सं॰ सं॰ सं॰ सं॰ 2/वि.60-48/2020-88—भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, सांस्कृतिक कार्य निदेशालय (कला, संस्कृति एवं युवा विभाग), बिहार, पटना के नियंत्रणाधीन जिला कला एवं संस्कृति कार्यालयों (क्षेत्रीय कार्यालयों) के लिपिकीय संवर्ग के पदों पर भर्ती/प्रोन्नति एवं अन्य सेवा शर्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते है :-

(1) यह नियमावली ''कला,ं संस्कृति एवं युवा विभाग क्षेत्रीय लिपिकीय संवर्ग (भर्त्ती एवं सेवा शर्त्तें) नियमावली, 2021'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगी।

2222.... परिभाषाएँ।- (क) परिभाषाएँ।- (क) परिभाषाएँ।- (क) परिभाषाएँ।- (क) इस नियमावली में, जब तक कि विषय या संदर्भ में अन्यथा अपेक्षित नहीं हो - (i) 'संवर्ग''संवर्ग''संवर्ग''संवर्ग' से अभिप्रेत है, ''कला, संस्कृति एवं युवा विभाग क्षेत्रीय लिपिकीय संवर्ग''; (ii) 'राज्य सरकार''राज्य सरकार''राज्य सरकार''राज्य सरकार' से अभिप्रेत है बिहार राज्य सरकार; (iii) 'नियुक्ति प्राधिकार' 'नियुक्ति प्राधिकार' से अभिप्रेत है निदेषक, सांस्कृतिक कार्य, सांस्कृतिक कार्य निदेशालय, कला, 'नियुक्ति प्राधिकार' 'नियुक्ति प्राधिकार' संस्कृति एवं युवा विभाग, बिहार, पटना; (iv) 'संवर्ग नियंत्री प्राधिकार'' 'संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है निदेषक, सांस्कृतिक कार्य, सांस्कृतिक कार्य निदेशालय, 'संवर्ग नियंत्री प्राधिकार'' 'संवर्ग नियंत्री प्राधिकार'' कला, संस्कृति एवं युवा विभाग, बिहार पटना; (v) 'विभाग''विभाग''विभाग''विभाग' से अभिप्रेत है कला, संस्कृति एवं युवा विभाग; (vi) 'आयोग''आयोग''आयोग''आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (vii) 'नियत तिथि''नियत तिथि''नियत तिथि''नियत तिथि' से अभिप्रेत है इस नियमावली के आरम्भ होने की तिथि; (viii) 'सदस्य''सदस्य''सदस्य''सदस्य' से अभिप्रेत है संवर्ग में नियुक्त कोई व्यक्ति तथा इस नियमावली के आरम्भ होने के पूर्व से संवर्ग में नियुक्त सभी व्यक्ति इसमें शामिल हैं;

(ix) 'अनुकम्पा के 'अनुकम्पा के 'अनुकम्पा के 'अनुकम्पा के आधार पर नियुक्ति'आधार पर नियुक्ति'आधार पर नियुक्ति'आधार पर नियुक्ति' से अभिप्रेत है प्रासंगिक परिपत्रों/अनुदेषों के अनुसार कर्त्तव्यावधि/ सेवाकाल में मृत सरकारी सेवक के आश्रितों में से किसी एक की अनुकम्पा के आधार पर नियुक्ति; तथा (x) 'विभागीय प्रोन्नति समिति' 'विभागीय प्रोन्नति समिति' से अभिप्रेत है विभाग द्वारा अधिसूचित विभागीय प्रोन्नति समिति। 'विभागीय प्रोन्नति समिति' 'विभागीय प्रोन्नति समिति' (xi) 'योग्यता' 'योग्यता' 'योग्यता' 'योग्यता' से अभिप्रेत है इस अधिसूचना के नियम 5 में निर्दिष्ट योग्यता।

(1) बिहार अधीनस्थ जिला कला एवं संस्कृति लिपिकीय संवर्ग राज्य स्त्तरीय होगा। (2) इस नियमावली के लागू होने के पूर्व से उक्त कोटियों में नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग में शामिल समझे जायेंगे।

(1) निम्न वर्गीय लिपिक के पद पर नियुक्ति के लिए न्यूनतम शैक्षणिक योग्यता कम्प्यूटर संचालन एवं कम्प्यूटर टंकन ज्ञान के साथ इन्टरमिडिएट (10+2) अथवा समकक्ष परीक्षा उर्त्तीण। (2) भर्ती के लिए न्यूनतम उम्र 18 वर्ष होगी और अधिकतम उम्र वहीं होगी जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर अवधारित की जाय।

6666.... नियुक्ति ।-नियुक्ति ।-नियुक्ति ।-नियुक्ति ।- (क) सीधी भर्त्ती - (क) सीधी भर्त्ती - (क) सीधी भर्त्ती - (क) सीधी भर्त्ती -

(1) निम्न वर्गीय लिपिक का 85 प्रतिषत पद सीधी भर्त्ती से भरा जाएगा तथा 15 प्रतिशत पद वैसे कार्यालय परिचारी/परिचारी (विशिष्ट), जो निम्न वर्गीय लिपिक के पद पर नियुक्ति की अर्हत्ता रखते हो, से बिना किसी परीक्षा के, वरीयता क्रम में भरा जाएगा। सीधी भर्त्ती के 85 प्रतिशत पदों में से 10 प्रतिशत पद अनुकम्पा के आधार पर नियुक्ति के लिए आरक्षित रहेगा।

(2) सीधी भर्त्ती से भरे जाने वाले पदों में से ऐसे सरकारी सेवक, जिनकी सेवाकाल में मृत्यु हो गई हो, के विहित अहर्ताधारी आश्रित की राज्य सरकार द्वारा, समय-समय पर विनिष्चित प्रक्रिया के अनुसार अनुकम्पा के आधार पर, नियुक्ति की जा सकेगी, जिसके लिए आयोग की अनुषंसा अपेक्षित नहीं होगी।

(3) प्रत्येक कलेण्डर वर्ष की 01ली अप्रैल के आधार पर रिक्तियों की गणना करने के बाद उक्त वर्ष के 30 अप्रैल तक रिक्तियों के लिए अधियाचना नियुक्ति प्राधिकार द्वारा आयोग को भेज दी जायेगी। आयु की पात्रता रिक्ति वर्ष की 01ली अगस्त के अनुसार होगी।

(4) संबंधित प्रतियोगिता परीक्षा के लिए अर्हता, नियम, प्रक्रिया एवं पाठ्‌यक्रम वही होंगे जो राज्य सरकार द्वारा विनिष्चित किया जाएगा।

(5) सीधी भर्ती बिहार कर्मचारी चयन आयोग की अनुषंसा पर निम्न वर्गीय लिपिक की कोटि में की जाएगी।

(ख) प्रोन्नति द्वारा नियुक्ति - (ख) प्रोन्नति द्वारा नियुक्ति - (ख) प्रोन्नति द्वारा नियुक्ति - (ख) प्रोन्नति द्वारा नियुक्ति -

(1) नियुक्ति प्राधिकार इंटरमिडिएट उर्त्तीण कार्यालय परिचारी/परिचारी (विशिष्ट) की वरीयता सूची तैयार करेगा।

(2) कार्यालय परिचारी/परिचारी (विशिष्ट) से निम्न वर्गीय लिपिक के पद पर प्रोन्नति, वरीयतानुसार विभागीय प्रोन्नति समिति की अनुशंसा पर दी जाएगी, परन्तु इस प्रकार से प्रोन्नत निम्न वर्गीय लिपिकों को प्रथम वेतन वृद्धि के उपरान्त अगली वेतन वृद्धि तबतक देय नहीं होगी, जबतक की उनके द्वारा कम्प्यूटर सक्षमता परीक्षा एवं हिन्दी टिप्पण एवं3 ;बपकरू4द्ध ;बपकरू23द्धख्;बपकरू4द्ध;बपकरू4द्ध;बपकरू25द्ध;बपकरू29द्ध प्रारूपण परीक्षा उर्त्तीण नहीं कर लिया जाय। उक्त परीक्षा उर्त्तीण करने के उपरान्त ही उनकी सेवा सम्पुष्ट की जा सकेगी।

(ग) (ग) (ग) (ग) कार्यालय परिचारी/परिचारी (विशिष्ट) का पद सृजित नहीं रहने अथवा कार्यरत कर्मी के अनुपलब्ध रहने की स्थिति में प्रोन्नति द्वारा नियुक्ति हेतु निर्धारित 15 प्रतिशत पद भी सीधी भर्त्ती से भरा जा सकेगा।

7777.... आरक्षण।- आरक्षण।- आरक्षण।- आरक्षण।- नियुक्ति/प्रोन्नति में राज्य सरकार द्वारा समय-समय पर अधिसूचित आरक्षण एवं रोस्टर के प्रावधान लागू होंगे।

8888.... परिवीक्षा अवधि।-परिवीक्षा अवधि।-परिवीक्षा अवधि।-परिवीक्षा अवधि।-निम्न वर्गीय लिपिक कोटि में परिवीक्षा अवधि नियुक्ति की तिथि से दो वर्षों की होगी, यदि परिवीक्षा अवधि संतोषजनक नहीं हो तो नियुक्ति प्राधिकार द्वारा लिखित रूप में अभिलिखित किये जाने वाले कारणों से परिवीक्षा अवधि एक वर्ष के लिए बढ़ायी जा सकेेगी। परिवीक्षा अवधि विस्तार संबंधित आदेश में, पायी गई कमियों को भी उल्लिखित किया जाएगा ताकि संबंधित कर्मी को स्वयं का सुधार करने का अवसर प्राप्त हो सके परन्तु परिवीक्षा की कुल अवधि तीन वर्षों से अधिक नहीं बढ़ायी जा सकेगी। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाया जाता है तो संबंधित व्यक्ति को सेवामुक्त कर दिया जाएगा।

9999.... प्रषिक्षण।-प्रषिक्षण।-प्रषिक्षण।-प्रषिक्षण।-

(1) परिवीक्षा अवधि में निम्न वर्गीय लिपिक को ऐसे प्रषिक्षण में भाग लेना आवष्यक होगा, जो विभाग के द्वारा विनिष्चित किया जाएगा।

(2) राजभाषा विभाग, बिहार द्वारा संचालित हिन्दी टिप्पण एवं प्रारुपण परीक्षा में उत्तीर्णता अनिवार्य होगी।

10101010.... विभागीय परीक्षा एवं पाठ्‌यक्रम।-विभागीय परीक्षा एवं पाठ्‌यक्रम।-विभागीय परीक्षा एवं पाठ्‌यक्रम।-विभागीय परीक्षा एवं पाठ्‌यक्रम।- नव नियुक्त निम्न वर्गीय लिपिको के लिए परिवीक्षा अवधि में विभागीय परीक्षा में उर्तीण होना आवष्यक होगा। विभागीय परीक्षा के विषय, पाठ्‌यक्रम एवं प्रक्रिया का अवधारण केन्द्रीय परीक्षा समिति, राजस्व पर्षद द्वारा किया जाएगा।

11111111.... सम्पुष्टि।- सम्पुष्टि।- सम्पुष्टि।- सम्पुष्टि।- परिवीक्षाधीन निम्न वर्गीय लिपिक की सेवा परिवीक्षा अवधि की संतोषजनक समाप्ति तथा हिन्दी टिप्पण एवं प्रारुपण एवं विभागीय परीक्षा की उत्तीर्णता के बाद सम्पुष्ट किया जाएगा।

12121212.... वरीयता का अवधारण।-वरीयता का अवधारण।-वरीयता का अवधारण।-वरीयता का अवधारण।- निम्न वर्गीय लिपिक की आपसी वरीयता, आयोग द्वारा अवधारित उनकी मेधा क्रम के अनुसार विनिष्चित की जायेगी। किन्तु इस नियमावली के आरंभ होने के पूर्व विनिष्चित आपसी वरीयता अपरिवर्तनीय रहेगी।

परन्तु अनुकम्पा के आधार पर नियुक्त व्यक्ति उन व्यक्तियों से कनीय होंगे, जो संबंधित भर्ती वर्षों में प्रतियोगिता परीक्षा के आधार पर नियुक्त किए जायेंगे, लेकिन किसी भर्ती वर्ष में प्रोन्नति द्वारा नियुक्त व्यक्ति संबंधित भर्ती वर्ष में प्रतियोगिता परीक्षा द्वारा नियुक्त व्यक्ति से वरीय होंगे।

13131313.... प्रोन्नति।-प्रोन्नति।-प्रोन्नति।-प्रोन्नति।-

(1) मूल कोटि से उच्चतर कोटि में प्रोन्नति सरकार (सामान्य प्रषासन विभाग) द्वारा समय-समय पर अवधारित कालावधि पूरा होने और विभाग द्वारा गठित विभागीय प्रोन्नति समिति की अनुषंसा पर दी जा सकेगी।

(2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा अलग आदेष से संसूचित किया जायेगा। 14141414.... अवषिष्ट मामले।-अवषिष्ट मामले।-अवषिष्ट मामले।-अवषिष्ट मामले।- इस नियमावली से अनाच्छादित मामलों में, राज्य सरकार के समुचित स्तर के अन्य कर्मियों के लिए सेवा शर्तों के संबंध में प्रवृत्त सभी नियम, अनुदेष आदि समान रूप से इस संवर्ग के सदस्यों पर भी लागू होंगे।

15151515.... कठिनाइकठिनाइकठिनाइकठिनाईयों का निराकरण।र्-यों का निराकरण।र्-यों का निराकरण।र्-यों का निराकरण।- विभाग समय-समय पर इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए ऐसा सामान्य या विषेष निदेष विधि विभाग से परामर्ष के पश्चात्‌ जारी कर सकेगा, जो आवष्यक हो और इस नियमावली के प्रावधानों से असंगत न हों। 16161616.... निर्वचन।-निर्वचन।-निर्वचन।-निर्वचन।- जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो वहाँ मामला विभाग द्वारा विधि विभाग के परामर्ष से विनिष्चित किया जायेगा और ऐसा विनिष्चय अंतिम होगा। 17171717.... निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।-निरसन एवं व्यावृत्ति।-

(1) इस नियमावली के लागू होने के पूर्व इस संवर्ग के संबंध में निर्गत सभी संकल्प एवं अनुदेष एतद्‌ द्वारा निरसित किये जाते हैं।

(2) ऐसे निरसन के होते हुए भी, पूर्व के संकल्प/अनुदेष द्वारा या उसके अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया कार्य या की गयी कार्रवाई समझी जाएगी मानो यह नियमावली उस दिन प्रवृत्त थी जिस दिन ऐसा कार्य किया गया था अथवा ऐसी कार्रवाई की गयी थी।

Art, Culture & Youth Department Regional Clerical Cadre

(Recruitment and Service Conditions) Rules, 2021

No. 2/वि. 60-48/ 2020-88— In exercise of powers conferred by the provision to Article 309 of the Constitution of India, the Governor of Bihar hereby makes the following Rules with respect to regulating recruitment/promotion and other service conditions in the clerical cadres of the District Art and Culture Offices (Field Offices) control of the Directorate of Cultural Affairs, Department of Art, Culture and Youth, Government of Bihar, Patna, namely: ―

1. Short title, extent and commencement:—

(1) These Rules may be called "Art, Culture & Youth Department Regional Clerical Cadre (Recruitment and Service Conditions) Rules, 2021."

(2) It shall extend to the whole State of Bihar. (3) They shall come into force from the date of it's publication in the official Gazette.

2. Definitions.―(a) In these rules, unless the context otherwise requires,-

(i) "cadre" means the Art, Culture & Youth Department Regional Clerical Cadre;

(ii) 'State Government' means the Government of Bihar; (iii) "Appointing Authority" means the Director, Cultural Affairs, Directorate of Cultural Affairs, Department of Art, Culture and Youth, Government of Bihar, Patna;

(iv) "Cadre Controlling Authority" means the Director, Cultural Affairs, Directorate of Cultural Affairs, Department of Art, Culture and Youth, Government of Bihar, Patna;

(v) "Department" means Department of Art, Culture and Youth, Government of Bihar, Patna;

(vi) "Commission" means the Bihar Staff Selection Commission; (vii) "Fixed Date" means the date of commencement of these Rules; (viii) "member" means a person appointed in the clerical cadre and it includes all the persons already appointed in the cadre before commencement of these Rules;

(ix) "Appointment on compensate ground" means grace-based appointment of any one of the dependents of the government servant in case of death during service period/tenure as per relevant circulars/instructions; and (x) "Departmental Promotion Committee" means the Departmental Promotion Committee as notified by the department.

(xi) "Qualification" means qualifications mentioned under Rule 5 of these Rules.

3. Cadre Structure.―The cadre structure of the clerical cadre of the District Art and Culture Offices shall be as follows:-

(1) All the members appointed and working in the said cadre prior to

fixed date will deemed to be included in this cadre automatically.

(2) Number of posts and scales of Lower Division Clerks, Upper Division

Clerks and Head Clerks will be the same as may have been notified or

may be notified by the State Government from time to time.

4. Constitution of Cadre.―

(1) The Art, Culture & Youth Department Regional Clerical Cadre will be State level Cadre.

(2) All the members appointed and working in the said cadre prior to these rules coming into force will be deemed to be included in this cadre automatically.

5. Qualification.―

(1) The minimum Essential educational qualification for appointment to the post of Lower Division Clerk shall be knowledge of Computer operation and Computer typing with Intermediate (10+2) or equivalent.

(2) The minimum age for recruiting Lower Division Clerk shall be 18 years and maximum age shall be the same as may be determined by the State Government (General Administration Department) from time to time.

6. Appointment- (a) Direct recruitment.—

(1) 85% Posts of Lower Division Clerk shall be filled up through direct recruitment and 15% Posts shall be filled up without any examination, in acordance with seniority from the office attendant/attendant (special), who have eligible for appointment on the post of lower division clerk. of the 85% direct recruitment posts, 10% will be reserved for appointment on compassion grounds.

(2) Appointment of the prescribed qualification holder, dependent of such Government Employees who dies during the service period, may be made on compensate ground as per process determined by the State Government from time to time, and for which recommendation of the Commission shall not be required.

(3) The Appointing Authority, after calculating the vacancies on the basis of 1st April every calendar year, shall send the requisition to the Commission by 30th April of that year. The eligibility of age of the candidate will be reckoned from the 1st August of the vacancy year.

(4) The eligibility, rules, process and syllabus for the concerned Competitive Examination will be the same as may be determined by the State Government.

(5) Direct recruitment shall be made in the category of the Lower Division Clerk on the recommendation of the Bihar Staff Selection Commission.

(b) Appointment through promotion-

(1) Appointing authority shall prepare seniority list of Intermediate Pass Office Attendant/Attendant (special).

(2) Promotion on the Post of Lower Division Clerk from Office Attendant/ Attendant (special) shall be given in accordance with seniority on the recommendation of departmental Promotion Committee, but such promoted Lower Division Clerk shall not get next increment after first increment till they pass Computer skill test and Hindi noting and drafting test. There service shall be confirm after passing that test.

(c) The 15% Posts of appointment through promotion shall be field up by direct recruitment in case the post of Office Attendant/Attendant (special) is not created or unavailability working employee.

7. Reservation.―The provisions of reservation/roster as notified by the State Government from time to time shall apply to the recruitment and promotion in the clerk cadre.

8. Probation period.—The probation period will be of two years in the category of Lower Division Clerk. If the probation period is not satisfactory, the probation period may be extended for one more year, with reasons to be recorded in writing by the Appointing Authority. The shortcomings which are recorded shall also be mentioned in the Sanction Order of extension of the probation period so that the working performance of the concerned employee is improved. However, in no circumstances, the probation period of any employee shall be extended more than three years. If the service of an employee is not found satisfactory even in the extended period of time, such employee shall be removed from the service.

9. Training.—

(1) The Lower Division Clerk shall have to participate in the training programme during the probation period which will be determined by the Department. (2) It shall be compulsory for the employees to pass in Hindi noting and drafting examination conducted by the Rajbhasha Department, Bihar.

10. Departmental Examination and Syllabus.―It shall be compulsory for the newly appointed Lower Division Clerk to pass departmental examination during the probation period. The subject, syllabus and process of departmental examination shall be determined by the Central Examination Committee, Board of Revenue, Bihar.

11. Confirmation.―The Lower Division Clerk of probation will be confirmed after satisfactory completion of the service probation period and after passing Hindi noting and drafting Departmental Examination.

12. Determination of seniority.― Inter- seniority of the Lower Division Clerk shall be determined accordance to the merit list determined by the Commission, but the inter- seniority determined prior to the commencement of these Rules shall remain unchangeable. Provided that the persons appointed on the basis of compensate ground shall be junior to such persons as has been appointed on the basis of Competitive Examination in the same year, but the persons appointed by promotion in any recruitment year will be senior to the persons appointed by the Competitive Examination in that year.

13. Promotion.―

(1) Promotion from basic category to higher category may be given from time to time on completion of the time period determined by the Government (General Administration Department) and on recommendation of the Departmental Promotion Committee constituted by the Department. (2) Departmental Promotion Committee will be constituted by the Department through a separate order.

14. Residual Matters.― In the matters not specifically covered by these Rules, all Rules, instructions, etc. applicable to the other employees of the appropriate levels in the state government in respect of service conditions shall be equally applicable to the members of this cadre.

15. Removal of Difficulties.―The Department, in consultation with the Department of Law, may issue such general or specific directives from time to time as will resolve the difficulties that might be coming in the implementation of any of provisions of these Rules, which are necessary but which are not inconsistent with the provisions of these Rules.

16. Interpretation.― Where any doubt arises as to the interpretation of any of the provisions of these Rules, the matter shall be decided by the Department in consultation with the Department of Law, and such decision shall be taken as the final decision.

17. Repeal and Savings:—

(1) All resolutions and instructions already issued with respect to this cadre before these Rules come into force are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the said resolutions and instructions, shall be deemed to have been done or taken under these Rules as if these Rules were in force on the day on which such thing or action was done or taken.
