होगा। उक्त आधार पर प्रोन्नति का लाभ अनुमान्य होगा। परन्तु, विभाग द्वारा ससमय प्रशिक्षण का आयोजन नहीं किये जाने की स्थिति में प्रोन्नति वाधित नहीं होगी।3 (cid:1)बहार गजट (असाधारण), 2222 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 8. विभागीय परीक्षा ।- (1) कर्मियों का राजभाषा विभाग, बिहार द्वारा आयोजित हिन्दी टिप्पण एवं प्रारूपण परीक्षा तथा विभाग द्वारा आयोजित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा।

(2) मूल कोटि के वेतनमान में द्वितीय वेतनवृद्धि विभागीय परीक्षा उत्तीर्णता एवं सेवा संपुष्टि के बाद ही देय होगी।

(3) कर्मियों का वेतनवृद्धि में यह रूकावट असंचयात्मक होगी और परीक्षा में उत्तीर्णता के उपरान्त रोकी गयी वेतनवृद्धियॉं दे दी जायेंगी।

(4) कर्मियों को 50 (पचास) वर्ष की आयु पूरी करने के पश्चात कर्मचारियों को विभागीय परीक्षा में उत्तीर्णता की अनिवार्यता से विमुक्ति सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत परिपत्रों/अनुदेशों के अधीन दी जा सकेगी।

9. सेवा सम्पुष्टि।- (1) परिवीक्षा की समाप्ति, विभागीय परीक्षा में उत्तीर्णता तथा अवधारित प्रशिक्षण कार्यक्रम के सफलतापूर्वक पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा स्थायी संवर्गीय पदों के विरूद्ध मूल कोटि में सम्पुष्ट की जाएगी।

(2) प्रोन्नति से मूल कोटि में नियुक्त सदस्यों की उप-नियम (v) के अधीन वर्णित शर्त्तों पर सेवा सम्पुष्ट की जा सकेगी।

10. वरीयता का अवधारण ।- वरीयता का अवधारण सामान्य प्रशासन विभाग द्वारा समय-समय पर अवधारित नीति के आलोक में किया जाएगा। एक भर्ती वर्ष में प्रोन्नत पदाधिकारियों को सीधे भर्ती किए गए पदाधिकारियों के मुकाबले पूर्वता मिलेगी।

11. मूल कोटि से उच्चतर पदों पर प्रोन्नति ।- (i) सेवा संवर्ग के पदसोपान में उच्चतर पदों पर प्रोन्नति ठीक नीचे की पंक्ति में कार्यरत कर्मियों से वरीयता सह योग्यता के आधार पर तथा सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत निदेशों के आलोक में दी जाएगी। लेकिन, कर्मियो को कंडिका-7 में प्रावधानित प्रशिक्षण में भाग लेने पर ही प्रोन्नति देय होगी।

(ii) परन्तु विभाग/संस्थान द्वारा ससमय प्रशिक्षण आयोजित नहीं किये जाने के फलस्वरूप प्रोन्नति बाधित नहीं होगी।

(iii) प्रोन्नति के लिए संपुष्टि आवश्यक होगी तथा प्रोन्नति का आधार वरीयता-सह-योग्यता होगा। (iv) विभागीय प्रोन्नति समिति- विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति हेतु विचार किया जा सकेगा। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

12. प्रकीर्ण - कठिनाई का निराकरण ।- (1) इस नियमावली के किसी नियमों का निर्वचन सामान्य प्रशासन विभाग/विधि विभाग/वित्त विभाग के परामर्श से करने में सक्षम होगा।

(2) विभाग इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण राजपत्र में समुचित आदेश, जो इस नियमावली के प्रावधानों से असंगत न हो, द्वारा कर सकेगा।

(3) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं है, उनके सम्बन्ध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में भी लागू होंगे। 13. निरसन एवं व्यावृति ।- (i) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/संकल्प एतद द्वारा निरसित किए जाते है।

(ii) ऐसे निरसन के होते हुए भी, पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायगी मानो यह नियमावली उसदिन प्रवृत थी जब वैसा कुछ किया या वैसी कार्रवाई की गयी थी।

No. 06 /Est.39/09-1264/Ag.—In exercise of power conferred under proviso of article–309 of the constitution of India, the Governor of Bihar is pleased to make the following rules to regulate the appointment, promotion and service Conditions of Bihar Agriculture Subordinate, Service category-1 (Agronomy):-

1. Short title , extent and Commencement :-

(i) These rules shall be called Bihar Agriculture Subordinate Service Cate- gory-1 (Agronomy), Rules -2014.

2. Definition :- In these Rules, unless other wise requires in the context:-

(i) "Department" means Agriculture Department of the Government of Bihar. (ii) "Cadre" means cadre of Bihar Agriculture Subordinate Service, category-1 (Agronomy).

(iii) "Commission" means Bihar Staff Selection Commission . (iv) "Year" means " financial year" i.e. from I st April to 31st March of next year .

(v) "Member" means person appointed under Bihar Agriculture Subordinate Service category -1 (Agronomy).

(vi) "Appointing Authority" means Agriculture Director, Agriculture Department, Bihar.

3. Constitution of Cadre and hierarchy:- This shall be a state Service and Agriculture Department shall be its administrative Department.

(1) Block Agriculture officer and equivalent officer shall be the basic grade post of this cadre.

4. Appointment and Promotion on basic grade post:- (1) 67 percent posts of basic grade shall be filled up by direct appointment. Remaining 33 percent posts of basic grade shall be filled up by promotion to jansewak/Rural Extension worker and Agriculture Coordinator as per Vacancy.

(2) The calculation of vacant posts for direct appointment against the sanctioned posts of cadre, shall be made on the basis of 1th April every year and by 30th April the appointing authority shall send requisition reservation category wise to the Commission.

(3) Academic qualification- Minimum academic qualification for direct appointment or promotion from the posts of basic grade in the cadre shall be graduation in Agriculture Science from a recognized university / Institute.

(iv) Direct Appointment :- (a) Direct appointment shall be made from amongst the candidates recommended on the basis of Competitive Examination conducted by the Commission.

(b) Age Limit - minimum age shall be 21 ( twenty one) years on 1st April of the year inviting the application and maximum age limit shall be the same as may be determined from time to time, by the Department of General Administration for direct appointment in the services of the state but in special circumstances, the department may increase it recording reasons for the same.

(c) Reservation :- The Provisions for reservation determined by the Department of General Administration from time to time, for direct appointment in the services of the state, shall be apply .

(d) For direct appointment :- requisition along with number of general and category wise vacancies shall be sent to the commission every year by the Department. (e) Subjects any syllabus of Competitive Examination there shall be following papers in the Competitive Examination .

(i) General Hindi – 100 Marks ( One Paper ) (ii) General knowledge – 100 Marks ( One Paper ) . (iii) Agriculture science - two papers carrying 200 marks each total - 400. It shall be compulsory to obtain 30 percent marks in Hindi but the marks obtained in this paper shall not be calculated for the purpose of preparation of merit list . The merit list shall be prepared on the basis of total marks obtained in Agriculture Science and5 (cid:1)बहार गजट (असाधारण), 2222 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 General knowledge. The syllabus of Hindi and General Knowledge shall be the same as may be determined by the Bihar Staff selection Commission for Joint Competitive examination organized by it. The syllabus for Agriculture science shall be prepared by the department in consultation with the commission.

(f) Recommendation of candidates by commission :- The Commission shall prepare merit list reserved category wise on the basis of marks obtained in the examination conducted by the Commission and shall send recommendation to the department according to the reported vacancies.

5. Appointment by promotion :- (i) The vacancy of 33 percent of posts of the regular strength of the cadre, shall be filled by giving promotion to Jansewak / Rural Extension worker and Agriculture Co- ordinator, as per vacancy.

(a) Jansewak / Rural Extension worker, working under Agriculture Department , shall be eligible for promotion against 16.5 percent of posts out of aforesaid 33 percent, under the quota .

(b) The Agriculture Co- ordinators working under Agriculture Department, shall be eligible for promotion against 16.5 percent posts under the quota .

(ii) The time period for promotion shall be the same as decided by the Government from time to time.

(iii) The provision for reservation in promotion prescribed by the Department of General Administration for the services of state , shall be applicable to this cadre also.

(iv) After being appointed on the basis of recommendation of the staff selection commission and promoted from the lower post , the inter –se – seniority of an employee shall be the same as determined by the department of General Administration.

(v) The inter-se- seniority of the employees appointed by promotion shall be the same as it was among Jansewak / Rural extension worker and the Agriculture Co- ordinator. The Agriculture Co- ordinators shall be placed higher in the seniority list.

6. Probation :- (1) Every member appointed by direct recruitment in the service , shall be on probation for the period of 2 years from the date of his Joining but in special circumstances, this period may be extended up-to one year recording the reasons. If in the said extended period also his performance is not satisfactory, he may be terminated from his services, by the Government, without asking any show cause , but he shall be given its written notice with reasons.

(2) The probation period shall be calculated for the purpose of regular service. 7. Training :- For promotion , it shall be compulsory for the members appointed in the Bihar Agriculture Subordinate Service category -1 (Agronomy) to obtain training from the institute determined by the department. Training Institute will be selected by the Department from time to time.

The benefit of promotion shall be admissible on the basis of it, but in case, if not holding training in time by the department, their promotion shall not be obstructed.

8. Departmental Examination :- (1) It shall be compulsory for the employees to pass in Hindi noting and drafting examination conducted by Rajbhasha department, Bihar, as well as in the departmental examination conducted by the department.

(2) Second increment in the pay scale of basic category shall be admissible only after passing in the examination and after confirmation of service .

(3) Held-up increments of the employee shall be non – cumulative and shall be payable after passing in the examination.

(4) Exemption from essentiality of passing the said departmental examination may be given to the employees after completing 50 (fifty) years of age, under the circulars/ instructions issued by the department of General Administration from time to time.

9. Confirmation of service:- (i) The services of the members of direct appointment, shall be confirmed against permanent posts in the basic category, only after completing probation period, passing in the Departmental Examination, completing the determined training programme successfully and on finding spotless service.

10. Determination of Seniority :- The seniority of a member shall be determined in the light of policy determined by the Department of General Administration, from time to time.

11. Promotion on higher posts from the post of basic grade :- (i) Promotion on higher post in the hierarchy of service cadre, shall be given to the employees working just below the promotional post, on the basis of seniority and in the light of instructions issued by the Department of General Administration from time to time. But this promotion shall be admissible to the employees only after Participating in the training as laid down under Rule -7

(ii) In case the department/ Institute does not organize training in time, their promotion shall not be barred.

(iii) Confirmation of service shall be essential for promotion and basis of promotion shall be seniority-cum-merit.

(iv) Departmental Promotion Committee :- The matter of promotion shall be considered on the recommendation of the Departmental Promotion Committee. The departmental promotion committee shall be constituted by the department.

12. Miscellaneous – Removal of difficulties. :- (1) The department shall be competent to interpret any rule of these rules in consultation with the Department of General Administration/ Law Department/ Finance Department.

(2) The department may remove the difficulty, if any in implementation of any rule of these rules, by publication of appropriate order in the official Gazette which is not inconsistent with these Rules.

(3) In respect of such subjects or points for which the provisions are not made in these rules, the provisions laid down in Code/ Rules / resolutions/ instruction, into force for the time being by the State Government shall apply to this context of this service also.

13. Repeals and Savings :- (i) All circulars / instructions/ resolutions in respect of the appointment/service conditions of the employees of this cadre are hereby repealed.

(ii) Not with standing such repeal any thing done or any action taken under any circular / instruction/ resolution, issued earlier shall be deemed to be done or taken under these rules as if these rules were in force when such thing was done or such action was taken.
