सं॰ 4/क्षे॰स्था॰सेवा नीति-(अमीन)-02/2011 रा॰-604(4)—भारत-संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार राज्य के जिलों, चकबंदी निदेशालय तथा भू-अभिलेख एवं परिमाप निदेशालय हेतु अमीनो की भर्त्ती, एवं अन्य सेवाशर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ।-(1) यह नियमावली "बिहार अमीन संवर्ग नियमावली-2013'' कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना प्रकाशन की तिथि से प्रवृत्त होगी। 2. परिभाषाएँ।-इस नियमावली में जब तक कोई बात विषय या संदर्भ के विरूद्ध न होः- (i) ''राज्य सरकार'' से अभिप्रेत है बिहार सरकार ; (ii) ''सवर्ग'' से अभिप्रेत है बिहार अमीन संवर्ग ; ं (iii) ''उप-संवर्ग'' से अभिप्रेत है अमीन संवर्ग से विभक्त उप संवर्ग; (iv) ''नियुक्ति प्राधिकार'' से अभिप्रेत है जिला उप-संवर्ग के अमीनों के लिए सम्बन्धित जिला के समाहर्त्ता (जिला पदाधिकारी); चकबन्दी निदेशालय उप-संवर्ग के लिए निदेशक, चकबंदी बिहार, पटना; भू-अभिलेख एवं परिमाप निदेशालय उप-संवर्ग के लिए निदेशक, भू-अभिलेख एवं परिमाप निदेशालय, बिहार, पटना;

(v) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है प्रधान सचिव, राजस्व एवं भूमि सुधार विभाग, बिहार; (vi) ''विभाग'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग, बिहार; (vii) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (viii) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात्‌ पहली अप्रील से 31 मार्च तक की अवधि ; (ix) ''वर्ष के अन्दर रिक्ति" से अभिप्रेत है सेवा में नये पदों के सृजन, सेवा निवृत्ति, मृत्यु, सेवा हटाये जाने और पदच्युत किये जाने से विशिष्ट वर्ष में उद्‌भूत रिक्ति।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 14141414 फरवर(cid:15)फरवर(cid:15)फरवर(cid:15)फरवर(cid:15) 2019201920192019 3. संवर्ग का गठन।-(1) इस संवर्ग में अमीन के पद होंगे। अमीन संवर्ग तीन उप सम्वर्ग में विभक्त होंगेः-

(क) जिला उप संवर्ग (ख) चकबंदी निदेशालय उप संवर्ग (ग) भू-अभिलेख एवं परिमाप निदेशालय उप संवर्ग

(2) नियुक्ति के समय आवंटित उप संवर्ग के बाद एक उप संवर्ग के पदों से दूसरे उप संवर्ग के पदों में पारस्परिक स्थानान्तरण नहीं किया जायेंगा।

(3) इस नियमावली के लागू होने के पूर्व से उक्त कोटि मेें नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग में शामिल समझे जायेंगे।

(4) स्वीकृत बलों की संख्या राज्य सरकार समय-समय पर घटा या बढ़ा सकेगी या पदों की कोई भी संख्या स्थगितावस्था में रख सकेगी तथा सेवा परिवर्तन कर सकेगी।

4. उम्र सीमा।-अमीन के पद के लिए उम्मीदवार की न्यूनतम आयु आवेदन आमंत्रित करने वाले वर्ष के 1 अगस्त को 18 वर्ष से कम नहीं होगी। अधिकतम आयु सीमा वही होगी जो राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर नियत की जाय।

5. आरक्षण।-इस संवर्ग में नियुक्ति में राज्य सरकार द्वारा समय-समय पर निर्धारित आरक्षण/रोस्टर के प्रावधान लागू होंगे।

6. नियुक्ति।-(1) अमीन के पदों पर सीधी नियुक्ति कर्मचारी चयन आयोग द्वारा अमीन के पदों के लिए आयोजित प्रतियोगिता परीक्षा के परीक्षा-फल के आधार पर प्राप्त अनुशंसा के आधार पर की जाएगी।

(2) जिला उप संवर्ग, चकबंदी निदेशालय उप संवर्ग, भू-अभिलेख एवं परिमाप निदेशालय उप संवर्ग हेतु अलग-अलग अधियाचना आयोग को उपलब्ध करायी जायेंगी तथा आयोग से अनुशंसा भी अलग-अलग प्राप्त की जायेंगी।

(3) अमीन की नियुक्ति के लिए अभ्यार्थी को किसी भी मान्यता प्राप्त बोर्ड/समकक्ष संस्थान से इन्टरमीडियट (102) या समकक्ष अर्हता का प्रमाण पत्र एवं सरकारी मान्यता प्राप्त संस्थान से अमानत की डिग्री या आई0टी0आई0 से सर्वेयर के प्रशिक्षण में सफल होना अनिवार्य होगा। 7. प्रतियोगिता परीक्षा हेतु लिखित पाठयक्रम।-अमीन की नियुक्ति हेतु कर्मचारी चयन आयोग द्वारा आयोजित प्रतियोगिता परीक्षा में निम्नलिखित दो पत्र होंगे, जिनका पूर्णांक 100 अंकों का होगा :-

(i) प्रथम पत्र।-सामान्य ज्ञान, समसामयिक घटना, सामान्य विज्ञान (50 अंक) एवं सामान्य हिन्दी (50 अंक)।

(ii) द्वितीय पत्र।-सामान्य गणित (50 अंकों का मैट्रिक स्तर) एवं अमानत से सम्बन्धित प्रश्नों के लिए (50 अंक)।

8. परिवीक्षा अवधि।-(1) मौलिक रिक्त पद के विरूद्ध नियुक्त होने वाला प्रत्येक अमीन पद ग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षा पर रहेगा।

(2) परिवीक्षा अवधि पूरी करने पर अमीन का आचरण एवं सेवा संतोषजनक नहीं पाए जाने पर सरकार परिवीक्षा अवधि और एक वर्ष के लिए बढ़ा सकेगी, यदि प्रतीत हो कि आचरण एवं सेवा में ंसुधार की सम्भावना है। बढ़ायी गयी अवधि में भी आचरण एवं सेवा संतोषजनक नहीं पायी जाय तो उसकी सेवा समाप्त की जा सकेगी।

9. प्रशिक्षण।-अमीनों को प्रशिक्षण देने के लिए सरकार, समय-समय पर, विनिश्चय करने हेतु स्वतंत्र है। सरकार द्वारा किये गए विनिश्चय के आधार पर अमीनों को प्रशिक्षण लेना अनिवार्य होगा। यदि प्रशिक्षण के अंत में कोई परीक्षा नियत की जाती है तो उसमें उत्तीर्ण होना अनिवार्य होगा।

10. विभागीय परीक्षा एवं पाठ्‌यक्रम।-सरकार समय-समय पर विभागीय परीक्षा एवं पाठ्‌यक्रम नियत कर सकेगी।

11. सम्पुष्टि।-परिवीक्षा पर नियुक्त अमीन परिवीक्षा अवधि की समाप्ति पर निम्नलिखित शर्त्तों के अधीन रहते हुए सेवा में सम्पुष्टि का पात्र होगाः-

(i) यदि सरकार कोई विभागीय परीक्षा विहित की हो तो वह अवश्य उत्तीर्ण हो चुका हो; (ii) समय-समय पर विहित किया जाने वाला प्रशिक्षण प्राप्त कर लिया गया हो और प्रशिक्षण के अंत में कोई परीक्षा हो तो उसमें उत्तीर्ण हो चुका हो;

(iii) इस अवधि में उसका आचरण एवं उसकी सेवा संतोषजनक रही हो। 12. वेतनमान्‌।-नवनियुक्त अमीन का वेतनमान-PB-1 (5200-20200) एवं ग्रेड पे-2000 या समय-समय पर सरकार द्वारा पुनरीक्षित उनके समकक्ष वेतनमान के अनुरूप होंगे।

13. वरीयता।-इस सेवा के सदस्यों की वरीयता आयोग से प्राप्त मेधा सूची के तथा यह राज्य सरकार के सामान्य प्रशासन विभाग द्वारा, समय-समय पर, नियत सिद्धान्तों एवं प्रक्रिया तथा नियुक्ति प्राधिकार के अधीन रहते हुए होगी।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 14141414 फरवर(cid:15)फरवर(cid:15)फरवर(cid:15)फरवर(cid:15) 2019201920192019 14. प्रकीर्ण।-स्थापना सम्बंधी कार्यों का नियंत्रण-(1) इस सम्वर्ग के सदस्यों की नियुक्ति एवं स्थापना सम्बन्धी सभी कार्य सम्बन्धित जिला पदाधिकारी/निदेशक, चकबंदी/निदेशक, भू-अभिलेख एवं परिमाप के अधीन होंगे। (2) इस सम्वर्ग के सदस्यों की नियुक्ति, पदस्थापन, स्थानान्तरण, सेवा-सम्पुष्टि, वरीयता सूची का संधारण एवं स्थापना सम्बन्धी सभी विषय यथास्थिति, सम्बन्धित जिला पदाधिकारी/निदेशक, चकबंदी/निदेशक, भू-अभिलेख एवं परिमाप के अधीन होंगे।

15. निरसन एवं व्यावृति।-(1) विभाग में अमीन के पदों के लिए कोई पूर्व संधारित संवर्ग नियमावली नहीं है। विभाग से निर्गत नियुक्ति सम्बन्धी पूर्व परिपत्रों को एतद्‌द्वारा निरसित किया जाता है।

(2) ऐसे निरसन के होते हुए भी, पूर्व में सरकारी परिपत्रों के अधीन की गयी नियुक्ति विधिमान्य बनी रहेंगी मानो वे इस नियमावली के समुचित उपबंधों के अधीन की गयी हो।

No. 4/Khse. Stha. Sewa Neeti-(Amin)-02/2011 Ra.-604(4)—In exercise of the powers conferred by the Proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules to regulate the recruitment and other service conditions of the Amins for Districts, Directorate of Consolidation and Directorate of land Records and Survey of the State of Bihar:-

1. Short title, extent and commencement.—(1) These Rules may be called "The Bihar Amin Cadre Rules, 2013";

(2) It shall extend to the whole of the State of Bihar; (3) It shall come into force from the date of publication of the notification. 2. Definitions.-In these rules, unless there is anything contrary to the subject or context:—

(i) "State Government" means the Government of Bihar; (ii) "Cadre" means the Bihar Amin Cadre ; (iii) "Sub-Cadre" means division of Cadre into sub-cadres; (iv) "The appointing authority" means: for the Amins of District sub-cadre, the Collector of the district (District Magistrate);for the Amins of Consolidation Directorate sub- cadre, the Director, Directorate of Consolidation, Bihar, Patna; for the Amins of Directorate of Land Records and Survey sub-cadre, the Director, Directorate of Land Records and Survey, Bihar, Patna.

(v) "Cadre Controlling Authority" means the Principal Secretary, Department of Revenue and Land Reforms, Bihar;

(vi) "Department" means the Department of Revenue and Land Reforms, Bihar; (vii) "Commission" means the Bihar Staff Selection Commission; (viii) "Year" means financial year i.e., the period from 1st April to 31 March; (ix) "Vacancy within year" means the vacancy occurring on account of creation of new post, retirement, death, termination and discharge from service in a specific year.

3. Constitution of the Cadre.—(1) This Service shall have the posts of the Amin cadre.

Amin cadre will be divided into three sub-cadres as:-

(a) District sub-cadre (b) Directorate of consolidation sub-cadre. (c) Directorate of Land Records and Survey sub-cadre.

(2) Mutual transfer of the post of one sub-cadre to another sub-cadre is not allowed after allotted sub-cadre at the time of appointment.

(3) Persons appointed and working in the said category prior to application of these rules shall automatically be deemed to be included in this service;

(4) The State Government may from time to time increase or decrease the number of sanctioned strength or may keep any number of posts under stagnant position. 4. Age limit.—The minimum age of the candidate for the post of Amin shall not be less than 18 years as on 1st of August of the year in which applications would be invited. The maximum age limit shall be the same as fixed from time to time by the Department of General Administration, Government of Bihar.

5. Reservation.—The provisions of reservation/ roster as fixed from time to time by the State Government shall be applicable to the appointment in this service.

6. Appointment.—(1) The direct appointment to the post of Amin shall be made on the basis of the recommendation obtained from Bihar Staff Selection Commission through competitive examination conducted for the post of Amin.

(2) Separate requisition of the District sub-cadre, Directorate of Consolidation sub- cadre and Directorate of Land Records and Survey sub-cadre will be sent to the commission and receive the recommendation from commission separately too.

(3) It would be essential for the candidate to have certificate of Intermediate (10+2) or equivalent qualification from a recognized Board or equivalent institution and Degree of Amanat from a Government recognised institute or success in the training of surveyor from I.T.I.

7. Written syllabus for competitive examination.—For appointment to the post of Amin there will be a competitive examination to be conducted by the Staff Selection Commission consisting of the following two papers of which full marks shall be 100 marks:-

(i) First paper.—General Knowledge, Current Events and General Sciences (50 marks) and General Hindi (50 marks).

(ii) Second paper.—General Mathematics (50 marks of Matric Level) and 50 marks for Amanat related questions.

8. Probation Period.—(1) Every Amin appointed against the basic vacant post shall remain on probation for a period of two years from the date of joining.

(2) In case the conduct and service of a Amin is not found to be satisfactory during the completion of the probation period, the probation period may be extended for further period of one year, if it appears that there is a possibility of improvement in conduct and service. If the conduct and service is found unsatisfactory even during the extended period, his service may be terminated.

9. Training.—The Government is free to take decision for training to Amins from time to time. On the basis of the decision taken the Government for training it would be essential to impart training to the Amins. If any examination is fixed at the in end of the training it would be compulsory to pass in it.

10. Departmental Examination and syllabus.—The Government may fix departmental examination and syllabus form time to time.

11. Confirmation.—The Amin appointed on probation shall be eligible for confirmation in the service on expiry of the probation period subject to following conditions:-

(i) If the Government has prescribed any departmental examination, he must have pass the said examination.

(ii) He has received training prescribed from time to time, and passed the examination at the end of training.

(iii) His conduct and his service have been satisfactory during this period. 12. Pay Scale.-The pay scale of the newly appointed Amin shall be PB-1 (5200-20200) and grade pay 2000 or equivalent pay scale as revised by the Government from time to time.

13. Seniority.—The Seniority of the members of this cadre shall be determined on the basis of the merit list obtained from the commission and it shall be subject to the principles and procedure fixed by the Department of General Administration of the State Government and the Appointing authority.

14. Miscellaneous-Control of the works relating to establishment.—(1) All works

relating to appointment of the members of this cadre and establishment shall be under the administrative control of the District Magistrate/Director, Consolidation/ Director, Land Records and Survey.

(2) The appointment, posting, transfer, confirmation of service, maintenance of seniority list, and all matters relating to establishment of the members of this cadre shall be under the control of the related District Magistrate/Director, Consolidation/ Director, Land Records and Survey, as the case may be.

Previous circulars relating to appointment issued by the Department are hereby repealed.

(2) Notwithstanding such repeal, appointment made under earlier Government circulars shall remain valid as if they were made under proper provisions of these rules.
