सं॰ 7/मुक0-08-27/2021सा0प्र0 4394—महानिबंधक, उच्च न्यायालय, पटना के पत्रांक-13325 दिनांक 04.03.2022 द्वारा माननीय सर्वोच्च न्यायालय में सिविल अपील संख्या-1517/2022 (एस0एल0पी0(सी) संख्या-19950/2021 से उद्‌भूत, राकेश कुमार बनाम बिहार राज्य एवं अन्य) में दिनांक 18.02.2022 को पारित न्यायादेश के अनुपालन में 30वीं बिहार न्यायिक सेवा प्रतियोगिता परीक्षा (वि0सं0-06/2018) के परीक्षाफल के आधार पर बिहार लोक सेवा आयोग, पटना के पत्रांक-8/वि0प्र0- 04-05/2017 (90) लो0से0आ0/गो0 दिनांक 02.12.2019 द्वारा अनुशंसित निम्नांकित अभ्यर्थी को असैनिक न्यायाधीश (कनीय कोटि) के पद पर बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली-1955 के नियम-24 के तहत रु0 27700-770-33090-920 -40450-44700/- के वेतनमान में समय-समय पर राज्य सरकार द्वारा स्वी—त जीवन यापन भत्ता एवं अन्य देय भत्तों के साथ अधोलिखित कंडिकाआें में निहित शर्त्ताें के अधीन नियुक्त किया जाता हैः-

2. माननीय सर्वोच्च न्यायालय में सिविल अपील संख्या-1517/2022 (एस0एल0पी0 (सी)संख्या-19950/2021 से उद्‌भूत, राकेश कुमार बनाम बिहार राज्य एवं अन्य) में दिनांक 18.02.2022 को पारित न्यायादेश की कंडिका-24 एवं 26 के निम्नांकित शर्ताें के अधीन यह नियुक्ति की जा रही हैः-2 ;बपकरू464द्ध ;द्ध 5 2022 24. The written undertaking on affidavit is today before us. Therein, the appellant has agreed to waive his claim to seniority and backwages:

"UNDERTAKING ON AFFIDAVIT

I, Rakesh Kumar, aged about 33 years (Male), S/o Shri Chandra Sekhar Paswan, R/o Village -Kashipur, P.S. - Samastipur Town, District-Samastipur (Bihar), presently at Samastipur do hereby solemnly swear and affirm as under:

1. I state that I am the Petitioner in the accompanying Special Leave Petition. 2. I state that in the event an order is passed by this Hon'ble Court to reinstate my service as Civil Judge (Junior Division) by setting aside or otherwise interfering with the impugned Order dated 26-10-2021 passed by the Hon'ble High Court of Judicature at Patna in CWJC No. NO.3835 of 2021, I undertake as under:

a. That I waive my claim for seniority and back wages from the date I offered to join as Civil Judge (Junior Division) at Biraul, Darbhanga from i.e. 08-06-2020 till the time of actual joining in service.

b. That I agree to undergo training with the next available batch. c. That I will not claim any benefit contrary to the present undertaking at any time in the future.

3. That I am also ready and willing to undergo training with the next batch of recruits."

26. The upshot of the above discussion is that the appellant will be entitled to the following reliefs: The impugned judgment is set aside. We allow the writ petition. The impugned notification is quashed to the extent the appellant's candidature is cancelled. The impugned orders will stand quashed. The appointment of the appellant is restored subject to the following: The appellant will not be entitled to claim seniority/ backwages as has been, in fact, held out by him in written undertaking which we have extracted. The appellant will be granted posting within a period of four weeks from today. The appointment of the appellant will be subject to all the conditions which have been incorporated in written undertaking. The terms of the undertaking will be incorporated in the order by which he is permitted to join. The appellant must necessarily undergo the requisite training as will be found appropriate and ordered by the High Court. We make it clear further that the appellant will be entitled to claim seniority only in terms of the undertaking and not under the provisions otherwise applicable to him. He will not be entitled to the seniority in accordance with the rules/provisions which would have otherwise applied to him.

3. यह नियुक्ति चरित्र एवं पूर्ववृत्त के संबंध में पुलिस सत्यापन प्रतिवेदन प्राप्त होने की प्रत्याशा में की जा रही है। यदि अभ्यर्थी का चरित्र एवं पूर्ववृत्त सत्यापन प्रतिवेदन प्रतिकूल होगा तो उनकी सेवा बिना किसी पूर्व सूचना के समाप्त कर दी जायेगी एवं आवश्यक विधिक कार्रवाई भी की जायेगी।

4. भविष्य में शैक्षणिक प्रमाण-पत्र/अभिलेखों के संबंध में गलत सूचना पाये जाने की स्थिति में इनकी सेवा कभी भी बिना किसी पूर्व सूचना के समाप्त कर दी जायेगी एवं आवश्यक कार्रवाई भी की जायेगी।

5. वित्त विभाग के संकल्प सं0-1964 दिनांक 31.08.2005 एवं 768 पे0 को0 दिनांक 03.07.2007 के अनुसार इन नियुक्त होने वाले न्यायिक पदाधिकारी पर नई अंशदायी पेंशन योजना लागू होगी।

6.बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2017 में बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम 25(ख) में विभागीय अधिसूचना संख्या-7/स्था0-1-4-05/2011 सा0प्र0 3245 दिनांक 17.03.2017 के द्वारा किये गये प्रावधान के अनुसार ''असैनिक न्यायाधीश (कनीय कोटि) के संवर्ग का कोई पदाधिकारी यदि सेवा के तीन वर्ष पूरा होने के पूर्व सेवा छोड़ देता है या सेवा त्याग देता है तो उसे तीन माह पूर्व इसकी सूचना देनी होगी अथवा उसके बदले तीन माह के वेतनादि के समतुल्य नकद राशि जमा करना होगा।'' 7. अभ्यर्थी को फोटोयुक्त नियुक्ति पत्र उपलब्ध कराया जा रहा है। फोटोयुक्त नियुक्ति पत्र प्रस्तुत न किये जाने पर योगदान स्वी—त नहीं किया जायेगा।3 ;बपकरू464द्ध ;द्ध 5 2022 8. नियुक्ति पत्र में अंकित नवनियुक्त परीक्ष्यमान न्यायिक पदाधिकारी की सेवायें माननीय उच्च न्यायालय, पटना को पदस्थापन हेतु सौंपी जाती है।

9. योगदान किये जाने हेतु उन्हें कोई यात्रा भत्ता देय नहीं होगा।
